Delivery hours were initially imposed by condition G41 on planning application A/00087/92 which was granted on 15 April 1992. These delivery hours have been extended through subsequent applications. The current delivery hours are: Monday to Saturday 0730 - 2000 Sunday 0930 - 1700. 3.2 Determining Issues Section 25 of the Town and Country Planning (Scotland) Act 1997 states - Where, in making any determination under the planning Acts, regard is to be had to the development plan, the determination shall be made in accordance with the plan unless material considerations indicate otherwise. If the proposals do not comply with the development plan, are there any compelling reasons for approving them? 3.3 Assessment To address these determining issues, it needs to be considered whether: a) the proposed extension of store delivery hours will intrude upon residential amenity to an unacceptable degree; and b) any comments raised have been addressed. This application is made under Section 42 of the Town and Country Planning (Scotland) (Act) 1997. On such an application the planning authority shall consider only the question of the conditions subject to which planning permission should be granted, and- (a) if they decide that planning permission should be granted subject to conditions differing from those subject to which the previous permission was granted, or that it should be granted unconditionally, they shall grant planning permission accordingly; (b) if they decide that planning permission should be granted subject to the same conditions as those subject to which the previous permission was granted, they shall refuse the application.     CITY OF EDINBURGH COUNCIL (PORTOBELLO PARK) BILL OBJECTION 57 – DR MAIRIANNA CLYDE I write to lodge a formal objection to this bill. I object to the whole bill. How will this affect me? This will affect me in three ways. (i) Firstly as a citizen of Scotland and Edinburgh because what the proposers wish to accomplish is nothing less than a trampling on general citizen rights to public parks which nineteenth century social reformers campaigned hard to obtain. Prior to this Scottish kings since the time of David I made available to the commons certain ‘common good’ land in royal burghs to which they would have unfettered access. I object very strongly to these rights being eroded. As a citizen of Scotland I have campaigned hard for over 40 years for a Scottish Parliament to be set up and the basis of this activism was that I believed that a Scottish Parliament would defend citizens’ rights and the integrity of the Law of Scotland better than if we had no home rule. Never did I imagine that a new Scottish Parliament might through long inexperience or ignorance of its own legal history, and prompted by the machinations of local politicians looking for a short-term fix to a pickle they have got themselves into, become an instrument of oppression against the common rights of the people of Scotland and act to corrupt the Law of Scotland. So this for me is a very, very, important principle, and no minor matter. I urge the committee to give this very close scrutiny.

It outlines four opportunities ‘access’, ‘waterway, development and environment’, ‘community, recreation and tourism’ and ‘infrastructure, drainage and climate change’ as well as the creation of seven ‘canal hubs’. The strategy is accompanied with a ‘Delivery Plan’ which sets out policies and proposals to make the Union Canal a successful and recognisable place. Since then outlined projects have been delivered such as the surface upgrading of the Canal towpath, between the canal basin and Ratho, in 2011, solar lighting (between Canal basin and Longstone) and improvements of several access points. These improvements have been a huge success with pedestrians and cyclists. Especially along the Edinburgh section of the towpath the use has increased significantly as a commuter route as well as for leisure activities. However, at the same time these growing numbers of both groups (pedestrians and cyclists) have brought some conflicts at times. Over the years Spokes has taken several initiatives to help foster thought and consideration by all path users.
