Jaffee: The Troubles with Law and Economics THE TROUBLES WITH LAW AND ECONOMICS Leonard 1? Jaffee* In this Article's first Part, the author sets Law and Economics' own devices against its fundamental proposition: In free contractual pursuit of personal wealth, we find the best means of serving nearly all of our legitimate interpersonaland social interests. Using the classic "efficient breach" case as paradigm, Profes- sor Jaffee argues that all contracts cases defy judgment of whether agreement or breach is efficient-that every such case is intractably ambiguous and threatens inefficient or vagrant costs, profits, or demoralization. He offers instead specific performance as the pre- ferred remedy for breach of contract. He argues that neither ex ante nor ex post contractual adjustments-whether toward an agreed remedy like liquidated damages or modification of obliga- tion-sufficiently resolve such cases or stay their threats, since we cannot ever know what is needed to compensate properly.

  • Idioms-And-Expressions.Pdf
Idioms and Expressions by David Holmes A method for learning and remembering idioms and expressions I wrote this model as a teaching device during the time I was working in Bangkok, Thai- land, as a legal editor and language consultant, with one of the Big Four Legal and Tax companies, KPMG (during my afternoon job) after teaching at the university. When I had no legal documents to edit and no individual advising to do (which was quite frequently) I would sit at my desk, (like some old character out of a Charles Dickens’ novel) and prepare language materials to be used for helping professionals who had learned English as a second language—for even up to fifteen years in school—but who were still unable to follow a movie in English, understand the World News on TV, or converse in a colloquial style, because they’d never had a chance to hear and learn com- mon, everyday expressions such as, “It’s a done deal!” or “Drop whatever you’re doing.” Because misunderstandings of such idioms and expressions frequently caused miscom- munication between our management teams and foreign clients, I was asked to try to as- sist. I am happy to be able to share the materials that follow, such as they are, in the hope that they may be of some use and benefit to others. The simple teaching device I used was three-fold: 1. Make a note of an idiom/expression 2. Define and explain it in understandable words (including synonyms.) 3. Give at least three sample sentences to illustrate how the expression is used in context.

NASHVILLE DAILY UNION August 1, 1862 -- February 22, 1863 NASHVILLE DAILY UNION, August 1, 1862, p. 1, c. 7 A Tennessee Union Girl. The Franklin (Tenn.) correspondent of the N. Y. Herald in a recent letter, pays the following graceful tribute to a heroic young lady living in the strongly rebellious town of Franklin, who like the Angel in the rebellion in Heaven "faithful proved amid the faithless." ["] In the midst of the prevailing sentiment of disloyalty a light occasionally comes, like a ray of sunshine, to dispel its dark and gloomy effects. l It is hard, very hard, for young and tender hearts and minds to sever their wishes and hopes from a cause in which friends and kindred are engaged; but occasionally instances are found—pray to Heaven there may be more of them—in which young ladies are willing to repel the popular delusion, although surrounded by a large circle of relatives who were drawn within its vortex.

1 E. L. Grant Watson—THE MAJOR NOVELS & STORIES Where Bonds are Loosed - 1 The Mainland – 5 Deliverance - 10 Shadow and Sunlight – 11 The Desert Horizon – 14 Daimon - 18 The Partners - 24 The Short Stories – ‘Out There’, ‘Gnilgie’, etc WHERE BONDS ARE LOOSED (1914) Based on Grant Watson’s observations of the stockman and medical staff living at the Lock Hospitals on Bernier and Dorre islands, the novel begins in a sweltering corrugated iron roofed hotel at ‘Port Kaimera’, or Carnarvon. John Sherwin, having shown his qualifications when provoked into a bar fight, is made an attractive offer—£3 a week, his own house and a young Solomon islander boy as a cook—to work as an overseer on Kanna [Bernier] Island. Sherwin’s subsequent voyage to Kanna with ‘Pomfrey’, in an old pearling lugger stinking from its earlier cargo of turbot shells and now carrying forty chained, seasick and frightened Aboriginal patients, resembles Bates’s later description of similar events, while a journey by the young research scientist Dr Hicksey—modelled on the real-life government pathologist Dr Steele—mirrors Grant Watson’s experiences with Henrietta and the ‘Shark’. The incumbent medical supervisor, Dr Hubbard, prefers the milieu of Fenton [Dorre] Island, where the female patients and nurses are housed, and stays away for up to six weeks at a time. Sherwin, while it is not part of his job, feels pity for the neglected male patients and tries to alleviate their suffering. Those who can walk are expected, under Sherwin’s rough but unquestioned authority, to help with patient care and labour at building 2 useless roads.
