Selle, brought a suit against three brothers, Maurice, Robin and Barry Gibb, known collectively as the popular singing group, the Bee Gees, alleging that the Bee Gees, in their hit tune, “How Deep Is Your Love,” had infringed the copyright of his song, “Let It End.” The jury returned a verdict in plaintiff’s favor on the issue of liability in a bifurcated trial. The district court, Judge George N. Leighton, granted the defendants’ motion for judgment notwithstanding the verdict and, in the alternative, for a new trial. Selle v. Gibb, 567 F.Supp. 1173 (N.D.Ill.1983). We affirm the grant of the motion for judgment notwithstanding the verdict. I Selle composed his song, “Let It End,” in one day in the fall of 1975 and obtained a copyright for it on November 17, 1975. He played his song with his small band two or three times in the Chicago area and sent a tape and lead sheet of the music to eleven music recording and publishing companies. Eight of the companies returned the materials to Selle; three did not respond. This was the extent of the public dissemination of Selle’s song.1 Selle first became aware of the Bee Gees’ song, “How Deep Is Your Love,” in May 1978 and thought that he recognized the music as his own, although the lyrics were different.

    Some back ground info (source: The internet). Dennis Bryon and Blue Weaver first met in the mid sixties in a group called Brother John & The Witnesses. In 1966 Blue Weaver and Dennis Bryon joined a group from Cardif called Amen Corner. This septet, complete with saxes, was led by Andy Fairweather-Low, who at that time was only 16 years old. The group got a recording contract with Deram Records in 1966 and had many big hits during the next four years. These included "Gin House Blues," "Bend Me, Shape Me," and "High In The Sky" for Deram, after signing with Immediate Records they had further hits such as "(If Paradise Is) Half As Nice". During the four years of their existance they recorded three albums. After the end of Amen Corner, Andy Fairweather-Low founded a new, more progressive group, which he simply called Fairweather. The musicians of the new group were the same musicians that made up Amen Corner except for the horn section, which was missing. The first single release "Natural Sinner" was a big hit. After only one year the group broke up in 1971. After the failure of "Life In A Tin Can" the Bee Gees started to restructure the group and their sound. At first they found a new drummer. Dennis Bryon had previously played with Amen Corner and now joined the group. The next step for the Bee Gees was to find a new sound. Together with Atlantic producer Arif Mardin they worked on a modern form of rhythm'n'blues music. At first they added more rock'n'roll to their music.

Derselbe Mann hat auch schon auf nordamerikanischen Riesenbühnen gestanden und zwar gemeinsam mit den Bee Gees. Fischerhude. Er war in den späten 70er Jahren der Keyboarder und Soundtüftler hinter "Stayin alive", "Night Fever" und vielen anderen Hits. Jahrzehntelang geisterte Blue Weaver als Musiker, Produzent und Songschreiber durch die höchsten Etagen des Pop und Rock. Heute lebt er zurückgezogen in Andalusien und in Worpswede. Wieso nimmt ein Musiker, der auf Platten von T-Rex, Lou Reed, John Cougar, Alice Cooper, den Pet Shop Boys, den Sisters of Mercy und anderen Stil prägenden Künstlern mitgewirkt hat, seinen Wohnsitz ausgerechnet in Worpswede? Dafür kann es nur eine Erklärung geben, deren Wurzeln eigentlich in Fischerhude liegen. Aber dazu später. Blue Weaver, 1947 in Cardiff geboren, wusste bereits als sehr junger Mann, dass die Rockmusik für ihn Berufung und Profession werden sollte. Der Umzug des 17-Jährigen ins Mekka des Pop nach London war spektakulär und wegweisend. Er reiste auf der Ladefläche des Equipment-Lieferwagens seines walisischen Landsmannes Tom Jones, mit dessen Gitarristen er befreundet war. Kaum in London angekommen, gründete er mit Andy Fairweather-Low die Band "Amen Corner", die mehrere Hitsingles hatte. "If paradise is half as nice" etwa gehört eindeutig zum Pop-Kanon der Sixties. Später ging er zu den "Strawbs", deren Organist Rick Wakeman zur Art-Rock Gruppe "Yes" wechseln wollte.
