Canada Abstract Letters from Yokohama: Major John Dickey and the Prosecution of Japanese Class 'B' and 'C War Crimes Mark Sweeney John Horace Dickey was a fourth generation Haligonian lawyer who, after serving on the domestic front with the Canadian Army travelled to Japan as a part of the Canadian War Crimes Liaison Detachment - Far East. Dickey was involved in the prosecution of Japanese Class 'B' and 'C war crimes committed against Canadian soldiers that were captured after the fall of Hong Kong in December 1941. Class 'B' and 'C or 'minor' war crimes consist of traditional or conventional war crimes, "violations of the laws and customs of war," and crimes against humanity, "murder, extermination, enslavement, deportation, and other inhumane acts.") These trials are important as they have been largely overlooked in favour of the Class 'A' trials, crimes against peace, at Nuremberg and Tokyo, and also allow for an investigation of the experiences of individual soldiers involved in both sides of the conflict. This study will broaden English language war crimes trials scholarship, and also make an addition to a growing body of historiography investigating Canadian involvement in war crimes trials. While the political impetus for Canadian involvement has already been well developed, analysing the experiences of individual prosecutors from a social history perspective allows for a better understanding of how the sentences and judgments were reached, and the context that the trials themselves were undertaken. 9 June 2008 Acknowledgments I would first like to thank Dr. Kirrily Freeman, my thesis supervisor, academic guide and life coach for her direction, patience and insight. Introduction On 15 April 1946, a young lawyer and Captain in the Canadian Army, John Horace Dickey, stepped off a plane accompanied by a contingent of two Canadian barristers, two former POWs and two administrative members of the military who comprised the Canadian War Crimes Liaison Detachment - Far East. The Detachment had just finished a week-long journey which saw them travel from Ottawa to Washington, Washington to San Francisco via Kansas, and then island hopping the Pacific Ocean, stopping at Honolulu, Kwajalein, and Guam until reaching its final destination, Atsugi Airport, north of Tokyo. This arrival marked the beginning of John Dickey's legal experience in Japan, representing Canada as a Chief Prosecutor at the Yokohama War Crimes Trials under the auspices of the American Eighth Army and the Supreme Commander for the Allied Powers (S CAP).l John Dickey was born on 4 September 1914 in Edmonton, Alberta. His father, Horace Beaumont Arthur Dickey, the third in a line of prominent Nova Scotian lawyers, was killed during the First World War, at which time Dickey and his mother Catherine moved back to Nova Scotia.2 Dickey received his undergraduate training at Saint Mary's College in Halifax, graduating in 1936, only to move on to Dalhousie Law School, attaining his LLB, and graduating second in his class in 1940.3 Dickey passed the Nova Scotia Bar in the fall of 1940, and was quickly recruited by Halifax law firm MacDonald, Mclnnes, MacQuarrie and Pattilo where he worked until 1 For a biographical sketch of John Dickey, please see Appendix, page 161. 2 See Nova Scotia Archives and Records Management (hereafter NSARM), MG 100, Vol. 234, #22, The Stewart Family Geneology, by C.S. Dickey's military experience was best described as "an exercise in frustration,"5 as Dickey spent the majority of the war bouncing from domestic training ground to domestic training ground, holding postings in an artillery camp in Petawawa, Ontario, anti-aircraft training in Eastern Passage, Nova Scotia, an infantry posting in Brockville, Ontario and an eventual posting in preparation for Pacific service in Vernon, British Columbia where he spent the remainder of the war.

Lainberger speaks of being drafted in April of 1945, basic and artillery training at Fort Bliss (Texas), and assignment to Sugamo Prison in Japan. He talks about duty as a pass clerk, working with visiting families of war criminals, and his awareness of the war crime trails. He comments on meeting Tokyo Rose and Hideki T ōjō, and he portrays the general demeanor of the prisoners. Lainberger describes a typical duty day, recreational activities, visiting Mount Fuji on leave, and seeing limited reconstruction of the country. After the start of the Korean War, he discusses being reassigned to a transportation section at headquarters of the 8th Army Headquarters in Yokohama. He tells of arranging to see his brother, who came through Yokohama with the Army. Lainberger touches on having enough points to be sent home in 1951, participating in Operation Longhorn in Texas with a military police outfit, and working as a security guard at Fort Custer (Michigan) until his discharge.

    The Treatment of Prisoners of War by the Imperial Japanese Army and Navy Focusing on the Pacific War TACHIKAWA Kyoichi Abstract Why does the inhumane treatment of prisoners of war occur? What are the fundamental causes of this problem? In this article, the author looks at the principal examples of abuse inflicted on European and American prisoners by military and civilian personnel of the Imperial Japanese Army and Navy during the Pacific War to analyze the causes of abusive treatment of prisoners of war. In doing so, the author does not stop at simply attributing the causes to the perpetrators or to the prevailing condi- tions at the time, such as Japan’s deteriorating position in the war, but delves deeper into the issue of the abuse of prisoners of war as what he sees as a pathology that can occur at any time in military organizations. With this understanding, he attempts to examine the phenomenon from organizational and systemic viewpoints as well as from psychological and leadership perspectives. Introduction With the establishment of the Law Concerning the Treatment of Prisoners in the Event of Military Attacks or Imminent Ones (Law No. 117, 2004) on June 14, 2004, somewhat stringent procedures were finally established in Japan for the humane treatment of prisoners of war in the context of a system infrastructure. Yet a look at the world today shows that abusive treatment of prisoners of war persists. Indeed, the heinous abuse which took place at the former Abu Ghraib prison during the Iraq War is still fresh in our memories.

I understand that my thesis may be made electronically available to the public. ii Abstract The members of the Canadian War Crimes Liaison Detachment – Far East travelled across the Pacific in April 1946 to participate in “minor” war crimes trials in Hong Kong and Japan. The assignment stemmed from the harrowing experiences of the Winnipeg Grenadiers and Royal Rifles of Canada in Hong Kong and Japan following the Japanese invasion in December 1941 through to their liberation from POW camps at the end of the Pacific War. Literature pertaining to war crimes trials during this period focuses primarily on the Nuremberg and other European trials, or on the major, often politicized Tokyo Trial. This dissertation addresses the frequently proffered recommendation in the literature that further explorations into the “minor” trials of 5600 Japanese war criminals are needed. The members of the Canadian Detachment served as prosecutors at the American operated Yokohama War Crimes Trials, as well as the British Hong Kong War Crimes Courts. Their cases covered the entirety of the POW experience, from atrocities during battle and in the immediate aftermath, to brutal abuses and medical neglect in POW camps and exploitation in war-related and dangerous labour.

National Archives Introduction Among the huge holdings of United States Government records in the National Archives are many thousands of cubic feet of documents pertaining to East Asia. They deal with many subjects, including military, diplomatic, economic, and cultural matters. Although many of these records are described in various preliminary inventories, lists, and pamphlets, it is regrettable that there exists at this time no single guide to these records that would describe them in terms of contents, dates, accessibility, and state of preservation. Such a guide would be highly desirable for students of East Asian history, yet it appears unlikely that the National Archives will produce one in the near future, considering the diminishing resources with which Governmental agencies are operating these days.

Prison and the Pure Land: A Buddhist Chaplain in Occupied Japan Melissa Anne-Marie Curley 1 Abstract In November 1945, the United States military took over the use of Tokyo’s Sugamo Prison in order to house those charged by the Allied Powers with war crimes. For close to three years, Hanayama Shinshō served as the prison’s volunteer Buddhist chaplain, attending thirty-six execu- tions. Hanayama did not protest the imposition of the death penalty but this essay argues that in his work as chaplain he nonetheless resisted the carceral logic shap- ing life and death inside Sugamo by mobilizing the ritual and narrative repertoire of Pure Land Buddhism.     PERSPECTIVES ON TERRORISM Volume 15, Issue 4 From Spandau to Guantanamo: Prisons as Propaganda Instruments for Extremists and Terrorists by Nathan Thompson and Amber Hart Abstract Prisons have featured repeatedly in narratives of terrorist and other violent extremist groups. Such groups have exploited the imprisonment of their members as a propaganda tool aimed at eliciting support and attracting new members through discourses of struggle and oppression. This article examines three such cases, to isolate key elements that support the use of prisons as a symbol of the ideological struggle of violent militants. It encompasses cases of right-wing extremism as well as nationalist and religious terrorism. With an emphasis on illustrating how terrorist groups utilize prisons to achieve various aims, this article seeks to provide a preliminary understanding of the symbolic and iconic use of prisons across a variety of ideologies. Greater understanding of the factors that promote the choice of prisons as symbols of ideological legitimization could serve to support approaches to minimise the representation of prisons in legitimizing ideologically motivated violence.
