I. Introduction

The purpose of this report is to reflect if there are newly discovered circumstances during the implementation of the project that have had an impact on people and reflection status of the implementation of the complaints and appeals mechanism. The date of beginning of the construction works on the project “Reconstruction of the “Zhetybay- Zhanaozen- Kenderli-border of the Republic of Turkmenistan” road" (to Turkmenbashy), km 0-73 km, was defined as February 20, 2018. Initial duration of construction works is 600 days.

II. Project Brief Description

The project includes the reconstruction of the road located between Zhetybay and Zhanaozen and the medium repair of bypass road of Zhanaozen. The project is located in , bordering the Caspian Sea. The end point of this road project is the city of Zhanaozen, which is an important economic center for export cargo, including terminals for pipelines that supply regional petroleum products to Western Europe.

The project consists of 2 sections (Lot 1 and Lot 2), which are being built separately.

Section 1: km 0–35 section includes the reconstruction of the existing road according to the parameters of I-b technical category with a four-lane carriageway, a dividing strip and a widening of the roadway. At this site, the direction coincides with the existing embankment of the subgrade. The total length of the projected road section is 35 km. The reconstruction project provides for the construction of 2 car pavilions and 3 rest areas, as well as the construction of 12 pipe culverts: • construction of box culverts (cattle passes) in size 4x2.5 m at PK195+07, PK331+91 and PK217+60. • construction of a two-section pipe at PK215+45. • construction of 8 pipe culverts.

Section 2: km 35 - 73. The total length of the project is 38 km. The reconstruction project provides:

• PK350+00 - PK573+87 - reconstruction of the existing road according to parameters I-b of the technical category with four lanes and a widening of the roadbed by 27.5 m • Construction of interchanges at two levels at the intersection of the road approach to Zhanaozen, road section of II category from PK574+00 to PK 644+40, the road approach to Zhanaozen PK11+80 - PK60+80. Exit road from Zhanaozen road section of III category PK00+00 - PK11+80 • Construction of the railway fly-over at PK615+48 and construction of the fly-over at the interchange to Zhanaozen at PK574+48 • Construction of 12 pipe culverts, and 1 box culverts in size 4x2.5m • External lighting of a traffic intersection at PK574+45

The Republic of Kazakhstan, acting through the Ministry of Industry and Infrastructure Development has been implementing the program on modernization the Zhetybay– Zhanaozen road Tranche 2 of the Central Asian Regional Economic Cooperation (CAREC) Investment Program (section of Mangystau Region). The project includes the reconstruction of the road located between Zhetybay–Zhanaozen and the construction of a new bypass of Zhanaozen. The project is located in Mangystau region, bordering the Caspian Sea. The end point of this road project is the city of Zhanaozen, which is an important economic center for export cargo, including terminals for pipelines that supply regional petroleum products to Western Europe. The project consists of 2 sections (Lot 1 and Lot 2), which are being built separately.

Lot 1, km 0–35 (Zhetybay–Zhanaozen): The length of the projected section of the road reconstruction km 83–118 km (–Zhanaozen) is 35 km. The direction coincides with the existing roadbed embankment. Reconstruction of the existing road in terms of parameters 1- B of the technical category with four lane roadways, dividing strip and roadway broadening. The total number of culverts is 12 pcs. At Pk195+70, Pk331+91 and Pk217+60 the construction of box culverts (cattle pass) is provided of 4x2.5 m in size. It is also planned to arrange 8 pcs of pipe culverts on the road and at the ramps and 1 two-section culvert at Pk215+45.

Contract 001-ADB/CW-2017 road section of Aktau–Zhetybay km 0–35 entered into force on March 10, 2017. Work commencement according to General Contract Conditions was fixed

Original construction duration is 600 days, after approved extension of time the actual completion date is March 30, 2020.

The main parties of the Contract are: • the Employer – Committee for Roads of MIID RK • the Contractor – “Ak Zhol Kurylys” LLP • the Construction Supervision Consultant – Grusamar Ingenieria y Consulting (Spain)/SNS-2017 (Kazakhstan). After termination of the contract with MID and GRUSAMAR Ingenieria y Consulting S.L.U. (Spain) the new contract on the provision of consulting services for this project was concluded between MID and SNS-2017 LLP (Kazakhstan) on June 10, 2019. The contract with the supervision consultant Grusamar Ingenieria y Consulting S.L.U (Spain) with the sub-consultant of “SNS-2017” LLP (Kazakhstan) was terminated by the Client on March 18, 2019. ADB approved the single-source selection method for hiring “SNS-2017” LLP as a new CSC to supervise the remaining work on March 26, 2018. Joint submissions 2 and 3 were approved by ADB on May 22, 2019. Contract negotiations were completed, and the contract was signed on June 10, 2019 • the Designer – “KazDorNII” JSC, Almaty.

The General Contact Conditions 001-ADB/CW-2017 includes the Contract Conditions for construction and engineering works developed by the Employer (approved edition, June 2010) prepared by FIDIC. The project was amended in October 2018 from PK 260+00 to PK 310+00 with a total length of 5 km, where a new air-strip will be built, as well as on the section at PK313+40 and PK314+80 with partial impact on the territory of 0.047 hectares, which will be required for the construction of a rest area according to the project. These project changes have impacted on land acquisition and resettlement. Three households that will be affected were identified as described in Section 4 below.

Lot 2 km 35-73: The length of the sections with different technical categories is: I B category - 22.4 km, II category – 6.283 km, III category - 7.655 km. Total is 38 km. The reconstruction project provides a traffic interchange at the junction of two roads: the route of the project road passes through Mangystau region lands, from Pk2+00 to Pk6+60 and from Pk95+50 to Pk501+50 – , from Pk6+50 to Pk95+50 - , from Pk501+50 to Pk614+76 and from Pk616+20 to Pk636+83 - lands subordinate to maslikhat of Zhanaozen, from Pk614+76 to Pk616+20 passes through the railway lands. The beginning of the site was taken at Pk2+00 and held in conjunction with the traffic interchange at the junction of the road to Zhetybay. At Pk569+60, there is a traffic interchange in two levels on the bypass of Zhanaozen. In addition, from Pk569+60, the entrance to Zhanaozen starts with 6400 m in length. At Pk615 + 48, the railway overpass has been projected. On the whole length of the project road 16 ramps were arranged to facilitate access to infrastructure facilities and 1 road intersection was placed to provide transport links for agricultural activities, as well as 3 box culverts at locations known to be regularly crossed by animals. At Pk103+46, Pk312+83 to the left and right from the axis of the designed road the new rest areas with arrangement of shelter shed, a toilet for two points, installation of benches, tables, garbage chutes, garbage cans and overpass. At the ramps of Pk231+72, Pk369+90, bus stops with auto-pavilions, corresponding to the parameters and norms of the projected highway were designed.

Contract 002-ADB/CW-2017 road section of Zhetybay–Zhanaozen km 35–73 (38 km) came into force on June 19, 2017. Construction duration is 20 months. General Conditions of the Contact 002-ADB/CW- 2017 includes the Contract Conditions for construction and engineering works developed by the Employer (approved edition, June 2010) prepared by FIDIC.

Original realization period: 20.02.2018–12.10.2019 (600 days), after approved extension of time the actual completion date is 30 March 2020.

The main parties of the Contract are: • the Client – Committee for Roads of Ministry of Investment and Development of RK • the Construction Supervision Consultant – Grusamar Ingenieria y Consulting (Spain)/SNS-2017 (Kazakhstan). After termination of the contract with MID and GRUSAMAR Ingenieria y Consulting S.L.U. (Spain) the new contract on the provision of consulting services for this project was concluded between MID and SNS-2017 LLP (Kazakhstan) in June 10, 2019 • the General Contractor – Cengiz Insaat Sanayi veTicaret A.S. (Тurkey) • the Designer – “KazDorNII” JSC, Almaty.

Work commencement was fixed on February 20, 2018. The Contractor received a license No.15002539 on February 4, 2015. Notification on construction work production commencement KZ95REA00081512 was received on December 29, 2017.

III. Methodology and Approaches in the report preparation

In the process of preparing this report methodology, tools and participatory approaches were used. The participatory approach consists of site inspections, community meetings and documentation review by the Social Safeguards Specialist of the Construction Supervision Consultant, followed by review by the implementing agency's Social Safeguards Team. Data from the Contractors' monthly reports were also used. Visits and inspections of construction sites, shift camps for the reporting period were carried out once in March. Subsequently, these visits were not possible due to the introduction in the Republic of Kazakhstan of the State of Emergency due to the coronavirus (COVID-19) pandemic for the period from March 24 to May 24, 2020. Further, until August 17, 2020, the government of the Republic of Kazakhstan declared quarantine due to the unfavorable sanitary and epidemiological situation in the country. To complete the project's socio-economic impact matrix of the project site, the Social Safeguard Specialist of the Construction Supervision Consultant used the information received from the responsible specialists of the Contractors, as well as from the Monthly Progress Reports.

The project specialists responsible for managing and monitoring the social and environmental impacts of the project reflected the information in the Contractor's monthly reports. The CSC specialists who are located directly at the sites have crosschecked this information. To work with complaints and appeals at Lot 1, according to the reminder of the ADB mission, a specialist in social protective measures with an intermittent work schedule and combining the main safety position had been appointed. At Lot 2, the function for handling complaints and appeals was assigned to a Health and Safety Specialist. More information is provided in Sections V and VI.

3.1 Site inspections by the Construction Supervision Consultant

Mitigation measures are designed to ensure the operation of the project in accordance with the requirements of laws and regulations of the Republic of Kazakhstan, as well as the requirements of the environmental and social policy (2009) of ADB. Execution requirements at all relevant stages of the project are focused on preventing identified social consequences, where possible, or on measures to minimize the consequences or reduce the possible consequences to an acceptable level. This project is categorized under involuntary resettlement as category B.

A comprehensive audit report on this project, drawn up in 2019, identified impacts on 3 APs associated with land acquisition without resettlement.

In July 2019, the CSC, together with the PMC and with the consultative participation of the national and international consultants of the ADB, developed a Corrective Action Plan (CAP) for the social impacts identified in the first half of 2019 at the site of Lot 1.

As part of the implementation of the CAP, all planned activities have been completed. The implemented activities are in line with the environmental and social policy (2009) of ADB. All 3 APs are satisfied with the results of the CAP. During the verification visit to the site on March 16, 2020, no new circumstances were identified. During the interview with the AP, a wish was expressed to install additional safety signs for the passage of livestock on the project road, since there are 2 livestock farms located next to the project road. These signs are included in the list of signs and will be installed in August 2020.

According to the ADB memo dated October 2019, the question of reimbursing to K. Alagozov (PH “Ansar” was renamed to the PH “Kuanysh”) a financial compensation for the restoration of the water supply system at its section PK261+00 along the project road and on the bypass road PK00+20. 20. Alagozov K. restored this structure himself at his own expense, and subsequently applied to the GRM for reimbursement of funds. These funds were included in Variation Order No. 5 and the payment on them was planned in the reporting period, but due to the long approval process, the payment was not made in the reporting period. Payment is expected in August 2020.

IV. Project change and impact on LARP

The project was amended: in October 2018, a parking lot for heavy vehicles with a total length of 5 km was built from PK260+00 to PK310+00. Also at the section of PK313+40 and PK314+80, the construction of the parking for heavy vehicles was performed, with a partial impact on the territory of 0.047 ha, which will be required for the construction of the rest site according to the project. These changes in the project have affected land acquisition and resettlement.

On June 24, 2019, the State Institution “Karakiya District Department of Land Relations, Architecture and Urban Planning” issued Order No. 01-05/345 on additional clarification of the area of the AP`s land plots. A summarized data on the effects of land redemption and resettlement is presented in Table 2 below.

According to the household inventory, changes in the project have led to the impact on 3 households. The impact turned out to be the ownership of one household on 0.2598 hectares of private land, and 2 private land plots were affected, one of which is used for commercial purposes with an area of 0.047 hectares, and the other for agricultural purposes with an area of 6.071 hectares. All owners wrote a voluntary return of the above land areas.

The owner, who returned 6.071 hectares under the bypass road, did not have access to 29- hectare plot between the project and bypass roads. This circumstance is stipulated by the legislation on land and for this AP, the withdrawal of 29 hectares was included in the Corrective Action Plan (CAP) in compliance with the LARF. In the process of implementing the CAP, the land user was changed the configuration of the site and on September 17, 2019 the state act on the land plot was issued taking into account 6.071 ha land plot under the bypass road and 29 ha without access.

According to the compensation matrix, ADB's policy on redemption and relocation and CAP, land owner Alagozov Karubay was paid one-time monetary compensation in the amount of 3 minimum wages in the Republic of Kazakhstan in the amount of 127,500 tenge on September 28, 2019 because he has Group 1 disability: labor injury.

During the reporting period, the CSC, with the advisory participation of the ADB national consultant, held consultation work with stakeholders in March.

Based on the results of site visits and meetings with APs, no new circumstances for land acquisition and resettlement were identified. No questions or new circumstances were revealed regarding the CAP.

V. Grievance mechanism

A guide to the grievance mechanism for the environmental and social protective measures at Lot 1 and Lot 2 has been formed since the start of the project. The general responsibility for the timely implementation of the grievance mechanism (GM) lies with the COR and the Mangystau branch of “NC KazAvtoZhol” JSC, with the support of project consultants such as PMC, CSC involved in the management and supervision of construction works. Construction contractors directly carry out construction work. Relevant region, district and village akimats authorized by law to carry out tasks related to handling complaints, and mediators / non- governmental organizations that are involved in assisting in the conflict-free resolution of complaints should also be included in the GM. Boxes indicating the contacts of those responsible for the extraction of content have been installed at the sites. Boxes for complaints have been also installed in the offices of the stakeholders of the Project: akimats of Zhetybay village, Zhanaozen, Karakiya district, in the office of MF “NC KazAvtoZhol” JSC. The GM provides two levels of resolution of complaints on road sector projects implemented under the direction of the COR: the Complaints Committee (CC) at the regional (oblast) and central (Nur- Sultan city) levels, in accordance with the GM guidelines. The CC consists of members appointed from the COR, akimats, Regional branches of “NC KazAutoZhol” JSC, PMC, CSC and Contractors. The CC at the regional and central levels is chaired by the leaders responsible for the overall work of GM and its effective and timely implementation, while the coordinators are responsible for involving relevant parties and coordinating the work of GM at the regional / central levels.

Detailed information on the GM composition is presented in Appendix 1 to this report. During the reporting period the GM received no complaints or appeals.

Since the beginning of the project 7 appeals have been received. 6 appeals are closed, one appeal has an open status. The applicant Alagozov Karubay (PH “Ansar”), during the construction period, at his own expense, restored the culvert under the project road, as well as under the bypass road at Pk260. The amount of expenses is 623,000 (six hundred twenty-three thousand) tenge. The applicant demands to reimburse him for these costs, since they are related with project activities, as a result of which he incurred unforeseen expenses. Reimbursement of expenses for the restoration and arrangement of culverts are included in Certificate No. 5 and payment for it is planned in August 2020.

On the GM, the process launched by the CSC on the appeal of the AP of Alagozov Karubay in connection with the reimbursement of costs for the restoration of water utilities at two places remained not closed. Earlier in the report on the implementation of the CAP (January 2020), a plan for further actions for the GM complaint closing was drawn up. Below in Table 7, further steps to close the process of resolving the complaint of Alagozov Karubay were defined.

Monitoring the fulfillment of CSC 20/02/2020 14/09/2020 compensation

At the time of this report preparation, Certificate No. 5 has been signed. Estimated payment in August 2020. The contractor will reimburse the applicant's expenses. This complaint also consists of the requirement to arrange an exit from the bypass road to the section of KH Alagozov Karubay, since the previous exit from the project road was excluded in order to ensure safety for road users. During the reporting period, the exit was arranged in a place agreed with the Applicant.

VI. Conclusions and recommendations The variations in the project for impact on the project APs were checked, and the possible risks of adverse effects on the APs were assessed. Comprehensive consultations were provided for the project affected persons. In the frame of GM work, the complaints of persons having an impact as a result of the project have been worked out. Monitoring of work at Nysan café site, as well as work to ensure a temporary exit from the bypass road of “Ansar” PH at Pk260 were carried out. Together with the PMC protective measures specialist and with the advisory participation of the ADB national consultant, a comprehensive monitoring of the project variations was carried out. Monitoring of the CAP implementation was performed. The CAP implementation monitoring report was prepared. A report on monitoring the implementation of the CAP will be submitted and posted on the ADB`s website.

Key conclusions: • During the reporting period, no new circumstances have been identified for the impact on the AP • For previously identified impacts on 3 APs, all Project impacts were removed. The procedures for land acquisition were carried out in a proper manner and documentation for land plots was drawn up. The interview with the AP showed that there were no other negative impacts from the project • The financial expenses of the PH “Ansar” for the restoration of the water supply network were not reimbursed. It is planned to cover the costs in August 2020 • The Contractor assisted in obtaining the Technical specifications for the pipe culvert for the PH “Ansar” by preparing a package of documents for submission to the relevant authorities • Arrangement of the retaining wall near the cafe “Nysan” with the design of the recreation area allowed the owner to significantly improve the appearance of his site, and the Project also increased the attractiveness of the owner's service for travelers

The final view of the recreation area near the cafe "Nysan" • The interaction of the ADB national consultant, PMC and CSC on this project demonstrated an effective mechanism of interaction and certainly contributed to a deeper understanding of the importance and necessity of adhering to ADB's operational policies, social policy standards and the importance of social aspects of investment projects.

Recommendations: • It is recommended to review the schedule of work of the protective measure’s specialist in the following CSC Contracts in the direction of increasing the days of presence on the site. The current intermittent work schedule does not contribute to the efficient operation of the GM. • Training of the Contractor's personnel, representatives of Local Authorities, Customer's specialists in the field is required on the operational policy of ADB, GM, land acquisition and resettlement issues
