PROPOSAL: Erection of two storey and first floor side extension.

APPLICANT: Mr B Henry

REFUSED. Reason(s) for refusal:-

1 The proposed extension, due to its design, would create a discordant and visually obtrusive addition to the existing property that would detract from the appearance of the host dwelling and detrimentally affect the character of the street scene; contrary to saved policies HD20 and H15 of the Harrogate District Local Plan, policy SG4 of the Harrogate District Core Strategy Development Plan Document along with supplementary planning guidance contained within the Councils House Extensions and Garages Design Guide (September 2005).

PROPOSAL: Application for approval of details required by conditions 3 and 4 of planning permission 6.79.3905.H.FUL in relation to colour of render and stand and details of security shutters / grills.

APPLICANT: Harrogate Town AFC

REFUSAL to confirm discharge of condition(s)

1 Conditions 3 and 4 of the planning permission specifically required that no development shall take place until details of the colour of the render and colour of the stand; and details of the window treatment and the security shutters / grills have been submitted to an approved by the Local Planning Authority.

Development has started; accordingly conditions 3 and 4 cannot be discharged as work has commenced prior to the conditions being discharged.

INFORMATIVES

1. It is not considered expedient to take further action in relation to the breach of conditions 3 and 4 because the colour of the render and cladding of the spectator stand are acceptable as is the window treatment and internal security grill; the development thus complies with Core Strategy Policy SG4 of the Harrogate District Local Development Framework.

LOCATION: 7 Heath Grove Harrogate North Yorkshire HG2 0PX

PROPOSAL: Erection of two storey and single storey extensions.

APPLICANT: Miss M Matless

REFUSED. Reason(s) for refusal:-

1 The proposed two storey side extension would by reason of its height, bulk and siting in such close proximity to 9 Heath Grove have a detrimental impact on the living conditions of the residents in terms of overbearing and loss of light to the kitchen window and use of the driveway. The proposal would therefore be contrary to the relevant parts of saved policies H15 and HD20 of the Harrogate District Local Plan and policy SG4 of the Core Strategy of the Harrogate District Local Development Framework. The proposal would also be contrary to the Council’s adopted House Extensions and Garages Design Guide.

PROPOSAL: Conversion of business unit (use class B2) to form 1 dwelling (site area 0.005ha).

APPLICANT: Mr P Smith

REFUSED. Reason(s) for refusal:-

1 The proposal would result in the creation of a residential unit within a back street. Whilst the accommodation proposed would be acceptable the level of amenity afforded to future occupants would be poor as the dwelling would have a poor outlook and no private amenity space. The proposed dwelling would overlook adjacent private yard areas, resulting in a loss of privacy to neighbouring dwellings. The location of the dwelling in the back street, mainly used as a servicing and parking area, would further reduce the quality of amenity. The application is recommended for refusal as being contrary to Policy Sg4 of the Core Strategy for the Harrogate District Local Development Framework, Saved Policy HD20 of the Harrogate District Local Plan and the House Extension and Garages Design Guide. Part APPROVED and part REFUSED as set out below:

PART TO BE APPROVED: The felling of trees T1,T7,T10,T14 as shown on the submitted plan and schedule and the crown cleaning and removal of deadwood of remaining trees subject to the application. Subject to the following Conditions;

1 The replacement planting of 4 Nº Scots pines shall be planted between November and March towards the rear boundary of the garden no closer than 2 metres from the boundary fence and be 1.0/1.5 metres tall at point of planting . Trees to be planted in a prepared pit, which is 50% larger than root ball of the tree to be planted. The sides of the planting to are to be forked over to help alleviate compaction and allow the tree roots to become established. Trees to be planted with the root collar at the same level as the surrounding soil levels and backfilled with topsoil clean of building contaminants. Trees to be anchored with a single stake angled at 45% and attached the trunk of the tree at approx.1 metre above ground level and the stake to be driven into the ground clear of the root ball.

2 The crown cleaning and deadwooding of all remaining trees on site shall include the cleaning out of any stumps, deadwood, hung up branches and climbers, the removal of sucker growth, plus trunk cleaning to a height of 2.5 metres above ground level and removal of ivy.

3 All works shall be carried out by an appropriately experienced and qualified tree surgeon with no pruning wounds in excess of 50mm diameter and shall be carried out so as to conform to British Standards 3998:2010 Recommendations for Tree Works.

4 The work hereby approved shall be carried out within 2 years of the date of this consent.

Reasons for Conditions:

1 To maintain the treed appearance of the area in the interests of visual amenity.

2 In the interests of the heath and amenity contribution of the protected trees within the woodland group and to accord with good sylvicultural practice.

3 In the interests of the health and amenity of the trees

4 In the interests of good sylvicultural practice and to ensure work is done in a timely fashion in the interests of the health and amenity contribution of the trees.

PART TO BE REFUSED:

Felling of 4 scots pine and the crown thinning of 4 Scots Pines by 15% and 1 Scots Pine by 10%.

Reasons for refusal:

1 The site has been subject to a tree survey though the technical detail supporting the loss of various trees is not substantive or backed with reasoned discussion. The supporting report has suggested the loss of 8 of the 17 trees based on minor justifications which are not normally considered justification for the loss of healthy trees that form part of a large group of pine trees seen as an important part of the local landscape and the loss of the 4 trees and the excessive crown thinning of 4 scots pines by 15% and 1 by 10% hereby refused is therefore contrary to saved policy HD13 of Harrogate District Local Plan and policy EQ2 of the Harrogate District Core Strategy as it would result in loss of the amenity the trees provide and not constitute good arboricultural practice.

PROPOSAL: Change of use of land to allow the siting of 10 camping pods and erection of toilet block.

APPLICANT: Ure Camping Pods

REFUSED. Reason(s) for refusal:-

1 The proposed development, by virtue of its siting, scale and lack of information regarding the levels of excavation involved under the proposed development, would be detrimental to the landscape character and visual amenity of the field and its wider importance to the setting of the immediate locality and the city of Ripon.

The works would conflict with the Policies C2, TR4 and HD20 of the Harrogate District Local Plan 2001 (as altered, 2004), Policies SG4, SG3, EQ2 and EQ1 of the Harrogate District Core Strategy DPD and with national guidance outlined within the ‘National Planning Policy Framework’ (NPPF) (adopted 2012).

2 The proposed development, due to it providing inadequate parking and access facilities, would be detrimental to the safety and amenity of both the users of the proposed development and also the residents of the surrounding residential properties. It would significantly add to the existing problems of access already experienced in the area.

The development would conflict with the requirements of Policy SG4 of the Harrogate District Core Strategy DPD (adopted, 2009), Policies TR4 and HD20 of the Harrogate District Local Plan 2001 (as altered, 2004) and with guidance within the ‘National Planning Policy Framework’ (NPPF) (adopted 2012).

3 Due to the inappropriate levels of parking and access provided as part of the proposed scheme and the detrimental impact that the proposed development would have on the landscape character of the locality, in addition to the possible noisy activities associated with the camping pods, the development would consequently harm the existing levels of amenity enjoyed by the surrounding residential properties. This would conflict with Saved Policies HD20 and TR4 of the Harrogate District Local Plan 2001 (as altered, 2004), Policies SG4 and EQ2 of the Harrogate District Core Strategy DPD (adopted 2009) and guidance within the ‘National Planning Policy Framework’ (NPPF) (adopted 2012). 4 The method statement submitted with the application would not adequately ensure that the ecological sensitivity of the site would be sufficiently mitigated for. The proposed development could potentially have a detrimental impact on Great Crested Newts on the site. This would be in conflict with the Local Planning Authority’s responsibilities to protect the biodiversity and ecology of the site and would be contrary to Policy EQ2 of the Harrogate District Core Strategy DPD (adopted, 2009) and with national guidance within ‘National Planning Policy Framework’ (NPPF) (adopted, 2012). 5 The proposed development would potentially involve the use of a non-mains foul drainage system. However, no assessment of the risks of pollution to the water environment has been provided by the applicant. Therefore, the proposed development would not adequately reduce the consequential risks related to environmental damage and the development would conflict with Policies EQ1 and EQ2 of the Harrogate District Core Strategy DPD (adopted, 2009) and with national guidance within the 'National Planning Policy Framework' (NPPF) (adopted, 2012). 6 The proposed development would involve a change of use involving an increased exposure to the public to a known risk of subsidence, in this case gypsum dissolution. The applicant has not demonstrated that there would not be any foreseeable instability or that the effects of such instability can reasonably be overcome. Therefore, the proposed development would conflict with the requirements of Saved Policy A7 of the Harrogate District Local Plan 2001 (as altered, 2004) and with national guidance outlined in the 'National Planning Policy Framework' (NPPF) (adopted, 2012).
