Dear Friends, This year is a critical year as Article 15-A of the Executive Law, “participation by minority group members and women with respect to state contracts,” expires in April 2018. Last year, State contracted Mason Tillman Associates, Ltd. to conduct a disparity study to examine MWBE participation in contracts awarded from April 2010 to March 2015. On June 30th, 2017, findings of the disparity study were released, highlighting recommendations that will significantly improve the form and function of MWBE’s in New York State. Here are some highlights from the NYS Disparity Study: • MWBE availability in state subcontracting has increased significantly since the 2010 Study (28.92% in 2010, 57.42% in 2016). While the availability has nearly doubled, the utilization remained stagnant in the past 5 years. • Construction field MWBEs represented 50.41% of the businesses, 28.64% were utilized; construction-related fields MWBES represented 59.09% of businesses 28.85% were utilized; non-construction fields MWBEs represented 62.77% of businesses, 22.96% were utilized. (see MWBE Availability vs. Utilization table below) • A bill to eliminate the Personal Net Worth requirement (PNW) was passed in both houses, and awaits Governor Cuomo’s signature. The sponsored Study recommended by (Bichotte, that A2819)/(Ritchie, if the State were S3018) to keep the PNW requirement, it should simplify and streamline the criterion. However, the study also indicates that because the State has conducted the Disparity Study, which meets the highest scrutiny standard, the PNW is not needed. The findings of the disparity study clearly show that we still have a long way to go. With that being said, in this legislative session, I am committed to help activate the outcomes of this MWBE disparity study to benefit small businesses and MWBEs throughout the state making it a more robust program.
