(EJiiPfflNITHIS Lance Armstrong Has Something to Get Off His Chest He doesn't use performance-enhancing drugs, he insists, no matter what his critics in the European press and elsewhere say. And yet the accusations keep coming. How much scrutiny can the two-time Tour de France winner stand? by Michael Hall In May of last year, Lance Armstrong was riding in the Pyrenees, preparing for the upcoming Tour de France. He had just completed the seven-and-a-half-mile ride up Hautacam, a treacherous mountain that rises 4,978 feet above the French countryside. It was 36 degrees and raining, and his team's director, Johan Bruyneel, was waiting with a jacket and a ride back to the training camp. But Lance wasn't ready to go. "It was one of those moments in my life I'll never forget," he told me. "Just the two of us. I said, 'You know what, I don't think I got it. I don't understand it.1 Johan said, 'What do you mean? Of course you got it. Let's go.' I said, 'No, I'm gonna ride all the way down, and I'm gonna do it again.' He was speechless. And I did it again." Lance got it; he understood Hautacam—in a way that would soon become very clear. -
3031 Katusha Management SA V
Tribunal Arbitral du Sport Court of Arbitration for Sport Arbitration CAS 2012/A/3031 Katusha Management SA v. Union Cycliste Internationale (UCI), award of 2 May 2013 (operative part of 15 February 2013) Panel: Prof. Luigi Fumagalli (Italy), President; Mr Luc Argand (Switzerland); Mr Michele Bernasconi (Switzerland) Cycling Refusal of registration according to the UCI Licensing Regulations Deviation, by special agreement, from the Panel’s full power of review Full power of review and review of evidently and grossly disproportionate sanctions Purpose of Article 2.15.011 of the UCI Cycling Regulations Grossly disproportionate character of a sanction 1. The question of the possibility for the parties to deviate, by special agreement, from the general rule of Article R57 of the CAS Cod needs to be considered in a broader context, taking in mind the nature and function of the CAS and those mandatory rules that may limit the power of an association to limit access to justice. The CAS jurisdiction cannot be imposed to the detriment of an athlete’s fundamental rights. In other words, an athlete basically cannot be precluded from obtaining in CAS arbitration at least the same level of protection of his/her substantive rights that he or she could obtain before a State court. In conclusion, the unrestricted scope of review of the CAS Panel as provided under Article R57 of the CAS Code may be validly limited to the same standard of review as the standard provided by State court proceedings. In Switzerland, this would mean that a review of a cassatory nature (“nature cassatoire”) as provided at Article 75 CC would be accepted. -
Tour De France
Tour de France The Tour de France is the world’s most famous, and arguably the hardest, cycling race. It takes place every year and lasts for a total of three weeks, covering almost 3,500km. History of the Race During the late 19th century, cycling became a popular hobby for many people. As time went on, organised bike races were introduced and professional cycling became very popular in France. On 6th July 1903, 60 cyclists set off on a race and covered 2,428km in a circular route over six stages. 18 days after setting off, 21 of the original 60 cyclists made it back to the finish line in Paris. The winner was Maurice Garin and the Tour de France was born. Except for war time, the race has taken place every year since then and has become more challenging with the addition of mountain climbs and longer distances. The Modern Tour de France Each year, the tour begins in a different country. The route changes annually too, though usually finishes on the Champs-Élysées in Paris. In 2019, the race starts in Brussels, Belgium on the 6th July and ends in Paris on the 28th July after 21 stages totalling a distance of 3,460km. There are 22 teams taking part in the Tour de France, each with eight riders. The reigning champion is Welsh cyclist Geraint Thomas.
