Campanie Promotionala “Castiga Cu M-Pesa” REGULAMENT OFICIAL Campanie promotionala “Castiga cu M-Pesa” REGULAMENT OFICIAL 1. Organizatorul 1. “ VODAFONE ROMÂNIA M-PAYMENTS S.R.L. ”, furnizor de servicii de plată cu monedă electronică comercial denumite “M-Pesa” si în conformitate cu autorizatia înregistrată cu nr. IEMERO-0002/16.12.2013 din Registrul institutiilor emitente de monedă electronică, emisă de Banca Natională a României, numită în continuare “VMP” sau “ Organizatorul ”, cu sediul social în cu sediul în Bucuresti, Sector 1, Blvd Barbu Vacarescu nr. 201, Globalworth Tower, etaj 7, CP 020285, cod unic de înregistrare: 30983107, Certificat de înregistrare la Registrul Comertului J23/3453/05.12.2012, capital social subscris şi vărsat: 42.438.640 RON, notată în Registrul de Evidentă a Prelucrărilor de Date cu Caracter Personal cu numărul 30707, prin Dna. Dana Maria Popescu si Andrei Bică, în calitate de Reprezentanti Legali., lanseaza campanie promotionala numita „Transferă si câstigă cu MPesa” pentru promovarea serviciului M-Pesa, de transfer de bani si plată (denumita in continuare „Campania”). 2. Participarea la Campanie implica acceptarea si insusirea de catre Participanti a prevederilor prezentului regulament oficial autentificat de notar public (denumit in continuare „ Regulamentul ”). Orice modificare se va face prin act aditional la prezentul Regulament care va fi autentificat de catre un notar public. 3. Regulamentul precum si detaliile Campaniei sunt disponibile in mod gratuit la adresa site-ului oficial al Organizatorului (www.m-pesa.ro), in toată reteaua de distributie a serviciului M-Pesa de pe teritoriul Romaniei in timpul programului afisat, pe toata Durata Campaniei. De asemenea, orice persoana interesata poate solicita o copie a prezentului Regulament, prin transmiterea unei cereri scrise trimise la adresa Organizatorului din Bucuresti, Sector 1, Blvd Barbu Vacarescu nr. 201, Globalworth Tower, etaj 7, CP 020285. 2. Scopul. Durata. Teritoriul 1. Campania este organizata pe baza prezentului Regulament si se desfasoara in conformitate cu dispozitiile Ordonantei de Guvern nr. 99/2000, actualizata, privind comercializarea produselor si serviciilor de piata. 2. Campania are ca scop promovarea serviciului M-Pesa catre persoane fizice utilizatori sau potential utilizatori. Serviciul M-Pesa consta servicii de transfer de bani si plata cu moneda electronica. In afara comisioanelor standard percepute pentru transferul de bani, PARTICIPANTILOR NU LE ESTE IMPUSA IN CONTRAPARTIDA NICIO CHELTUIALA DIRECTA SAU INDIRECTA, SUPLIMENTARA, iar PARTICIPAREA LA CAMPANIE ESTE GRATUITA PENTRU TOTI PARTICIPANTII. Atat pe Durata cat si dupa incetarea Campaniei, tariful pentru serviciul promovat va ramane acelasi. Comisioanele pentru transfer de bani prin serviciul M-Pesa sunt urmatoarele: - pentru sume cuprinse intre 1 si 150 lei – comision de transfer de 1 leu; - pentru sume cuprinse intre 151 - 500 lei – comision de transfer de 2 lei; - pentru sume de peste 501 lei – comision de transfer de 3 lei. 3. In acest sens, toti Participantii sunt inscrisi gratuit si automat in Campanie in momentul realizarii cu succes a unui transfer de bani de minimum 50 de lei prin M-Pesa, catre un alt utilizator M-Pesa sau in momentul in care primesc orice suma de bani de la orice persoana aflata in afara Romaniei utilizand locatiile partenerului (MoneyGram) sau prin intermediul site-urilor partenere www.azimo.com sau www.worldremit.com . 4. Campania se va desfasura pe teritoriul Romaniei in perioada 11 mai 2016, de la ora 00.00.00 - 15 Iunie 2016, pana la ora 23:59:59 (denumita in continuare „ Durata ”). Campania poate fi prelungita sau 2 suspendata de catre Organizator prin Act Aditional la prezentul Regulament. In cazul in care Organizatorul va suspenda/prelungi Campania, un anunt va fi publicat pe site-ul www.m-pesa.ro. Nicio parte interesata nu poate avea temei legal pentru a cere continuarea Campaniei sau despagubiri de orice fel in cazul modificarii duratei sau suspendarii Campaniei. 3. Participantii 1. La Campanie poate participa orice persoana fizica, utilizator activ în perioada 15 aprilie – 15 iunie 2016 (client cu serviciul M-Pesa activat pe numarul de telefon si care nu a fost suspendat) al serviciilor de transfer de bani M-Pesa, cetatean roman cu domiciliul sau resedinta in Romania, sau cetatean strain rezident pe teritoriul Romaniei (care poate face dovada acestui statut, pe baza certificatului de rezidenta fiscala inregistrat la Administratia Financiara), care a implinit varsta de 14 ani la data demararii Campaniei si care accepta termenii si conditiile prezentului Regulament (denumiti in continuare "Participantii "). 2. Nu pot participa la aceasta Campanie si nu li se pot acorda premii: - utilizatorilor cu varsta mai mica de 14 ani la data demararii Campaniei, acestia nefiind eligibili pentru activarea serviciului M-Pesa; - angajatilor Organizatorului, sotii şi rudele acestora până la gradul II inclusiv, nu sunt eligibili pentru a participa la Promotie. De asemenea, colaboratorii, distribuitorii şi subdistribuitorii Vodafone, precum şi angajatii acestora, nu au drept de participare la Campanie; - utilizatorilor care la momentul tragerii la sorti sunt suspendati (inclusiv pentru frauda), dezactivati sau in curs de portare catre o alta retea de telefonie mobila. - utilizatorilor care nu au serviciul M-Pesa activ la data tragerii la sorti sau care au contul blocat, suspendat (inclusiv din motive de verificare Anti-Money-Laundry sau fraudă). 3. Dacă ulterior acordării premiului se constată din verificările organizatorului că participantul câstigător a folosit modalităti de fraudare în scopul de a-si favoriza sansele de a câstiga, Organizatorul îsi rezervă dreptul de a retrage premiul prin orice măsuri pe care le consideră adecvate. Premiul astfel acordat va fi anulat. 4. Mecanismul Campaniei 1. Utilizatorii M-Pesa sunt eligibili pentru a participarea la tragerea la sorti si sunt înscrisi automat in Campanie atunci cand: realizează cu succes un transfer de bani către un alt utilizator M-Pesa în sumă minimă de 50 de lei . Primesc orice suma de bani dintr-un transfer international de bani prin partenerii MoneyGram, Azimo sau WorldRemit. 2. Un participant eligibil la Campanie va participa o singura data la tragerea sorti din Campanie, indiferent de numărul total al tranzactiilor realizate cu succes (transfer de minim 50 de lei sau orice suma primita din strainatate). 3. Intervalul orar 00:00:00 - 23:59:59 precum si intervalele orare corespunzatoare Premiilor mentionate in prezentul Regulament sunt cele determinate de setarile de timp ale sistemelor tehnice ale Organizatorului. 4. Participantul care nu doreste sa participe la Campanie ca urmare a achizitionarii serviciului promovat va putea solicita gratuit, in orice moment, sa nu mai participe la Campanie prin telefon la *789 (apel gratuit pentru clientii Vodafone). Ulterior acestei solicitari, Participantul nu va mai primi mesaje cu continut promotional privind Campania, nu va mai participa la tragerile la sorti ulterioare inregistrarii cererii sale si isi va pierde dreptul de a castiga unul dintre premiile din cadrul Campaniei. 5. Organizatorul pleacă de la premisa că fiecare participant întelege şi este de acord să utilizeze serviciul M- Pesa în limitele unei utilizări rezonabile şi în condiţiile unor practici corecte. În acest sens, serviciul M-Pesa nu poate fi folosit in mod abuziv de catre clientii săi. 5. Premiile 5.1. Premiile sunt oferite de Organizator prin tragere la sorti . Premiile oferite Participantilor desemnati Castigatori in cadrul Campaniei („Premiile”) sunt urmatoarele: Vodafone România M-Payments SRL Bucuresti, Sector 1, Blvd Barbu Vacarescu nr. 201, Globalworth Tower, etaj 7, CP 020285 Inmatriculata la Registrul Comertului: J23/3453/05.12.2012 Inregistrata la Registrul institutiilor emitente de moneda electronica sub nr. IEME-RO-0002/16.12.2013 Cod Unic de Inregistrare: 30983107 Capital social subscris si varsat: 42.438.640 RON telefon +40372021000; fax +40372021001; e-mail: [email protected] Site: www.m-pesa.ro 3 a. Marele Premiu, consta intr-o excursie in valoare totala de 1.200 de euro (circa 5.366 lei la cursul oficial BNR de 4.4715 lei/euro din data de 14.04.2016) pentru doua persoane intr-unul dintre cele 10 orase Europene: Roma, Torino, Valencia, Barcelona, Madrid, Paris, Londra, FranKfurt, Viena, Praga . Premiul este compus din: transport cu avionul dus-intors din Bucuresti, taxe de aeroport, cazare doua nopti la hotel 3 stele cu mic dejun inclus. In cazul in care, pretul excursiei in conditiile specificate este mai mic decat suma totala a premiului, diferenta se va acorda prin acoperirea cheltuielor de acomodare pe durata sederii (masa de pranz si cina, in baza facturilor doveditoare). Perioada de desfasurare a excursiei de tip CityBreaK este obligatoriu a fi aleasa intre 15 iulie si 15 septembrie 2016. Marele Premiu are o valoare bruta totala de 1,403 EUR (echivalentul in lei al sumei de 6,274 RON la cursul de schimb oficial comunicat de BNR de 4.4715 lei/euro din data de 14.04.201).” “Premiile constand in tablete Vodafone Tab Prime 9.6’ 4G au o valoare bruta totala de 2,383 EUR (echivalentul in lei al sumei de 10,655 RON la cursul de schimb oficial comunicat de BNR de 4.4715 lei/euro din data de 14.04.201).” Valoarea bruta totala a premiilor include TVA-ul si impozitul pe premii calculat si retinut la sursa, conform prevederilor Codului Fiscal. Niciun fel de alte taxe nu sunt incluse in pret si nicio alta cheltuiala realizata de catre Castigator nu va fi decontata/suportata de catre Organizator. b. 10 premii constand in cate o tableta Vodafone Tab Prime 9.6’ 4G. Valoare premiilor este de 2.216,2 euro inclusiv TVA (echivalentul in lei al sumei de 9.910 lei , la cursul de schimb oficial comunicat de Banca Nationala a Romaniei aplicabil la data de 14.04.2016). Premiile vor fi expediate prin curier in magazinul Vodafone specificat de comun acord cu Castigatorul. 5.2 Aspecte Generale 1. Premiile aferente prezentei Campanii au o valoare totala de 3.786 EUR (echivalentul in lei al sumei de 16.928 lei, la cursul de schimb oficial comunicat de Banca Nationala a Romaniei aplicabil la data de 14.04.2016 2.

Syahdan No. 9, Palmerah, Jakarta Barat 11480 ABSTRACT This paper mainly discusses about strategy of China mobile phone manufacturer. Based on the interview with the manufacturer’s representative, we tried to comprehend the strategy behind the China mobile phone raid in Indonesia. As people know that mobile phone industry keeps on growing day by day, especially by the invention of the Android operating system, an open source OS with integrated capability. By having a free licensed OS, mobile phone manufacturer can focus mainly on their hardware development. Mobile phone industry is getting crowded by the appearance of new players from China. As the result of the interview shown, in short, the manufacturers are growing because of their innovations and ideas to create a new product with competitive price, usage of right media for promotion, and persistence in penetrating the Indonesian market. It is also through this paper that we hoped to invite young entrepreneur to join the manufacturing industry, as it is a fast growing industry that will surely be developed by the fresh ideas of the young generation of Indonesia.
