PES STATEMENT ON THE REFERENDUM ON ABORTION IN PORTUGAL A woman has the right to control her own sexual and reproductive health. Above all a woman has a right to choose – including, and if necessary, the right to choose a safe abortion. We welcome the abortion referendum in Portugal and urge the Portuguese people to take the opportunity to vote. We support those Portuguese women and men who have been campaigning in favour of choice and welcome the positive position of the Socialist Party. It IS a question of choice – a woman’s right to have a choice based on the right information, education and medical support. It is most certainly not a question of being in favour of abortion. The Portuguese people will vote on whether to give women a choice, or whether to continue to criminalise those who decide an abortion may be necessary. Criminalising abortion does not prevent abortion – it merely drives it away: leading either to clandestine abortions or abortions abroad. Banning abortion merely leads to illegal and unsafe abortions. Banning abortions means that the rich can afford abortions abroad and the poor must take a risk with an illegal operation. In supporting the campaign for choice in Portugal, we are expressing the views of the vast majority of Europeans who believe in a woman’s right to choose. Like most Europeans we believe that sexual and reproductive rights are personal choices which cannot be dictated by imposed moral or religious rules. Portugal has benefited from enormous social and economic progress since joining the European Union. We urge Portugal not to be isolated from Europe on the question of abortion but rather to join the rest of Europe in modernising its abortion law and give women free choice. Shunning Direct Intervention: Explaining the Exceptional Behaviour of the Portuguese church Hierarchy in Morality Politics by Madalena Meyer Resende (FCSH-UNL and IPRI-UNL) and Anja Hennig (European University Viadrina) Abstract Why are the Catholic churches in most European countries politically active in relevant morality policy issues while the Portuguese hierarchy has remained reserved during mobilizing debates such as abortion and same-sex marriage, whose laws’ recent changes go against Catholic beliefs? The explanation could be institutional, as the fairly recent Portuguese transition to democracy dramatically changed the role attributed to the church by the former regimes. However, in Spain – whose case is similar to Portugal in matters of timing and political conditions – the hierarchy’s behaviour is different. This begs the question: what elements explain the exceptionality of the Portuguese case? This article shows that the Portuguese case illustrates an element usually not emphasized in the literature: the ideological inclination of the church elites. The article thus concludes that institutional access is a necessary, but not a sufficient, condition for the church to directly intervene in morality policy processes. A church may have access to influence political decision makers but, for ideological reasons, may be unwilling to use it. Wrongful Birth and Wrongful Life Actions (The Experience in Portugal as a Continental Civil Law Country) Vera Lúcia Raposo Abstract This article presents a brief overview of how medical liability for wrongful birth and wrongful life issues is addressed under continental civil law in Portugal. It analyses the requisites for tort liability (wrongfulness, culpability, causation and damage), then explores how these elements operate in wrongful birth and life lawsuits. This is done to determine whether they can be applied as they would be in any other medical liability situation, or whether they require adaption. In addition, this article examines other circumstances that can affect the outcome of these legal procedures, namely standing to file a lawsuit, the judicial consideration of hypothetical events and the legal regulation of abortion. In addition to analysing the particularities of continental civil law within the domain of wrongful birth and life suits, this article will provide some suggestions for improving the current law and caselaw and some insights regarding the development of these legal proceedings for the near future. I. Juridical Contextualisation of Wrongful Birth and Wrongful Life Actions Wrongful birth actions arise when a child is born with a disease or a malformation and his or her parents (the claimants) want to hold responsible those who professionally advised on the pregnancy without providing complete information on it. It used individual- level data on all pregnancies in Portugal from 2008 to 2014. It retrieved the socio-economic determinants of abortion in Portugal to find that young women, educated, employed, working in low skilled jobs, single, with previous children, without easy access to abortion services and living in conservative regions are more prone to abort.
