    PTM, irredentist Afghan claims on Pakhtunkwa & Pakistan army Pashtun Tahafuz Movement, PTM, is a peaceful movement for people’s rights violated in the war on terror that especially devastated certain Pashtun areas in the northwest of Pakistan. Political parties of Pakistan could not change the military controlled Afghan policy that was causing the devastation and Pakistan army allowed all the devastation as ‘collateral damage’. The result: within about one and a half decade the PTM emerged in the area, driven by the ‘children of war’— former child victims of the war. The movement is led by 24 years old Manzoor Pashteen, who also grew up a war child. Civilian governments in Pakistan have little control over Afghan policy of Pakistan and expecting anything from them is useless. The PTM, therefore, directly addressed its demands to the concerned authorities: the power generals of Pakistan. This research explores the role of the Mahsud tribe in the rise of the religious militancy in South Waziristan Agency (SWA). It further investigates the impact of militancy on the socio-cultural and political transformation of the Mahsuds. The study undertakes this research based on theories of religious militancy, borderland dynamics, ungoverned spaces and transformation. The findings suggest that the rise of religious militancy in SWA among the Mahsud tribes can be viewed as transformation of tribal revenge into an ideological conflict, triggered by flawed state policies. These policies included, disregard of local culture and traditions in perpetrating military intervention, banning of different militant groups from SWA and FATA simultaneously, which gave them the raison d‘etre to unite against the state and intensify violence and the issues resulting from poor state governance and control.

    PTM LEADER DETAINED BY PAKISTANI GOVERNMENT IN VIOLATION OF HUMAN RIGHTS RIGHTS WATCH (UK) BRIEFING 28 January 2019 Summary - The leader of the Pashtun Tahafuz Movement (PTM), Manzoor Pashteen, was arrested in Khyber Pakhtunkhwa (KP), Pakistan on 27 January 2020. The arrest comes ahead of a planned rally organised for Monday 27 January, which has been postponed following his arrest. - Official information relating to the grounds for his arrest indicate charges stemming from his alleged violation of laws prohibiting sedition, criminal intimidation, conspiracy and condemnation of the Pakistani State. - The situation giving rise to these charges was a speech given at a large gathering by Pashteen on January 18 2020, where he demanded that the Pashtun people should enjoy the protection of the Pakistan constitution.1 In addition to the severe and long-running abuse of the Pashtun people’s civil and political rights, he also mentioned the abuse of their socio- and economic rights. In particular, he said that communities living in KP do not receive adequate access to water, energy and state revenues therefrom. Police documents, however, accuse Pashteen of rejecting Pakistan’s constitution and using “insulting language” against the State. - It is understood that after each and every peaceful gathering of the PTM, of which there have been a number throughout Federally Administered Tribal Areas (FATA) and KP, a First Information Report (a basic document used to report a crime which serves as the first step to launch the criminal investigation process) is issued against Pashteen, however this is the first time he has been arrested pursuant to a FIR.

    ADR (Grand Jirga), Truth, Justice and Reconciliation Commission and peace on the Pakistan -Afghanistan frontier Zia Akhtar 1 Abstract The mechanism for dispute resolution in the Pushton heartlands of Afghanistan and Pakistan is the Jirga which is based on a tribal forum that offers a form of restorative justice. It has an established constitutional role in Afghanistan where it is part of the legislative Assembly, and is responsible for approving laws and ratifying treaties. In the north- west- frontier province of Pakistan (now Khyber Pakhtunkhwa ), the tribes who live on the borderlands also convene a local jirga when settling disputes by mediation. The Pushton tribes live in the Federally Administered Territorial Area (FATA) ,which has been absorbed into the KP province by the 25 th Constitutional Amendment in 2018. This transformation is in the aftermath of the allied US - Pakistani military success in the ‘war on terror’ and the tribes who live in this region fear the encroachment of state institutions that will erode their Code of Paktunwali. The excesses in the war have had a continuing impact on the Pushton population and as the casualties have mounted the Pushton rights organization Pushton Tuhaffaz Movement (PTM) has been formed. This advocates the redress of grievances and protection for their ethnic group as well as accountability. The argument of this paper is that there should be a Truth, Justice and Reconciliation Commission (TJRC) modelled on the Loya or 'Grand' Jirga that will serve as an instrument for healing. The settlement needs to be based upon the Declaration of the Rights of the Indigenous Peoples 2007, that will facilitate peace on both sides of the border.
