INTRODUCTION Introduction to the 2007-08 Annual Report It is my pleasure to introduce the Third Annual Report of the Gibraltar Maritime Administration. This report covers the period 1 April 2007 to 31 March 2008. During the period covered by the report, the Gibraltar Maritime Administration has continued to grow while maintaining the high quality of the Ship Register. During the reporting period, the number of ships registered increased by 22 with an increase in tonnage of 100,000 GT, bring the fleet size to 255 vessels with an average age of 10 years. This young and modern fleet continues to enhance the reputation of the Gibraltar flag both within the EU and world wide. This was recognised by the improvement of Gibraltar’s position on the Paris MOU White List and being invited by the USCG to join QualShip21, an invitation extended to only 11 other flags world wide. This increase in the fleet size has lead to an increase, to over 3,000 in the number of endorsement and revalidations issued to Officers who wish to serve on Gibraltar flag ships. There have been significant changes in the senior personnel during this report period with Alan Cubbin taking over from Tony Nation as Maritime Administrator, while Richard Montado took over Robert White as Registrar. Both Tony and Robert had served the Maritime Administrator extremely well over several years. I would like to thank both Tony and Robert for all their efforts in the past and congratulate all the staff of the Maritime Administration on their efforts to improve and advance the Maritime Administration and, so enhancing the reputation of Gibraltar in shipping circles I commend the report to you. FUNCTIONS The Gibraltar Maritime Administration is a part of the Ministry for the Enterprise, Development, Technology and Transport. The responsibilities and statutory obligations remain as in previous years, which are the following activities: 2.1 Ship Registration • The maintenance of a Register of Ships that fly the flag of Gibraltar, ensuring that registration requirements are met, and maintained, in accordance with flag state law. • The registration of mortgages on maritime property. • The maintenance of a register of Foreign Maritime Entities 2.2 Survey, Inspection and Certificate – (International) • The conduct of a programme of inspections to ensure that ships flying the flag of Gibraltar comply with all the requirements of all applicable conventions, ordinances and regulations with respect to ship safety, ship security, protection of the crew and the protection of the marine environment. • The maintenance of complete records of all inspections and certificates • A commitment to ensure that inspections and surveys are conducted in an efficient and expeditious manner. • The issue of certificate to specify the Safe Manning requirements. 2.3 Port State Control • The participation in co-operative agreements, including Memoranda of Understanding, with other like-minded states to give effect to policy with respect to the inspection of foreign registered ships. Gibraltar is part of the Paris MoU. 2.4 Survey and Inspection – (National) • The conduct of a programme of inspections and certification to ensure that locally operated vessels comply with all the requirements of all applicable national legislation with respect to ship safety and the protection of the marine environment. Page 6 of 37 Gibraltar Maritime Administration – Annual Report 2007 / 2008 • The maintenance of complete records of all inspections. • A commitment to ensure that inspections and surveys are conducted in an efficient and expeditious manner to ensure safe operation by local operators. 2.5 Casualty Investigation • The investigation of marine casualties and incidents on Gibraltar state vessels world wide, and other vessels in Gibraltar territorial waters, with a view to determine what action, if any, is needed to ensure the protection of life and property at sea and the marine environment. 2.6 Legislation • The development of regulations and standards for the marine industry in the areas of maritime safety and marine environmental protection in particular to transpose the provisions of international conventions, and EC legislation into Gibraltar law. 2.7 Enforcement • The enforcement of regulations and standards for the marine industry in the areas of maritime safety and marine environmental protection, taking account of the commercial impact of the manner of enforcement. • The recommendation to the Ministry for the Enterprise, Development, Technology and Transport for the ordering of investigations into competence, conduct and/or fitness of an officer in case of loss of ship, loss of life, serious damage to a ship, heavy pollution and indications of impairment and criminal offence. • Assisting the Attorney General for Gibraltar to bring about the prosecution of offenders particularly in relation to serious
