The thesis is dedicated to my father. 4 Abstract The present thesis makes a twofold contribution to the existing literature. Firstly, it shows that clientelism complements cartelization, providing parties with stability in condition of weak mass mobilization. Secondly, it traces the specific mechanisms through which cartel parties channel public resources, within the institutional setting of the post-communist Europe. It provides an important extension to the cartel party literature in the context of new democracies. The main finding of this project is that cartel parties can survive and achieve stability through clientelistic distribution of benefits, both within, and outside their organisations. Furthermore, I find that cartelization generates a new model of clientelism, as public resources (e.g. procurement contracts) are also used to finance the party organisations, not only the clients. Through the in-depth case study of Romania, we can see that when political parties have little time to develop territorial networks and mobilization capacity, clientelism becomes an effective tool for establishing roots in society. The context of post-communist countries presents distinctive conditions for clientelistic linkages and the cartelization process. Multi-party systems in these countries have reappeared simultaneously with the institutions of the democratic state. Consequently, party-state interpenetration has been more profound, building upon previous legacies, as well as the permissive transitional circumstances. The present thesis analyses the following sequences of clientelistic exchanges: (1) internal party selection – patrons within the party organisations, (2) party patronage – political interference in public institutions, (3) politicization—political appointments in key positions of the Central Government (i.e. Senior Civil Servants), and finally (4) preferential resource allocation—public funding channelled through party networks. The threat comes not only from the rise of political movements that openly reject liberal democratic values, including the governing parties of Hungary and Poland, but also from the risk of creeping authoritarianism caused by a gradual decline in standards of governance and the weakening of important democratic underpinnings, such as the rule of law. Romania is a country of particular concern. Although it has earned international praise for its recent efforts to stamp out corruption, a detailed examination of Romania’s anti-corruption activities shows that they often provide convenient cover for acts of political score settling and serious human rights violations. The methods used show a considerable degree of continuity with the practices and attitudes of the communist era. The strong correlation between those targeted for prosecution and the interests of those in power is indicative of politicised justice. Cases have often been accompanied by campaigns of public vilification designed to maximise their political impact. Far from being above politics, Romania’s National Anti-corruption Directorate (DNA) is an active participant in its partisan struggles. Although the rule of law requires the justice system to work independently of government, there is clear evidence of collusion between prosecutors and the executive in Romania.

There are important differences between all Eastern European countries regarding the implementation of pension system privatization. The differences regarding the political configuration between the countries from Eastern Europe might be a possible explanation for the amount of diversity in this area. The ideology of political parties that form or sustain the government that implements the reform can also be an explanation, but this influence must be studied beyond the cliché that stipulates that the right-wing parties will support the public pension system reform and the left-wing parties will oppose it. Armeanu (2010a) showed that there are countries where privatization was supported by the centre-left coalitions that needed to overpass a strong opposition made by the right-wing parties. Using the Ideal Point Estimation technique within the voting sessions related to pension reform during the last three Romanian legislatures, we will explain the formation of pro and against coalitions regarding the pension reform from Romania during the privatization process of public pension system. We also test the hypotheses of the model presented by Armeanu (2010a, 2010b), model that predicts the behaviour of political parties based on the position they have on a two-dimensional space related to the costs of pension reform.     With regard to “Financial incentives and market barriers” (Article 10(2) of Directive 2010/31/EU): In order to reduce energy consumption in buildings and to increase the number of buildings with a reduced consumption of energy, the following legislative acts were promoted: - Government Emergency Order No 18/2009 on the increase in the energy performance of residential buildings. The legislative document provides for funds to finance the works carried out for the envelope of residential buildings, as follows: Ø 50% from allocations from the State budget; Ø 30% from funds provided under the local budgets and/or from other legally established sources; Ø 20% from the fund of the owners’ association, which is intended for repairs, and/or from other legally-established sources. Likewise, the legislative act provides for the putting in place of specific measures so as to ensure that the specific annual heating consumption has decreased below 100 kWh/square meter of useful area. - Government Emergency Order No 69/2010 on the thermal rehabilitation of residential buildings with funds from bank loans granted under a Government guarantee. The legislative act provides mainly for the following issues: Ø the non-discriminatory access of the owners’ associations and natural persons acting as owners of single-family residential buildings to bank loans granted under a Government guarantee and having a subsidized interest rate for the thermal rehabilitation of buildings. The value of the loan shall account for 90% of the value of the works to be executed but not above the following thresholds: - the equivalent amount in RON of EUR 1,850/room, VAT inclusive, in the case of residential blocks, - the equivalent amount in RON of EUR 7,400/room, VAT inclusive, in the case of individual residences.
