Fortress Europe: The Myth Martin Bangemann * The anticipation of the 1992 continental-wide market has already had an unexpected effect: one-third of the average 3.7% increase in eco- nomic growth of the European Community for 1988 is the result of in- vestors anticipating the big market.' This is the clearest signal the business community could make to show its confidence in Europe. This is the beginning of the most extensive exercise of deregulation the Euro- pean Community has experienced since its creation in the 1950s. Every- body agrees that it is an irreversible trend. Long gone is the "benign neglect" of those on Wall Street and Penn- sylvania Avenue that led the United States press to coin the sinister "Europessimism" concept of the early 1980s. Indeed, during last year, many East Coast analysts depicted Europe as a five trillion dollar econ- omy, thus granting the EC the economic powerhouse status it deserves.2 But awe often goes hand in hand with envy, which has resulted in the fashionable East Coast notion of "Fortress Europe." Before killing this myth, one crucial but often forgotten issue must be clarified: there is indeed nothing more legitimate for the Community than wanting to achieve one single market, abolishing national frontiers, and letting goods, persons, services and capital circulate freely. -

Luxembourg is one of the smallest countries in the EU, but it is also the wealthiest per capita. Following Italy and Latvia, Luxembourg is the third in this Presidency Trio, and will be the second full Presidency to work with the new Commission headed by compatriot and former Prime Minister Jean-Claude Juncker. Luxembourg is the seat of several major institutions such as the European Court of Justice, the European Investment Bank, and the Court of Auditors. Attitude toward the EU Luxembourg is one of the six founding members of the European Union and has historically played a key role in its formation. -

A 10-Year Perspective of the Merger of Louisville and Jefferson County, KY: Louisville Metro Vaults From 65th th to 18 Largest City in the Nation Jeff Wachter September, 2013 Over the past 50 years, the idea of merging a city with its neighboring or surrounding county has been contemplated in many American cities, voted upon in a few, and enacted in even fewer. The most prominent American mergers have been Jacksonville, FL; Indianapolis, IN; Nashville, TN; and Lexington, KY. Other cities—including Pittsburgh, PA and Memphis, TN— have attempted mergers, but failed at various stages in the process. City/county consolidation has been a controversial topic, with advocates and opponents pointing to different metrics that support their expectations for the consequences of a merger. Louisville, KY, which merged with Jefferson County on January 1st, 2003, is the most recent example of a city/county consolidation executed by a major American city. This report examines how Louisville Metro has performed over the past decade since the merger took effect by analyzing the city’s economy, population, government spending and efficiency, and public opinion about the merger. In the late 1990s, business and political leaders came together in an attempt to address some of the issues facing the Louisville region, including a long declining population and tax- base, escalating government spending, and multiple economic development organizations fighting to recruit the same businesses (often to the detriment of the greater Louisville region at- large). These leaders determined that a merger of the Louisville and Jefferson County governments was in the best interests of the region, despite the contentious nature of merger debates. -

The debate is traced from its inception on March 23, 1983, when Reagan announced his decision to accelerate ballistic missile defence research, to the eclipse of SDI as a major source of transatlantic and international controversy when Presidents Reagan and Gorbachev signed the INF Treaty in December 1987. The transatlantic SDI debate is investigated to determine: (1) the underlying cause, or reasons, for the controversy, (2) how the Alliance managed the differences which arose, and (3) how East- West relations affected the manner in which the controversy was handled. -

ESSAY ANTITRUST AND REGULATORY FEDERALISM: RACES UP, DOWN, AND SIDEWAYS ELEANOR M. Fox* In this Essay, Professor Eleanor Fox analyzes regulatory competition and regula- tory federalism with respect to competition law. In considering whether some de- gree of higher-than-national-levelregulation is wis Fox observes possible races to the bottom and the top, as vell as the race to be te model for the world. Sie then analyzes regulatorydisregard. the tendency of nationalsystems and their actors to disregardtheir neighbors and to disregard the problem of excessively overlapping regulatorysystems. Professor Fox concludes that there is a modest and marginal race to the bottom; that there is also a race to the top; that there is little competition as such among competition regimes to attractinvestment, but there is competition between the UnitedStates and the European Union to export competition law mod- els to the rest of the worId and dm4 in view of nationalisticraces and regulatory disregard,there is a case for the internationalizationof certain speciftc procedures and principles. INTODUCrION Antitrust law is national. Markets-many of them-are global. Arguments have been made for internationalizing antitrust law or raising surveillance of anticompetitive restraints to a level higher than that of the nation.1 Analysis of these arguments is complicated by the fact that there are many versions of antitrust law and its goals, both descriptive and normative, and there are many possibilities for inter- nationalization or cooperation on antitrust rules and their enforcement. * Walter J. Juli 2000 wurde im Deutschen Bundestag die Reform des Stiftungssteuerrechts beschlossen. Damals kündigte die Bundesregierung die Vorlage eines Gesetzentwurfs zur Reform des Stiftungszivilrechts an. Zwar hat sich mittlerweile eine Arbeitsgruppe des Bundes und der Länder der Thematik angenommen. Prak- tikable Ergebnisse stehen aber bis heute aus. Ob in absehbarer Zeit mit einem Regierungsentwurf zur Reform des Stiftungsrecht gerechnet werden kann, hat die Bundesregierung in ihrer Antwort auf eine entsprechende Kleine Anfrage der F.D.P.-Bundestagsfraktion (Drucksache 14/5055) offen gelassen. Über die Parteigrenzen hinweg besteht aber weiterhin Einigkeit darin, daß eine weitere Stärkung der Stiftungskultur in Deutschland ein modernes Stiftungsrecht voraussetzt. In der Praxis verzweifeln potentielle Stifter immer wieder an den bürokratischen Strukturen der Stiftungsbe- hörden. Zudem gelten Stiftungen und ihre Tätigkeiten in der Öffentlichkeit immer noch als wenig transpa- rent. -
