INLAND NAVIGATION REGULATIONS IN BELGIUM

In 2014, a sixth state reform took place in Belgium. In the case of pleasure craft use, the change introduced regionalisation of the general shipping regulations. The Belgian regions, including Flanders, are responsible for that nowadays. Nevertheless, the federal government also retained an important authority regarding pleasure craft use. It remains responsible for the technical requirements and registration of vessels, as well as for boating licences.

SHIPPING REGULATIONS

GENERAL REGULATIONS The general regulations applicable to the vast majority of waterways: General Police Regulations for Shipping on Inland Waterways ('Algemeen Politiereglement voor de Scheepvaart op de Binnenwate- ren' – APSB) General Regulations for Shipping channels in the Kingdom ('Algemeen reglement der scheepvaartwegen van het koninkrijk' – ARSK) These general regulations are based on CEVNI 4 (The European Code for Inland Navigation Channels). COMMERCIAL SHIPPING AND PLEASURE CRAFT – YES, SAILING TOGETHER IS POSSIBLE!

HAZARDOUS GOODS

HOW DO YOU RECOGNIZE SHIPS THAT ARE TRANSPORTING HAZARDOUS GOODS?

Ships carrying certain hazardous cargoes must show that with a blue light (night) or a blue cone (day). That is why we call them cone ships.

THERE ARE THREE CATEGORIES OF SHIPS CARRYING HAZARDOUS GOODS:

The more hazardous the cargo they are transporting, the greater the number of blue cones or lights they carry. There are in fact three categories:

11 DO NOT FORGET YOUR LIFE JACKET!

The risk of ending up in the water unfortunately exists for everyone who sails – be it for recreation or commercial purposes. Just like when wearing a seat belt in the car, a life jacket or personal floatation device can save your life in perilous situations.

You can consult the shipping messages in a list as well as on a map. You can receive the shipping notices via email (by waterway or by category).

MARINE VHF RADIO

The marine VHF radio (sometimes known as the maritime telephone) is not actually a telephone, but a radio transceiver. Having one on board is mandatory for motor boats from 7 metres upwards. Listen to channel 10 (unless otherwise indicated on the bank or a chart) for easy contact with inland shipping and fellow sailors.

WHERE CAN YOU CANOE, KAYAK, ROW OR USE A STAND-UP PADDLE BOARD?

This is permitted on navigable inland waterways in Flanders, except on: the Gent-Terneuzen canal; the shipping channel on the Lower Tidal Sea Scheldt (The lower section of the Tidal Scheldt, downstream of Burcht); the inner reaches of the waterways such as on the Reien (Reie) in Bruges and the Diversion channel of the Nete in Lier;

You must behave according to the shipping regulations, in particular the following: shipping has priority at all times. It is important that you are always able to respond quickly and adjust your course. De Vlaamse Waterweg nv’s preference is to promote development of soft forms of water recreation on and alongside smaller waterways (CEMT classes I and II) where the conditions are safer for performing this form of recreation, or where the preconditions for recreation can be better met. This brochure contains an overview map showing these waterways. For safety reasons, access to locks on the Flemish waterways is forbidden for all small manually propelled vessels. De Vlaamse Waterweg nv can actually permit access by way of an exception, subject to any conditions it may set. No documents or licenses are required for canoeing, rowing and paddle boarding on Flemish waterways. For your own safety and that of other waterway users, certain features are required on board if you sail on inland waterways. These are listed on the website of the FPS Mobility and Transport.

You may never fish in locks, on top of bridges of navigable waterways, in fish passages and in all places where a temporary or permanent fishing ban is indicated by signage. Fishing in a navigable watercourse is only allowed if you have a valid fishing permit. The Agency for Nature and Forests (Agentschap Natuur en Bos) offers handy angling maps that indicate all important public fishing waters for each province. The angling charts list the species of fish that are regularly caught in each fishing water sector. They are highly recommended for every angler!

WHAT IS METAL DETECTION/MAGNET FISHING?

Metal detection in the water is fishing for metal objects with a fishing magnet or digging up metal objects from a dried-out bank or the bed of a waterway. This, however, entails safety risks. There might be old ammunition lying in any stream or watercourse that existed in Flanders during the world wars. As manager of navigable waterways, De Vlaamse Waterweg nv is authorized to permit metal detection on its network. On the advice of the Belgian service for Clearance and Destruction of Explosive Materials (DOVO), De Vlaamse Waterweg nv therefore does not allow metal detection, including magnet fishing, on the Flemish Waterways. For safety reasons, the waterway manager advises, when sailing at great speed in the high-speed sections mentioned above, that you should wear a life jacket and to take a position on your vessel as provided for by the manufacturer. In zones 1-27, the maximum allowed speed is 60 km/h. Outside of the designated sectors, the maximum permitted speed of 20 km/h applies/ That speed limit is reduced if a lower maximum speed for the waterway in question is established in the special regulations. When passing a sailing, discharging or moored ship, the speed limit reduces to 10 km/h. Water scooters (seated models) are allowed to run in all high-speed sections, provided there is compliance with the rules laid down in art. 6.35 (paragraphs 1, 2 and 6) of the General Police Regulations for Shipping on Inland Waterways (‘Algemeen Politiereglement voor de Scheepvaart op de Binnenwateren’ – APSB). You must be able to guarantee stability at low speed and when stopped, and you must maintain a more or less rectilinear course. Water scooters (standing models) are only allowed to run at high speed in the high speed sections designated for operating water scooters (‘varen met waterscooters’) in accordance with art. 6.35 and art 6.35/1 of the APSB. Ordinary motor boats are allowed to sail at high speed in both the zones marked ‘sailing at high speeds’ and ‘water ski and analogue activities’, but not in the sections marked ‘sailing with water scooters’, in accordance with art. 6.35 and art 6.35/1 of the APSB. The necessary signage is in place to demarcate the zones in question. Irrespective of Article 6.35, paragraph 7 and 6.35/1, paragraph 4 of the APSB, in the zones 10 meters along the banks of sections 17, 18, 19, 22, 23 and 24, recreational water activities with manually propelled vessels (e.g. canoes and kayaks) is allowed. The pleasure craft should then wait until the facility is operated for commercial shipping, except when: no ship will reach the Moerbrugge bridge or Nieuwege bridge within 2 hours; or when the previous operation occurred at least 2 hours earlier; In addition, priority attention will be given to ensuring that there are no regular route buses in the immediate vicinity of the bridge concerned.

B. From the Flandria marina (Bruges) towards the coast: Operation for convoys at 09:00 at the Gentpoort bridge and then sailing in convoy towards the coast (Ostend). For those who have to wait there is a waiting dock at the Katelijnepoort bridge.

C. From the coast towards Bruges: No limitation of passage to Nieuwegee bridge. Grouped operation 14:00 at the Scheepsdale bridge and then sailing in convoy towards Bruges.

D. From Bruges towards Ghent: Grouped operation 09:30 at the Gentpoort bridge and then sailing in convoy towards Ghent.

Large groups of pleasure craft (more than 6 boats) always have free passage without waiting times (subject to the aforementioned shut-of times). Recreational boaters are requested to leave as close together as they can, and to reach the bridges as tightly grouped as possible.
