Ideen fikk jeg imidlertid under et utvekslingsopphold i Berlin vinteren 2007/08. Fagene ”Politische Theorie und Geschichte am Beispiel der Weimarer Republik” og ”Politische Philosophien im Kontext des Nationalsozialismus” gjorde meg oppmerksom på at Nasjonal Samling må ha vært noe mer enn bare vertskap for tyske invasjonsstyrker. Hans Fredrik Dahls eminente biografi om Quisling: En fører blir til, vekket interessen ytterligere. Oppgaven kunne selvfølgelig vært mye mer omfattende. Det foreligger uendelige mengder litteratur både om liberalistisk elitisme og spesielt fascisme. Nasjonal Samlings historie kunne også vært behandlet mye mer inngående dersom jeg hadde hatt tid til et mer omfattende kildesøk. Dette gjelder også persongalleriet i Nasjonal Samling som absolutt hadde fortjent både mer tid og plass. Fremtredende personer som Johan B.Hjorth, Halldis Neegård Østbye, Gulbrand Lunde og Hans S.Jacobsen kunne hver for seg utgjort en masteravhandling alene. En videre diskusjon av de dominerende ideologiske tendensene i Nasjonal Samling kunne også vært meget intressant. Hvordan fortsatte den ideologiske utviklingen etter 1937 og frem til krigen, og hvordan fremsto Nasjonal Samling ideologisk etter den tyske invasjonen? Desverre er dette spørsmål som jeg, eller noen andre, må ha til gode. For å levere oppgaven på normert tid har det vært nødvendig å begrense omfanget av oppgaven.

The b. tells of a demonic fiddler who seduces an aristocratic lady; afterwards she sees no alternative to killinG him, but she is so haunted by his melody that she dances herself to death. Sibelius composed this, his only b. score, in 1913. Later versions by Lemanis in Riga (1936), R. HiGhtower for de Cuevas B. (1951), and Irja Koskkinen [!] in Helsinki (1955). This is the description of Sibelius’s Scaramouche, Op. 71, in The Concise Oxford Dictionary of Ballet. Initially, however, Sibelius’s Scaramouche was not a ballet but a pantomime. It was completed in 1913, to a Danish text of the same name by Poul Knudsen, with the subtitle ‘Tragic Pantomime’. The title of the work refers to Italian theatre, to the commedia dell’arte Scaramuccia character. Although the title of the work is Scaramouche, its main character is the female dancing role Blondelaine. After Scaramouche was completed, it was then more or less forgotten until it was published five years later, whereupon plans for a performance were constantly being made until it was eventually premièred in 1922. Performances of Scaramouche have 1 attracted little attention, and also Sibelius’s music has remained unknown. It did not become more widely known until the 1990s, when the first full-length recording of this remarkable composition – lasting more than an hour – appeared. Previous research There is very little previous research on Sibelius’s Scaramouche.

It began with narrowing down my wide field of interests to the Norwegian resistance movement. This was done through several discussions with professors at the historical institute of NTNU. Via further discussions with Frode Færøy, associate professor at The Norwegian Home Front Museum, I got it narrowed down to reprisals, and the cases and questions this thesis tackles. First, I would like to thank my supervisor, Jonas Scherner, for his guidance throughout the process of writing my thesis.     02 ChildrenWW2 12/5/05 5:14 pm Page 71 –4– Meant to be Deported Lars Borgersrud In Norway, World War II resulted in 10,000–12,000 children of German fathers and Norwegian mothers. During the first months after the end of the war, Norwegian political authorities took on what they saw as an urgent task: to develop a judicial framework to regulate the national status and citizenship of these chil- dren, officially labelled ‘war children’. This chapter aims to describe the process through which their national status and citizenship was established and to outline some important effects of that process on the condition of war children’s upbringing. The process started with a proposal to deport the children, a proposal which influenced events in significant ways, even if it was not carried out. The social-affairs authorities were faced with acute problems when thousands of single mothers and their children were left without any means of support once the German administration was dismantled after the armistice. However, when the topic of war children and their mothers was raised in the press and in public opinion, concerns for their maintenance were seldom voiced. Rather, the discus- sion was characterized by massive demands that the children and their mothers be deported to Germany, their real fatherland. Many senior civil servants and politi- cians held similar opinions. However, several practical and moral problems made such a plan difficult to implement. To present proposals as to what should be done, the Norwegian government appointed a fast-track committee, the War Child Committee.

    The rule of law, constitutionalism and the judiciary Why Adolf Hitler Spared the Judges: Judicial Opposition Against the Nazi State By Hans Petter Graver Abstract The Nazi regime had loyal judges who willingly transformed the liberal German law into an instrument of oppression, discrimination and genocide. This was achieved without substantially interfering with the operation of the courts and without applying disciplinary measures on the judges. But, not all judges were congenial servants of the regime—some resisted in their capacity as judges. Based on case-studies and existing literature, this Article distinguishes between two different lines of judicial opposition to those in power: Between opposition taking place in the open and opposition in secret, and between opposition within what is accepted by those in power as being within the law and opposition that is in breach of the law. The Article then seeks to explain the deference the regime gave to judicial by employing institutional theory and the concept of path dependence. Germany was deeply embedded in the Western legal tradition of emphasis on law as an autonomous institution with an independent judiciary.
