Members wishing firther information about this report should contact: Michael O’Neill, Director of Education, on 01236 441478, of Murdo Maciver, Head of Service, on 01236 441372 68 NORTH LANARKSHIRE COUNCIL : EDUCATION DEPARTMENT Use of Repistered Services in School TransDort 1 Introduction 1.1 This report summaries the background to the registration of local bus services and how these arrangements relate to school transport. 2 Legal Background to the Registration of Local Bus Services 2.1 The 1985 Transport Act requires operators of local public bus services to register routes and timetables with the Traffic Commissioner. They must give 42 days notice of any proposal to commence, change or withdraw the service. The Commissioner accepts the registration but in normal circumstances only the police and roads authority can object to a registration and even then only on grounds of safety. 3 Transport of Pupils on Existing Registered Services 3.1 In North Lanarkshire, 327 pupils are transported on existing services ( appendix 1 ). The normal procedure is for the contractor to tender on this basis, indicating that use will be made of spare capacity or that additional capacity will be provided or that an existing registration will be modified. 4 Transport of Pupils on Services Registered after award of School Transport Contract 4.1 At the time of tendering an operator may indicate that if successful they intend to register the contract. Operators may register a school service so long as 50 % of the capacity is available to members of the public including fare - paying pupils. This covers both legs of the return journey between home and school. 4.2 The registration of a school contract has a number of advantages and disadvantages for the operator and the Council. The cost of these are further analysed in table 2 below. (2) on a pro-rata basis, if all pupils were carried on dedicated bus services the additional cost to the council would be approximately E100,OOO. 5.3 However, this specialist advice from SPT is that the additional cost of a full dedicated bus service for school transport would be much higher. Taking account of vehicle supply and tendering experience the indication is that this additional annual cost would be E240,OOO rather than E100,OOO. This is detailed in appendix 1. 6 Conclusions 6.1 The arguments in favour of the appropriate use of registered services for the transport of school pupils are convincing. Firstly, there are efficiency savings to the authority. Secondly, they enhance the transport service available to the paying pupils, perhaps encouraging less use of private cars for the journey to school. Thirdly, the public bus service available to the wider community is improved. Finally, the overriding concern for the safety of pupils is not compromised. 7 Recommendations 7.1 The education resources sub-committee is recommended : (a) to note the analysis of registered and dedicated bus services contracted to school transport. (b) to approve the selective use of registered services for the provision of school transport.
