OCTOBER/NOVEMBER 2010 55 COPYRIGHT IN THE DIGITAL AGE: Industry Issues and Impacts

edited by Trevor Fenwick and Ian Locks on Behalf of The Worshipful Company of Stationers and Newspaper Makers

Price: £24.95 ISBN: 9780854900800 Extent: 192 pp. Size: 234 x 156mm Binding: Paperback The primary purpose of this book is to inform the debate on the future of copy- right in the digital age: a professional resource for those seeking information on the importance and value of Copyright to the UK’s Creative Industries and to pr omote understanding of the importance of those industries and their reliance on their ability to ‘own’ intellectual property through copyright legislation. The book contains articles and submissions by leading industry practitioners, lawyers and academics with practical experience of the importance of Copyright in the UK as well as those at the ‘sharp end’ as publishers and producers. It reflects the chal- lenges to be faced with the development of the digital usage of copyright material as well as tracking the Stationers’ 450 years of involvement in the development of copyright, enshrined in law by the Statute of Anne 300 years ago.

The Stationers’ Company is the City of London Livery Company for the visual and graphic com- munications industries. The Company was founded in 1403 when the manuscript writers and illuminators formed a guild, taking the name ‘Stationers’ from the fact that they had stopped being itinerant vendors and had set up fixed stalls in St Paul’s Churchyard. At the end of the 15th century when printing first came to England, the Stationers had the good sense to embrace the new technol- ogy. The guild received a Royal Charter in 1557 in which they were given a monopoly in printing and the responsibility to check and register all books produced in England. Today the Company has over 800 members, the vast majority of whom are senior executives in the complete range of trades within the visual and graphic communications industries, from paper, print, publishing, packaging, office products, newspapers, broadcasting and online media. Membership is drawn from across the UK and increasingly throughout the world and now includes major companies as well as individual members. The Company still uses Stationers’ Hall for the purpose for which it was built 350 years ago: to bring together the major players in our associated industries so that they can enjoy each other’s company, learn from one another, swop ideas and together develop strategies for the future of an industry that is vital to global economic growth. Activities range from formal dinners, informal lunches, lectures, seminars and intimate round-table sessions to online reports and discussion fora.

56 WILDY’S BOOK NEWS COURT SCENES The Court Art of Priscilla Coleman

Commentary by Paul Cheston

Price: £19.99 ISBN: 9780854900398 Extent: 64 pp. Size: 300 x 242 mm Binding: Hardback

Priscilla Coleman has been drawing court scenes for over 20 years. The pictures collected here mark many of the most important trials of that period. There is a widespread misunderstanding among those who see pictures on TV or in the newspapers that an artist can sketch as much as they like in court. As lawyers know, far from taking a palate and easel into the public gallery, any attempt at photography, drawings or visual representations is strictly verboten. Artists have to memorise in court the colours, shades, clothing, facial mannerisms and physi- cal idiocyncracies then go out and draw a likeness from memory . . . against the clock.

Priscilla Coleman was born in Chilton, near Waco Texas and went to high school in Chilton and Huntsville before studying fine art and graphics at Sam Houston State University, Texas. Inspired by her mother Henrietta, a talented fashion illustrator and portrait painter, Priscilla is driven by a love of drawing people. She approached ITN with a video tape of her electronic news graphics and court drawings from her time with Channel 13 and KTRK TV in Houston where she was art director for news, and was hired straight away. Her first sketch was of Jeffrey Archer and Monica Coghlan in the notorious High Court libel trial.

Paul Cheston is the courts correspondent of the London Evening Standard. He was born in Ab- erdare, Mid Glamorgan and educated at Kimbolton School and the University of East Anglia. He covered his first court case for the Diss Express and, after training on the Middlesbrough Evening Gazette, came to Fleet Street to work for the Press Association. He joined the short-lived London Daily News and was in court on the final day of the Jeffrey Archer libel trial when owner Robert Maxwell closed the paper down. After brief work for the Daily Star and Sunday Express he joined the Evening Standard as a general news reporter. He was appointed courts correspondent in 1993 and is co-author of Brothers in Blood published in 1994.

OCTOBER/NOVEMBER 2010 57 A Practitioner’s Guide to Wills 3d edition

Lesley King, Keith Biggs and Peter Gausden

Consulting Editor: Meryl Thomas

Price: £59 ISBN: 9780854900725 Extent: 502 pp. Size: 29 x 152 mm Binding: Hardback & CD-ROM

The third edition of this popular title provides a practical and comprehensive reference for all those concerned in drafting and interpreting wills, and in giving effect to their provisions. The commentary is supported throughout by an exten- sive range of specimen clauses and model wills are provided in a separate appen- dix. All precedent material is included on the accompanying CD-Rom, enabling practitioners to adapt precedents for their own use.

Fully updated, A Practitioner’s Guide to Wills features a new chapter on the use of Pilot Trusts and deals with the Mental Capacity Act 2005, Charities Act 2006 and Perpetuities and Accumulations Act 2009. It examines the impact of the leg- islative changes in recent years to tax planning, notably the new capital gains tax regime and the radical changes to the IHT treatment of trusts, particularly those affecting provision in wills for spouses and civil partners and children. The impact on planning and drafting is also considered, together with the role that the nil rate discretionary trust might still have to play in financial planning notwithstand- ing the introduction of the transferable nil-rate band between spouses and civil partners. The chapter on testamentary capacity has been fully revised in the light of the Mental Capacity Act 2005 and its effect on the application of the Banks v Goodfellow test as considered in recent cases including Re Perrins, Re Ritchie and Key v Key.

Lesley King is a , and a principal lecturer at the College of Law. Keith Biggs was formerly District Probate Registrar at Winchester, and is now a con- sultant on common form probate. Peter Gausden was formerly a principal lecturer at the College of Law. He is now a consultant solicitor at Rowlinsons. Meryl Thomas is Professor in Property Law at Birmingham City University, and Visiting Professor in Succession at the Institute of Law in Jersey 58 WILDY’S BOOK NEWS Law of Field Sports

Tim Russ and Jamie Foster

Price: £35 ISBN: 9780854900695 Extent: circa 160pp. Size: 216 x 138mm Binding: Paperback

Written by leading practitioners in the field, Law of Field Sports is the first book on the Game Act 1831 for the best part of a century during which time there has been considerable reform of the law. This book contains a detailed analysis of the civil and criminal law relating to shooting and hunting and offers a practical evaluation of the Hunting Act 2004. The authors look at the law of poaching and control of shooting and hunting in terms of closed seasons and provide up-to-date precedents on the Ground Game Act 1880. A useful overview of pertinent firearms law is also included.

Land ownership of rural land is also covered so far as it relates to shooting and hunting, in particular the issue of how field sports rights are treated by the law of real property. The book also sets out the law appertaining to badgers, deer and other species managed in the countryside.

Law of Field Sports provides a comprehensive single source of reference that will prove invaluable for practitioners drafting game rights in sporting or farming leases, or defending those who might have fallen foul of the law and be facing prosecution in relation to game issues.

Tim Russ is a Partner with Clarke Willmott LLP. He specialises in agricultural property disputes including agricultural tenancy and related issues and has been recognised as an agricultural expert by the Chambers and Legal Experts directo- ries. 60 WILDY’S BOOK NEWS Legal Research: A Practitioner’s Handbook

Peter Clinch with contributions by James Mullan

Price: £39 ISBN: 9780854900640 Extent: 450 pp Size: 246 x 189mm Binding: Hardback

This comprehensive reference is specifically aimed at busy practitioners (solici- tors, barristers and professional support lawyers), particularly those who do not have the benefit of access to a law librarian or information officer. Legal Re- search: A Practitioner’s Handbook provides practical advice on every aspect of effective legal research: problem analysis, selecting and finding the best sources, and presenting results effectively.

Part A covers problem identification and analysis, followed by advice on how to select the best sources and formats (paper or electronic) for research. Part B deals with the information most frequently sought by practitioners, listing sources with analytical comments and, for a selection of the most complex, ‘how to use’ instructions developed to a standard template. Jurisdictional coverage includes England, Wales, Scotland, Northern Ireland and the European Union, with the ad- dition of information on key sources in European human rights and international law. Part C details sources on how to make the presentation of the results of legal research more effective.

OCTOBER/NOVEMBER 2010 61 Small Claims Procedure in the County Court (5ed) A Practical Guide to Mediation and Litigation

Patricia Pearl and Andrew Goodman

Price: £19.99 ISBN: 9780854900527 Extent: 309pp. Size: 152mm x 229mm Binding: Paperback

Legal professionals rarely receive any formal training or guidance on how to run a small claims case in the county court, while litigants in person often have to conduct such cases without legal representation. A lack of understanding of the rules frequently leads to confusion and mistakes, which in turn adds to expense and causes delay. The fifth edition of this popular title (formerly entitled Small Claims Procedure: A Practical Guide) will prove invaluable for busy practitioners and litigants in person alike, equipping them with the latest know-how on avoid- ing errors and making the most of the procedures that are available.

The mediation section of the book has special prominence in this edition. Liti- gants using the small claims track can now agree to have their cases diverted to a mediation service run by the Courts service and at no additional charge. The system has been in operation now for over a year and has proved popular with court users, especially litigants in person. This book sets out the scheme in detail together with practical tips on how to make the best use of this new service.

Updating material in this edition has been significant; of particular importance are the clarified rules on the date upon which court proceedings are served and the material which must be included in letters before action and other pre-action steps. Finally, the book has been made even more user friendly by improved cross-referencing, handy tables and an extensive glossary.

62 WILDY’S BOOK NEWS THE SNAIL AND THE GINGER BEER The Story of Donoghue v Stevenson

Matthew Chapman

Price: £14.99 ISBN: 9780854900497 Extent: 200 pp. Size: 152mm x 229mm Binding: Hardback

On an August evening in 1928 May Donoghue, a shop assistant, entered a café in Paisley. The circumstances of her visit made legal history. A ginger beer was ordered for Mrs Donoghue who famously complained that, to her surprise and shock, a decomposed snail had tumbled from the bottle into her glass. Mrs Dono- ghue sued for the nervous shock she claimed to have suffered as a result. The question whether she had a case in law against the manufacturer of the ginger beer was argued as far as the House of Lords. It is hard to overstate the importance of the decision in Donoghue v Stevenson. It represents, perhaps, the greatest contri- bution made by English and Scottish lawyers to the development of the common law. Donoghue v Stevenson made it clear that, even without a contract between the parties, a duty of care is owed by ‘A’ to take reasonable care to avoid acts or omis- sions which could reasonably be foreseen as likely to cause injury to his neigh- bour: ‘B’. This concept, developed by the great jurist Lord Atkin, has become known by the universal shorthand, ‘the neighbour principle’. Who, Lord Atkin asked rhetorically, is ‘in law’ my neighbour? Donoghue v Stevenson provides the answer. The Snail and the Ginger Beer tells the full story of this remarkable case. It pro- vides vivid biographical sketches of the protagonists and of the great lawyers who were involved in the case. It sets Donoghue v Stevenson in its historical context and re-evaluates the evidence. The roots of the neighbour principle are excavated in the parable of the Good Samaritan and the case law of the United States. The constitutional importance of the case is also dealt with; the blow it struck for a moral approach to the law which departed from a rigid doctrine of precedent. Finally, the book investigates the influence of Donoghue v Stevenson across the common law world: from the USA to the countries of what is now the Common- wealth.

Elspeth Berry

Price: £29 ISBN: 9780854900602 Extent: 183 pp. Size: 216 x 138mm Binding: Paperback

This book contains a mass of legal and practical information within a compact, user-friendly format. It provides a comprehensive and comparative explanation of the law relating to all three types of business partnership available under English law; general partnerships, limited partnerships and LLPs.
