Bono, the Culture Wars, and a Profane Decision: The FCC's Reversal of Course on Indecency Determinations and Its New Path on Profanity Clay Calvert* INTRODUCTION The United States Supreme Court has rendered numerous high- profile opinions in the past thirty-five years regarding variations of the word "fuck." Paul Robert Cohen's anti-draft jacket,' Gregory Hess's threatening promise, 23George Carlin's satirical monologue,3 and Barbara Susan Papish's newspaper headline 4 quickly come to mind. 5 These now-aging opinions address important First Amendment issues of free speech, such as protection of political dissent,6 that continue to carry importance today. The Rise of Controversial Content in Film
The Climb of Controversial Film Content by Ashley Haygood Submitted to the Department of Communication Studies in partial fulfillment of the requirements for the degree of Masters of Arts in Communication at Liberty University May 2007 Film Content ii Abstract This study looks at the change in controversial content in films during the 20th century. Original films made prior to 1968 and their remakes produced after were compared in the content areas of profanity, nudity, sexual content, alcohol and drug use, and violence. The advent of television, post-war effects and a proposed “Hollywood elite” are discussed as possible causes for the increase in controversial content. Commentary from industry professionals on the change in content is presented, along with an overview of American culture and the history of the film industry. The material at issue was aired in connection with the “Elliot in the Morning” program on Stations WWDC(FM), Washington, D.C., WRXL(FM), Richmond, Virginia, and WOSC(FM), Bethany Beach, Delaware. The Commission proposed the statutory maximum forfeiture of $27,500 for each of nine apparent indecency violations. The Commission found nine apparent indecency violations that involved graphic and explicit sexual material, and were designed to pander to, titillate and shock listeners. The Commission proposed the statutory maximum forfeiture amount because of Clear Channel’s history of violations relating to the broadcast of indecent material. Time spent with family became something to look forward to and feel grateful for, as opposed to years ago when it felt like an irritating obligation. Is it because the older I get the more human my parents become? When their hair began turning gray, did I suddenly value their company more because I finally and tangibly understood that they're growing older and are someday going to die? Or maybe I just relate to them a bit more on an eye-to-eye level now that I'm older. And things that used to mean so much have kind of lost their value a bit. Watching sports is still enjoyable but the importance of my team winning and the agony of them losing have both softened into feelings almost indistinguishable from each other. It's a saddening realization that this softening is only a pit stop on the road to indifference. It's amazing that it took until this day, in my thirty-seventh year God, that sounds so old to have what I will consider from here on to be the greatest moment in my life. -

INTRODUCTION Just one week before rendering its controversial landmark decision on the Patient Protection and Affordable Care Act1— arguably the most anticipated ruling of the October 2011 Term—the U.S. Supreme Court sidestepped the longstanding question of whether the First Amendment, given today‘s multifaceted media landscape, no longer permits the Federal Communications Commission to regulate broadcast indecency on the nation‘s airwaves. The Court‘s narrow ruling in FCC v. Fox Television Stations, Inc.2 (―Fox II‖) let broadcasters off the hook for the specific on-air transgressions that brought the case to the Court‘s docket— twice3—but did little to resolve the larger looming issue of whether such content regulations have become obsolete. In recent years, the FCC has not only pursued hi gh profile enforcements such as Janet Jackson’s well -known Super Bowl half time show, but perhaps more important, has issued fines against broadcasters in record amounts totaling millions of dollars. Critics claim that these enforcements are politicized, arbitrary, and chilling of free speech. This article proposes a new, market -based mechanism for indecency regulation that avoids the pitfalls of the FCC’s current approach. The proposal focuses on the viewer -- advertiser relationship, in distinction to the FCC’s regulations, which concentrate solely on the broadcaster. Drawing on recent economic theory involving “two sided markets,” we argue that if the FCC required disclos ur e of all programming advertisers sponsor, consumers could then directly pressure a dvertisers, resulting in programming that better reflect s “community standards” of indecency. Introduction Michael Powell, Chairman of the Federal Communications from 2001 to 2005 will likely be most remembered for his controver sial and attention-gra bbing indecency enforcement actions against Howard Stern and, of course, Janet Jackson’s Super Bowl “wardrobe malfunction.”1 This legacy is deserved, for in addition to these high -profile enforcement ac tions, Michael Powell imposed, according to The Cente r for Public Integrity , a higher total fine amount for 2004 broadcast indecency than for all the previous 10 years combined.2 † Keith Brown is a consultant at CNA Corporation in Washington, D.C . -

Under the scope of work, KO was charged with developing a statewide campaign, including earned media, TV, radio, and digital to supplement the State Board of Election’s social media campaign. The public education campaign also included broad stakeholder engagement to help educate voters about the vote by mail election. In order to build the campaign, KO partnered with a number of stakeholder firms to help us develop the campaign and reach target audiences throughout the State. Our partners included: • Mission Media – a full-service advertising and marketing firm to assist with creative design, campaign production and media buying. • Sandy Hillman Communications – a public relations firm and minority business enterprise to assist with earned media and oversee broad stakeholder engagement throughout the state. • GreiBO – a public relations and marketing firm based in Baltimore to assist with stakeholder outreach to the African American community statewide, including key influencer messaging, in-community events and social media for Baltimore City residents. • Cool & Associates – a full-service management consulting firm that brings Hispanic strategy, workforce development, education, marketing and outreach to the forefront of any organization. In this Notice of Apparent Liability for Forfeiture (“NAL”), we find that Infinity Broadcasting Operations, Inc., (“Infinity”), licensee of Station WNEW(FM), New York, New York, apparently violated 18 U.S.C. § 1464 and 47 C.F.R. § 73.3999, by willfully and repeatedly broadcasting indecent language on three occasions. Based upon our review of the facts and circumstances in this case, we conclude that Infinity is apparently liable for a forfeiture in the amount of twenty-one thousand dollars ($21,000). II. BACKGROUND 2. The Commission received two complaints alleging that WNEW(FM) broadcast indecent material during the “Opie and Anthony Show,” a show that is regularly scheduled to air on weekdays from 3 p.m. to 7 p.m. The first complaint cited material that aired on November 15, 2000 and November 16, 2000. The complainant provided tapes with various portions of the show. A song entitled “Teen Week” was aired during one segment of the November 15, 2000 “Opie and Anthony Show.” “Teen Week” consisted of lines of dialogue with a musical background. A portion of the song follows: Young girl’s voice-- YV Dad-- D *** YV: Daddy, can I come too? Can I come too? Daddy, it won’t fit in my mouth.
