2.1 The Committee considered and discussed the memorandum advising of consents granted, consents under application and of consent processing actions since the last meeting of the Committee.

2.3 Mr C H McLellan, Consents Manager, provided an overview summary to the Committee on the main consent processing activities carried out by the Council in 2015/2016.

2.3 Councillor N W Walker sought discussion on the South Taranaki District Council’s consent relating to the coastal marine area of the Patea River mouth. The condition of the North and South moles (remaining structures of historical port) was discussed. The consent requires all the coastal marine structures to be fit for purpose and are monitored by Council staff annually. The consent holder (STDC) are aware of their maintenance responsibilities under the resource consent in relation to coastal structures.

THAT the Taranaki Regional Council 1. receives the schedule of resource consents granted and other consent processing actions, made under delegated authority

3.1 Ms H Meintjes, Science Manager, spoke to the memorandum and answered questions concerning two tailored compliance monitoring reports covering the monitoring period 2015-2016, and provided an overview on environmental performance and

consent compliance from each report.

3.2 The case study on W Abraham Limited (Abraham’s Funeral Home) was noted and discussed. It was advised that the air discharge consent does control what cannot be put into a casket before cremation and adequate controls are in place.

THAT the Taranaki Regional Council 1. receives the 16-74 STDC Patea Beach Greenwaste 2015-2016 and adopts the specific recommendations therein 2. receives the 16-75 Value Timber Supplies Ltd Woodwaste Disposal 2015-2016 and adopts the specific recommendations therein. Cloke/Walker

4. Incident Register – 14 May 2016 to 30 June 2016

4.1 The Committee received and noted the summary of the Council’s Incident Register for the period 14 May 2016 to 30 June 2016.

4.2 Mr B E Pope, Compliance Manager, provided an overview to the Committee on the reported incidents and answered questions concerning officer responses to non- compliances. Mr Pope provided an overview summary to the Committee on the main monitoring and enforcement activities carried out by the Council in 2015/2016 with comparative 2014/2015 data.

Recommended

THAT the Taranaki Regional Council

1. receives this memorandum on the proposal by District Council’s to transfer functions relating to the Resource Management (National Environmental Standard for Assessing and Managing Contaminated Soil to Protect Human Health) 2011 (NES) pursuant to section 33 of the Resource Management Act 1991

2. recommends that the Council agree, in accordance with section 33(4) of the Resource Management Act 1991, that the transfer is desirable on all of the following grounds:

a) the Taranaki Regional Council represents the appropriate community of interest relating to the exercise or performance of the function, power, or duty

b) efficiency

c) technical or special capability or expertise.

3. recommends that the Council agree in principle to the transfer of NES functions, powers and duties that relate to the activities of landfarming, mixed bury cover, surface application and similar contaminant remediation and such activities require discharge consent from Taranaki Regional Council under section 15 of the Resource Management Act (RMA)

4. notes that the actual transfer of functions will be made by agreement between the District Council’s and the Regional Council, on such exact terms and conditions as are yet to be agreed and can only occur once the District Council’s have carried out a special consultative procedure in relation to the transfer and served notice of the transfer proposal on the Minister for the Environment

5. notes that the transfer agreement will be the subject of a future memorandum

6. acknowledges that upon the transfer, the Council’s functions, powers and duties shall be deemed to be extended in such manner as may be necessary to enable it to undertake, exercise, and perform the function (section 33(7) RMA)

7. acknowledges that having transferred its functions, the District Council’s may change or revoke the transfer at any time by notice to the Taranaki Regional Council (section 33(8) RMA) and that the Taranaki Regional Council may relinquish the transfer in accordance with the transfer agreement (section 33(9) RMA).

Purpose The purpose of this memorandum is to advise the Committee of consents granted, consents under application and of consent processing actions since the last meeting. This information is summarised in figures at the end of this report.

Executive summary Memorandum to advise the Committee of recent consenting actions made under regional plans and the Resource Management Act, in accordance with Council procedures and delegations.

Recommendation That the Taranaki Regional Council: 1. receives the schedule of resource consents granted and other consent processing actions, made under delegated authority.

Background The following resource consent applications have been investigated by officers of the Taranaki Regional Council. They are activities with less than minor adverse effects on the environment or minor effects and affected parties have agreed to the activity. In accordance with sections 104 to 108 and section 139 of the Resource Management Act 1991, and pursuant to delegated authority to make decisions on consent applications, the Chief Executive or the Director—Resource Management has granted the consents/certificates of compliance.

The exercise of delegations under the Resource Management Act 1991 is reported for Committee Members’ information. Under the delegations manual, consent processing actions are to be reported to the Consents and Regulatory Committee.

The attached appendices (consent applications in progress) show the total number of applications in the consent processing system over the last twelve months. The number of applications for the renewal of resource consents is also shown. The difference between the two is the number of new applications, including applications for a change of conditions. New applications take priority over renewal applications. Renewal applications are generally put on hold, with the agreement of the applicant, and processed when staff resources allow. A consent holder can continue to operate under a consent that is subject to renewal. The above approach is pragmatic and ensures there are no regulatory impediments to new activities requiring authorisation.

Also attached are the following:  Applications in progress table - the number of applications in progress at the end of each month (broken down into total applications and the number of renewals in progress) for this year and the previous two years.  Consents issued table - the number of consents issued at the end of each month for this year and the previous two years.  Potential hearings spreadsheet outlining the current status of limited/notified applications where hearing committees have been appointed.  Breakdown of consents issued. This is the number of consents issued broken down by purpose – new, renewals, changes or review.  Types of consents issued, further broken down into notification types – non-notified, limited notified or public notified.  Public and iwi involvement in non-notified consents. This assessment excludes routine farm dairy discharges as generally affected party approval and iwi consultation is not required for these.  Application processing time extensions used compared to the previous years.  Consent type process shows the notification type including applications submitted on and the pre-hearing resolution numbers.

Discussion Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act.

Background The Council considers the regular reporting of comprehensive and well-considered compliance monitoring is vital to undergird-  community standing and reputation enhancement for companies that consistently attain good or high levels of environmental performance. Informed feedback is appropriate and valuable, and assists a proactive alignment of industry’s interests with community and Resource Management Act expectations. Reporting describes the effective value of investment in environmental systems;  a respectful and responsible regard for the Taranaki region’s environment and our management of its natural resources. Reporting allows evaluation and demonstration of the overall rate of compliance by sector and by consent holders as a whole, and of trends in the improvement of our environment; and  the Council’s accountability and transparency. Reporting gives validity to assessments of effective intervention.

There are 18 reports for presentation to the meeting. Recommendations pertaining to each site or programme are set out in the relevant report. The attention of Committee members is directed to the Executive Summary at the front of each report.

These reports have been prepared by staff of the Science Services section and have been submitted to the consent holder for comment prior to publication. All reports provide environmental performance and administrative compliance ratings for each consent holder in relation to their activities over the period being reported and provide recommendations for the following monitoring year.

Of the 18 reports being presented to this meeting, 16 cover the activities of individual consent holders while two reports cover joint monitoring programmes. Within the reports fifteen high, five good, two improvement required and one not yet rated, environmental performance ratings were assigned, (Table 1).

Science Services have continued to prepare and present a number of case studies to this committee. Keeping to the recent theme of air quality, we have included another example of an industrial site (TBS Blasting), which details the measures taken to meet their obligations with regard to their air discharge permits.

Case Study TBS Coatings Limited

TBS Coatings Limited (TBS) operates an abrasive blasting and spray painting facility at Corbett Road Bell Block. This facility was established in 1974 on a 4.5 ha property situated in the south-eastern corner of the industrial area of Bell Block, New Plymouth.

Abrasive blasting is used to clean and prepare surfaces for painting. The process involves blasting an abrasive substance on to the surface of the object in question. Material from the blasting process becomes airborne due to the release of high pressure air used to accelerate the abrasive media to the required cleaning velocities. Emissions from abrasive blasting operations have the potential to cause nuisance and possible health risks, especially when conducted within populated areas. Sources of possible air pollution include dust from blasting inside the blasting sheds and in the large metalled yard, and from re-suspension of blast debris and scrubber sludge that has been disposed of on site in the past.

At TBS, various items, mainly steel, are brought to the site for cleaning by dry abrasive blasting and for the application of protective coatings. Blasting occurs mostly in purpose- built blasting booths, within sheds situated on the southern part of the site. Occasionally items too large to fit in the blasting booths are blasted in a paint-shed on the western part of the site. Chilled Iron Grit is the main blast media used and this is recycled. Garnet blast media (also recyclable) is sometimes also used. Protective coating is carried out in enclosed areas, mostly in paint rooms adjacent to the blasting sheds and occasionally in a shed on the western part of the site. The rooms are ventilated with air extraction systems, for the protection of paint workers.

Presently TBS mitigates potential emissions into the air from the blasting and coating operations in a number of ways:

 The enclosed blasting facilities at this site are designed for control of emissions and recovery of blasting material. The larger blasting booth is a side draught booth connected to two dust collectors in parallel. The smaller grit blast booth has been recently upgraded over the last eighteen months and the previous wet scrubber fan and conveyor recycling system has been replaced with a vacuum unit coupled to a reverse pulse dry bag dust control system located fully indoors with zero emissions. The paint shed that is occasionally used for blasting also has an air extraction system. When open blasting is performed (this has not occurred in the last five years) the item being treated in the yard are screened as completely as practicable, to contain dust emissions.  The boundaries of the site are screened on all four sides with shelter belts of trees and a filter fabric fence, to reduce passage of wind-blown dust onto neighbouring properties. The trees also add aesthetic value. There is a gap, along one third of the northern boundary that is not screened which enables items that are too large to fit through the Corbett Road entrance to be brought to and from the site.  Because the management and recycling of grit material generates significantly less waste material than if a non-recyclable media were used, blast debris is no longer disposed of by burial on the site.

 Over the last year TBS has also dug out areas of the metal yard and laid bidum cloth underlay prior to reinstating heavy rolled metal mixed with used road millings as a trial to reduce metalled yard dust. Early indications are that this process has provided a less dusty and more robust heavy traffic surface and is preventing fines from surfacing and becoming wind-blown dust.  Finally, TBS has recently committed to completing a further trial area of yard metal upgrading.

It is estimated that total dust emission from the site has been reduced by a third as a result of recent upgrades and this has allowed TBS to significantly improve their level of environmental compliance.

Discussion

Trustpower - Motukawa HEP Scheme Trustpower Limited (Trustpower) operates the Motukawa hydroelectric power (HEP) scheme in the Manganui River and Waitara River catchments. Trustpower draws water from behind a weir on the Manganui River near Tariki and diverts this water through a race to Lake and then through penstocks to the Motukawa Power Station. The power station discharges into the Makara Stream, a tributary of the Waitara River. Consents for the Motukawa HEP scheme allow Taranaki Generation Ltd to maintain structures, to take, divert and discharge water, and to disturb the bed of Lake Ratapiko. This report for the period July 2015-June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess Trustpower’s environmental performance during the period under review, and the results and environmental effects of their activities.

During the monitoring period, Trustpower Limited demonstrated an overall high level of environmental performance.

Trustpower holds a total of 23 resource consents, which include a total of 186 conditions setting out the requirements that the Company must satisfy. The Company holds five consents to allow it to take and use water, five consents to discharge water or sediment into the Makara, Mangaotea, and Mako streams, one consent to discharge wastes to land around Lake Ratapiko and four land use permits for bed disturbance and structures in the Manganui River, Mangaotea Stream and Lake Ratapiko. Seven additional consents allow Trustpower to abstract water, and construct and maintain structures in the Mangaotea Stream.

During the period under review, Trustpower demonstrated a high level of environmental performance at the Motukawa power scheme.

The Council’s monitoring for the period under review included eleven inspections of fish passage and residual flow facilities, continuous water temperature at two sites between November and April each year, a biomonitoring survey, fish monitoring and review of abstraction, discharge, and lake and race water level data forwarded by the Company, as well as elver transfer data.

The monitoring showed that during the period under review, the management of abstraction rates, race and lake water levels was generally good. With regard to the management and recording of flows within the diversion race, performance has improved significantly compared to previous monitoring years, with no significant loss of data. This is the first monitoring period to record no such occasions of lost data since monitoring has focused on the continuity of the data record. There were only two occasions where such required flow rates were not complied with. The first related to equipment failure, the second to a severe weather event, and both were of extremely short duration (no more than 2 hours).

Water temperature differences appear to have reduced between natural flows and those in the residual flow reach since the establishment of the 400 L/s residual flow limit. Over the reported period, there was a slight increase in the number of days that water temperatures in the residual flow reach exceeded 25˚C, occurring from December 2015 to February 2016. However, the temperature differences between upstream and downstream of the weir were similar to the average, with the exception of November and December when temperature differences were higher than average.

Macroinvertebrate monitoring indicates improvement at some sites since the increased residual flow was implemented, however elevated water temperatures and denser periphyton substrate cover have affected macroinvertebrate communities of the residual flow reach in more recent surveys. In terms of the current report, it is considered that the communities sampled were representative of a low flow community. The results indicate that the MCI scores at these sites were higher (better) than most previous surveys, as were the SQMCIS scores, which were all significantly higher than their respective medians. However, a similar result was recorded at the control site indicating that there is a catchment wide improvement also.

Overall, the results indicate that the invertebrate community supported by a residual flow of 400 L/s, with regards to presence/absence of taxa, and their respective abundances, is not significantly different to that supported by natural flows. The principal difference between the two flows is that there is a greater amount of invertebrate habitat available under natural flow conditions due to the increased amount of wetted riverbed width.

A significant result of fish monitoring undertaken to date, is the presence of the key indicator species redfin bully, shortjaw kokopu and inanga upstream of the weir. Migrating trout were netted and tagged during the current monitoring period, and it is hoped that angler catch returns will provide some information about the movement of these fish in the Manganui River catchment and Motukawa scheme. Interim results indicate that trout are able to negotiate the fish pass and flow control valve. Overall, fish results to date indicate that with respect to the management objectives for which the residual flow was developed:

• reasonable water quality is being maintained; • passage for trout is probably being achieved through the residual flow reach and past the weir; • passage for some (but not all) native fish is being achieved in the residual flow reach and it would appear through the fish pass; • habitat of native fish has improved but fish diversity is similar to that recorded prior to the 400 L/s residual flow and may suggest that the objective of ‘some native fish habitat’ is not being achieved for torrentfish, although redfin bullies and inanga have been recorded in the residual flow reach.

Eel and elver passage requirements were generally fulfilled with the elver transfer system at the power station working well. The total weight of elvers transferred in the reporting period was the second highest of the last seven years. Electric fields have been installed at the intake and forebay and testing indicates that these are successful in deterring fish from these areas. Transfer of adult eels was attempted during each migration season, although due to low numbers only four longfin eels were transferred in the most recent migration season.

During the reported period, Trustpower’s performance was generally maintained at a high level. There were no incidents that warranted enforcement action. There were a number of minor incidents, but due to the swift response of the consent holder, they remained minor, and it is likely no environmental impact resulted.

The improved environment al performance of the consent holder is a result of efforts to improve their internal systems and monitoring of this highly complex scheme. Trustpower has maintained a good level of communication with the Council, including notifying the Council of any breach of consent they become aware of. Overall, it is considered that Trustpower was

able to demonstrate a high level of environmental performance and compliance with the resource consents, and compliance with the administrative requirements of the consents.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

In terms of overall environmental and compliance performance by the consent holder over the last several years, this report shows that the consent holder’s performance is improving.

This report includes recommendations for the 2016-2017 year.

Cheal Petroleum Limited - Deep Well Injection Cheal Petroleum Limited (the Company) operates a number of wellsites within the Taranaki region, most notably their Cheal wellsites, located south of Stratford. Each wellsite contains varying numbers of producing wells and associated production infrastructure. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) in relation to the Company’s deep well injection (DWI) activities. The report details the results of the monitoring undertaken, assesses the Company’s environmental performance during the period under review and the environmental effects of their DWI activities.

The Company holds four resource consents for DWI activities, which include a total of 63 conditions setting out the requirements that the Company must satisfy. Only one consent was exercised during the period being reported.

During the monitoring period, Cheal Petroleum Limited demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included four site inspections, two injectate samples and five groundwater samples collected for physicochemical analysis. The monitoring programme also included a significant data review component, with all injection data submitted by the company assessed for compliance on receipt.

The monitoring showed that the Company’s DWI activities were being carried out in compliance with the conditions of the applicable resource consents. There is no evidence of any issues with any injection well currently in use, or the ability of the receiving formation to accept injected fluids. The results of groundwater quality monitoring undertaken show no adverse effects of the activity at monitored locations. Inspections undertaken during the monitoring year found sites being operated in a professional manner and there were no unauthorised incidents in relation to any of the Company’s DWI consents.

During the year, the Company demonstrated a high level of environmental and administrative performance with the resource consents.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

In terms of overall environmental and compliance performance by the Company over the last several years, this report shows that the Company’s performance remains at a high level.

This report includes recommendations to be implemented during the 2016–2017 monitoring period. Central Greenwaste 2012 Central Greenwaste 2012 (the Company) was formerly known as Greenwaste 2007 and Greenwaste 2008. The Company operates a green waste collection and composting operation located at Victoria Road, Stratford, in the Patea catchment.

The Company collects green waste from domestic sources in the Stratford urban area and then composts it at its Victoria Road site. The principal components of green waste collected are lawn clippings and material from garden pruning.

This report for the period July 2014 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds consent 6876-1, which includes a total of 11 conditions setting out the requirements that the consent holder must satisfy. This consent covers the discharge of green waste, stormwater and leachate to land. The consent was originally held by the Central Taranaki Employment Trust. It was subsequently transferred to Greenwaste 2007, then to Greenwaste 2008 and again to Central Greenwaste 2012.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the period under review included four inspections that focussed on assessing the materials being accepted for composting, general site operation, stormwater and leachate control, and odour.

As in previous years, the site inspections found that the site was well managed and it was considered that activities at the site would not have posed any threat of adverse environmental effects. There were no unauthorised incidents recording non-compliance in respect of this consent holder during the period under review.

During the period under review, the Company demonstrated a high level of environmental and administrative performance with their resource consent.

For reference, in the 2014-2015 year, 75% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 22% demonstrated a good level of environmental performance and compliance with their consents. Groundworkx Taranaki Ltd Groundworkx Taranaki Limited (the Company) operates a cleanfill located on Victoria Road at Stratford, in the Patea catchment. This report for the period July 2014 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds one resource consent to discharge cleanfill onto and into land for quarry reinstatement purposes. The consent includes a total of ten conditions setting out the requirements that the Company must satisfy.

During the monitoring period, the Company demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the years under review included four compliance monitoring inspections. No water samples were taken as the site is well contained and some distance from the nearest waterway.

The monitoring showed that there had been no significant adverse environmental effects in the receiving environment as a result of the Company’s cleanfilling activity. For the most part the Company managed unauthorised material deposited at the site well, although on one occasion a small amount of treated timber off cuts were found in the tip face. This material was removed promptly on request and would have had negligible effect. There were no unauthorised incidents recording non-compliance in respect of this consent holder during the period under review.

During the period under review, the Company demonstrated a good level of environmental and a high level of administrative performance with the resource consent.

Dimar Partnership Closed Landfill Dimar Partnership Limited (the consent holder) previously operated a refuse dump located on Ararata Road, Hawera, in the Tangahoe catchment. The site was investigated in June 2013, and it was found that it was accepting household rubbish and other refuse from off-site. It was also found that the edge of the disposal site was closer than 25 metres to a waterway. As this did not comply with the permitted activity rule for on farm domestic refuse disposal, an abatement notice was issued, and the site owner then applied for a consent to discharge leachate into the Mangimangi Stream.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the consent holder’s environmental performance during the period under review, and the results and environmental effects of the consent holder’s activities. This is the third annual report for this site.

The consent holder holds one resource consent, which includes a total of five conditions setting out the requirements that the consent holder must satisfy. The consent allows the consent holder to discharge contaminants (leachate) from a closed farm refuse dump into land where it may enter the Mangimangi Stream.

During the monitoring period, the consent holder demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the year under review included two inspections and four water samples collected for physicochemical analysis.

The monitoring showed that no environmental impacts were found. The site was capped, contoured and, for the most part, vegetated appropriately. On one inspection a minor amount of stock damage was observed in localised spots on the slope towards the stream, however there was no significant erosion or exposed refuse found. There were no unauthorised incidents recording non-compliance in respect of this consent holder during the period under review, and the abatement noticed issued during the 2013-2014 monitoring period was being complied with.

During the year, the consent holder demonstrated a good level of environmental performance and a high level of administrative performance.

NPDC Landfills The New Plymouth District Council (NPDC) maintains two reinstated landfills, one at Inglewood and one at Okato. Both landfills have been used in the past, and are now used as transfer stations but are also held in reserve to accept refuse, if required, as a contingency. The Inglewood landfill is located on King Road at Inglewood, in the Waiongana catchment, and the Okato landfill is located on Hampton Road at Okato, in the Kaihihi catchment.

NPDC also maintains a closed landfill, Park (Marfell) landfill in the Huatoki catchment. This landfill does not accept any waste for disposal and has been fully reinstated.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess NPDC’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of NPDC’s activities in regard to these closed landfills.

Overall, during the monitoring period NPDC demonstrated a high level of environmental performance.

NPDC holds seven resource consents, which include a total of 59 conditions setting out the requirements that they must satisfy. NPDC holds three consents to discharge leachate and stormwater into various streams, two consents to discharge contaminants onto and into land, and two consents to discharge emissions into the air.

The Council’s monitoring programme for the year under review included seven inspections, three discharge samples, 11 receiving water samples, two biomonitoring surveys of receiving waters, and one ambient air quality analysis. Monitoring was not scheduled at the Marfell landfill site during the year under review.

During the monitoring year there were no incidents logged by Council associated with NPDC’s landfills covered in this report.

Overall during the year, NPDC demonstrated a good level of environmental performance and a high level of administrative performance in relation to the Inglewood landfill consents. Although no significant environmental effects were found due to the operation of the site, the trend of increasing nitrogen compounds in the landfill tributary and the main tributary indicate that there may be the potential for environmental effects to emerge in the future, if the cap remediation undertaken during the 2014-2015 year is not confirmed as having arrested this trend.

During the year, NPDC demonstrated a high level of environmental performance and a high level of administrative performance in relation to the Okato landfill resource consents.

STDC Eltham Central Landfill In 1996 the South Taranaki District Council (STDC) instigated plans to establish a large landfill in the Eltham area. The purpose of this site was to ultimately accept waste from the South Taranaki and Stratford Districts. The plan was changed to allow for a regionalised approach to waste disposal and the site is now currently a proposed option as the replacement regional landfill once the facility at Colson Road, New Plymouth has reached capacity. The final decision is subject to review of all alternatives to be undertaken by the district councils of the region. The (proposed) Eltham Central landfill site is situated in the Waingongoro catchment on Rotokare Road approximately two kilometres south of Eltham. This report for the period July 2015 to June 2016 describes the baseline monitoring programme implemented by the Taranaki Regional Council (the Council).

The STDC holds a total of five consents which contain 77 special conditions. These consents cover all aspects of the construction and operation of the landfill. At present none of the consents held by STDC in relation to landfill construction and operation have been exercised. The consents have extended lapse periods to allow for an interim period prior to exercise.

Consent conditions specify that baseline monitoring of the ground and surface receiving waters are to be undertaken to obtain data for comparison to that gathered from compliance monitoring surveys when the landfill has commenced operations.

During the monitoring period, the environmental performance of STDC at the Eltham Central Landfill was not assessed as the consents are yet to be exercised.

Consent conditions specify that baseline monitoring of the ground and surface receiving waters are to be undertaken to obtain data for comparison to that gathered from compliance monitoring surveys when the landfill has commenced operations. This report outlines all of the consents held by the STDC, reports on the baseline monitoring activities carried out in the 2015-2016 period, and discusses these results along with the previously obtained groundwater monitoring results.

As baseline monitoring has been undertaken for a number of years, since the 2014-2015 year, monitoring has been scaled back to consist of the collection and analysis of six surface water samples per year.

The monitoring showed that surface water quality was comparable to that found during previous monitoring periods and was indicative of good water quality when compared to that expected in similar streams in the area. No incidents were recorded by Council in regards to this site during the period under review.

STDC demonstrated a high level of administrative compliance with its resource consents. No rating is given for environmental effects as none of the consents have been exercised.

Waverley Sawmills Woodwaste Sites Waverley Sawmills Limited (the Company) operates a wood waste disposal site located on Monk Road at Waverley, in the Whenuakura catchment, and a former wood waste disposal site located on Village Settlement Road at Waverley, in the Moumahaki catchment. The Monk Road site is consented to receive untreated wood waste only, and the Village Settlement Road site is consented to receive treated and untreated wood waste. All the wood waste discharged at both sites originates from the Company’s sawmill in Waverley. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities. This is the tenth compliance monitoring report on the Company’s activities at the Monk Road and Village Settlement Road sites.

The Company holds a total of four resource consents relating to its wood waste disposal sites, which include a total of 35 conditions setting out the requirements that the Company must satisfy. The Company holds one land use consent for the purpose of piping a stream, two consents to discharge wood waste onto and into land, and one consent to discharge leachate and stormwater to land and water.

Overall an improvement was required in the Company’s level of environmental performance with their resource consents.

The Council’s monitoring programme for the period under review included three inspections, nine water samples, and four soil/wood waste samples collected for physicochemical analysis. Eight additional wood waste samples were collected as a result of treated wood waste having been disposed of at the Monk Road site.

At the Monk Road site it was found that treated wood waste had been disposed of on one occasion during the year under review. An abatement notice was issued requiring that the waste be removed. The Company undertook an investigation to identify the area containing the treated wood waste, and this was then removed within the agreed timeframe. It was also found that leachate at the Monk Road site still has potential to cause effects, and elevations in the concentration of contaminants were noted. There was one minor non-compliance relating to the filtered carbonaceous biochemical oxygen demand in the Kohi Stream tributary.

At the Village Settlement Road discharge site, remediation undertaken during the 2013-2014 year has remained effective and stable during the 2015-2016 year, although a marginal breach of the copper consent limit on the soil beyond the site boundary was found (43 mg/kg dry weight versus a limit of 42 mg/kg dry weight). This would result in little, if any, environmental effect and therefore resampling is recommended after the spring rains.

Concrete Plants This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the environmental performance of three concrete batching plants within the Taranaki Region. The report also details the results of the monitoring undertaken and assesses the environmental effects of their activities. The three concrete batching plants covered by this programme are located in Waitara, Hawera and Stratford.

Allied Concrete Limited (Allied Concrete) operates a concrete batching plant located on Mould Street, Waitara, in the Waitara catchment. The site operation includes the storage and mixing of cement, aggregate, sand, and builders mix.

Allied Concrete holds one resource consent, which was renewed during the year under review. The consent in force at the start of the 2015-2016 year included a total of four conditions setting out the requirements that they must satisfy, whilst the renewed consent includes 10 conditions. The consent allows for the discharge of wastewater into an unnamed tributary of the Waitara River.

During the year under review, Allied Concrete demonstrated an overall high level of environmental performance.

Firth Industries is a division of Fletcher Concrete and Infrastructure Limited is hereafter referred to as Firth Industries. They operate a concrete batching plant located on Glover Road, Hawera in the Tangahoe catchment. The site operation involves mixing of cement, aggregate, water and additives in concrete mixing trucks for delivery to end users, and recently it has been used only as a satellite plant. The site also stores aggregate, sand and builders mix for retail.

Firth Industries holds one resource consent, which includes a total of seven conditions setting out the requirements that they must satisfy. The consent allows for the discharge of treated wastewater onto and into land and into an unnamed tributary of the Tawhiti Stream.

During the year under review, Firth Industries demonstrated an overall high level of environmental performance.

Fletcher Concrete and Infrastructure Limited (Fletcher Concrete) operates a concrete batching plant and pre-cast manufacturing plant on a site just north of Stratford on State Highway 3 in the Kahouri catchment. Activities at the site include the storage and mixing of aggregate, cement, water and additives, as well as the manufacturing of pre-cast drainage soak-hole liners and lids, offal hole lids and troughs. The concrete batching plant is operated by their subsidiary Firth Industries, and the pre-cast facility and sales depot is operated by their subsidiary Humes Pipeline Systems (Humes).

Fletcher Concrete holds one resource consent, which includes a total of 13 conditions setting out the requirements that the consent holder must satisfy. The consent allows for the discharge

NPDC holds 19 resource consents, relating to those water supply systems which include a total of 149 conditions setting out the requirements that the consent holder must satisfy. There are seven consents to take and use water, five consents to discharge to water, seven consents to maintain structures, and one consent to discharge filter backwash onto and into land.

During the monitoring period, NPDC demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included an annual inspection of each water supply scheme, three samples collected for water quality analysis, an assessment of the abstraction data provided, and three fish surveys.

The monitoring showed that overall the NPDC water schemes are well operated and maintained and appeared to be having no adverse effects on the environment.

NPDC provided all the abstraction data required under consent conditions and the data showed that all daily volume limits and instantaneous abstraction rates were complied with.

During the year, NPDC demonstrated a high level of environmental and administrative performance with the resource consents.

SDC Water Supplies The Stratford District Council (SDC) operates three water treatment plants (WTP’s) in the Stratford district, that supply water to Stratford, Midhirst, and Toko. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess SDC’s environmental performance during the period under review, and the results and environmental effects of SDC’s activities.

SDC holds 10 resource consents in relation to water supplies, which include a total of 60 conditions setting out the requirements that the consent holder must satisfy. The consent holder holds four consents to allow it to take and use water, three consents to discharge filter backwash, and three consents to construct and maintain in-stream structures.

During the monitoring period, SDC demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included an annual inspection of the all of SDC’s plants, weirs and discharges, a review of abstraction data, and a collection of a sample from the Stratford WTP’s backwash pond.

During the monitoring period SDC upgraded its plant at the Toko WTP. This plant is now up and running providing data to the council database via telemetry. SDC also undertook works to improve the weir in the Konini Stream. There were some minor issue in regards to abstraction rates during the brief intermittent periods of low flow restrictions in the Patea River, however, no environmental effects were noted.

During the year, SDC demonstrated a high level of environmental performance. However SDC demonstrated a poor level of administrative performance due to the fact, that despite repeated reminders by Council staff, renewal applications for the weirs in the Konini Stream and Patea River, and for the backwash discharge at the Stratford WTP were submitted by SDC too late to qualify for ongoing protection of section 124 of the Resource Management Act 1991 (RMA). As a result these consents expired during application processing and in the case of the renewal applications for the weirs in the Konini Stream and Patea River, these matters are still in the process of being resolved.

South Taranaki Water Supplies The South Taranaki District Council (STDC) operates a total of 11 water treatment plants (WTP’s) throughout the district. STDC holds 34 resource consents which include 317 conditions setting out the requirements that must be satisfied. STDC holds 15 consents to take water, ten consents to discharge to both land and water, and nine consents to construct and maintain in-stream structures.

Oaonui Water Supply Limited (OWSL) operates the Oaonui WTP. OWSL hold two resource consents which include a total of 15 conditions setting out requirements that must be satisfied. OWSL holds one consent to abstract water and one consent to maintain an in-stream structure.

The Nukumaru Water Scheme Society Incorporated (NWSSI) operates a rural water supply scheme. NWSSI holds one consent to take groundwater, this consent has seven conditions.

Cold Creek Water Supply Limited (CCWSL) operates a private WTP in the Cold Creek catchment. There are three consents associated with CCWSL‘s WTP with a total of 27 conditions. There is one consent to cover water abstraction, one to maintain an in-stream structure, and one to discharge treated backwash.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the environmental performance of the four organisations during the period under review, and the results and environmental effects of their activities.

During the monitoring period, STDC demonstrated an overall high level of environmental performance.

During the monitoring period, OWSL demonstrated an overall good level of environmental performance.

During the monitoring period, NWSSI demonstrated an overall high level of environmental performance.

Chemical sampling of discharges and receiving waters, macroinvertebrate surveys and fish surveys, all indicated that the water supply schemes did not appear to be causing any significant adverse environmental effects.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess NPDC’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of Aquatic Centre’s activities.

NPDC holds two resource consents relating to the Aquatic Centre, which include a total of thirteen special conditions that NPDC must satisfy. One consent allows NPDC to discharge swimming pool wastewater into the Tasman Sea, and the other allows it to erect, place, use and maintain a discharge pipe at the site.

During the monitoring period, NPDC demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included one site inspection, two marine ecological inspections, two discharge samples and two samples of the receiving waters collected for physicochemical analysis.

Both of the wastewater discharges that were monitored in the period under review were compliant with consent conditions. Neither of the discharges had any observable effects on the ecology of the Kawaroa Reef outside of the designated mixing zone.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds one resource consent, which includes a total of seven conditions setting out the requirements that the Company must satisfy.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme included two inspections, review of the discharge data provided by the consent holder, and two water samples collected from the wastewater discharge for physicochemical analysis.

During the 2015-2016 monitoring year, the factory was not in operation and as a result there had been no consent related activity on-site. The site was well managed by the local staff, however there were some administrative issues that meant that the contingency plan was not fully adhered to. Overall, the monitoring that was undertaken during the period under review found that the likely environmental effects from the exercise of resource consent 0934-3 were negligible.

During the year, the Company demonstrated a high level of environmental performance and a good level of administrative performance with the resource consent.

NPDC Urenui and Onaero Beach Camps New Plymouth District Council (NPDC) operates the sewage disposal systems located at Urenui Beach Camp and Onaero Bay Holiday Park. NPDC holds resource consents to allow it to discharge septic tank treated sewage to groundwater via infiltration trenches at each of the motor camps. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess NPDC’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the NPDC’s activities.

NPDC holds one resource consent per beach camp, each of which has five special conditions setting out the requirements that NPDC must satisfy.

During the monitoring period, NPDC demonstrated an overall high level of environmental performance.

The Council’s routine monitoring programme for the year under review included three inspections per motor camp during the Christmas holiday period. One of these inspections included bacteriological sampling at four sites at Urenui and five sites at Onaero. An additional sampling round was undertaken at Onaero as per recommendations outlined in the 2014-2015 monitoring report.

The water samples collected at Urenui gave no indication that any adverse environmental effects were caused by the Urenui Beach Camp’s sewage treatment system.

Results from the water samples collected at Onaero suggest that there may be a number of factors that are adversely affecting water quality in the lower reach of the Onaero River. Although there is little evidence to suggest otherwise, further monitoring is required to confidently rule out Onaero Bay Holiday Park’s sewerage system as a contributing factor.

During the year, a high level of environmental performance and compliance was demonstrated by NPDC with regards to the resource consents for both the Urenui Beach Camp (2046-3) and Onaero Bay Holiday Park (1389-3), as indicated by site inspections and bacteriological monitoring of coastal and riverine waters.

STDC Wai inu Beach Settlement The South Taranaki District Council (STDC) operates a sewage treatment system located at the Wai-inu Beach Settlement, in the Waitotara catchment. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess STDC’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of STDC’s activities.

STDC hold one resource consent in relation to the sewage treatment system, which includes a total of six conditions setting out the requirements that STDC must satisfy.

During the monitoring period, STDC demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included three site inspections, with associated bacteriological sampling of seawater.

The monitoring showed that the wastewater treatment system was well maintained during the period under review. As in previous years, the monitoring indicated that the exercise of resource consent 3769-3 was not having an adverse effect on the environment.

During the 2015-2016 monitoring year, STDC demonstrated a high level of environmental and administrative compliance with their resource consent.

The consent holder also holds a consent to erect, place and maintain a rock wall along the front of the accommodation on the Wai-iti Beach foreshore. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the consent holder’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the consent holder’s activities.

The two resource consents that the consent holder holds include a total of 24 conditions setting out the requirements that the consent holder must satisfy.

During the monitoring period, the consent holder demonstrated a level of environmental performance that required improvement.

The Council’s monitoring programme for the year under review included three inspections of the wastewater system, including one inspection of the rock wall, and bacteriological water sampling of the Wai-iti Stream and Wai-iti Beach on one occasion.

An additional bacteriological water sampling survey was also undertaken, following recommendations made in the 2014-2015 monitoring report.

Monitoring indicated that the camp’s effluent system was contaminating an unnamed tributary and the Wai-iti Stream. These results were confirmed when the consent holder discovered a ruptured effluent soakage trench in the vicinity of the waterbodies. The rupture was promptly repaired by the consent holder. Monitoring and further works are planned in order to prevent further issues from arising. An inspection of the rock wall found that the structure remained in good repair, and that it was not causing any significant environmental effects.

An improvement in the consent holder’s environmental performance is required in relation to the exercise of resource consent 1971-3. A high level of environmental and administrative performance was demonstrated in relation to the exercise of resource consent 6462-1.

Ample Group Ltd (Taranaki Abattoirs) The Ample Group Ltd (the Company) operate an abattoir and rendering plant, located on Mountain Road at Stratford, in the Kahouri Stream catchment, a tributary of the Patea River. The Company processes sheep and beef. Wastewater is treated in a two pond system, which is either irrigated to land when conditions allow, or to the Kahouri Stream during high flow conditions. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities. Note that the Company took over the site and resource consents from Gold International Meat Processors in January 2016 and though this reporting period is for July 2015 to June 2016, only monitoring from January 2016 onwards applies to the Company.

The Company holds six resource consents, which include a total of 90 conditions setting out the requirements that the Company must satisfy. The Company holds one consent to allow it to take and use water, two consents to discharge effluent and stormwater into the Kahouri

Stream, two consents to discharge wastewater and degenerating product to land, and one consent to discharge emissions into the air at this site.

During the monitoring period, Ample Group Ltd demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the year under review included four inspections, eight water samples collected for physicochemical analysis, two hydrological gaugings and two, three site biomonitoring surveys of receiving waters.

As in previous years, the monitoring indicated that the day to day running of the site was generally of a good standard. There were processes in place to minimise the contamination of stormwater and to minimise the generation of wastewater, but this could be further improved. The discharge of wastewater into the Kahouri Stream did not cause any recorded impact on the macroinvertebrate communities of this stream, and the impact on water quality was minimal. However, discharge rates to the Kahouri Stream need to be reduced to ensure a 1:100 dilution. The irrigation of wastewater was undertaken with no significant adverse effects on the environment, but further improvement regarding preferentially applying wastewater to land as opposed to the Kahouri Stream would be desirable. Furthermore, improvement is still required regarding compliance with the application depth of wastewater. Water quality monitoring indicated an increase in ammoniacal nitrogen in the unnamed tributary as it flowed through these paddocks, although not to the extent as to have a lethal impact on the stream biota. This increase may be due to the historical over application of nitrogen to these paddocks.

There were no unauthorised incidents recording non-compliance in respect of this consent holder during the period under review. In addition, although odour was noted during one inspection, there was no odour noted that was considered likely to cause off-site effects. The rendering plant has closed, and this is likely to reduce the number of odour complaints related to the site.

During the year, the Company demonstrated a good level of environmental and administrative performance with the resource consents.

Purpose The purpose of this memorandum is to allow the Council to consider and receive the summary of the Incident Register for the period 1 July 2016 to 7 August 2016.

Executive summary There are 44 incidents reported.

14 of the incidents were found to be compliant and twenty five were found to be non- compliant. Five of the incidents reported relate to non-compliance from previous periods (updates). The action taken is set out for Members information.

There was no non-compliant incidents reported as a result of the 2016/2017 annual dairy inspection round, from 49 monitoring inspections.

Background The Council receives and responds to pollution events and public complaints throughout the year. Compliance monitoring undertaken can also identify non-compliance. This information is recorded in the Incident Register together with the results of investigations and any follow-up actions. Incidents are publicly reported to the Council through the

Attached is the summary of the Incident Register for the period from 1 July 2016 to 7 August 2016.

Change of Format to Increase Understanding The incident register information presentation was reviewed in 2014-2015 to increase reader understanding. The first section addresses compliant incidents and can be publically discussed. The second section provides an update on non-complaint incidents from previous meetings and where an incident has been resolved it can be publically discussed. The third section provides information on non-compliant incidents during the period that are still under investigation and staff are limited in terms of public disclosure of information while the investigation is ongoing and enforcement responses have not been determined. The incident register flow chart and definition of terms provide further detail.

Discussion Council responds to all complaints received with most complaints responded to within four hours. Responses to complaints and non-compliances with rules in the Council’s regional plans, resource consents and the Resource Management Act 1991 are recorded in the Incident Register. Where necessary, appropriate advisory or enforcement actions are implemented. The latter may include issuing an inspection, abatement or infringement notice, or initiating a prosecution. Where an infringement notice or prosecution is possible, details of the incident in the Incident Register and staff comment will be restricted for legal reasons. Further information will be provided at a later date to the Council and for prosecutions a detailed report will be provided, in the confidential section of the agenda.

A summary of incidents for the period 1 July 2016 to 7 August 2016 is attached. The ‘compliant’ incidents are presented first in a table and the ‘non-compliant’ incidents are presented after in a more detailed summary.

Generally incidents in the ‘compliant’ table have a recommendation of ‘no further action’. However, an incident is considered ‘compliant’ until such time as a non-compliance is found. Therefore occasionally an incident in the ‘compliant’ table will have a recommendation of ‘investigation continuing’, if an ongoing investigation is still underway to confirm compliance.

A series of graphs are also attached comparing the number of incidents between 2015-2016 and 2016-2017, and also showing how the incidents are tracking in 2016-2017 in relation to environment type and compliance status. There is also a graphs showing enforcement action taken to date during 2016-2017.

Comments: Self-notification was received from a construction Company that drums containing an unknown product had been uncovered during earthworks at a property on Norman Street, Waitara. An inspection of the site found that buried drums had been partially exposed. The works on site ceased while New Plymouth District Council undertook a thorough investigation. Samples were taken and it was found that asbestos was present in the drums. A site management plan is being developed for the removal of the drums. An approved asbestos handling contractor has been appointed and the product is scheduled to be removed as soon as weather conditions allow. Reinspection will be undertaken after removal of the drums.

Comments: Notification was received regarding a breach of resource consent 1450-2, with regards to fat content of a 24 hour composite discharge sample, from a milk processing plant near Hawera. Analysis of the sample found that there was a total fats concentration of 1100 milligrams/litre, in contravention of the resource consent limit of 800 milligrams/litre. The shoreline and outfall were monitored by Fonterra and no adverse effects were observed. Observations of the foreshore undertaken by Council staff did not find any adverse effects. A letter of explanation was received outlining that the discharge was due to human error.

It was found that approximately 35m3 of inert plastic polymer beads, from the redundant water treatment plant at the Fonterra Whareroa site,had been disposed of at the site. These beads had become mobilised during rainfall events and were found to be tracking towards surface water. Most of the beads were subsequently removed and disposed of lawfully. The removal of beads is on going. Some letters of explanation have been received.

An investigation found that the underground fuel tanks had been replaced onsite and fill contaminated with hydrocarbons had been removed from site and deposited at a residential subdivision and a cleanfill. Dewatering activities were found to be occurring at the site in association with the instillation of the new tanks. The dewatering activities were in breach of the Regional Freshwater Plan for Taranaki as the volume being extracted exceeded the permitted daily take. Abatement notices were issued requiring the contaminated fill to be disposed of at an appropriately consented facility. This has been done. Letters of explanation have been received and Council is considering the responses provided.

Comments: A complaint was received regarding a 'white' discharge into the Herekawe Stream from the New Plymouth District Council stormwater system on Centennial Drive, New Plymouth. Inspection found that there was a white discharge slightly discolouring the Herekawe Stream. The discharge was traced to a residential complex on Centennial Drive. It was found that when a compactor truck compacted prior to emptying a skip bin white paint discharged onto land from the truck. The caretaker who discovered the discharge washed the paint into the adjacent storm water drain. At the time of inspection the site owner was spoken to and undertook to mark all storm water drains around the site to prevent any future unauthorised discharges. This was done.
