EXECUTIVE SUMMARY In the Fiscal Year 1992 Treasury and Postal Service, and the Department of Defense Appropriations Bills, language was included directing the General Services Administration (GSA), and the Department of Defense (DOD) to conduct an inventory of all real property owned or controlled by the Federal Government in the state of Hawaii. GSA was to conduct the inventory of Federal civilian agencies. DOD was to conduct the inventory of its own properties and submit it to GSA which would submit a complete inventory package to Congress by September 30, 1992. The request for an inventory was prompted principally by the lack of a centralized data base listing and detailing the historic use of Hawaiian lands ceded, set aside, or conveyed since 1898 to the United States Government for use by its agencies for specified public or governmental purposes. A comprehensive, consolidated and verified inventory was considered essential to determine the status of all public lands, ceded, acquired or controlled, in the State of Hawaii.

COMMENCEMENT OF INVENTORY The inventory has been conducted and is reported in two segments, civilian agencies and Department of Defense. Civilian agency inventory. Utilizing the services of two real property experts with experience in Hawaii real property and ceded land issues, GSA commenced its inventory of civilian agency real property on March 3, 1992. Following an introductory briefing with Senator Inouye's staff, the inventory team (team) conducted briefings in Washington, DC, with all agencies having real property holdings in Hawaii, and received from them, all available documentation that would support the on-site effort. On March 23, 1992, the team established an office in the Federal Building in Honolulu, Hawaii, and commenced its on-site inventory. Entrance briefings were held with Senator Inouye's staff and appropriate Federal and State officials. On May 29, 1992, the team concluded the on-site data gathering portion of the civilian agency inventory. The report consists of inventory data for each Federal civilian agency and accompanying narrative. It contains such data elements as have been agreed to by GSA and Senator Inouye's staff. Department of Defense Inventory. The DOD portion of the inventory commenced in October 1992 with a notice to proceed to the successful contractor, Charles Blackard and Associates, under Contract No. DACA83-92-R-0037. The completed inventory was delivered to the contracting officer on February 1, 1993.

- 1 - SCOPE OF THE INVENTORY The scope of the civilian agency portion of the inventory was determined through several meetings with Senator Inouye's staff and evolved further after the team began its on-sight inventory. It became apparent that existing civilian agency data (summary and on-site) and mapping would not support the inventory depth initially sought. This is not to say that civilian agency record keeping is not accurate or maintained in accordance with acceptable records management. Rather, it is the diverse nature of the data, the decentralization of record keeping, and data archiving that makes any data retrieval task extremely labor intensive, and sometimes impossible. This problem was further exacerbated in Hawaii due to the lack of central title information. The ultimate agreed upon scope varies somewhat between civilian agencies and is reflected in the format for each agency. Basically however, each civilian agency's real property holdings in Hawaii are addressed in narrative form for acquired property (including ceded lands), and in spread sheet form for leased or lesser interests in real property. Because of time constraints and sheer volume of United States Postal Service properties, they are listed by address and reflect owned or leased status only. The scope of the DOD portion of the inventory follows the statement of Work provided for in the contract, and is noticeably more detailed than the civilian agency portion of the inventory. This is due primarily to the existence of detailed DOD records and mapping, the historical emphasis on DOD real property in Hawaii, and previous DOD inventories directed to ceded lands.

There are several facilities in Hawaii that are occupied by the various Bureaus of the United States Department of Agriculture. one facility, a 4.2 acre agriculture experimental station on the island of Maui formerly operated by the Cooperative State Research Service and set aside by a Governor's Executive Order in 1931, is in the process of being excessed by the Department of Agriculture. Pursuant to Public Law 88-233, the site will be reconveyed to the State of Hawaii when the Administrator of GSA determines it to be surplus property (Public Law 88-233). The remaining properties currently under control of the various Bureaus within the Department of Agriculture are discussed in the following paragraphs. Agricultural Research Service The Agricultural Research Service (ARS) currently occupies federally owned facilities at four locations in Hawaii for the Tropical Fruit and Vegetable Research Program and one location of the National Clonal Germplasm Repository. At four of these locations the federally owned facilities are in the custody of ARS while the land is provided by the University of Hawaii at no cost to the Government (Hilo, two sites, Honolulu and Kapaa, Hawaii). At the fifth site, the federally owned buildings are in the custody of ARS while the federally owned land is provided by the Department of Defense, U.S. Navy at the Barking Sands Naval Base, Kekaha, Hawaii.

- 5 - ARS occupies off ice/laboratory space at two additional worksites-the Sugarcane Physiology Research, Aiea, and Tropical Aquaculture Research, Kanehoe, Hawaii. The office/laboratory space for both research programs is provided at no cost to the Government. On the island of Hawaii, ARS occupies two locations at the Waiakea Branch Agricultural Experiment Station, University of Hawaii. The Tropical Fruit and Vegetable Research Laboratory (TFVRL) occupies 2.1 acres of land under a long-term lease agreement with the University. The nine buildings at the site are federally owned and maintained by ARS. The lease agreement, which terminates September 18, 2010, contains a 25-year renewal option at the request of the Government. Upon the termination of the lease agreement, all improvements may be conveyed to the University upon payment of their depreciated value. If the University elects not to acquire the improvements, the Government is obligated to remove them within 2 years after termination. The National Clonal Germplasm Repository for Tropical Fruits and Nuts occupies a separate 0.4 acre parcel of land at the Waiakea Branch Agricultural Experiment Station, Hilo. The facilities are federally owned and maintained by ARS. The terms and conditions of this lease agreement, which expires September 19, 2010, are the same as the TFVRL site. On the island of Oahu, the TFVRL occupies approximately one acre of land at the Manoa Campus, University of Hawaii, Honolulu, Hawaii, under a Revocable Permit. This Permit was

- 6 - recently extended to June 8, 1997, under the condition that ARS relocate the research program and vacate the premises as soon as possible. The eight buildings, totalling 16,765 sq. ft., are federally owned. Under terms of the Permit, these improvements will convey to the University upon payment of the depreciated value when ARS vacates the premises. Improvements not acquired by the University must be removed by ARS. The TFVRL site on the island of , is located at the Kauai Branch Experiment Station, Kapaa, Hawaii. ARS occupies 3.8 acres of University-owned land under a lease agreement which expires December 31, 1997. The improvements at this site are federally owned and maintained except for janitorial services which are provided by the University for a fee of $1,440 per year. Upon termination of this lease, the buildings may be sold to the University at the depreciated value or removed by ARS. The federally owned mobile homes at this site will be removed. Also on the island of Kauai, the U.S. Navy has constructed three buildings, totaling 2,800 sq. ft., with ARS funds for the TFVRL location at the Barking sands Naval Base, Kekaha, Hawaii. ARS occupies this Department of Defense controlled land under a Land Use Agreement with the U.S. Navy. The U.S. Navy provides maintenance for the facilities with ARS reimbursing the Navy of part of the maintenance cost. The two remaining ARS research programs in Hawaii are located on the island of Oahu. The Sugarcane Physiology Research Program, Aiea, Hawaii, occupies office and laboratory space provided by the Hawaii Sugar Planters Association. The

- 7 - space is provided at no cost to the Government. The Tropical Aquaculture Research Program at Kanehoe, Hawaii, occupies office and laboratory space provided by the Hawaii Sugar Planters Association. The space is provided at no cost to the Government. The Tropical Aquaculture Research Program at Kanehoe, Hawaii, occupies office and laboratory spaced provided by Hawaii Institute of Marine Biology. This space is also provided at no cost to the Government. Farmers Home Administration The Farmers Home Administration occupies general purpose office space on the islands of Kauai, Maui, Hawaii and Molokai. All spaces except that located on Molokai are provided by GSA. The Farmers Home Administration has a five-year lease expiring September 30, 1996, with the Molokai Center for a 647 square foot office at an annual rental of $15,621. Farmers Home Administration pays rent to GSA for space on the other islands. United States Forest Service The United States Forest Service has two locations in Hawaii. One is a laboratory facility containing approximately 4,500 square feet located at 1150 Punchbowl Street, Honolulu, Hawaii. The State Division of Lands and Natural Resources provides the facility at no cost to the Federal government pursuant to the terms and conditions contained in a revocable Master Memorandum of Understanding between the State of Hawaii and the United States Department of Agriculture executed June

27, 1958, and remaining in force until revoked by either party upon giving 60 days written notl ce to the other. The second

- q - facility consists of a 15 acre tract on the island of Hawaii occupied under the terms and conditions of a no-cost, revocable permit from the State of Hawaii, Department of Lands and Natural Resources. This permit was executed May 23, 1975. The site is used for a forest research purposes. Animal and Plant Health Inspection Service The Animal and Plant Health Inspection Service operates two facilities on Oahu. One is the Animal Quarantine Facility located on a 9.1 acre tract permitted from the United States Coast Guard. The improvements are owned and maintained by the Department of Agriculture. The permit expires December 31, 1997. The other facility is the Hawaii Sterile Fruit Fly Rearing Facility at Waimanalo under a cooperative agreement with the University of Hawaii. The agreement commenced in 1983, and expires in 2032, the same date that the University of Hawaii's lease from the Damon Estate expires. Improvements constructed by the Department of Agriculture at an approximate cost of $8 million are maintained by that agency on the lands (a minimum of four acres) provided by the University of Hawaii. Animal Damage Control Facility There is also an Animal Damage Control Facility at Hilo, Hawaii, operated by the Denver Wildlife Research in a 2,791 square foot building leased from the Hawaiian sugar Planters Association at a current rental of $13,889 per year. The lease runs from June, 1989, through May, 1999.

- 9 - Soil Conservation Service The Soil Conservation Service currently leases off ice space at four separate locations in Hawaii from private parties. The locations are Pahola, Hamuela, Papaaloa on the island of Hawaii, and the center in Honolulu on Oahu island. In each case, the agency is paying fair market rental value. The total administrative space occupied is 3,736 square feet and the total initial rental was $69,864. The size of the space ranges from 540 square feet to 1,140 square feet. The leases were obtained by the agency with GSA consent. The Soil Conservation Service also operates a Plant Material Center on 81.2 acres of land leased for 25 years (January 1, 1973 through December 31, 1998) from the State of Hawaii at no monetary rental payment. The Service funded and constructed three buildings containing a total of 3,356 square feet on the premises at a cost of approximately $120,800. In addition, support facilities costing $43,700 were also added. The constructed facilities may be removed by the government at the expiration of the lease. The site is located on the island of Molokai. The lands were Hawaiian homelands conveyed to the state of Hawaii in exchange for other state owned lands.

- 10 - Department of Commerce

The United States owns four sites in Hawaii that are administered by the Department of Commerce. Pacific Tsunami Warning System Site The largest of these sites is the Pacific Tsunami Warning System Site located at Ewa Beach on the island of Oahu near Honolulu. The site is 175 acres in size and was originally acquired by the Department of Navy through condemnation proceedings in 1944. The site was transferred to the Department of Commerce in 1959. Approximately ten acres are occupied by improvements and the balance is retained as buffer space for electronic noise interference reduction. Southwest Fishery Center The Southwest Fishery Center, located on 2.2 acres of land located at 2570 Dole Street in Honolulu, was conveyed to the United States in 1950 by Territorial Deed Number 10227. The land was acquired by the Territory from the Bishop Estate through condemnation proceedings. The United States has constructed 23,000 square feet of improvements at an approximate cost of $400,000. These improvements are operated and maintained by the United States. The facility has always been operated as a laboratory facility for fishery research and development, and if not so used, the land reverts to the grantor pursuant to the terms and conditions contained in the deed.

- 11 - Ionosphere Sounding Station The Ionosphere Sounding Station located at Kihei, Maui Island, Hawaii, is situated on a 1.13 acre site, being a portion of a larger site purchased by the United States in 1956 for the sum of $8,500. In 1974, 3.75 acres were reported excess to GSA for disposal. The remaining area of 1.13 acres supports the sounding facilities which are operated and maintained by the Department of Commerce under a contract funded by the Air Force. Mauna Loa Observatory The Mauna Loa Observatory is located on a 4.05 acre parcel of ceded land set aside by Governor's Executive Order 1720 dated January 28, 1956 for use by the United States Weather Bureau station. It is still used for the purposes stated in the Executive Order. on October 8, 1985, the government obtained a 23.13 lava barrier easement from the State of Hawaii at no cost. The barrier, constructed and maintained by the United States, protects the observatory. When abandoned, the lands will revert to the State of Hawaii. In addition to the facilities discussed above, the Department of Commerce utilizes several facilities acquired from Federal and State agencies by lease, permit or license. Some of the facilities have been provided by the State Division of Aviation at no cost to the Federal government because a technical function in support of aviation, i.e., aviation weather reporting service, is performed by Commerce. 14 Department of Justice

Immigration and Naturalization Service

The Department of Justice, United States Immigration and

Naturalization Service (INS), currently controls 3.1416 acres of

land ceded to the United States for naval purposes.

Seven acres of land were originally set aside in 1898 and

1899 for naval reservation purposes by Presidential Proclamation.

By Act of Congress dated March 3, 1903, Congress appropriated $30 thousand " ... for the complete establishment of an immigration station and the erection of necessary buildings at Honolulu,

Hawaii, on land owned by the United States adjoining wharf known as Channel Wharf •.. " on January 8, 1904, the secretary of Navy transferred the 7 acres originally set aside for naval reservation purposes to the Treasury Department (INS) to accommodate the new immigration station. A portion of the 7 acres was later retransferred to the War Department.

on December 20, 1939, the Secretary of War transferred a small portion of the site to the Department of Labor (INS). On

September 1, 1953, the State ceded to INS 1.18 acres in exchange for 1.18 acres needed for harbor purposes (Executive Order No.

1576, September 1, 1953). On December 3, 1962, 951 square feet of the site was deeded by the State of Hawaii to the United

States, and subsequently returned to the State of Hawaii by deed of October 31, 1981.

The net effect of the cessions and transfers hereinbefore discussed is that INS currently occupies 3.1416 acres of land ceeded to the United States for naval purposes.

- 15 - Drug Enforcement Administration

The Drug Enforcement Administration of the Department of

Justice currently occupies approximately 0.32 acres of land at the Keaukaha Military Reservation on Hilo, Hawaii, under a use permit granted by the Hawaii Department of Defense. The permit was effective October 1, 1988 and is renewable annually by the parties and revocable at will by the State of Hawaii. The Drug

Enforcement Administration has constructed a hangar building on the facility. Approximately 8800 square feet of the property is used to park and store two helicopters.

- 16 - Department of Labor

Federal property under the Department of Labor consists entirely of three leased facilities which provide Job Corps training opportunities to the citizens of Hawaii. A Description of the leased facilities follows:

I. Hawaii Job Corps Center (KoKo Head Park), Honolulu, Oahu Lease: 19.476 Acres Contract No.: 99-6-4511-14-004-06 Owner: City & County of Honolulu Department of Parks & Recreation Term: Successive 1 year terms, beginning January 1, 1986 extending through December 31, 1993. Rental: $5 for the full term, including all renewals. If student enrollment falls below 50\ of Hawaii residents, rent will be increased to current appraised fair market value. The Federal Government pays all utilities, maintenance and operation costs. This lease will be terminated upon completion of construction of a new Job Corps Center currently at another location. II. Hawaii Job Corps Center, Hihimanu Street, Waiwaualo, Honolulu, Oahu. Lease: 12.4 acres contract No.: 99-1-4932-14-007-06 Owner: State of Hawaii Board of Land & Natural Resources Term: Successive 65 one year terms beginning September 1, 1991. Rental: $7,400 per annum, which is 20\ of the annual fair market rental which will be transferred to the Off ice of Hawaiian Affairs. The Federal Government will construct a new building within 3 years at a cost of not less then $1,000,000. The Federal Government pays all maintenance, operation, and utility costs.

- 17 - III. Maui Job Corps Center, Makawao, Maui

Lease: 12.0 acres Owner: County of Maui, Maui Island Term: successive 50-one year terms beginning September 1, 1985 Rental: $10 for full term, including all renewals. The Federal Government may terminate at anytime upon 90 day notice. Maui may terminate anytime after December 1994 upon 90 day notice. The Federal Government pays all alterations, maintenance, repair, operation and utility costs.

National Park Service The National Park Service administers lands owned or controlled by the United States and lying within the established boundaries of six national parks or historic sites in the State of Hawaii. Federal laws established the parks' boundaries and contain the authority for and limitations on the acquisition of land. Not all lands within the boundaries of the parks are owned or controlled by the United States, and those lands that are so owned, are composed of ceded lands, lands acquired by the Territory or State of Hawaii and transferred to the United States, lands purchased from private parties by the United States, and lands donated to the United States by private parties. It is appropriate to discuss the various terms used in describing the lands discussed herein. "Ceded lands" are lands ceded in fee simple absolute to the United States of America by the Republic of Hawaii upon annexation in 1898, or private lands acquired by the Territory in exchange for ceded lands unless such exchange was pursuant to the Act of February 27, 1920 as amended and herein after discussed. "Acquired lands donated by the Territory or State of Hawaii" are composed of two types of land: (1). Private property acquired by the Territory in exchange for ceded land pursuant to the authority of the Act of Congress approved February 27, 1920, as amended. This act authorized the Governor of the Territory

- 19 - of Hawaii to acquire, at the expense of the Territory, by exchange or otherwise, all privately owned lands within the national park boundaries. Section 2 of this act stated, "that the provisions of Section 73 of an act entitled, •an act to provide a government for the Territory of Hawaii,' approved April 30, 1900 as amended by an act approved May 27, 1910, relating to exchange of public lands, shall not apply in the acquisition, by exchange, of the privately owned lands herein referred to." and (2). Those privately owned lands acquired by the Territory or state by purchase, donation, or condemnation. Most of the ceded lands and all of the properties acquired by the Territory or State of Hawaii from private owners were transferred to the United States by deed. Since the United states already had title to ceded lands, the deeds of conveyance from the Territory describing ceded lands are considered to have

relinquished the Territorial right of ~he use, possession and control to the United States. The necessity for such conveyance is questionable, and on July 12, 1952, the Commissioner of Public Lands informed the Superintendent of Hawaii National Park that the Attorney General had advised that, "All lands falling within the perimeter boundaries fixed by Public Law Number 680, that had the status of "ceded" lands on June 20, 1938 (the date of the passage of said act), are now a part and parcel of the Hawaii National Park, and no further action need be taken by the land off ice or by the Governor to perfect the vesting of title to the same in the United States."

- 20 - The Attorney General further opined that when the Act

(Public Law No. 680) was passed by Congress, the possession, use and control (held by Territory pursuant to section 91 of the

Organic Act) were reunited with their title in the United

States.

- 21 - Haleakala National Park

The Haleakala National Park was established as a separate park by an act of Congress approved September 13, 1960, (74 stat

881). Originally the park was part of the Hawaii National Park established by an act of Congress approved August 1, 1916.

Subsequent to the establishment of the park, several boundary changes were authorized by various acts of Congress, and according to National Park Service records, the Haleakala

National Park now contains a total of 28,655.25 acres, 174.32 acres of state-owned land, and 1004.43 acres of privately owned land which have not yet been acquired by the United States.

In the following summary, those lands identified as acquired lands donated to the United States by the Territory or State, and amounting to 11,609 acres were all acquired by the Territory of Hawaii in exchange for ceded lands pursuant to the authority contained in the Act of February 27, 1920.

- 2 ) - HAWAII VOLCANOES NATIONAL PARK

The Hawaii Volcanoes National Park was initially authorized as a part of the Hawaii National Park by the Act of Congress approved August 1, 1916. Subsequent Acts of Congress have amended the initial Act and expanded the boundaries. By Act of September 22, 1961, the name of the park was changed to the Hawaii Volcanoes National Park. The park as now authorized is the largest national park in the State of Hawaii and contains an area of 229,173.03 acres. Four acres of State owned land and 11,874.983 acres of private lands are not yet acquired. The Secretary of the Interior has permitted the Department of the Army to utilize an area of 54.6 acres within the Hawaii Volcanoes National Park. The present permit expires August 31, 1996. In addition to the permitted lands, the Army has acquired five tenths of an acre in fee by condemnation; a license for 12.35 acres; and a road easement of 4.23 acres, all from the Bishop estate. This in-holding encompasses a gross area of 71.68 acres known as the Kilauea Military Camp. It is operated by the Army as an Armed Forces recreation center. The 54.6 acre permit is the only out-grant from the National Park Service. Easements, permits or licenses for public utilities and roads are not considered out-grants for the purposes of this report, nor are concessions operated under agreements with the National Park Service. - 25 - Kalaupapa National Historic Park

The Kalaupapa National Historic Park, authorized by Public

Law 96-565 in December of 1980, contains a total area of

10,778.88 acres. 1,684 acres of state land (including 60 acres

of submerged lands), 1,247 acres of Hawaiian homelands, and 72

acres of privately owned lands have not been acquired. 22.88

acres of land owned by the United States are ceded lands set

aside by Presidential Executive Order No. 692 in 1908 (21.6

acres) (corrected and amended by Presidential Order Number 8000

in 1938 to 22.8 acres), for lighthouse purposes as the Molokai

Lighthouse Reservation. In 1974, the United States Coast Guard reported 22.13 acres excess to its needs to GSA which in turn transferred the property to the National Park Service in 1981.

The Coast Guard retained .75 acres for the lighthouse site. It should be noted that national park lands are excluded from the operation of the Conveyances Act of 1963, which requires ceded lands no longer needed by the United States to be reconveyed to the State of Hawaii.

Kaloko-Honokohau National Historic Park

The Kaloko-Honokohau National Historic Park established by

an Act of Congress approved November 10, 1978, contains a gross

area of 1,160.91 acres. 615.9 acres have been purchased by the

United States from private interests. 544.48 acres have not

been acquired and consist of 518.83 acres owned by the State of

Hawaii and 26.18 acres owned by private interests.

- 27 - Puuhonua O Honaunau National Historic Park

The Puuhonua o Honaunau National Historic Park (known as the City of Refuge National Historic Park until 1978) authorized by the Act of July 21, 1955, (69 stat 376) contains a gross area of

181.8 acres transferred to the United States by the State of

Hawaii. None of these lands are ceded lands. 164.42 acres were acquired by the State from the Bishop Estate with the provision that the State reconvey them to the United States for park purposes. The balance of the lands were acquired from private parties by state condemnation actions commenced after Hawaii became a state.

Puukohola Heiau National Historic Site

The Puukohola Heiau National Historic Site was authorized by the Act of August 17, 1972 (86 stat 562) and contains a gross area of 80.47 acres. 34.38 acres were donated to the United

States by Queens Medical. The balance of the lands have not been acquired and are owned as follows: State of Hawaii, 22.88 acres (including 6.7 acres of submerged lands) and 20.80 acres of privately owned lands. The County and State of Hawaii also own 2.41 acres of rights of way.

National Park Service inventory. However, the inventory in three instances does not agree with the acreages cited in the deeds. At Haleakala National Park, State Land Patent Number s- 14195 cites an acreage of 5,724.039 acres and the National Park

Service inventory cites an area of 6,279.34 acres, a difference

555.301 acres. State of Hawaii Deed Number 74-24997 cites an area of 1.238 acres and the National Park Services inventory cites an area of 1.21 acres, a minor difference of 0.028 acres.

The other variance is at Hawaii Volcanoes National Park State. state Deed Number S-1775 cites an area of 370.3 acres and the

National Park Service inventory cites 299 acres. These variances in acreage have been called to the attention of the

Park Service.

Federal Fish and Wildlife Service

The Secretary of the Interior is authorized to establish National Wildlife Refuges by the Endangered Species Act of 1973, as amended, and by the several National Wildlife Refuge Acts passed by Congress on various dates. Eight refuges have been established in Hawaii pursuant to these authorities for the purpose of protecting and enhancing endangered species of wildlife and Native Hawaiian flora and fauna. Additionally, two refuges originally reserved and set apart in 1909 and 1926 for management by the Department of Agriculture are now managed by the Department of Interior.

HAWAIIAN NATIONAL WILDLIFE REFUGE The Federal Fish and Wildlife Service manages 254,418 acres of land and water in the extreme western extension of the Hawaiian archipelago. It was originally reserved and set apart for the use of the Department of Agriculture as a preserve and breeding ground for native birds by Presidential Executive Order Number 1019, February 3, 1909.

JOHNSTON ATOLL NATIONAL WILDLIFE REFUGE On June 29, 1926, Presidential Executive Order Number 4467, reserved and set apart two small islands and surrounding water (approximately 100 acres), known as Johnston Island and Sand Island for use by the Department of Agriculture as a refuge and breeding ground for native birds. Although not part of the State of Hawaii, it is grouped with the Hawaii refuges for administrative management purposes.

- 30 - Hakalalu National Wildlife Refuge

The Hakalalu National Wildlife Refuge located on the Island of Hawaii presently contains an area of 15,455.64 acres owned in fee and 25.32 acres in Facilitation and Conservation Easements for a gross area of 15,480.96 acres. The government is in the process of acquiring an additional 15,716 acres from the World

Union of Hong Kong. A complaint in condemnation was filed

December 5, 1989 and settlement negotiations are currently under way. All acquired lands have been obtained from private parties by direct purchase as detailed in the following chart.

The Kilauea Point National Wildlife Refuge is located on the island of

Kauai and contains an area of 187.50 acres. 34.75 acres (31 acres in fee

- 37 - Pearl Harbor National Wildlife Refuge

The Pearl Harbor National Wildlife Refuge is located on the island of Oahu and is situated on a portion of the lands assigned to the Navy. On October 17, 1972, the Navy permitted

61.15 acres to the Federal Fish and Wildlife Service for use as a National Wildlife Refuge area. This permit will be addressed in the DOD portion of the inventory.

- J 8 - Kealia Pond National Wildlife Refuge

The Kealia Pond National Wildlife Refuge, located on the island of Maui, is a recent acquisition by the United States. A conservation easement on 437 acres was acquired by condemnation proceedings filed on August 27, 1986. A monetary settlement of

$6.9 million was recently reached with the defendants, Alexander and Baldwin. Defendants Alexander and Baldwin also donated a conservation easement on an additional 253 acres.

- 39 - Kapahulu Avenue, Honolulu Hawaii

A small administrative site containing approximately 0.23 acres is utilized by the Fish and Wildlife Service. The land was acquired in 1911 by condemnation for use by the Army. In

1967 the site was reported excess to GSA and transferred to the

Wildlife Service by that agency in 1968. The site on Kapahulu

Avenue in Honolulu continues to be used for storage purposes.

U.S. Coast Guard Federal real property under the jurisdiction of the Coast Guard in Hawaii consists of 49 Federally owned installations, and 55 owned facilities situated at sites where the use of the underlying land is by a lesser interest in real property, i.e., easement, lease, license, permit or navigation servitude. In addition the Coast Guard has two other installations situated on Department of the Navy land, one at Barbers Point Naval Air Station and one at Naval Radio Station Lualualei. The installations/facilities are scattered throughout the Hawaiian Islands and for the purposes of this report are broadly categorized as Coast Guard owned Lighthouse Operational and Family Housing sites and Coast Guard owned Facilities located on lesser interest land. A list of the 55 lesser interest properties by location only is attached. All of these facilities are required to be located where they are to serve the public purpose. None occupy any more land area than absolutely necessary to accommodate each specific facility, together with access thereto. In every case, should the public need for a facility cease, the underlying fee owner would immediately regain unencumbered title due to the nature of the limited interest held by the United States. Also, a list of the 39 Coast Guard owned sites originally acquired for Lighthouse purposes and still serving the same function is attached. The fee simple acreage only is shown at

However, most have right-of-way easements appurtenant for access, utilities, etc. A brief individual description of the other 12 coast Guard Operations and Family Housing installations follows (10 Coast Guard owned and 2 on other federally owned lands): (1) Base Pier 4 This installation is located in Honolulu, Oahu on Ala Moana Blvd. adjacent to the U.S. Federal Building and consists of approximately 0.70 acres of ceded land, including some submerged land, improved with a wharf and pier structure facility constructed by the United States. The U.S. originally acquired the property by Presidential Proclamation in 1898 as part of a Naval reservation. It was transferred to the Department of Commerce by Presidential Executive Order No. 2381 dated May 11, 1916. It has been used continuously for lighthouse and exercise of navigational jurisdiction purposes and is owned by the Coast Guard as successor functional agency. All maintenance, operation and utility costs are paid by the United States. (2) Station Omega This installation is located just west of Kaneohe, Oahu adjoining the Waiahole Forest Reserve and comprises 698.172 acres consisting of 196.022 acres fee simple (including 28.8 acres ceded land) and 502.150 acres easement. It was originally known as Haiku Naval Radio Station. In 1944 the United States Navy acquired 125 acres of Privately owned land by condemnations, Civil No. 540 filed October 30, 1944 and

- 44 - the 28.8 acres of ceded land by Governor's Executive Order 1058, dated March 14, 1944, and began construction of the radio

facility. Subsequently, 40.958 acres fee and 498.842 acres easement was conveyed to the United States by deed from the City and County of Honolulu in June 1962. The property was determined excess to the needs of the Navy and proposed for transfer to the

U.S. Coast Guard by Disposal Report No. 411 approved by the Armed

Services Committees of Congress on June 14, 1973. The property was formally transferred to the Coast Guard on November 5, 1973, and the radio facility has been continuously operated by it since that time. This facility is part of a worldwide multi-nation radio operation and will ultimately transition into a satellite operation. However, this probably will not occur before 2002.

Additionally, 9.1 acres of the fee land has been outleased at no cost to the Department of Agriculture since December 3,

1969, for an Animal Holding Facility.

(3) Upolu Point

This installation is situated at Upolu Point, North Kohola,

Hawaii, and comprises 92.689 acres of fee owned land under jurisdiction of the Coast Guard. 68.9 acres of privately owned land was acquired by condemnation, Civil No. 2771, filed November

16, 1967. The remaining land was subsequently acquired by fee simple purchase from private parties. It has been continuously used as a Loran Station which use is now being phased out. The

Coast Guard is currently assessing future uses of the land including possible use for construction of family housing.

- 45 - (4) Base Honolulu - Sand Island This installation is situated in Honolulu on a pennisula known as Sand Island in Honolulu harbor. It comprises 40.76 acres of ceded land and is the main Coast Guard marine operating base in Hawaii. The United States first acquired title to this property by Act of Congress, July 7, 1898, which provided for ceding absolute fee and transfer of public property, specifically "ports, harbors", this property being submerged lands at that time. The property was later filled by dredge material from the enlargement of Honolulu Harbor. Quitclaim deeds obtained in 1902 as a result of litigation by private parties further perfected title in the United States. After enactment of the Organic Act April 30, 1900, and in accordance with the provisions thereof, Presidential Executive Order No. 3358, dated 24 November 1920, set aside 193 acres of Sand and Quarantine Islands for "military purposes". Subsequently, by a series of transfers beginning with Presidential Executive Order No. 6584, dated February 6, 1934, transferring 4.47 acres to the Commerce Department, predecessor agency, and Presidential Executive Order No. 8527, dated August 27, 1940, transferring 4.079 acres to the Treasury department for "Coast Guard purposes", the entire installation as it now exists was transferred to the Treasury Department for U.S. Coast Guard purposes. The property has been in continuous use by the U.S. Coast Guard and all maintenance, operation and utility costs are paid by the United States.

- 46 - (5) Family Quarters Kia Kai Hale - Red Hill This installation is situated at Halawa, Honolulu, Oahu straddling Route H-1 at an area known as Red Hill. It comprises 79.946 acres of fee owned land under jurisdiction of the U.S. Coast Guard. 66.8 acres of this site is improved with 284 units of family housing for Coast Guard personnel and the remainder of the site is proposed for construction of family housing support facilities. The property was originally a portion of land acquired by the U.S. Navy by condemnation assembly filed February 14, 1941, Civil No. 442. It was transferred to the Coast Guard in two transactions; 66.828 acres by formal transfer dated March 12, 1965, and the remainder by formal transfer on February 15, 1968. All maintenance, operation and utility costs are paid by the United States. (6) Family Quarters Wailupe, Oahu This installation consists of 3.20 acres of fee owned land under jurisdiction of the Coast Guard situated on the north side of Kalanianole Highway, at Waialae-Iki, Honolulu, Oahu. The property was acquired in fee simple by the United States (Navy) by deed dated October 20, 1920. It was originally known as Wailupe Navy Radio Station and used by the Navy until transfer to the Coast Guard. It was formally transferred to the Coast Guard on March 14, 1947; is improved with 6 units of family housing; and has been continuously used for assignment to Coast Guard personnel and their dependents. The United States pays all maintenance, operation and utility costs.

- 47 - (7) Diamond Head Light and Family Quarters

This installation is located at the tip of Diamond Head and

consists of 2.19 acres of ceded land under jurisdiction of the U.S. Coast Guard as successor functional agency.

Approximately 2 acres of the property was first set aside

for military purposes as part of Fort Ruger by Presidential

Executive Orders dated January 18, 1906, and July 1, 1909. It was transferred by Presidential Executive Order No. 1261 dated October 31, 1910, to the Department of Commerce and Labor and set

aside for lighthouse reservation purposes. An additional 0.19

acres was added to the site by Presidential Executive Order No.

4686, July 11, 1927.

The Property has since been continuously used for lighthouse and family quarters purposes and the quarters are occupied by the

senior Coast Guard Flag Officer.

(8) Family Quarters, Koloa, Kauai

This installation is located in a subdivision known as Lawai

Valley Estates, Koloa, Kauai, and contains 1.075 acres of fee simple owned land. It was privately owned and purchased by the

Unites states (U.S. coast Guard) by deed dated March 6, 1972. It

is improved with 6 family housing units which are assigned to

Coast Guard personnel and their dependents. All maintenance, operation and utility costs are paid by the United States.

This installation is located in the Mariners View

Subdivision, South Hilo, Hawaii, and comprises 1.008 acres of fee simple land. It was purchased by the United Stated (U.S. Coast

Guard) from private parties by deed dated February 24, 1975.

It is improved with 5 family housing units which are assigned to Coast Guard personnel and their dependents. All maintenance, operation, and utility costs are paid by the United

States.

(10) Family Quarters - Maui

This installation is located at Wailuku, Maui, and consists of 1.033 acres of fee simple, formerly privately owned land, purchased by the United States (U.S. Coast Guard) by deed dated

May 14, 1975.

It is improved with 6 family dwelling units which are assigned to Coast Guard personnel and their dependents. All maintenance, operation, and utility costs are paid by the United

States.

OPERATIONS FACILITIES LOCATED ON OTHER FEDERAL ENCLAVES

The following two Coast Guard installations are situated on land under jurisdiction of the Department of the Navy and occupied under provisions of Use Permits and Agreements.

- 49 - A) Air Station Barbers Point, Oahu The Coast Guard occupies 47.965 acres under Permit at this installation for use as its principal air operations base. The land area is owned in fee simple by the United States, acquired by the Navy by condemnation, Civil No. 432, filed in the U.S. District court, Hawaii.

B) Communications Station - Wahiawa, Oahu The Coast Guard jointly occupies building space and other facilities for its area radio transmitting and receiving station. The property is under jurisdiction of the U.S. Navy and known as the Naval Communication Area Master Station, EASTPAC and the Radio Transmitting Facility, Lualualei.

Federal Aviation Administration

The United States owns or controls several hundred acres of land in the State of Hawaii that are administered by the Federal

Aviation Administration (FAA). A large number of parcels are leased from various private parties including Hawaiian Homelands and from the State of Hawaii. All of the leased lands support facilities on the , the navigational approach facilities to the airports, or the enroute air navigation facilities. There are numerous "no cost" leases from the State of Hawaii. However, the various acts of Congress authorizing the expenditure of millions of dollars for airport improvements require the State to provide the real estate upon which technical facilities are constructed, operated and maintained by the Federal government, free of cost to the United States. In some instances the FAA leases lands directly from private parties, sometimes paying fair market rent or receiving the lease as a donation, or at a nominal rent in other cases. Administrative space (nontechnical) at airports is usually leased from the State at a fair market rental rate. The leases, licenses, and permits are listed together with pertinent information in the tabulation at the end of this section.

The lands owned in fee by the United States and administered by the FAA consist of lands ceded or set aside by the Territory

of Hawaii and those lands acquired by the United states and

currently administered by the FAA. The ceded lands were all set

- 59 - aside by Governor's Executive Orders for use by the Civil

Aeronautics Administration, the predecessor to the FAA, and

consist of 8.508 acres for sites and 7.386 acres for road or

utility easements. The present uses of the lands by the FAA are

all considered to be in conformity with the original purposes and

intent of the cession orders. However, technological changes may

have occurred, e.g. lands set aside for a low frequency radio

range site now support a variable omni-range facility for Vortac,

the technical successor to the low frequency radio range

navigation facilities. A list of the Governor's Executive Orders

follow:

- E.O. 1271 dated November 10, 1948 set aside 4.442 acres of

ceded lands at Hilo, Hawaii. 3.912 acres were for a road right­

of-way to the 0.53 acres set aside for the range site.

- E.O. 1858 dated September 2, 1958, set aside 0.018 acres

as an addition to the aforementioned range site. The expanded

site is used as a Vortak (radio navigational facility) which use

conforms to the original purpose of the set asides.

- E.O. 1808 dated October 30, 1957, set aside 2.96 acres on

the Island of Maui as the Peripheral High Site (communications

facility), 1.084 acres for access road, and 0.15 acres for

utility easement.

- E.O. 1413 dated January 22, 1951, set aside 1.6 acres on

the Island of Maui as a communications repeater site.

E.O. 1832 dated April 11, 1958, set aside ceded lands

consisting of a 3.4 acre site and 2.24 acres of supporting road

and utility easements to be used for all legitimate purposes of

- 60 - the CAA. This facility is presently used as a Combined Center

Radar Approach Control Facility.

The FAA has acquired two sites in fee, (one on Hawaii and one on Molokai) and one clear zone easement (on Molokai) from private parties by deed recorded in book 17373, pages 792 to 797. The u. s. purchased a 4.9 acre site on Hawaii in September of 1983 for the sum of $73,410. It supports various communications and navigation facilities. On Molokai, a 0.331 acre fee site and a 58.77 acre clear zone easement were purchased from Molokai

Ranch Company by deeds dated December 23, 1991 to support the

Vortac. The consideration was $668,000.

In addition to the land ceded to the United States by the

Territory of Hawaii and those lands purchased from private parties by the United States, 230.9 acres of land, originally acquired by the United States through condemnation for use by the

Navy, were transferred to the FAA pursuant to the authority contained in the International Aviation Act (49 u.s.c. 1156 and

1157) of 1964.

There are several out-grants (leases, licenses and permits)

on facilities administered by the FAA. Except as noted below,

all out-grants are to Federal, state or local governmental

agencies, or to utility companies at no cost to the user except

for reimbursement of "fair share" maintenance cost. All uses

authorized by the out-grants are compatible with the primary uses

of the FAA. Examples include joint use of roads, antenna towers,

20 square feet of building in which to place a communications

radio, etc. These out-grants are not considered significant

- 61 - enough to separately list. However, they have been examined and are in the office files of the FAA. The exception mentioned above is a license to Puuloa Homes to use 14.1 acres of acquired lands at Ewa for a golf course. Puuloa Homes pays the United

States $8,460 per year for use of the lands. The FAA retains control of these lands to ensure adequate clearance zone protection for its facility. These lands are a portion of the lands condemned by the Navy and transferred to the FAA by the International Aviation Act.

The Department of Veterans Affairs (VA) has seven leased facilities in the State of Hawaii in addition to the National

Memorial Cemetery of the Pacific which is owned by the United

States and under the administrative control of VA.

The leased facilities are all privately owned and are leased at fair market rental rates. A matrix describing these facilities follows. Additionally, a new program, the proposed

Pacific Center, will necessitate leasing 5,000 to 6,000 square feet in Honolulu and 9,000 square feet in Hilo for an Intensive

Residential Facility.

The National Cemetery of the Pacific contains a total of

116.74 acres comprised of 34.22 acres ceded land originally acquired in January 1906, as part of the Punchbowl Hill Military

Reservation; 77.32 acres ceded land acquired in May 1950, from the State of Hawaii as a site for the National Memorial Cemetery of the Pacific; and 5.20 acres in fee simple transferred from

General Services Administration on January 5, 1978.

The 34.22 acres is a portion of a 157.5 acre site temporarily set aside for the Punchbowl Hill Military Reservation by Presidential Executive Order Number 395-A dated January 18,

1906, and reaffirmed by Presidential Executive Order 1531 dated

May 11, 1912, for military purposes. It was used by the U.S.

Army and the Hawaiian National Guard for rifle range purposes

until the National Memorial Cemetery of the Pacific was

established by the Department of the Army, General Order Number

- 77 - 68 effective October 1, 1948. The state of Hawaii set aside

77.32 acres by Governor's Executive Order Number 1378 on May 3,

1950, and the national cemetery boundaries were extended to include it by the Department of the Army General Order Number 31, dated September 26, 1950.

The entire 111.54 acres of ceded land together with .29 acres utility easement was transferred to the VA effective

September 1, 1973, pursuant to the National Cemeteries Act of

1973.

VA pays all the construction, operation and maintenance costs of the cemetery except for the Honolulu Memorial at the cemetery which was erected and maintained by the American Battle

Monuments Commission. This Commission is an independent agency of the Executive Branch of the United States government established by Congress in 1923 to commemorate the services and achievements of the U.S. Armed Forces.

Property under the jurisdiction of the Federal Communications Commission (FCC) in Hawaii consists of its co-located District Office and Waipahu Monitoring Station. This installation contains 47.762 acres of fee simple land located on Waipio Peninsula adjoining the Ted Makalena golf course. The United States (U.S. Navy) acquired the property by condemnation, Declaration Taking Civil No. 489 filed in the U.S. District Court on August 22, 1945. The Navy used the property until about 1959 when the FCC began using it under a Permit from the Navy. After approval of a Navy Report of Excess by the U.S. Armed Services Committees of Congress, the property was formally transferred by GSA to FCC on April 15, 1964. The site is actively used by FCC for accomplishment of its mission. However, technical electronic signal problems have developed between a privately owned local television station and FCC. Relocation of a portion of the FCC facilities appears to be the best solution to the problem. Negotiations are underway between GSA and the State of Hawaii pursuant to Public Laws 100-594 and 101-396 which provide authority to sell the property to Hawaii and the proceeds be used by FCC for its relocation and replacement costs. It appears that FCC will continue to use ten acres of the present site and use the 37.762 acre remainder will be involved in the replacement transaction with Hawaii.

- 82 - General Services Administration

The real property under jurisdiction of the General Services

Administration (GSA) in Hawaii consists of four Federally owned and 20 leased installations. In addition, GSA has two facilities located on the Department of the Air Force land at Hickam Air

Force Base, Oahu, and uses space in four U.S. Postal Service owned facilities; three at Honolulu, Oahu, and one at Wailuku,

Maui.

One of the functions of GSA as "housekeeper" for the government is to provide space and facilities to all Federal agencies as needed. Therefore, occupancy of all real property owned or controlled by GSA is classified as general purpose and is assigned to numerous other agencies or used for its own operation and administrative use.

A matrix of pertinent data concerning the use of Federally owned and leased space use is attached. All of the leased

facilities are leased at current fair market rental rates.

The Air Force and Postal Service owned space is included herein for reference and continuity only.

The following described GSA owned installations contain a

total of 11.862 acres of which 3.786 acres is ceded land:

(1) Prince Kuhio Federal Building, and U.S. Courthouse, 300

Ala Moana Boulevard, Honolulu, Ohau. This installation comprises

8.076 acres of land owned in fee simple improved with a 1,028,749

gross square foot Federally constructed building completed in

1977.

- 83 - 4.346 acres of the site was a portion of former Fort

Armstrong originally acquired by the United States under

Presidential Proclamations in 1898 and 1899. It was used by the

U.S. Army and Navy until the early 1960 1 s when plans for a new

Federal building at the site began to develop and such use phased down. The State of Hawaii quitclaimed all it's right, title and interest in this portion of the site to the United States by deed dated November 27, 1962 (Liber 4487/502). In a subsequent land exchange with the U.S., the State of Hawaii conveyed an 3.730 acre fee simple addition to the site by deed dated May 22, 1969

(Liber 6531/11). The U.S. pays all operation and maintenance costs for this facility.

(2) Federal Building, Post Office and Courthouse at

Kinoole and Waianuenue Avenues, Hilo, Hawaii.

This installation comprises 1.525 acres of ceded land improved with a 49,792 square foot Federally constructed building originally completed in 1917 and expanded in 1937.

Approximately 2,000 square feet of the site to round off the corner of what is now Kinoole and Wailuku Streets was granted by revocable license to the County of Hawaii on April 15, 1912.

This portion of the property is still in use for public street purposes.

The site was originally acquired by Act of the U.S.

Congress, 59th Congress, First Session, Chapter 3435, approved

June 19, 1906, modified by Act of the 61st Congress, Second

Session, Chapter 383, Section 19, approved in 1910. The property was set aside as a site for a Federal building and such use

- 84 - continues today. The U.S. pays the entire operation and maintenance cost of the facility.

(3) Federal Building, 29 Kuhio Street, Hilo, Hawaii.

This installation consists of 0.811 acres of ceded land at the northwest corner of Kalanianaole and Kuhio Streets improved with a 7,144 square foot Federally constructed building completed in 1941. The facility is operated and maintained entirely at u. s. government expense.

The land was set aside by Governor's Executive Order Number

862, dated October 13, 1939, for Federal building purposes and it has been in such continuous use since construction.

(4) Vehicle parking area, part of former Fort Armstrong,

Honolulu, Oahu.

This installation consists of 1.45 acres of ceded land

located at the intersection of Pleasanton and Buford Avenues

abutting the southwestern most boundary of the U.S. Immigration

station. The site is a portion of Lot 6 (portion of Reef of

Kaakaukukui) originally reserved for Naval Purpose by

Presidential Proclamation Number 10, dated November 10, 1899. By

a series of Presidential Executive Orders ((beginning with

Presidential Executive Order (PEO) Number 108 dated January 15,

1909)), lands were transferred from the Department of the Navy to

the War Department for establishment and enlargement of a

military reservation which became Fort Armstrong. PEO 5487 dated

November 14, 1930, amended the description of Fort Armstrong

Military Reservation as it then existed including most of this

site which is a portion of Tract Number 1 therein.

The Act of 57th Congress, Session II, Chapter 1007 approved

March 3, 1903, directed establishment of an Immigration Station

and erection of necessary buildings on land owned by the United

states adjoining the "Channel Wharf." By letter dated January 8,

1904, the Secretary of the Navy transferred a tract of the

original naval reservation to the Department of the Treasury for

the immigration station site. Administrative jurisdiction of the

then Immigration Service passed from the Department of the

Treasury to Department of Labor and subsequent thereto, the

Department of Labor retransferred a portion of the immigration

site to the War Department by letter dated December 16, 1939, as

an addition to Fort Armstrong and a part thereof became the most

northeastern 63 feet of subject site.

Department of the Army General Order dated June 7, 1950,

effective June 1, 1950, transferred jurisdiction over 2.892 acres

at Fort Armstrong including subject site to the U.S. Army Chief

of Engineers as the Honolulu District Engineer Reservation. The

U.S. Army District Engineer used the property until reporting it

excess to GSA by Final Report of Excess Real Property, SF-118,

transmitted by letter of January 17, 1975. By deed dated

December 31, 1980, GSA quitclaimed the right, title and interest

of the United States in the property to the State of Hawaii,

reserving, however, the subject 1.45 acre site which is under

jurisdiction of GSA and is used by various government agencies

for vehicular parking.
