MARCH 2016 THE TRANS-PACIFIC PARTNERSHIP: INTELLECTUAL PROPERTY, PUBLIC HEALTH, AND ACCESS TO ESSENTIAL MEDICINES Zahara Heckscher Protests against the TPP DR MATTHEW RIMMER PROFESSOR OF INTELLECTUAL PROPERTY AND INNOVATION LAW FACULTY OF LAW QUEENSLAND UNIVERSITY OF TECHNOLOGY Queensland University of Technology 2 George Street GPO Box 2434 Brisbane Queensland 4001 Australia Work Telephone Number: (07) 31381599 1 Executive Summary This submission provides a critical analysis of a number of Chapters in the Trans-Pacific Partnership addressing intellectual property, public health, and access to essential medicines – including Chapter 18 on Intellectual Property, Chapter 9 on Investment, and Annex 26 on ‘Healthcare Transparency.’ The United States Trade Representative has argued: ‘The Intellectual Property chapter also includes commitments to promote not only the development of innovative, life-saving drugs and treatments, but also robust generic medicine markets.’ The United States maintained: ‘Drawing on the principles underlying the “May 10, 2007” Congressional-Executive Agreement, included in agreements with Peru, Colombia, Panama, and Korea, the chapter includes transitions for certain pharmaceutical IP provisions, taking into account a Party’s level of development and capacity as well as its existing laws and international obligations.’ The United States Trade Representative also argued that the agreement protected public health: ‘The chapter incorporates the Doha Declaration on the TRIPS Agreement and Public Health, and confirms -

Chapter 3 USFWS Great egret looking for lunch along Back Bay shoreline Affected Environment Summary Summary Back Bay National Wildlife Refuge is located in southeastern Virginia along the Atlantic Ocean and within the southern half of the city limits of Virginia Beach. The environment of this 9,035-acre Refuge consists mostly of water, barrier sand dunes, and wetland marsh. The immediate surrounding environment is residential, rural agriculture, barrier dunes, inland water, and ocean front. The area just north of the Refuge is urban. Back Bay NWR was established by Executive Order #7907 on June 6, 1938. Prior to acquisition by the Federal government, the barrier beach portion was generally flat and sandy. The saline soils were unproductive. Periodic storms from the northeast (northeasters) and hurricanes pushed large quantities of sea water across these flat beaches, and into Back Bay. During the early 1930’s the Civilian Conservation Corps built brush fences and planted cane and bulrush to catch moving sands; thus building and stabilizing new sand dune formations. Later, wooden sand fences were constructed, and many dunes were planted with Beachgrass (Ammophila breviligulata). These new dunes protected the bayside flats from oceanic waters and permitted formation of an oligohaline marsh, which is nearly free of salt particles. The original 1938 Executive Order established Back Bay NWR “….as a refuge and breeding ground for migratory birds and other wildlife.” Another of the Refuge’s primary purposes (for lands acquired under the Migratory Bird Conservation Act) is “… use as an inviolate sanctuary, or for any other management purpose, for migratory birds.” The Refuge is part of the eastern portion of the Atlantic Flyway. -

Filibuster 2008 Writing a book is an adventure. To begin with, it is a toy and an amusement. Then it becomes a mistress, then it becomes a master, then it becomes a tyrant. Friends, full fraught with war-sweat glaring, kismet-dashed with derring-do, doth here present case: Alas the day when all voices cease and the final hours of coiling conundrum crash all together like minute pawns against the wagerly knights and evening kings and kingly queens in furious disparagement dispatch- ing the last breaths of mighty air! Not really. So, as both an editor and a writer, my chiefest frustration is also the greatest gift: I’m not included in this issue! “Humbug!” says Scrooge; “Hilarious!” says I! Aye. The focus changes when a feverish brain must reach for words other than its own, and here presented is the fruit of my labor(ers). No, I didn’t hire a score of goblins to sit in a dungeon and swim through page after page of unfaltering text. No. I swam through page after page, and one of the hardest things an editor must, MUST, do is say “No” to someone. I had to turn down some submissions. Sounding the trumpet from the blistering recesses of the computer lab to the towering heights of the Library’s tenth floor yielded a great wealth of submissions, for which I among others am thoroughly grateful.
