Their cases were considered as the criminal cases of the warlords or the human rights violators. By the lapse of time and ups and downs of politics in Afghanistan, the war criminals were not indicted by law and as the violators of human rights, they were not sanctioned. Instead, they raised themselves in political arena as the influential leaders, making decisions about the national affairs. At the beginning, the people were very hopeful about bringing the criminals and the human rights violators to justice. In the meantime, the perpetrators, who were accused of violation of human rights, had lost their audacity to challenge the new current, struggling for hearts and minds of the people by changing their policy. Even if the peace efforts do not bear the expected results, they would expose the iceberg of challenges, which currently only the tip is visible. Since the peace efforts implemented so far, such as activities of the Peace Commission, has not been pursued through a peace framework, it has not produced any results. So far, the efforts for peace have been carried out through traditional frameworks such as nationalism, patriotism and ethnic honor. As the conflict in Afghanistan has turned to a strategic conflict, it needs to be settled through consideration of strategic aspects of the conflict and array of the regional, international and the domestic players. Peace is the top necessity in Afghanistan. Beside that, building a democratic and progressive government, a pluralist political system and observing civil freedoms and global shared values are other urgent necessities of the nation. Opposing peace is stupidity, but similarly speaking about peace without a clear framework is stupidity as well as treason. The opposition groups and civil organizations should not blindly blame the government for peace negotiations with the insurgent groups. But instead, they should pressurize the government to present a transparent and clearly‐defined peace plan. Only in this case, the civil organizations would be able to evaluate the peace program with consideration of the mentioned factors. As there is no logic and specific ground for the reasoning of the proponents and oppositions to the negotiations, the government and civil organizations have nothing to say except ineffectual and damaging expressions. The argument that the constitution is the framework for peace talks with the insurgents is so much indefinite notion which cannot be considered significant. If the peace process is to be pursued persistently there should be developed a framework for the peace. Because, at present the talks with the insurgent groups are facing the question: 'peace in what framework?'
