1 SB333 2 3 4 ENROLLED, An Act, 5 Relating to Schedule I controlled substances; to 6 amend Sections 13A-12-231 and 20-2-23, Code of Alabama 1975, 7 to increase the requisite weight for trafficking in controlled

8 substance analogues; to include additional synthetic 9 controlled substances and analogues to the Schedule I 10 controlled substances list; and in connection therewith would 11 have as its purpose or effect the requirement of a new or 12 increased expenditure of local funds within the meaning of 13 Amendment 621 of the Constitution of Alabama of 1901, now 14 appearing as Section 111.05 of the Official Recompilation of 15 the Constitution of Alabama of 1901, as amended. 16 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 17 Section 1. This act shall be known and may be cited 18 as Landon's Law. 19 Section 2. Sections 13A-12-231 and 20-2-23, Code of 20 Alabama 1975, are amended to read as follows: 21 "§13A-12-231. 22 "Except as authorized in Chapter 2, Title 20: 23 "(1) Any person who knowingly sells, manufactures, 24 delivers, or brings into this state, or who is knowingly in 25 actual or constructive possession of, in excess of one kilo or

1 2.2 pounds of any part of the plant of the genus Cannabis, 2 whether growing or not, the seeds thereof, the resin extracted 3 from any part of the plant, and every compound, manufacture, 4 salt, derivative, mixture, or preparation of the plant, its 5 seeds, or resin including the completely defoliated mature 6 stalks of the plant, fiber produced from the stalks, oil, or 7 cake, or the completely sterilized samples of seeds of the

8 plant which are incapable of germination is guilty of a 9 felony, which felony shall be known as "trafficking in 10 cannabis." Nothing in this subdivision shall apply to samples 11 of including, but not limited to, all 12 synthetic or naturally produced samples of 13 tetrahydrocannabinols which contain more than 15 percent by 14 weight of tetrahydrocannabinols and which do not contain plant 15 material exhibiting the external morphological features of the 16 plant cannabis. If the quantity of cannabis involved: 17 "a. Is in excess of one kilo or 2.2 pounds, but less 18 than 100 pounds, the person shall be sentenced to a mandatory 19 minimum term of imprisonment of three calendar years and to 20 pay a fine of twenty-five thousand dollars ($25,000). 21 "b. Is 100 pounds or more, but less than 500 pounds, 22 the person shall be sentenced to a mandatory minimum term of 23 imprisonment of five calendar years and to pay a fine of fifty 24 thousand dollars ($50,000).

Is 500 pounds or more, but less than 1,000 2 pounds, the person shall be sentenced to a mandatory minimum 3 term of imprisonment of 15 calendar years and to pay a fine of 4 two hundred thousand dollars ($200,000). 5 "d. Is 1,000 pounds or more, the person shall be 6 sentenced to a mandatory term of imprisonment of life without 7 parole.

8 "(2) Any person who knowingly sells, manufactures, 9 delivers, or brings into this state, or who is knowingly in 10 actual or constructive possession of, 28 grams or more of 11 or of any mixture containing cocaine, described in 12 Section 20-2-25(1), is guilty of a felony, which felony shall 13 be known as "trafficking in cocaine." If the quantity 14 involved: 15 "a. Is 28 grams or more, but less than 500 grams, 16 the person shall be sentenced to a mandatory minimum term of 17 imprisonment of three calendar years and to pay a fine of 18 fifty thousand dollars ($50,000). 19 "b. Is 500 grams or more, but less than one kilo, 20 the person shall be sentenced to a mandatory minimum term of 21 imprisonment of five calendar years and to pay a fine of one 22 hundred thousand dollars ($100,000). 23 "c. Is one kilo, but less than 10 kilos, then the 24 person shall be sentenced to a mandatory minimum term of

Is 10 kilos or more, the person shall be 4 sentenced to a mandatory term of imprisonment of life without 5 parole. 6 "(3) Any person who knowingly sells, manufactures, 7 delivers, or brings into this state, or who is knowingly in

8 actual or constructive possession of, four grams or more of 9 any , opium, or any salt, , or salt of an isomer 10 thereof, including , as described in Section 20-2-23(2) 11 or Section 20-2-25(1)a., or four grams or more of any mixture 12 containing any such substance, is guilty of a felony, which 13 felony shall be known as "trafficking in illegal ." If 14 the quantity involved: 15 "a. Is four grams or more, but less than 14 grams, 16 the person shall be sentenced to a mandatory minimum term of 17 imprisonment of three calendar years and to pay a fine of 18 fifty thousand dollars ($50,000). 19 "b. Is 14 grams or more, but less than 28 grams, the 20 person shall be sentenced to a mandatory minimum term of 21 imprisonment of 10 calendar years and to pay a fine of one 22 hundred thousand dollars ($100,000). 23 "c. Is 28 grams or more, but less than 56 grams, the 24 person shall be sentenced to a mandatory minimum term of

1 imprisonment of 25 calendar years and to pay a fine of five 2 hundred thousand dollars ($500,000). 3 "d. Is 56 grams or more, the person shall be 4 sentenced to a mandatory term of imprisonment of life without 5 parole. 6 "(4) Any person who knowingly sells, manufactures, 7 delivers, or brings into this state, or who is knowingly in

8 actual or constructive possession of 1,000 or more pills or 9 capsules of methaqualone, as described in Section 20-2-1, et 10 seq., is guilty of a felony, which felony shall be known as 11 "trafficking in illegal drugs." If the quantity involved: 12 "a. Is 1,000 pills or capsules, but less than 5,000 13 pills or capsules, the person shall be sentenced to a 14 mandatory minimum term of imprisonment of three calendar years 15 and pay a fine of fifty thousand dollars ($50,000). 16 "b. Is 5,000 capsules or more, but less than 25,000 17 capsules, that person shall be imprisoned to a mandatory 18 minimum term of imprisonment of 10 calendar years and pay a 19 fine of one hundred thousand dollars ($100,000). 20 "c. Is 25,000 pills or more, but less than 100,000 21 pills or capsules, the person shall be sentenced to a 22 mandatory minimum term of imprisonment of 25 calendar years 23 and pay a fine of five hundred thousand dollars ($500,000).

Is 100,000 capsules or more, the person shall be 2 sentenced to a mandatory term of imprisonment of life without 3 parole. 4 "(5) Any person who knowingly sells, manufactures, 5 delivers or brings into this state, or who is knowingly in 6 actual or constructive possession of 500 or more pills or 7 capsules of hydromorphone as is described in Section 20-2-1,

8 et seq., is guilty of a felony which shall be known as 9 "trafficking in illegal drugs." If the quantity involved: 10 "a. Is 500 pills or capsules or more but less than 11 1,000 pills or capsules, the person shall be sentenced to a 12 mandatory term of imprisonment of three calendar years and to 13 pay a fine of fifty thousand dollars ($50,000). 14 "b. Is 1,000 pills or capsules or more, but less 15 than 4,000 pills or capsules, the person shall be sentenced to 16 a mandatory term of imprisonment of 10 calendar years and to 17 pay a fine of one hundred thousand dollars ($100,000). 18 "c. Is 4,000 pills or capsules or more but less than 19 10,000 pills or capsules, the person shall be sentenced to a 20 mandatory term of imprisonment of 25 calendar years and to pay 21 a fine of one hundred thousand dollars ($100,000). 22 "d. Is more than 10,000 pills or capsules, the 23 person shall be sentenced to a mandatory term of life in 24 prison without parole.

1 "(6) Any person who knowingly sells, manufactures, 2 delivers, or brings into this state, or who is knowingly in 3 actual or constructive possession of, 28 grams or more of 4 3,4-methylenedioxy , or of any mixture containing 5 3,4-methylenedioxy amphetamine, is guilty of a felony, which 6 felony shall be known as "trafficking in illegal drugs." If 7 the quantity involved:

8 "a. Is 28 grams or more, but less than 500 grams, 9 the person shall be sentenced to a mandatory minimum term of 10 imprisonment of three calendar years and to pay a fine of 11 fifty thousand dollars ($50,000). 12 "b. Is 500 grams or more, but less than one kilo, 13 the person shall be sentenced to a mandatory minimum term of 14 imprisonment of five calendar years and to pay a fine of one 15 hundred thousand dollars ($100,000). 16 "c. Is one kilo, but less than 10 kilos, then the 17 person shall be sentenced to a mandatory minimum term of 18 imprisonment of 15 calendar years and to pay a fine of two 19 hundred fifty thousand dollars ($250,000). 20 "d. Is 10 kilos or more, the person shall be 21 sentenced to a mandatory term of imprisonment of life without 22 parole. 23 "(7) Any person who knowingly sells, manufactures, 24 delivers, or brings into this state, or who is knowingly in 25 actual or constructive possession of, 28 grams or more of

1 5-methoxy-3, 4-methylenedioxy amphetamine, or of any mixture 2 containing 5-methoxy-3, 4-methylenedioxy amphetamine is guilty 3 of a felony, which felony shall be known as "trafficking in 4 illegal drugs" if the quantity involved: 5 "a. Is 28 grams or more, but less than 500 grams, 6 the person shall be sentenced to a mandatory minimum term of 7 imprisonment of three calendar years and to pay a fine of

8 fifty thousand dollars ($50,000). 9 "b. Is 500 grams or more, but less than one kilo, 10 the person shall be sentenced to a mandatory minimum term of 11 imprisonment of five calendar years and to pay a fine of one 12 hundred thousand dollars ($100,000). 13 "c. Is one kilo, but less than 10 kilos, then the 14 person shall be sentenced to a mandatory minimum term of 15 imprisonment of 15 calendar years and to pay a fine of two 16 hundred fifty thousand dollars ($250,000). 17 "d. Is 10 kilos or more, the person shall be 18 sentenced to a mandatory term of imprisonment of life without 19 parole. 20 "(8) Any person who knowingly sells, manufactures, 21 delivers, or brings into this state, or who is knowingly in 22 actual or constructive possession of, four grams or more of 23 , or any mixture containing phencyclidine, is 24 guilty of a felony, which felony shall be known as 25 "trafficking in illegal drugs." Is four grams or more, but less than 14 grams, 2 the person shall be sentenced to a mandatory minimum term of 3 imprisonment of three calendar years and to pay a fine of 4 fifty thousand dollars ($50,000). 5 "b. Is 14 grams or more, but less than 28 grams, the 6 person shall be sentenced to a mandatory minimum term of 7 imprisonment of five calendar years and to pay a fine of one

8 hundred thousand dollars ($100,000). 9 "c. Is 28 grams or more, but less than 56 grams, 10 then the person shall be sentenced to a mandatory minimum term 11 of imprisonment of 15 calendar years and to pay a fine of two 12 hundred fifty thousand dollars ($250,000). 13 "d. Is 56 grams or more, the person shall be 14 sentenced to a mandatory term of imprisonment of life without 15 parole. 16 "(9) Any person who knowingly sells, manufactures, 17 delivers, or brings into this state, or who is knowingly in 18 actual or constructive possession of, four grams or more of 19 lysergic acid diethylamide, of four grams or more of any 20 mixture containing lysergic acid diethylamide, is guilty of a 21 felony, which felony shall be known as "trafficking in illegal 22 drugs." If the quantity involved: 23 "a. Is four grams or more, but less than 14 grams, 24 the person shall be sentenced to a mandatory minimum term of

1 imprisonment of three calendar years and to pay a fine of 2 fifty thousand dollars ($50,000). 3 "b. Is 14 grams or more, but less than 28 grams, the 4 person shall be sentenced to a mandatory minimum term of 5 imprisonment of 10 calendar years and to pay a fine of one 6 hundred thousand dollars ($100,000). 7 "c. Is 28 grams or more, but less than 56 grams, the

8 person shall be sentenced to a mandatory minimum term of 9 imprisonment of 25 calendar years and to pay a fine of five 10 hundred thousand dollars ($500,000). 11 "d. Is 56 grams or more, the person shall be 12 sentenced to a mandatory term of imprisonment of life without 13 parole. 14 "(10) Any person who knowingly sells, manufactures, 15 delivers or brings into this state, or who is knowingly in 16 actual or constructive possession of, 28 grams or more of 17 amphetamine or any mixture containing amphetamine, its salt, 18 optical isomer, or salt of its optical isomer thereof, is 19 guilty of a felony, which felony shall be known as 20 "trafficking in amphetamine." If the quantity involved: 21 "a. Is 28 grams or more but less than 500 grams, the 22 person shall be sentenced to a mandatory minimum term of 23 imprisonment of three calendar years and to pay a fine of 24 fifty thousand dollars ($50,000).

Is 500 grams or more, but less than one kilo, 2 the person shall be sentenced to a mandatory minimum term of 3 imprisonment of five calendar years and to pay a fine of one 4 hundred thousand dollars ($100,000). 5 "c. Is one kilo but less than 10 kilos, then the 6 person shall be sentenced to a mandatory minimum term of 7 imprisonment of 15 calendar years and to pay a fine of two

8 hundred fifty thousand dollars ($250,000). 9 "d. Is 10 kilos or more, the person shall be 10 sentenced to a mandatory term of imprisonment of life without 11 parole. 12 "(11) Any person who knowingly sells, manufactures, 13 delivers, or brings into this state, or who is knowingly in 14 actual or constructive possession of, 28 grams or more of 15 or any mixture containing methamphetamine, its 16 salts, optical , or salt of its optical isomers 17 thereof, is guilty of a felony, which felony shall be known as 18 "trafficking in methamphetamine." If the quantity involved: 19 "a. Is 28 grams or more but less than 500 grams, the 20 person shall be sentenced to a mandatory minimum term of 21 imprisonment of three calendar years and to pay a fine of 22 fifty thousand dollars ($50,000). 23 "b. Is 500 grams or more, but less than one kilo, 24 the person shall be sentenced to a mandatory minimum term of

1 imprisonment of five calendar years and to pay a fine of one 2 hundred thousand dollars ($100,000). 3 "c. Is one kilo but less than 10 kilos, then the 4 person shall be sentenced to a mandatory minimum term of 5 imprisonment of 15 calendar years and to pay a fine of two 6 hundred fifty thousand dollars ($250,000). 7 "d. Is 10 kilos or more, the person shall be

8 sentenced to a mandatory term of imprisonment of life without 9 parole. 10 "(12) Any person who knowingly sells, manufactures, 11 delivers, or brings into this state, or who is knowingly in 12 actual or constructive possession of 28 56 or more grams of a 13 synthetic controlled substance analog or a synthetic 14 controlled substance analogue, as described in subsection (4) 15 or (5) of Section 20-2-23, is guilty of a felony, which felony 16 shall be known as "trafficking in synthetic controlled 17 substance analogs substances." If the quantity involved: 18 "a. Is 28 56 grams or more, but less than 500 grams, 19 the person shall be sentenced to a mandatory minimum term of 20 imprisonment of three calendar years and to pay a fine of 21 fifty thousand dollars ($50,000). 22 "b. Is 500 grams or more, but less than 1 kilo, the 23 person shall be sentenced to a mandatory minimum term of 24 imprisonment of 10 calendar years and to pay a fine of one 25 hundred thousand dollars ($100,000).

Is one kilo, but less than 10 kilos, then the 2 person shall be sentenced to a mandatory minimum term of 3 imprisonment of 15 calendar years and to pay a fine of two 4 hundred fifty thousand dollars ($250,000). 5 "d. Is 10 kilos or more, the person shall be 6 sentenced to a mandatory term of imprisonment of life without 7 parole.

8 "(13) The felonies of "trafficking in cannabis," 9 "trafficking in cocaine," "trafficking in illegal drugs," 10 "trafficking in amphetamine," "trafficking in 11 methamphetamine," and "trafficking in synthetic controlled 12 substance analogs substances" as defined in subdivisions (1) 13 through (12), above, shall be treated as Class A felonies for 14 purposes of Title 13A, including sentencing under Section 15 13A-5-9. Provided, however, that the sentence of imprisonment 16 for a defendant with one or more prior felony convictions who 17 violates subdivisions (1) through (12) of this section shall 18 be the sentence provided therein, or the sentence provided 19 under Section 13A-5-9, whichever is greater. Provided further, 20 that the fine for a defendant with one or more prior felony 21 convictions who violates subdivisions (1) through (12) of this 22 section shall be the fine provided therein, or the fine 23 provided under Section 13A-5-9, whichever is greater. 24 "(14) Notwithstanding any provision of law to the 25 contrary, any person who has possession of a firearm during

1 the commission of any act proscribed by this section shall be 2 punished by a term of imprisonment of five calendar years 3 which shall be in addition to, and not in lieu of, the 4 punishment otherwise provided, and a fine of twenty-five 5 thousand dollars ($25,000); the court shall not suspend the 6 five-year additional sentence of the person or give the person 7 a probationary sentence.

8 "§20-2-23. 9 "(a) The Legislature finds the following: 10 "(1) New synthetic substances are being created 11 which are not controlled under the provisions of existing 12 state law but which have a potential for abuse similar to or 13 greater than that for substances controlled under existing 14 state law. These new synthetic substances are called 15 "controlled substance analogs," "synthetic controlled 16 substances or synthetic controlled substance analogues" and 17 can be designed to produce a desired pharmacological effect 18 and to evade the controlling statutory provisions. Controlled 19 Synthetic controlled substance analogs substances or synthetic 20 controlled substance analogues are being manufactured, 21 distributed, possessed, and used as substitutes for controlled 22 substances. 23 "(2) The hazards attributable to the traffic in and 24 use of a synthetic controlled substance analogs or synthetic 25 controlled substance analogues are increased because their

1 unregulated manufacture produces variations in purity and 2 concentration. 3 "(3) Many new synthetic substances are untested, and 4 it cannot be immediately determined whether they have useful 5 medical or chemical purposes. 6 "(4) The uncontrolled importation, manufacture, 7 distribution, possession, or use of controlled substance

8 analogs analogues has a substantial and detrimental impact on 9 the health and safety of the people of this state. 10 "(5) Controlled substance analogs Synthetic 11 controlled substances or synthetic controlled substance 12 analogues can be created more rapidly than they can be 13 identified and controlled by action of the Legislature. There 14 is a need for a speedy determination of their proper 15 classification under existing law. It is therefore necessary 16 to identify and classify new substances that have a potential 17 for abuse, so that they can be controlled in the same manner 18 as other substances controlled under existing state law. 19 "(b) The controlled substances listed in this 20 section are included in Schedule I: 21 "(1) Any of the following opiates, including their 22 isomers, esters, ethers, salts, and salts of isomers, esters 23 and ethers, unless specifically excepted, whenever the 24 existence of these isomers, esters, ethers and salts is 25 possible within the specific chemical designation:

Although this bill would have as its 5 purpose or effect the requirement of a new or increased 6 expenditure of local funds, the bill is excluded from further 7 requirements and application under Amendment 621, now

8 appearing as Section 111.05 of the Official Recompilation of 9 the Constitution of Alabama of 1901, as amended, because the 10 bill defines a new crime or amends the definition of an 11 existing crime. 12 Section 4. This act shall become effective 13 immediately following its passage and approval by the 14 Governor, or its otherwise becoming law.
