    Gemeinsame Erklärung Keine halben Sachen – Wir für ein wirksames Betriebsrätestärkungsgesetz! Wir begrüßen, dass das Betriebsrätestärkungsgesetz in Form des Referentenentwurfs vom 21.12.2020 auf den Weg gebracht wurde. Dies ist ein erster Schritt in Richtung zeitgemäße Mitbestimmung. Wir halten die beabsichtigte Verbesserung des Schutzes für diejenigen Beschäftigten, die einen Betriebsrat gründen wollen, für richtig und dringend notwendig. Insbesondere in Betrieben bis 250 Beschäftigten stößt die Wahl von Betriebsräten zu häufig auf Abwehr der Arbeitgeber. Mitsprache und Mitbestimmung muss gerade auch dort möglich sein, wenn Demokratie auch in der Arbeitswelt gelten soll. Wir begrüßen deshalb den Gesetzentwurf, weil er in der entscheidenden frühen Phase einer Betriebsratsgründung den Initiatoren den notwendigen Schutz gibt. Ergänzend schlagen wir vor, § 15 Abs. 3a KSchG neu um einen nachwirkenden Kündigungsschutz für Wahlinitiatoren nach Bekanntgabe des Wahlergebnisses entsprechend der Regelung für Wahlvorstandsmitglieder zu erweitern. Aber auch die in § 15 Abs. 3b KSchG neu genannten Vorfeldinitiatoren benötigen einen nachwirkenden Kündigungsschutz bis zu sechs Monate nach Bekanntgabe des Wahlergebnisses. Wir sehen die Gefahr, dass der Entwurf in entscheidenden Punkten wie dem besonderen Kündigungsschutz entwertet und damit für die Praxis und die im Koalitionsvertrag beschriebenen Zielsetzungen unbrauchbar wird. Arbeitgeber, die eine Betriebsratsgründung verhindern wollen, gehen sowohl den Weg über eine betriebsbedingte ordentliche Kündigung als auch über eine außerordentliche Kündigung. Wenn die Betroffenen zunächst die Unwirksamkeit der Kündigung feststellen lassen müssten (bei gleichzeitig in der Regel nur schwer durchsetzbarem Weiterbeschäftigungsanspruch) ist ihnen in keiner Weise geholfen! Deshalb ist der Schutz der Vorfeldinitiatoren auch gegenüber außerordentlichen Kündigungen Gemeinsame Erklärung einschließlich der geplanten Änderungen in § 103 BetrVG so wichtig und muss der besondere Kündigungsschutz für alle Kündigungen gleich aus welchem Grund, d.h.
