POLICY BRIEF APRIL 20, 2021 Why Extended UI Benefits were Turned Off Prematurely for Workers in 33 States ALEX BELL, THOMAS J. HEDIN, GEOFFREY SCHNORR, AND TILL VON WACHTER SUMMARY In some states, up to 30% of people receiving unemployment insurance benefits are losing access to state Extended Benefits because of how unemployment levels are currently measured. UI benefits are automatically extended when particular unemployment rates reach certain thresholds. However, one of the relevant rates does not count people who are receiving UI benefits from extension programs, it can move in the opposite direction of more commonly accepted measures of unemployment. This means Extended Benefits can "trigger off" when they are needed most. This Policy Brief explains how these automatic benefit extensions work, and uses data from the U.S. Department of Labor to quantify the impact of the design of the Extended Benefit program for UI claimants during the COVID-19 pandemic and in other downturns. NARAL PRO-CHOICE AMERICA The United States ACCESS FACT: Currently, there are no states that provide total access Restricted Access The state of reproductive healthcare access in the United States is alarming. Due to the dearth of access in many regions, the nationwide status is “restricted access.” The meter’s colors represent the status of reproductive healthcare access in each state: a spectrum from bright red for “severely restricted access” to dark purple representing “total access.” As shown below, a handful of states have made great strides in expanding and protecting access to reproductive healthcare, achieving the status of “strongly protected access.” Yet, no state has achieved “total access” at this time. The majority of the states are in red, which should serve as a warning about the lack of reproductive healthcare access in much of the nation. An overview of the states that fall within each access category is below, and more detailed information about each state can be found in the state profiles. Ruling Out the Rule of Law Kim Forde-Mazrui 60 Vand. L. Rev. 1497 (2007) Although criminal justice scholars continue to debate the overall value of the void-for-vagueness doctrine, broad consensus prevails that requiring crimes to be defined in specific terms reduces law enforcement discretion. A few scholars have questioned this assumption, but the conventional view remains dominant. This Article intends to resolve the question whether the void-for-vagueness doctrine really reduces police discretion. It focuses on traffic enforcement, a context in which laws are both specific and subject to discretionary enforcement. The Article concludes that specific rules do not constrain discretion unless judicial limits are placed either on the scope of activities that may be criminalized or on police authority to under- enforce the laws. The Article also argues that the Supreme Court's response to specific-rule discretion is inadequate. The Court reassures us that the Equal Protection Clause protects against discriminatory traffic enforcement.

DEMITCHELL PROOF V5 10/31/2013 12:23 PM A PARENT’S CHILD AND THE STATE’S FUTURE CITIZEN: JUDICIAL AND LEGISLATIVE RESPONSES TO THE TENSION OVER THE RIGHT TO DIRECT AN EDUCATION TODD A. DEMITCHELL & JOSEPH J. ONOSKO† I. INTRODUCTION Who should direct the education of our nation’s youth? This question is important because education is of prime concern to parents and the state. As the United States Supreme Court observed in Meyer v. Nebraska, “The American people have always regarded education and the acquisition of knowledge as matters of supreme importance which should be diligently promoted.”1 Parents have a legitimate and long-recognized primary role in directing the education of their children. The Supreme Court in Troxel v. Granville stated, “[T]he interest of parents in the care, custody, and control of their children—is perhaps the oldest of the fundamental liberty interests recognized by this Court.”2 In many ways, educating a child is the essence of parenting. In Wisconsin v. Yoder, the Supreme Court asserted, “The history and culture of Western civilization reflect a strong tradition of parental concern for the nurture and upbringing of their children. This primary role of the parents in the upbringing of their children is now Professor of Education & Lamberton Professor of Justice Studies, University of New Hampshire; B.A., M.A.T., University of La Verne; M.A., University of California at Davis; Ed.D., University of Southern California; Post-Doctorate, Harvard Graduate School of Education. † Associate Professor of Education, University of New Hampshire; B.S., M.A., & Ph.D., University of Wisconsin.

VANDERBILT LAW REVIEW VOLUME 70 JANUARY 2017 NUMBER 1 ARTICLES Sector Agnosticism and the Coming Transformation of Education Law Nicole Stelle Garnett* Over the past two decades, the landscape of elementary and secondary education in the United States has shifted dramatically, due to the emergence and expansion of privately provided, but publicly funded, schooling options (including both charterschools and private school choice devices like vouchers, tax credits, and educational savings accounts). This transformation in the delivery of K12 education is the result of a confluence of factors-discussed in detail below-that increasingly lead education reformers to support efforts to increase the number of high quality schools serving disadvantaged students across all three educationalsectors, instead of focusing exclusively on reforming urban public schools. As a result, millions of American children now attend privately operated, publicly funded schools. This rise in a "sector agnostic" education policy has profound implications for the state and federal constitutional law of education because it blurs the distinction between charter and private schools.

  • Triggers” for State Tax Cuts Provide Illusion of Fiscal Responsibility by Michael Mazerov and Marlana Wallace
820 First Street NE, Suite 510 Washington, DC 20002 Tel: 202-408-1080 Fax: 202-408-1056 [email protected] February 6, 2017 www.cbpp.org Revenue “Triggers” for State Tax Cuts Provide Illusion of Fiscal Responsibility By Michael Mazerov and Marlana Wallace Ten states1 (including the District of Columbia) have enacted laws in recent years that cut personal or corporate income taxes at a future date, contingent on state revenues first reaching a certain level or growth rate. Though these “triggered” tax cuts — like other tax cuts enacted with a significantly delayed effective date2 — are sometimes portrayed as fiscally responsible, they are nothing of the sort. Lawmakers enacting them typically have no idea if they will be affordable or desirable when they take effect, and they can cause deep and lasting damage to a state’s ability to invest in its people and communities. Triggered tax cuts have caused serious financial problems in some states that have adopted them (see the Appendix) and will likely continue causing problems as they kick in in additional states, because they: Are based on inadequate information about projected revenues and spending. When lawmakers approve them, they often lack up-to-date, multi-year forecasts of what the tax cuts will cost when they take effect, and they almost never know what state services will likely cost at that time. Both kinds of forecasts could be done in most cases, but multi-year estimates of revenue losses are the exception rather than the rule, and long-term estimates of the cost of providing “current services” (taking into account inflation, population growth, and caseload growth) are almost never done.3 Without that information, policymakers cannot responsibly evaluate the tax cuts’ impact on state services.

2019 HOUSE HUMAN SERVICES COMMITTEE HB 1546 2019 HOUSE STANDING COMMITTEE MINUTES Human Services Committee Fort Union Room, State Capitol HB 1546 1/21/2019 31113 ☐ Subcommittee ☐ Conference Committee Committee Clerk: Elaine Stromme by Nicole Klaman Explanation or reason for introduction of bill/resolution: Relating to prohibition on human dismemberment abortion; and to provide a penalty. 6 Vice Chairman Rohr Opened the Hearing of HB 1546: Representative Luke Simons: Introduced HB 1546, Oral testimony given, written not provided. This bill would ban all dismemberment abortions for a living baby. At 16 weeks old the baby is 7 inches long, not stretched out, and the head is the size of a peach. A dismemberment abortion is completed by a physician using forceps begins to work the body parts off a living baby in utero. This is a barbaric, horrible process that this bill will stop. (Stopped at 0:02:14) Vice Chairperson Rohr: Further supporting testimony HB 1546? Paul Mallony, Testimony in support, see attachment 1 (0:03: 30-0:05:53) Representative Mary Schneider: Isn’t there a case currently pending on this in the 8th circuit of appeals? If so, wouldn’t it make sense to wait for the outcome of this case? Paul Mallony: Yes, it is being challenged, it’s been passed in 10 states already. No, waiting would not make sense. When Roe V Wade was decided, state after state was legalizing abortion. I don’t suppose anyone in support of abortion thought they should stop at one state and wait. This is something we need to stop.
