APPLICANT'S MARK IS NOT PRIMARILY MERELY A SURNAME

The Examining Attorney has refused registration of the subject mark on the Principal Register pursuant to Section 2(e)(4) of the Lanham Act, 15 U.S.C. §1052(e)(4), stating that the mark is primarily merely a surname. Applicant respectfully disagrees and submits that its mark is not primarily merely a surname under the applicable legal test.

As the Trademark Manual of Examining Procedure ("TMEP") states, in determining whether a mark is primarily merely a surname, the Examining Attorney must consider the mark's primary significance to the purchasing public. See,~, Ex Parte Rivera Watch Co1:p. , 106 USPQ 145,

149 (Comm'r Pats. 1955) (RIVERA held not to be primarily merely a surname)); TMEP §§ 1211 and 1211.01. The burden is on the Examining Attorney to present evidence sufficient to establish a prima facie case that a mark is primarily merely a surname. In re Benthin

Management GmbH, 37 USPQ2d 1332, 1333 (TTAB 1995). To deny registration, the

Examining Attorney would have to conclude that the term is "fundamentally only a surname".

In re Yeley, 85 USPQ2d 1150, 1151 (TTAB 2007) (emphasis added). If there is any doubt as to whether a term is primarily merely a surname, the doubt is to be resolved in favor of the applicant. In re Yeley, 85 at 1151 ; In re Benthin Management GmbH, 37 USPQ2d at 1334.

As noted in § 1211 .01 of the TMEP, five factors must be considered in deciding whether a mark is primarily merely a surname:

(1) whether the surname is rare (see TMEP §1211.0l(a)(v));

(2) whether the term is the surname of anyone connected with the applicant;

(3) whether the term has any recognized meaning other than as a surname (see TMEP

§§ 1211.0l(a)-121 l.Ol(a)(vii));

1 NYOI :4383215.1 (4) whether it has the "look and feel" of a surname (see TMEP § 1211.0l(a)(vi)); and

(5) whether the stylization of lettering is distinctive enough to create a separate commercial impression (see TMEP § 1211.0l(b)(ii)).

However, the Examining Attorney has, at best, addressed only factors (1) and (3) above, although "all of the relevant factors" must be evaluated. In re Garan, Inc. 3 USPQ2d 1537, 1540.

Consideration of all relevant factors leads to the conclusion that SCHERMERHORN is not primarily merely a surname.

1. Schermerhorn is a very rare surname

As to the first factor, according to the Examining Attorney the subject mark appears 3,570 times as a surname in the whitepages.com database. The home page of this database (Ex. A hereto) states that it contains "over 5 billion person-identity records". Even taking the 3,570 listings at face value, this amounts to just .0000714% of the whitepages.com listings (assuming there are 5 billion listings in the database, although the website states there are "over 5 billion"). Therefore,

Schermerhorn is clearly a very rare surname, which strongly militates against Applicant's mark being "primarily" merely a surname. The Examining Attorney has not considered the significance of this rarity. See In re Garan (when drafting the statute "the word 'primarily' was added to 'merely' with the clear intent ... to draft a provision which would prevent a refusal to register only because a surname was found in a directory to be the name of somebody somewhere."). As the TTAB pointed out in In Garan, supra, a determination of whether a mark is primarily merely a surname "cannot stop with the [telephone] directory listings and absence of

[dictionary] meanings, but must evaluate all of the relevant factors." 3 USPQ2d at 1540. The rarity of a surname is evidence that the term is not perceived as primarily merely a surname . .llL;_

2 NYOI :4383215.1 In re Benthin Management GmbH, 37 USPQ2d at 1333. It is telling that the Examining Attorney has not cited a single case in which a term was found to have been primarily merely a surname, when such a miniscule percentage of persons have that surname.

Even if a mark is a tern1 that serves as a surname for some people, so long as it also has another meaning it is not primarily merely a surname. A determination of whether a mark is primarily merely a surname requires that the relevant purchasing public perceive the mark "only" as a surname. Ex parte Rivera Watch Company, 106 USPQ at 149. Only after the Examining

Attorney has met his burden of establishing a prima facie case, does the applicant have to rebut the showing that the term is primarily merely a surname. But the evidence provided by the

Examining Attorney does not meet this burden. Instead, this evidence that only a minute segment of the population has Schern1erhorn as a surname, makes it much less likely that it is primarily perceived by the public as a surname.

2. Schermerhorn is not the surname of anyone connected with Applicant

It is undisputed that no one employed by or affiliated with the Applicant has the surname

"Schermerhorn." Applicant intends to use Schermerhorn as an arbitrary term for its services, not because of any surname significance this tern1 might have. This factor militates against a finding that Schermerhorn is primarily merely a surname. In re Garan Inc., 3 USPQ2d at 1540.

3. Schermerhorn is used other than as a person's surname

There are many other uses of Schernrnrhorn other than as a person's surname, across the country, such as i) the Schermerhorn Symphony Center, located in Nashville, Tennessee, ii) the

Schermerhorn Marina, located in Hammond, New York, and as previously noted, iii)

3 NYOI :4383215.1 Schern1erhorn Street in Brooklyn, New York, and iv) the historic Schermerhorn Row Block located in Manhattan, New York. (See Exhibit B) The use of the applied-for mark as a geographic tern1 helps prove that the mark is not primarily merely a surname. In re Colt

Operating Corp., 195 USPQ 75, 78 (TTAB 1977). In addition, the Schermerhorn Symphony

Center is very well-known and has been the subject of many articles. (See Exhibit C) If anything, the public would associate SCHERMERHORN with the symphony hall or one of these other locales. In view of all of the above uses, it cannot be plausibly argued that Schermerhorn meets the requirement of being "fundamentally only a surname". In re Yeley, 85 USPQ2d at

1151.

4. There is no evidence that Schermerhorn has the look and feel of a surname

Turning to the fourth factor, the Examining Attorney did not discuss or present any evidence that

SCHERMERHORN has the "look and feel" of a surname. Since, he has not carried his burden of proof on this issue, this factor favors Applicant.

5. There is no stylization involved

As the applied-for mark is in standard block letter format, the fifth factor does not apply. In re

Benthin Management GmbH, 37 USPQ2d at 1333-1334.

In sum, applying the factors set forth in the TMEP, the primary significance of

SCHERMERHORN to the relevant purchasing public is not merely a surname.

Furthermore, Applicant's prior application (Serial No. 85/736,722) for the same mark presently at issue was approved by the Trademark Office without any objection having been raised that

SCHERMERHORN'S issued without a surname objection, and application Serial No. 77100581 for BE@SCHERMERHORN was approved by the Trademark Office and published for opposition (a notice of allowance issued too) without a surname objection. (See Exhibits E and

F, respectively). These precedents are additional reasons the present application should likewise proceed to publication.

Conclusion

For all of the above reasons, Applicant respectfully requests that the Examining Attorney withdraw the refu sal and pass the mark on for publication in the Official Gazette.

The financial crisis of 2008, compounded by the damage sustained by the Schermerhorn Symphony Center in the 2010 flood, helped put the organization in a very tight financial spot by the summer of 2013 (which it eventually worked through, with some difficulty).

i ·. However, the symphony's 2016 audit showed phenomenal fiscal growth, proving that the multiple-Grammy-winning ensemble overcame those obstacles with colors flying. But like all orchestras, the NSO faces one never-ending challenge: finding the balance between its roots

In its 2017-18 season, which features a kaleidoscopic array of music spanning from the early 18th century to the world premiere of brand new works, the Nashville Symphony shows it's up to the task.

The classical series opens Sept. 14-16 with a program topped by the 1919 suite from Stravinsky's spectacular The Firebird (as well as pieces by Debussy, McDowell and Nashville-residing glam-metal frontman Kip Winger). One of the world's finest pianists, Andre Watts, joins as a special guest.

That's followed Oct. 5-7 by that warhorse of all warhorses, Beethoven's Fifth Symphony. Despite having conducted the immensely popular (and rather difficult) piece more times than he can remember, music director Giancarlo Guerrero tells the Scene he always enjoys revisiting it, because it provides an opportunity to see how he and the orchestra have grown and changed.

Other highlights include Haydn and Verdi programs that give the Nashville Symphony Chorus a chance to shine; "Earth: An HD Odyssey," a follow-up the extremely popular presentation of Holst's The Planets with HD footage from NASA; and the Fifth Symphony of Gustav Mahler, for whom Guerrero has a special affinity. "Commissioning is something that gives me a lot of joy, because it creates a historical database [showing] that the Nashville Symphony has become involved in championing and making an investment in the future warhorses of classical music. That's absolutely important. Beethoven's Fifth became a staple because it's been performed many, many, many times over the years, and it has to start somewhere. For us, making these commissions is definitely an investment in our art form that we're hoping other orchestras will pick up."

Among the commissioned works. this season is a symphony by the young American composer Jonathan Leshnoff, called "Heichalot" after a tradition in sacred Jewish literature which features visions of ascent into holy palaces. The performance will play on the intimate relationship between artist and instrument in a particularly poignant way: Members of the orchestra will play the piece on the Violins of Hope, a group of instruments that survived the Holocaust when in many cases their owners did not, collected and lovingly restored by Amnon Weinstein.

"These instruments are trying to tell a story," says Guerrero. "It's up to us to make sure the story never gets lost."

And that's just the classical series. The pops series, which features the full orchestra or orchestra members performing with a broad range of guest artists, includes appearances by Tony-winning singer Lea Salonga and supreme pop maestro Brian Wilson, with fellow Beach Boys co-founder Al Jardine - supported by an all-new sound system (which made its debut in 2016) that Larry Tucker, the NSO's vice president of artistic administration, says has vastly improved the experience for artists and audience alike by presenting as natural an amplified sound as possible.

Then there's the jazz series, which includes the amazing vocalist Stacey Kent (how often do you get to hear someone who sings material by Booker Prize-winning novelist Kazuo Ishiguro?) and trumpeter/bandleader extraordinaire and Presidential Medal of Freedom recipient Arturo Sandoval. A non-series concert is also scheduled with jazz fusion pioneer John McLaughlin, performing a Mahavishnu Orchestra retrospective that also features fellow guitar wizard Jimmy Herring.

en years ago this month, internationally renowned T conductor Leonard Slatkin walked onstage at the newly opened Schermerhorn Symphony Center, gave the Nashville Symphony Orchestra its downbeat, and ushered the ensemble into the big time.

For the NSO, it's been an adventurous and tumultuous decade. The ensemble has been on a Grammy-winning streak, gaining international accolades for its recordings of contemporary American music. The orchestra

also barely skirted disaster after the 2008 economic downturn and the 2010 flood.

Nashville Symphony over the past 10 years," NSO music director Giancarlo Guerrero tells the Scene. "But we've survived and thrived, and now we want to say thank you to the community that has supported us through the years."

The NSO will express its gratitude in high style, with concerts that celebrate the orchestra's past and pave the way to its future. Guerrero will officially open the NSO's classical series next Thursday with a nod to his predecessor, Kenneth Schermerhorn, performing the late, great music director's Jubilee: A Tennessee Quilting Party for Orchestra.

"I never got to meet Kenneth in person, but I see his legacy everywhere in this concert hall," Guerrero says. "I thought the most appropriate way to open the season was to play this celebratory piece, which Kenneth composed in 1985 for the Tennessee Governor's School for the Arts."

That program (Sept. 22-24) at the Schermerhorn will also include a performance of Mahler's Symphony No. 2 in C minor, "Resurrection." Slatkin conducted the final two movements of the Mahler Second at the inaugural opening of the Schermerhorn on Sept. 9, 2006. Guerrero, who's spent the past several years surveying all of Mahler's music, felt the time was right to play the entire symphony.

The NSO's future is the focus of the next classical concerts (Oct. 7-8), which will feature 22- year-old pianist Conrad Tao in a performance of Edvard Grieg's evergreen Piano Concerto in A minor. The orchestra's youthful associate conductor, Vinay Parameswaran, will lead the program, which will include a piece called Tumble bird Contrails by the NSO's Gabriella Smith, a 24-year-old composer lab fellow.

Although many aficionados now view the NSO as one of the country's top classical groups, Guerrero and his partner, NSO president Alan Valentine, consider the orchestra to be primarily a heartland ensemble. To underscore that point, the orchestra will perform a major American work on every program. ! !•.

Guerrero will round out that program with Brahms' Symphony No. 2.

Barber's seldom-heard Essay No. 2 for orchestra will open a program that will also include Mozart's Piano Concerto No. 24 with pianist Inon Barnatan and Tchaikovsky's Manfred Symphony (Nov. 4-5). Vassily Sinaisky will be the guest conductor.

Guerrero will return to the podium for a program that pairs two American works - Jonathan Leshnoffs Starburst and Aaron Jay Kernis' Color Wheel - with two pieces by Rachmaninoff, Piano Concerto No. 4 and Rhapsody on a Theme ofPaganini (Nov. 17-19). Pianist Boris Giltburg will solo.

"The opening of the Schermerhorn Symphony Center changed everything for us, because the quality of the sound in the hall elevated our playing to a much higher level," says Valentine. "That's definitely worth celebrating."

Sept. 16-18: Nashville Ballet's Cinderella at TPAC's Polk Theater

Nashville Ballet opens its 2016-17 season with this classic work, featuring Prokofiev's grand and majestic score. Parents will no doubt marvel at this ballet's elegant pirouettes and graceful arabesques. The kids will love the slapstick comedy of the ugly stepsisters, whose roles are, by tradition, danced in ungainly fashion by men.

Sept. 26: Gateway Chamber Orchestra at the Franklin Theatre

The Clarksville-based ensemble, under the direction of Gregory Wolynec, presents Nashville composer Conni Ellisor's Blackberry Winter. Mozart's Symphony No. 41 ("Jupiter") will close the program.

Oct. 6 & 8: Nashville Opera's Don Giovanni at TPAC's Andrew Jackson Hall

For its season opener, Nashville Opera is staging Mozart's 1787 masterpiece, which tells the story- sometimes comical, sometimes supernatural - of history's most infamous rake. Don Giovanni's feminine conquests number in the thousands. Mozart reveals the scoundrel's seductive art in the unforgettably beautiful duet "Laci darem la mano."

Oct. 13: Alias Chamber Ensemble at Vanderbilt's Blair School of Music

Nashville's ever-adventurous chamber group presents Paul Schoenfeld's Cafe Music for piano trio, Matt Walker's Sixes and Sevens for , marimba, cello and bass, and Jake Reggie's Three Folk Songs for soprano and piano. Works by Jacques Ibert and Georg Philipp Telemann round out the program.

Oct. 19: Nashville Concerto Orchestra at West End United Methodist Church

Nashville's newest orchestra presents the orchestral premiere of Michael Alec Rose's Cello Concerto with cellist Felix Wang. The concert will also include music by Handel.

Oct. 20-22: Nashville Ballet's Something Wicked at TPAC's Polk Theater

Something wicked-good comes to Music City, courtesy of Nashville Ballet's artistic director Paul Vasterling, who has combined Shakespeare's Macbeth with the music of contemporary American composer Kenji Bunch.

Oct. 24: Gateway Chamber Orchestra at the Franklin Theatre

The ensemble gets transcendental, presenting Arvo Part's life-affirrping Fratres along with Morton Gould's Spirituals. Works by Mendelssohn and Vaughan Williams are also on the program.

Nov. 11-13: Nashville Opera's Glory Denied at the Noah Liff Opera Center

Nov. 11: New Dialect at TPAC's Polk Theater

Nashville's red-hot contemporary dance group New Dialect makes its TPAC debut with a new work by choreographer Banning Bouldin, featuring the music of Cristina Spinei and Sound Riot. New works by choreographers Yin Yue and Idan Sharabi are also on the bill.

Nov. 15-17: Violinist Isabella Faust at Blair's Turner Hall

The noted German violinist performs the complete cycle of Beethoven's violin sonatas over the course of three nights at the Blair School of Music. Pianist Alexander Melnikov will assist.

Nov. 20: Violinist Itzhak Perlman at the Schermerhorn

The famed virtuoso performs music by Beethoven, Franck and Stravinsky,.along with popular showpieces announced from the stage. Pianist Rohan de Silva will assist.

Dec. 1: chatterbird at WELD Nashville, 90 Oceanside Drive

Nashville's avant-garde ensemble continues to push the envelope, presenting Thierry de Mey's Table Music for six hands and three tables, Daniel Wahl's Kin for percussion and electronics, and Halldor Smarason's Game 13 for amplified chess board and ensemble. The concert will also feature a new piece by Bryan Clark.

Plaza Hotel Inspiration @[]

Tasked with recreating the classic look of the Park Plaza Hotel on the face of the Schermerhorn Symphony Center in downtown Nashville, the team at Orange Thread Live partnered with creatives and pixel mapping experts, Meptik, to use projection mapping to create this perfect moment. They brought the ambiance and feel of the Plaza Hotel to downtown Nashville.

The event was a tribute to a memorable experience attendees previously had at the Plaza Hotel. It was important to evoke the perfect atmosphere to transform those in attendance back to the Plaza and stir up the emotions and memories.

Once the scope of the projection the client wanted was determined, we took pictures and measurements of the front of the building and used X-Agora to simulate the projection to determine brightness, projector placement, and number of projectors needed. Then once the content was built it was mapped to the building

So, the thinking goes, unless you yearn for songs about pickup trucks and broken hearts, don't bother visiting, right? Wrong! I

Nashville arguably has more facets, more surprises and more per capita creativity than any other American city its size (700,000 in town; 1.8 million in the 13-country metro area). I recently spent four days there, and still had more great I food, sophisticated culture and little-known treasures to explore.

The city's rapidly changing skyline.

That it's a certifiable boom town sure helps. Construction cranes are everywhere, raising office buildings, trendy condos and high-end hotels. Federal census data show that 100 people a day move here, and it's been like that for the past few years. Huge corporations (AT&T, HCA Healthcare and Nissan) draw a cosmopolitan workforce, and universities (including Vanderbilt and Fisk) lend a youthful vibe.

Want music? Obviously, it's here in Music City, where even the stoplight control boxes serenade pedestrians. But just like the 150 venues hosting live music at least four nights a week, it's not all country. The sound also can be jazz, rock or classical.

It's a classic: The Laura Turner Concert Hall at the Schermerhorn Symphony Center.

Consider, for instance, the Nashville Symphony. Recently finishing its ?0th season, the orchestra of 83 full-time musicians is based at the Schermerhorn Symphony Center. Though this neoclassical structure is across the street frorn the Country Music Hall of Fame and Museum, it is very unlike its neighbor. The 11-year-old building's architecture and detailing echo a 19th-century European concert hall. Named for a former music director, the symphony center has a 1,830-seat shoebox-style concert hall with finely tuned acoustics and a feeling that's almost intimate, at least by the standards of symphonic spaces. There's the usual slate of classics as well as surprisingly contemporary programs. Many weekends, while a movie such as E.T. or La La Land is shown on a giant screen, the orchestra plays the soundtrack live.

Just as surprising and highly regarded in its class is a little musical venue set in a strip mall between a barber and a beauty shop. Despite its nondescript appearance, the Bluebird Cafe is easy to find-it's the place on Hillsboro Pike with long lines of music-lovers stretching to each side of the front door (reservations on the left; hopeful walk-ups to the right). Inside, the performers are songwriters of various genres, typically not household names, but rather the "heroes behind the hits." With the 90 sets arranged so that the performers sit in the middle of the room, you are up close as the they play and tell the stories behind their music.

Rory Feek, one-half of the Grammy-winning country duo Joey+ Rory, announced on Tuesday (June 27) he will perform publicly for the first time since his wife Joey died last year to raise funds for the Music Health Alliance, a nonprofit that helped his family with insurance and medical bills.

The Academy of Country Music-winning duo stopped performing when Joey's cancer returned in 2015, although the couple recorded a gospel in between her chemotherapy treatments. The album, Hymns, won best gospel roots album this year at the Gram mys. joey died on March 4, 2016, at the age of 40.

Feek said during a press conference for the Music Health Alliance that he had been thinking about performing again to celebrate his wife's birthday in September. The two started their careers separately, with Rory Feek pursuing songwriting and Joey Feek trying to make it as a singer, but gained popularity as a duo competing on the Country Music Television singing competition Can You Duet? in 2008.

He'll perform at a barn at his home in rural Pottsville, Tennessee, on Sept. 8 and 9, where the two used to perform together. The couple gained national attention through Rory Fee k's blog as he documented their faith and the strength of his wife as they decided to stop her treatment.

"I should get onstage and see what's there," Feek said. "What's in store? What would I say if I were up there by myself? For me it will be good because I will learn why I am supposed to be there and what the future holds."

Music Health Alliance is asking the music community to donate 5 percent of their earnings for one day to help assist others with medical needs, and the city declared Oct. 20 as Heal the Music Day. The nonprofit, based in Nashville, helps those employed in the music industry find doctors, sign up for health insurance and navigate policies. The nonprofit estimates that more than 75 percent of the 56,000 people in Nashville are self-employed or do not have access to group health insurance.

Feek said he first reached out to the Music Health Alliance after his wife's cancer returned and she wanted to seek treatment at a facility that was considered out of network under their health insurance. Feek said the nonprofit helped them with the problem.

"It was a blessing, because if you don't make it through cancer or if you do, you at least would like to feel good about the choices you made," Feek said.

After her death, Feek needed help again after returning home with their daughter, Indiana.

"What was waiting on me was a huge stack of medical bills," Feek said. "I could not navigate the barrage of medical bills that were coming in. What is covered? What is not covered? What isn't covered but should be? So I reached out to them again."

Joshua Bell's deep and abiding love for the violin is well known. So when the Academy of St. Martin in the Fields announced that the famed American violinist would become the ensemble's new music director, many of Bell's fans were startled. Was Bell going to trade his bow for a baton?

"Absolutely not," Bell tells the Scene. "I still play the violin 100 percent of the time during my performances and have simply added conducting to my duties."

Nashvillians will get the chance to see Bell in the dual role of violinist and conductor this evening, when he leads the prestigious London-based ensemble in a program of Mendelssohn and Mozart at the Schermerhorn. Appropriately enough, Bell will preside over

"The transition from being a soloist to being a soloist-conductor happened quite organically for me," Bell says. "Initially, as a guest artist, I led the Academy of St. Martin in the Fields in small-scale works, like Vivaldi's The Four Seasons. Over time I started taking over larger scale works, like Beethoven symphonies. By the time I became music director in 2011, conducting all of these works, big and small, seemed very natural."

Without question, Bell and the Academy seem like a natural fit. Founded in 1959 by the noted conductor Neville Marriner, the Academy of St. Martin in the Fields quickly developed the reputation as one of the world's most elegant and polished ensembles. Working with the pianist Murray Perahia, it has released definitive recordings of Bach and Mendelssohn concertos. The orchestra is probably best known for its performances on the soundtrack of Milos Forman's film Amadeus.

Bell's talents were recognized early. As a teen, he studied with the noted violin professor Josef Gingold at Indiana University. Bell developed his now famously pure, luminous tone, produced with minimal vibrato and seemingly no effort whatsoever, while studying in Gingold's studio. He all but started his career at the top, appearing as soloist with the Philadelphia Orchestra at age 14 and debuting at Carnegie Hall at 17.

Bell is probably best known for performing the composer John Corigliano's music on The Red Violin soundtrack. In 2007, Bell also participated in a now famous Washington Post experiment, in which he performed anonymously (in jeans and baseball cap) at the L'Enfant Plaza subway station. Performing such works as Bach's mighty Chaconne in D minor, Bell managed to collect $32.17 in donations. Washington Post writer Gene Weingarten, who penned an extensive feature on the experiment, won the Pulitzer Prize.

In Nashville, Bell will solo in Mozart's Violin Concerto No. 4, a work that boasts one of the composer's most songful and reflective slow movements. Bell will also conduct two works by Mendelssohn: The Hebrides Overture and The Symphony No. 4 "Italian."

In one scene, a teen on a 10-speed bike races an 18-wheeler, the vivacious music of Mendelssohn seemingly spurring him on. A Bloomington native, Bell relates to that scene.

"Breaking Away got it exactly right," says Bell. "Mendelssohn's 'Italian' Symphony is a bike race."

Music has always been in the family bloodlines with Alabama lead singer Randy Owen -- his cousins Teddy Gentry and Jeff Cook are his partners in the group. But he also has another activity that is just as personal to him that his family participates in: the family farm just outside of his native Fort Payne, Ala., and he says it's quite the busy time of year.

"My daughter and my son-in-law run the ranch, and we're getting ready for our production sa le on May 7," he told Billboard. "We sell Angus and Hereford cattle, and it's. because of country music that I've been able to carry on the tradition of my two grandfathers." Owen said that it's hard for some to fathom him gathering cattle and baling hay -- but it's as part of his heritage as music. "People don't believe it, but I am a farm boy. That is what I am. I just got lucky in the music business, and that has allowed me to keep it going."

When asked what his favorite part of the agricultural experience was, Owen didn't hesitate for a second. "Calving season would be my favorite -- when the new babies come. It's just a happy time to see the mother with her little one, and you get to watch new births. We have two calving seasons -- in the fall and the spring, but that would be my favorite part of it. It's also a family thing. It's my wife and my children, and hopefully one day, it will also be my grandchildren."

Owen hasn't forgotten his "other" career in music. Alabama is gearing up for one of its most extensive road tours in years this summer, which kicks off with a career first for the Country Music Hall of Fame members: a three-night stand with the Nashville Symphony at the Schermerhorn Center on May 12-14.

"It's going to be a little intimidating for me. I'm just going to have to put it in the back of my head. Hopefully, they can play with our mediocrity as far as our knowledge of notes, and we'll sing our songs. Hopefully it will be a special night for us and all involved."

When asked if he would approach any of the group's classic records differently with a symphony backing him up, Owen laughed, admitting that he would just do what he's always done. "How would I take a different approach? That'? like asking what kind of outfit I'm going to wear. I don't really know if I have ever had a definite approach to anything. I might phrase a little different from time to time -- especially on something I may have written, but as far as the approach, it's pretty much hard to change. We've been doing it the same way since 1980."

One song that he's very interested to see translated to the Schermerhorn setting is "Lady Down on Love." Of the No. 1 hit from 1983, he said, "That's a very intimate song. Last year, we were in Wisconsin, and I was doing a big show up there on the Mississippi. I got to the third verse of the song, and I saw tears in this woman's eyes. I just lost it. There is a reason you write these songs, and I was inspired when I wrote it because of this lady telling me a story about her life. I remember going straight back to my room and writing the song. Still, when I get to that part in the song, I get emotional because I can still see her face. I felt like I was seeing her right inside of her heart. Some songs that you write, it's not about you -- it's about the person. I wouldn't say it's autobiographical, but it did happen."

The song was actually written years before Alabama hit the Country Top 40 for the first time in 1979 with "I Wanna Come Over," and Owen recalls that it was originally intended for Johnny Rodriguez. However, after Alabama recorded it for the album The Closer You Get, another country music artist took notice of the song -- which led to a phone call one summer afternoon to Randy's house.

"I remember one day I was out by the pool, and the phone rang. It was Conway Twitty. I about jumped in the pool. He said, 'Randy, what about that song 'Lady Down on Love?' I told him that was going to be our next single, to which he replied, 'I was afraid of that.' So, I lost my opportunity to have a Conway cut.''

However, Twitty continued to pay attention to what Owen was doing. "But, later on, we did a I song called 'I Want to Know You Before We Make Love' that Becky Hobbs wrote that was on our 40 Hour Week album. We were standing at an awards show, and the same thing happened. I told I I him that the label didn't like the song, and he said 'Good, because I'm recording it tomorrow, and ! it's going to be a number one hit for me' -- and it was." "What an honor. I felt so good about my choice, and to have him reiterate that to me what I thought I already knew was an amazing thing."

The music continues for Alabama. The group has just released "Come Find Me," a collaboration with Alison Krauss. "I listened to so many songs for this album, and I was just looking for a song that said something a totally different way. Dwight Yoakam is a singer who's famous for his own unique flavor of country music which blends together different classic sounds. Throughout his 30-year career Yoakam has released more than a dozen albums, and raked In numerous awards and nominations. Asi de from music he's also a talented actor capable of t ackling a diverse set of roles, and a successful businessman with his brand Bakersfield Biscuits.

You mig ht be wondering what's the latest regarding our favorite country singer. Before we ch eck out the latest about Yoakam, let's first take a look at his journey and how he rose to stardom.

Dwight Yoakam's Early Life

Born on October 23, 1956, Dwight Da vid Yoakam relocated from his birthplace at Pikeville, Kentucky, to Columbus, Ohio, where he spent his ch ildhood. At six years of age Yoakam had his first guitar which he quickly learned how to pl ay, and his exposure to the music of and further fueled his love for the tunes. In high school Yoakam took every opportunity to play music by joining bands while his skills in acting were also developed thanks to school plays which he was usually the lead actor. Yoa kam ditched college in favor of pursuing his dream of making music.

Yoaka m flew to Nashville in an attempt to kickst art his career but his version of the genre wasn't the thing there. He transferred to Los Angeles and began his work on introducing a new flavor of country music he coined " hillbilly music" by playing extensively in rock clubs all around town. Soon enough Yoakam amassed a good number of fans. It was also here where Yoakam met , a guitarist and producer who shared the same love he had for this new version of honky tonk music.

In 19B6 Yoakam released his debut album titled Guitars, Cadillacs, Etc. Etc. and Anderson served as both producer and electric guitarist. Critics lauded the album and it received much airplay on radio stations all over the country. This helped boost both the fanbase and the sa les of the album which eventually reached platinum for selling over a million copies. His cover of " Honky-Tonk Man" by was the first ever music video of its genre to be aired on MTV. Also in 1986 Yoakam was given the "Top New Male Voca list" award during the Academy of Country Music Awards.

His two other offerings for the decade namely Hi//b//Jy Deluxe (1987) and Buenas Noches from a Lonely Room (1988) continued Yoakam's roaring success with singles that ra nked at the top spot of the country charts.

Yoakam started the 90s with his fourth album . Most of its songs found places at the Hot Country Singles chart of Billboard while the album itself ranked at number seven. His 1993 album This Time fared better than his previous work and was certified triple platinum, but the following Gone (1995) marked as Yoakam's first time to not have even a single track to make it to the top ten.

I n 1997 Yoakam released Under the Covers, and a month later, and both were cover albums that ga thered somewhat positive critical reception. He returned to singing his original songs in 1998 with A Long Way Home but unfortunately it didn't sell well and failed t o earn even a gold certification, another first in Yoakam's highly successful ca reer.

Throughout the 2000's Yoakam released eight studio albums. After his sixteenth album (2005) Yoa kam took a break from working on original music and instead released the tribute album (2007) in honor of singer Buck Owens.

After seven years Yoakam made a comeback in 2012 with which was considered as among his greatest albums, appearing in many top lists of critics and gathering virtually universal acclaim. Fo r this monumental comeback Yoakam was given the "Artist of the Year" award during the Americana Music Awards in 2013.

Yoakam's 2015 album Second Hand Heart also enjoyed a good amount of praise especially towards his efforts in reconnecting with the sounds of his earlier albums.

As acting was one of Yoakam's dreams way back in high school, it didn't take long after his success In music for him to land a role. His very first appearance was In the drama television series P.S. I Luv U In 1991. In 1993 he had a minor role in the thriller Red Rock West as a truck driver.

In 1996 he starred alongside Billy Bob Thornton In the award-winning drama Sling Blade. The next year he got the lead role in the drama film Painted Hero. Before the decade ended Yoakam appeared in three more films na mely The Newton Boys, When Fade, and The Minus Man. He also provided the voice of Lan e Pratley in the animated comedy series King of the Hill. In the 2000s he appeared In several films such as Panic Room (2002). Wedding Crashers (2005), Crank: High Voltage (2009), and 90 Minutes in Heaven (2015).

Yoakam ventured into the realm of directing in 2000 with the Western flick South of Heaven, West of Hell wherein he also starred as the lead character. His twelfth studio album was the soundtrack of the film, while the other tracks were dialogue from the movie. Unfortunately Yoakam's directorial efforts were met with negative critical reception and the film was also a commercial failure. In 2002 he served as one of the producers of the comedy Waking Up in Reno.

He returned to acting In television series In 2014 at Under the Dome and the next year In the biographical drama To Appomattox. In 2015 he was set to team up with comedian Jack Bl ack In the production of a comedy set in Nashville titled Belles & Whistles but so far there are no updates about It.

Yoakam released his latest album last September titled Swlmmln' Pools, Movie Stars... which featured his old songs but given a bluegrass twist . He also paid tribute to the legendary singer Prince with a cover of " Purple Rain" on the album. So far the album has been given positive reception.

Since the start of this year Yoakam has been actively performing on stage. He performed at the Schermerhorn · ·,.,: .~Q>. .- ·- ·· Symphony Center last July and it was a first time for Yoakam since t he start of his career. He was part of the annual :.wl1nmJn' 1'11041. M1,1~!e St~s ... Norsk Hostfest in North Dakota last September, and the yearly music festival Austin City Limits (he hosted the said event last year).

He Is currently on tour in support of his latest album. He has a long list of performances throughout October to December. He will also have shows next year on January, February, May, and June.

He Is part of the cast in the upcoming drama Boomtown and telev ision series Goliath. Recently he appeared in the "Bar Fights" episode of I Drunk History as Jesse Benton.
