The management (in the form of Government) seeks information to enable it to direct and monitor the progress of employees and to ensure that capable managerial and technical talent is available according to the organisation‟s needs. In the changing nature of state and the functions of Civil Service and other „Services under the State‟, organisational career development has become more important today. The purpose of career development is to attract and retain men and women of talent and ambition in the government employment. This is ensured by providing equal opportunity for promotion and advancement. Article 16 of the Constitution gives effect to the doctrine of equality in all matters relating to public employment. The equal opportunity for the purpose of seniority, promotion and like matters of employment is available only to the persons who fall substantially within the same class or unit of service. The seniority principle in government service is widely prevalent as a method of promotion in most countries. The seniority of an employee is required to be determined in a cadre on the basis of relevant principles enunciated either in the statutory rules or in the absence of any rule by administrative instructions, which remain operative in the field. For example, the year of allotment and fixation of seniority in the Indian Administrative Services would be determined under the rules in force at the time of appointment and not at the time of occurrence of vacancy. The seniority of the Government employees selected through interview or competitive examination or training by a selecting authority shall be determined by the order of merit in which they are selected for appointment. In the absence of statutory rules or administrative instructions the court may evolve a fair and ust principle for determination of inter-se seniority of the direct recruits. A post which the rules require to be filled up by direct recruitment, has to be filled up in accordance with the rules existing at the time when the post is advertised for the purpose. i In determining the seniority of promotees, it is laid down by the Supreme Court that the promotees get their seniority only from the date of regular promotion in accordance with rules and within quota. In case of promoted officers the main criteria to be considered for confirmation are (i) availability of substantive vacancy and (ii) suitability for the post. The seniority in the lower grade has no meaning for determining seniority in the higher grade except for determining inter-se seniority of the promotees. In the absence of specific provision in the Service Rules, inter-se seniority of the promotees would be determined on the basis of length of serviced, irrespective of the date of passing the qualifying examination. The service rendered by an employee on deputation should be counted to entitle him to promotion in the parent department. The service rendered by a deputionist in an equivalent cadre in the parent department cannot be taken away by an executive order, instruction, rule or regulation, while counting his seniority in the deputed post or absorption. However, an officer on deputation is not entitled to promotion in either new or parent department as a matter of right by virtue of his seniority only where promotion is on the basis of seniority-cum-merit. Normally, the seniority is determined from the date of initial appointment of the direct recruits on the basis of the length of continuous service of the promotees. The direct recruits will rank senior to the promotees when direct recruits are appointed against substantive vacancies and the promotees are appointed on officiating or regular basi thereafter. A direct recruit who comes into service after the promotee who is already unconditionally and without reservation promoted and whose promotion is not shown to be invalid or illegal according to relevant statutory or non statutory rules, should not be permitted by any principle of seniority to score a march over a promote, because that by itself being arbitrary would be violative odf Arts. 14 and 16 of the Constitution. Once the direct recruits and promotees form one class, discrimination between them at the time of further promotion is violative of Arts. 14 and 16 of the Constitution. In other words, after integration of the employees recruited from two different sources into one grade, discrimination for further promotion is not permissible in law. The Supreme Court has laid down the following three important principles regarding fixation of seniority: (i) the normal rule is that seniority should be measured by length of continuous officiating service unless a contrary intention appears from the rules; (ii) the promotees regularly ii appointed during a particular period in excess of their quota for want of direct recruits can claim their whole length of service for seniority even against direct recruits who may turn up in succeeding periods; (iii) the promotees who had exceeded their quota would have to be pushed down to accommodate direct recruits coming after their appointment. The expression “relative seniority” between a promote and a direct recruit shall be determined by the year of appointment or promotion of each in the post, cadre or grade, irrespective of the date of joining, would obviously mean the year of regular promotion and not any ad hoc promotion being made contrary to the statutory rules. Each year, the President’s Pay Agent issues a memorandum to continue locality pay for non-GS categories. This memorandum continues locality payments in 2015 for the same Governmentwide and single-agency categories of employees who are authorized to receive 2014 locality payments, except where agencies have informed us they no longer need locality payments for certain single-agency categories of employees. This action does not increase percentage rates of locality pay and does not authorize locality pay for any categories of employees not already receiving locality pay. Under the President’s alternative pay plan for 2015, locality pay percentages will continue at the same rates that were in effect since 2010 for the Governmentwide categories shown in Attachment 1 with no further action required by any agency. Under the statute, locality payments may be made to single-agency categories of employees only at the request of the head of an Executive agency. Attachment 2 shows single-agency categories receiving locality pay in 2014, and these categories will continue to receive locality pay in 2015 at existing percentage rates without any further action required by any agency unless the head of an Executive

    The Governor Genera. and the Head of State Functions THOMAS FRANCK* Lincoln, Nebraska In most, though by no means all democratic states,' the "Head o£ State" is a convenient legal and political fiction the purpose of which is to personify the complex political functions of govern- ment. What distinguishes the operations of this fiction in Canada is the fact that the functions of head of state are not discharged by any one person. Some, by legislative enactment, are vested in the Governor General. Others are delegated to the Governor General by the Crown. Still others are exercised by the Queen in person. A survey of these functions will reveal, however, that many more of the duties of the Canadian head of state are to-day dis- charged by the Governor General than are performed by the Queen. Indeed, it will reveal that some of the functions cannot be dis- charged by anyone else. It is essential that we become aware of this development in Canadian constitutional practice and take legal cognizance of the consequently increasing stature and importance of the Queen's representative in Canada. Die Beiträge von Personal und Arbeitgeber werden nicht in einen auf den Kapitalmärkten angelegten Pensionsfonds einbezahlt, sondern einem fiktiven oder virtuellen Fonds zugeordnet, mit der Rechtsverpflichtung der Mitgliedsstaaten zur Zahlung der Pensionen. Wichtig ist die Feststellung, dass es sich nicht um ein Umlagensystem handelt. Die Höhe der Beiträge wird jährlich angepasst und ist nicht an die Höhe der laufenden Pensionsausgaben gekoppelt, sondern wird auf Grundlage jährlicher finanzmathematischer Bewertungen festgelegt, um so den Kosten der in jedem Dienstjahr erworbenen Pensionsansprüche zu entsprechen. So wird das finanzielle Gleichgewicht gewahrt, und wenn die Angehörigen des Personals in den Ruhestand treten, wurden die Kosten für ihre Pension bereits entrichtet. Die Pensionsschuld wird am Ende jedes Jahres festgelegt.

This Volume was earlier released in the year 1969. Over the years, several new services were framed and consequently new rules introduced. So, this Department considered it absolute necessary to update the Statutory Manual by constituting a Committee with experts who were senior retired officials of the Personnel and Administrative Reforms Department and for them to be assisted by key officials of the Department. After a massive effort involving all Departments, the Personnel and Administrative Reforms (S) Department has now updated the Manual with the Assistance of Committee Members, Officers of this Department, all other Departments of Secretariat and the respective Heads of Department. Taking into consideration the massive contribution and involvement of the team in Personnel and Administrative Reforms Department that made this possible, it is fitting to place their names on record in appreciation of the good work done. Copeland Specialist in American National Government Government and Finance Division The Executive Schedule IV Pay Cap on General Schedule Compensation Summary Annual pay adjustments for about 1.3 million employees under the General Schedule (GS) and certain other systems are governed by Section 529 of P.L. 101- 509, the Federal Employees Pay Comparability Act of 1990 (FEPCA), which generally requires that covered employees receive an annual basic pay adjustment and a locality-based comparability payment. For the GS pay adjustment that took effect in January 2008, the size of the total pay increase (i.e., the annual adjustment plus locality pay) varied across the 32 pay areas, but averaged 3.5% nationwide. In recent years, though, an increasing number of GS employees have not received all of the base and locality pay increases that were designated for their pay areas. By law (5 U.S.C. §5304(g)(1)), base GS pay and locality pay combined cannot exceed Level IV of the Executive Schedule (EX-IV) — which, for 2008, is set at $149,000. Therefore, GS employees whose total pay was already equivalent to EX-IV could only receive the same amount of pay increase that was provided to employees in the Executive Schedule (which, for 2008, was 2.5%). Any employees whose pay was below EX-IV but, after the increase, would have been above Level IV, could only receive a portion of the total increase scheduled for other employees in their pay area.
