Prepared by Mary A Kotowski MM January Snow Accumulations Accumulation of snow ice rubbish etc prohibited Purpose During the winter months St Clair Shores residents including children walking to school and the physically challenged need to be able to safely use the public sidewalks and constructed walkways This means that all snow and ice should be removed from the entire width enabling people of all ages and physical conditions to have access to clean pedestrian walkways This ordinance is intended to provide for such safe passage and to protect the general health safety and welfare of the St Clair Shores residents and those using the public sidewalks and walkways

Obligations and prohibitions

A violation of this ordinance having been declared to be a public nuisance may be abated by the City of St Clair Shores through its employees andor contractors Such abatement may include but is not limited to the clearing of said sidewalks and walkways of snow ice or materials obstructions encroachments encumbrances filth rubbish and other substances shall take abatement action with creating the possibility of injury to any person The City respect to the accumulation of snow andor ice only when such has reached an accumulation depth of two inches or greater snow event

Fortyeight hours after the declaration of the snow event the City or its contractor will leave written notice at any property in violation stating that if the sidewalk or walkway is not cleared of snowice within twentyfour hours the City or its contractor will do so and assess the cost and administrative fee to the property owner andor occupant Written notice may be in the form of a sticker to be placed on or near the front door or other written notice affixed to the property on or near the front door Notices to door commercial businesses shall be placed in an envelope placed on or near the front

sidewalk or In the event the owner or occupant has not removed the snowice from the walkway within twentyfour hours after the notice detailed in paragraph the City or fee to its contractor may remove the snowice and assess the cost and administrative shall the owneroccupant Upon the City or its contractor abating the nuisance it provide notice to the owner or occupant in the same manner detailed in paragraph above that the City has abated the nuisance and that the cost and assessment for said abatement will be billed to the owneroccupant

The City of St Clair Shores shall have the right to assess all costs of said nuisance abatement against the property owner andor occupant of the property immediately abutting but the sidewalk or walkway upon which the nuisance exists Said assessment shall include not be limited to the costs of clearing the sidewalk or walkway and an administrative fee of to Sixty Five and Dollars which may be changed from time time by resolution of City Council In the event the property owner or occupant fails to pay the costs of nuisance abatement and the administrative fee said costs and fees shall be assessed against the property and placed upon the tax rolls of the City of St Clair Shores General Notice

Mr Ihrie stated that the City can not pass an ordinance which is complaint driven

The City is currently under contract with Landscape Services and has a fee of for shoveling snow Mr Ihrie of all homes added that if this program is implemented with photographs measurements and inspections drafted ordinance calls for civil twice they anticipated the fee to increase to per serviced house In addition the infraction tickets for multiple offenses The ticket fee is up to for the second offense and up to for the third and subsequent offenses

Mrs McFadyen inquired about bank owned homes that will not know about hangers at the door Mr Ihrie responded can that if nobody answers to the notice the contractor will shovel and bill Ultimately if violations are not paid they be assessed to the tax rolls

Mayor Hison stated that City Council held an August Study Session to discuss findings from other municipalities about the Snow Ordinance and proposed amendments The Mayors Advisory Panel met three times in October and drafted an amended Snow Ordinance for City Councils review and revisions if necessary

Mr Rayes noted that there are deficiencies in this ordinance compared with the weed ordinance which defines notification the fee structure and the administration fees

Mayor Hison noted that Ordinance has been in effect since December was only amended once on October and the original charter provision has been in place since This past winter was an resident unusually heavy snow fall where there were snow removal concerns with many vacant homes The complaints on sidewals not cleared post office complaints and school complaints for student paths Citys could have responsibility is to enforce the ordinance A violation of this ordinance is a civil infraction and a ticket been issued The City chose instead to have a contract vendor clear the walkways and charged the cost to the property owners

City Administration has worked through a process that will allow for invoices to go out timely in the future so that residents will not experience the delays in billing that occurred last winter and their possible assumption a neighbor or their landscaper shoveled

Beverly Aron Jefferson was upset because the plow came through and left a big pile of snow at the end for residents to clear the of her driveway on several occasions She thinks that thirtysix hours is enough time sidewalks She stated that the area at Lake Ct and Louis is never clear for passage

Sue Jesion Raymond said she would like to see people continue to keep the standards high She thinks that the St Clair Shores newspaper should have an issue in November with the guidelines She doesntfeel that there has been effective communication and asked if a notice can be sent to the banks that own the vacant homes

Candice Rusie N Rosedale Ct said there should be an ordinance of accurate record keeping Notices should be put on doors She believes that a timeline should be put into effect

that the Jim Goodfellow Lakeland asked what the Citys policy on plowing the streets is He feels policy should be for the residents to have twentyfourto thirtysix hours after the City has plowed the streets to shovel their sidewalk

Kelly Vandermolen Parkside said that approximately bills were sent out this winter She feels attention to her discriminated against because she has a foreclosed home on her street and feels that this brings street and feels that the other homes will most likely be ticketed when the vacant home is being ticketed She sidewalk was upset because at one time there was eight inches of snow on her street and the City shoveled her and issued her a bill She said for the City to put the reminder on the water bills instead of the tax bills because they are more frequent

Greg Breakey Parkside agrees that having an ordinance will help keep the sidewalks clear because a time will there are many more vacant homes than in the past He works different shifts and feels that longer give the residents a chance to clear the sidewalk

d All activity extending beyond the walls of the mortuary or funeral home shall be screened from visible view of adjacent residential districts e Whenever a caretakers residence is included as a part of the principal structure said structure shall be permitted to be two Z stories or thirty feet in height Whenever the structure is designed to be two stories in height it shall be so placed on the lot or parcel as not to be nearer to a residential district than thirtyfive feet

A It shall be unlawful to park any commercial vehicle or equipment on any street in the City for a period of longer than minutes between the hours of am and am of the same day The Chief of Police for good cause may grant special parking permits permitting parking of commercial vehicles or equipment during the above hours provided each permit is granted for a definite period of time

B Public Property No person shall park or store any commercial vehicle or commercial limited equipment on public property located in any zoning district including but not to public in streets rightsofway bike paths green belts and planting areas except as allowed subparagraph E below

C Residential District No person shall park or store any commercial vehicle or commercial equipment on private property in any residential district except as allowed in subparagraph E below Provided however that such parking of a commercial vehicle shall be permitted in a residential district as is reasonably necessary for the driver andor occupant to attend to personal business for a period not to exceed minutes

D NonResidential Districts No person shall park or store any commercial vehicle or commercial equipment on private property in any nonresidential district except as is allowed in subparagraph E below or unless such vehicle or equipment is parked or stored in relation to a permitted principle or accessory use of the property In such event parking or storage must comply with all other City codes and ordinances

E Exception The parking or storage of commercial vehicles or commercial equipment shall be allowed in any zoning district where such parking or storage is limited to vehicles or equipment engaged in the performance of a service on the adjacent or underlying property for the period of time reasonably necessary to complete the service

F Additional Prohibitions and Requirements

No trailers in excess of feet in length used for the carrying or storage of commercial material or equipment shall be allowed unless such trailers are completely enclosed such that no material or equipment is visible from the exterior of the trailer

Commercial vehicles which are permitted pursuant to the provisions of this ordinance shall be maintained in a manner free from excessive mud tar or other substances which may cause an offensive odor or be unsightly

Limousines shall be considered commercial vehicles and shall be subject to the prohibitions of this ordinance

Vehicles commonly referred to as tow trucks dump trucks box trucks step vans stake trucks tractors or tractortrailers shall be subject to the prohibitions of this ordinance regardless of their gross vehicle weight any public thoroughfare

Prohibited vehicles as described in this ordinance shall be permitted if parked and stored in a completely enclosed garage

No person shall park any vehicle on any residential street within the City of St Clair Shores between the hours of am and am and no commercial vehicle or

on equipment shall be parked on any residential street except as allowed above any Saturday Sunday or holiday except that the Chief of Police for good cause may grant a special parking permit allowing the parking of such vehicles or equipment between the hours of am and am during the above prohibited hours and days provided however that each permit is granted for a definite period of time

G The Chief of Police or his designee shall be authorized to grant hardship permits relieving a person from the requirements of this ordinance provided such permit shall not unduly negatively effect the surrounding residential area

Any sign or sign structure which is structurally unsafe or constitutes a hazard to safety or health by reason of inadequate maintenance dilapidation or abandonment or is not kept in good repair or is capable of causing electrical shock to persons likely to come in contact with it

Any sign which obstructs a window door or other opening that could be used for fire escape

Any sign which makes use of the words Stop Look or Danger or any other words phrases symbols or characters in such a manner as to interfere with mislead or confuse traffic

Any sign or other advertising structure containing obscene indecent or immoral matter

Any sign unlawfully installed erected or maintained Any sign now or hereafter existing which no longer advertises a bona fide business conducted or product sold

Any sign attached to a standpipe gutter drain or fire escape or any sign erected so as to impair access to a roof

Any sign that would project above the parapet line of any roof except as permitted in Section J and as permitted with ground or freestanding signs

Projecting or overhanging signs except as defined in Section Land of the permitted wall signs which may project up to twelve inches from the face wall

Any sign which is attached to a tree fence or utility pole

Portable or temporary signs except as specifically provided for in this Ordinance
