Executive Summary

On 11 March SIPA conducted an operation in Sarajevo (Canton 9) and arrested eight persons suspected of being involved in an international drug trafficking ring. On 24 March SIPA officers arrested three persons in Bijeljina area, suspected of being involved in the case of abuse and misuse of computerized CIPS (Citizens Identification Protection System) ID cards and passports system, including document forgeries provided to persons indicted for war crimes. On 10 March, a prison break occurred from the Ustikolina prison during which two prison guards were disarmed and nine inmates escaped. Local police in Foca conducted a successful search and arrest operation involving

13 Albanian illegal migrants and 3 Bosnian facilitators. On 13 March 2009, following the HR decision to repeal a previous order, travel documents were returned to certain individuals who were allegedly involved in war crimes in Srebrenica in 1995 and were named on the so called ‘Srebrenica List’. Amendment I to the BiH Constitution over the status of Brcko District adopted by BiH Parliamentary Assembly (PA). At the Peace Implementation Council (PIC) Steering Broad in Sarajevo on 25 and 26 March the continuation of OHR and the maintenance of the HR with all prerogatives were confirmed. On March 26th, Mr. Valentin Inzko was appointed new High Representative and new EUSR by the Peace Implementation Council. The 122 Vasa policija public

8627/09 EXT 1 MS/ts 2 ANNEX CPCC EN information campaign, launched on 13 February in cooperation with the BiH law enforcement agencies, reached a peak of activities throughout March. On 18 March, PS Trebinje received a report that a journalist from Banja Luka was verbally assaulted by unknown individuals nearby the Orthodox Cathedral whilst taking footage for reportage. BiH experienced 2 earthquakes during the day of 30 March and the night of 30/31 March, (no damage to EUPM property or person occurred).

Comments by Head of Mission

March saw important events, including key activities with regard to police and the European agenda. The Minister of Security, Tarik Sadovic hosted a visit of the Director of Europol on 2 March 2009. The aim of the visit was to promote full implementation of the Strategic Agreement with Europol and brought together ministerial and police officials from all competent authorities dealing with Europol. The Europol Director paid a half-day visit to EUPM where he was informed about the implementation of the ESDP-EUROPOL technical agreement on exchange of information. We also discussed how to support the deployment of police liaison officers from Bosnia and Herzegovina to Europol.

In parallel to this visit several teams of member states’ experts visited Bosnia and Herzegovina to assess progress with regard to the Visa Liberalisation Road Map. EUPM contributed to this work through briefings by mission members.

The mission continued its activities in line with its mandate and conducted a first video conference with the new Head of Operations of the CPCC, 16 March.

On 17 March, the Operational Commander EUFOR and DSACEUR, Gen. Sir McColl, paid a visit to EUPM during his assessment visit in preparation for the upcoming SMR (Six Monthly Review) of EUFOR Althea.

The Political Directors of the Peace Implementation Council Steering Board met in Sarajevo 25/26 March. The meeting was chaired by the outgoing High Representative in the presence of the incoming, Dr Valentin Inzko. As a member of the Board of PrincipaIs, HoM participated in all meetings.

8627/09 EXT 1 MS/ts 3 ANNEX CPCC EN The mission’s activities were focused on the stabilization of SIPA following the submission of a SIPA report on investigating high-level corruption and abuse of office to the State Prosecutors Office. The media battle among politicians and key SIPA managers continued. The problems which were exposed to the public and other institutions did contribute to a feeling of uncertainty about the direction the country would take.

On 26 and 27 March, the three Directors of State-level law enforcement agencies, the State Prosecutor, the Directors of Federation and RS Police and the Chief of Brcko District Police and one representative of the cantonal Police Commissioners met, following the invitation of Mr Dragan Mektic, the Director of the Service for Foreigners’ Affairs. The meeting provided an important opportunity for HoM to refocus the joint work with Directors of LEA on the achievement of joint objectives.

27 March, the seventh six monthly review was submitted to the Civilian Operations Commander for consideration and circulation to member states. I concluded March with a debriefing session on 31 March between Minister of Security Tadovic and myself on EUPM priorities and recommendations for the upcoming period and my intent for the briefing of EU Member States on 3 April (PSC, Brussels).

Mandate Implementation

Support in the Fight against Organised Crime

SIPA operation targeting International drug ring - On 11 March, following a long term investigation and based upon an order issued by the BiH State Prosecutor’s Office, SIPA conducted an operation in Sarajevo (Canton 9) and arrested eight persons suspected of being involved in an international drug trafficking ring. During the operation, several locations were searched. Prior to this operation, FMoI officers arrested one person in Sarajevo and two in Zenica (Canton 4) as a part of this investigation. In total 3 kg of suspected heroin were seized, as well as a significant amount of money in various currencies, two firearms, mobile phones and vehicles. EUPM was involved from the initial phase of the investigation and was deployed in the field, and noted that the

8627/09 EXT 1 MS/ts 4 ANNEX CPCC EN co-operation between SIPA and FMoI was excellent and should be an example of how to share information and how to cooperate successfully. The investigation is continuing and EUPM will monitor.

SIPA arrests in relation to CIPS case - On 24 March, based on an order issued by the State Prosecutor’s Office, SIPA officers arrested three persons in Bijeljina area, suspected of being involved in the case of abuse and misuse of computerized CIPS (Citizens Identification Protection System) ID cards and passports system, including document forgeries provided to persons indicted for war crimes. Two of the arrestees are senior police officials, PSC Bijeljina Chief of uniform police and PS Janja Assistant to Commander. The two are also under investigation pertaining to misuse of power. SIPA searched their private accommodations, offices and vehicles. EUPM teams were deployed in the field to monitor the operation which passed without incidents. The operation was professionally and properly carried out by SIPA and conducted with assistance and full cooperation of Chief of PSC Bijeljina.

Background: On 28 May 2008, following a long-term investigation undertaken by the State Prosecutor’s Office, SIPA, Brcko District and RS MoI officers executed 26 search warrants in Banja Luka, Brcko and Bijeljina. During the operation, 20 persons were arrested and four CIPS offices have been searched. The investigation uncovered evidence that the illegally obtained cards, possibly numbering hundreds, have been used as part of criminal activities in BiH (See MAR 05/08).

Joint Meeting of Law Enforcement Agencies from Northeast of BiH - An important meeting was held at the Canton 3 MoI (Tuzla) between all the major Police Chiefs/Directors of Northeast Bosnia and Herzegovina. Issues of future cooperation and strategies to combat organized crime were discussed, the meeting was productive in terms of mutual cooperation. This initiative is the first one in recent years, which has been organized in the Tuzla region. EUPM monitored, supported and encouraged this event since the early stages of the planning. It was agreed that these kinds of meetings will continue in the future and that the next agenda should contain specific crime topics. It is likely that the next joint meeting will take place in Brcko District in April. EUPM will monitor, follow and be actively involved.

BiH Constitutional Court confirmed the constitutionality of Article 13(2) of the Law on BiH Court - The BiH Constitutional court at its sessions on 27 and 28 of March, discussed and confirmed the constitutionality of the Article 13(2) of the Law on BiH Court that establishes the criminal jurisdiction of the BiH Court including its jurisdiction under certain circumstances over crimes prescribed in the entity laws. The decision was long expected and accompanied by vivid discussions at the political level. The OHR, as the original drafter of the article, and the OSCE had submitted their opinion, in support of the BiH Court jurisdiction. The decision has to be marked as major success in the jurisprudence of the Constitutional Court and will further pave the way to a successful fight in major and organized crime cases at state level. It will have a positive impact on a series of cases pending at state level, including the HNK case, in which former high officials from the Mostar Canton are indicted for corruption related crimes and in which the defence had claimed that the BiH Court has no jurisdiction and therefore the case need to be transferred back to the Mostar Canton.

Police Reform

Amendments to Federation Law on Internal Affairs (FLIA) – developments - On 13 March 2009, the Federation BiH Prime Minister sent a letter to the FMoI Minister, stating that, in accordance to a letter sent on 9 March 2009 by OHR and EUPM to FMoI (see WSR 11/09, 06/09), it is necessary for the Minister to put together the final draft of changes and amendments to the FLIA (which should take account of remarks and recommendations elaborated in the letter from OHR and EUPM), and delegate it for a session of FBiH Government.

On 20 March 2009, the Director of Police (DoP) of the Federation sent a letter to the FMoI Minister, OHR and EUPM, reminding the Minister of the letter from OHR and EUPM of 9 March, and the Federation PM letter of 13 March, concerning the issue of passing changes and amendments to the FLIA. The DoP requested the Minister to organize a meeting in the last week of March, and

8627/09 EXT 1 MS/ts 6 ANNEX CPCC EN before the next Federation Government session, with a view to defining the final text of the common draft changes and amendments to FLIA, which would be submitted to Federation Government for consideration. The DoP stated that, besides the Federation Minister and DoP, OHR and EUPM representatives should attend the meeting as well.

Laws in Parliamentary Proceedure: The House of Peoples (HoP) of the BiH Parliament rejected the Proposal on Independent Board and Public Complaints Board at a session on 26 March due to negative votes of RS representatives.

Proposed Law on Juvenile Perpetrators of Criminal Acts and Criminal-Legal Protection of Children and Minors rejected. On 18 March, 2009, the House of Representatives (HoR) of the BiH Parliamentary Assembly discussed the Report by the Collegium committee on efforts to reach an agreement on the Proposed Law on Juvenile Perpetrators of Criminal Acts and Criminal-Legal Protection of Children and Minors in the second reading. The Collegium did not reach an agreement and in the second round of vote the Law was rejected due to negative votes of RS representatives.

8627/09 EXT 1 MS/ts 7 ANNEX CPCC EN Proposed Law on Movement Control of Weapons and Military Equipment Rejected by the BiH HoP at its session on 26 March in the first reading, due to negative votes of RS representatives. No Agreement on the Law on Border Control by the Collegium of the House of Representatives of the BiH Parliamentary Assembly - HoR Collegium reported that it did not reach an agreement on the Joint Defense and Security Commission (JSDC) Opinion on the Proposed Law on Border Control (law in the first reading). The Opinion was refused in the second round of voting, due to negative votes from the Federation. The Law was once again returned to the Commission.

Police Accountability

Police arrest fugitives from Ustikolina prison (Gorazde, Canton 5) - On 10 March, a prison break occurred from the Ustikolina prison during which two prison guards were disarmed and nine inmates escaped. During the incident they stole one automatic rifle with 150 bullets, 2 pistols and two official vehicles which they used to drive to Sarajevo (Canton 9). The cars were subsequently found abandoned. Police managed to re-arrest 8 prisoners in Ilidza municipality (Canton 9) and recover an automatic rifle and one pistol. Out of nine fugitives, three were sentenced for murder all

8627/09 EXT 1 MS/ts 8 ANNEX CPCC EN of whom were re-arrested. The last fugitive was caught on 16 March, in an apartment located in Sarajevo, by the Drugs Department staff. All the 9 fugitives are now back in jail. There was good coordination between police forces of FMoI, RS, Canton 9 and Canton 5, with the majority of coordinating activities carried out by PC MoI Canton 9. All officers acted professionally and managed to control a dangerous situation avoiding a serious incident escalating into a major one. EUPM issued a press release commending the prompt reaction which resulted in the arrest. “The swift reaction from the police resulted in the arrest of eight of the nine prisoners in a remarkably short time” said EUPM HoM, “I particularly would like to congratulate the Police Commissioner of Canton Sarajevo, Himzo Selimović and the Chief of Public Security Centre East Sarajevo, Zoran Mandić. The excellent cooperation between the police of Canton Sarajevo and the Public Security Centre East Sarajevo was the key to success”.

Immigration

Illegal migrants arrested in Foca - During the reporting period, local police in Foca conducted a successful search and arrest operation involving 13 Albanian illegal migrants and 3 Bosnian facilitators. The former have all been removed from the country and the latter are being prosecuted. Although the Border Police were not involved at the outset of the operation they were quickly appraised of the situation as was the Service for Foreigners Affairs. By cooperating closely in this work a successful result was achieved. A debrief of this operation was held at Pale PSC so that both local counterparts and EUPM could assess the level of cooperation and what, if any, improvements could be made in future. Equally important, in light of the success of this operation, was to highlight where good practice could be used as an example by others working in different regions. Good practice should become standard practice particularly in state level LEAs. If there was a lesson to be learnt from this operation it is that cooperation needs to be systemic rather than ad hoc or just based on good personal relations between two or more colleagues. There is still a lack of trust (and a poor view of the competence of the BP held by local police), which needs to be overcome. More outcomes like this one will certainly help.

Return of travel documents - On 10 July 2007, the High Representative ordered the seizure of travel documents belonging to certain individuals who were allegedly involved in war crimes in Srebrenica in 1995 and were named on the so called ‘Srebrenica List’. On 13 March 2009 the HR announced the decision to repeal the order. Also, the Basic Court in Zvornik passed a decision to reinstate seven police officers from the Republika Srpska (RS), who were suspended in July 2007 in relation to the “Srebrenica list". It is expected from Basic Courts in Vlasenica and Srebrenica that similar decisions will be passed in favour of the 23 remaining police officers.

Extract from the OHR press release: This Decision does not call into question the validity of the Orders Seizing Travel Documents and those Orders remain in force except as expressly repealed by this decision against those individuals listed. This Decision does not entitle any individual listed to compensation for any remuneration, benefits, privileges, or status forfeited as a result of the application of the Orders Seizing Travel Documents. The latter is not expunged and remains as part of the legislative record of Bosnia and Herzegovina. This Decision does not prejudice any ongoing or future investigation against those individuals listed in Annex and does not prejudice the right of the High Representative to take future action against any individual listed on Annex should s/he again obstruct, or threaten to obstruct, the implementation of the General Framework Agreement for Peace. This Decision has immediate effect and will not require any further procedural steps.

General overview of the economic situation in BiH - BiH is suffering the consequences of the global economic crisis as evidenced in a reduction of exports, foreign investments and remittances, increase in unemployment, economic growth stagnation, resulting in a weakening of the internal demand and a substantial reduction of revenues collected by the different taxation authorities. Subsequently, the steady increase of VAT revenues that had been supporting over the last years the burden of the expensive and ineffective BiH Public Administrations is no longer there. Fragmented as they are, they all face difficult challenges, but the Federation is a case apart, a case for grave concerns. Strained by social welfare expenses (most pegged to electoral promises), the Federation has neither the possibility to assist the population and the economy, nor is in a position to help itself. BiH authorities have been forced to seek assistance from The World Bank and the IMF, but

8627/09 EXT 1 MS/ts 10 ANNEX CPCC EN the same situation of Federation finances will be the main obstacle for the negotiations as a crucial requirement will be to rationalize and cut public expenses. Not surprisingly, the Republika Srpska (RS) authorities have not lost time to stress that the RS has always been in position to sign any IMF standby arrangement unlike the Federation. Nevertheless, this is a good opportunity for the Federation to undertake the necessary reforms in the social welfare, health and education systems, but it is still to be seen if Federation politicians will show the will to look for mid and long term (though harsh) solutions.

Foreseen increase of civil unrest and criminality adds to the concerns that a financial crisis raises for Police bodies. The lack of funds will impact on the capability and capacities of the Police bodies to fight crime. The salaries of the Police Officials of the Federation have been delayed for the last two months, and several Cantons have already foreseen cuts in salaries of all public employees. But present difficulties should not shade the long term objectives of Police in BiH. Therefore, EUPM will face this challenge as an opportunity to further improvement of strategic planning, to endorse accountability appealing to the professionalism of the Police Officials, to assist the Police bodies in making better use of available resources and to encourage the cooperation in order to better share among them the means available.

Amendment I to the BiH Constitution over the status of Brcko District adopted by BiH Parliamentary Assembly (PA) - The month of March was marked by the activities related to the adoption of the Amendment I) to the BiH Constitution over the status of Brcko District (BD). After the public discussion that was held in five BiH towns (Brcko, Banja Luka, Mostar, Tuzla and Sarajevo) the adoption procedure in the BiH Parliamentary Assembly was completed when the House of Representatives adopted the Amendment I) on 25 March and the House of Peoples did the same the next day on 26 March. The amendment adds Brcko District to the BiH Constitution, as defined by the Arbitration Tribunal’s awards, and provides the District an effective and direct access to the BiH Constitutional Court, while ensuring that no party can change the status or powers of the District as defined by the Arbitral Awards. Following the adoption of the Amendment I) over the status of Brcko District and appointment of the new BD Government, BD Supervisor Raffi Gregorian announced that those steps would allow him to focus on resolving the various administrative and legal tasks necessary to complete Supervision in line with the process laid out in the Final Award.

8627/09 EXT 1 MS/ts 11 ANNEX CPCC EN PIC stays the course as the new era with Valentin Inzko begins - At the Peace Implementation Council (PIC) Steering Broad in Sarajevo on 25 and 26 March the continuation of OHR and the maintenance of the HR with all prerogatives were confirmed. Despite pressure from the RS to transition OHR into EUSR, and counterbalance from SDA for it to remain, the PIC stood by its 5 plus 2 formula, noting the limited progress made since last November’s Prud Agreement.

On March 26th, Mr. Valentin Inzko was appointed new High Representative by the Peace Implementation Council. He is also the EUSR for BiH. One of Mr. Inzko’s first statements was that his priority would be constitutional reform, to which the RS politicians responded with certain anxiety and resentfulness, emphasizing it was not a mandatory requirement for EU accession. Reaction in the RS to the PIC meeting has been muted. In general, various constitutional issues were the focus of political attention during the past month. From passing the amendment to the BiH Constitution on Brcko’s status by both houses of BiH Parliamentary Assembly, to the package of RS constitutional amendments and final adoption of an RSNA Declaration on the Platform for Talks on Possible Changes of BiH Constitution and Protection of RS Interests, under debate in the RSNA throughout March and passed on 25 March.

122 Vasa Policija campaign continues across BiH - The 122 Vasa policija public information campaign, launched on 13 February in cooperation with the BiH law enforcement agencies, reached a peak of activities throughout March. Regional launches of the campaign in the seats of all police agencies were in most cases combined with the strategic communication meetings with either NGOs, educators, journalists or students. Topics included inter alia juvenile delinquency, false bomb alarms in schools, domestic violence, drugs abuse, police accountability. As part of the campaign, EUPM has also introduced “Meet your Police Chief” project. Police Chiefs will make themselves available once a week for citizens’ inquiries. The campaign will feature over 40 PR events across the country and 5 thematic TV shows until 17 April 2009.

8627/09 EXT 1 MS/ts 13 ANNEX CPCC EN 17 March 2009 – EUPM representative participated in the television programme ‘Unsolved Cases’(Nerijesen Slucaj) on the national State Channel BHTV, regarding the Djordje Zdrale case (see WSR 07/09 – 9-16 February) urging any witnesses to come forward with information.

122 Vasa Policija media campaign - “Accountable and efficient police” was the theme of a television program hosted by EUPM in the context of 122 Vasa policija campaign on 18 March broadcast on FTV (Federation TV). The HoM, the Director of FBiH Police Zlatko Miletic, Sarajevo Canton Police Commissioner Himzo Selimovic and the Vice President of the High Judicial and Prosecutorial Council Zekerija Mujkanovic were guests in the show, where they discussed issues such as police functioning, the effects of insufficient budgetary resources on the operational work of police, and ways to improve communication and coordination among the police agencies. The guests also answered telephone and email questions from citizens.

HoM; ‘State institutions matter’ -“The task now is to rebuild the credibility of state level law enforcement and to support sound management structures and processes“, stated HoM addressing the members of the Parliamentary Assembly of Bosnia and Herzegovina and the NATO Parliamentary Assembly on Friday 20 March. “State institutions came under attack. The citizens witnessed what appeared to be a breakdown in communication. Serious problems were exposed to the public. This contributed to the feeling of insecurity and uncertainty. “Speaking jointly with the SIPA Director, Mirko Lujić, on a panel dealing with police reform, Feller said that “State level law enforcement has been challenged as never before. This demands our full attention and engagement. I am assured by the fact that SIPA remains operational and carries out important and successful activities. State level law enforcement institutions have started to matter.“ The further development of these institutions is dependent on the support of political actors. Feller called upon the members of the Parliamentary Assembly not to accept a slowdown in the strengthening of state level law enforcement to which Bosnia and Herzegovina committed vis-à-vis her citizens and the EU. “Despite political challenges, there is a professional police able and willing to uphold public peace and order, “he stressed. “Setbacks cannot be avoided. Bosnia and Herzegovina and the EU have the duty to address them with strategic European answers approach and resolve“

Other aspects

Monitoring of harassment of journalist

On 18 March, PS Trebinje received a report that a journalist from Banja Luka, was verbally assaulted by unknown individuals nearby the Orthodox Cathedral whilst taking footage for reportage. The journalist, Mr Slobodan Vaskovic, editor in chief of the “Stav” magazine and correspondent of the FTV programme “60 minutes”, is a Bosnian Serb from Banja Luka. Therefore the case seems not to be ethnically motivated, but rather politically.

It is believed that Mr Vaskovic was verbally attacked because of his articles published in “Stav”. Some members of the general public in Trebinje may have found them disagreeable.

The EUPM Regional Office Mostar is evaluating practical steps to prevent a re-occurrence of such events. Advice will need to weigh and take into account different individual rights and public activities: the freedom of movement, the freedom of press, adequate and appropriate police measures to prevent public unrest, as members of the general public in Trebinje claimed that the journalist’s activities violate their rights to privacy and freedom of worship.

Police in Trebinje declared that they cannot exclude similar incidents happening again, if Mr Vaskovic chooses to work in their area of responsibility without giving prior warning to them.

The request for ex-ante cooperation will be the subject of a public discussion, as an attempt by local police to control Mr Vaskovic’s movements and freedom to operate.

Nevertheless, the performance of the Trebinje police on 18 March 2009 was not fundamentally criticized by any of the involved parties (politicians, journalists). The police in Trebinje reacted promptly and, upon his request, took measures to protect Mr Vaskovic and escort him from the scene. In retrospect, it has transpired as a short-coming that police stopped escorting Mr Vaskovic between Trebinje and Ljubinje. Mr Vaskovic reported that once left alone, a second incident occurred.

The Chief of the Public Security Centre Trebinje, Mr Zubac, filed reports for violation of public order against those individuals who are suspected of verbally harassing Mr Vaskovic and causing public disturbance in Trebinje.

EUPM will continue to monitor the case and provide advice to police in Trebinje.
