ORCID: 0000- 0002-2251-7639, E-mail: [email protected] ABSTRACT: Human sciences as a reflection of social transformations fluctuate with dynamic changes of current cognitive paradigms. Following the textual and visual turn and the turn towards things (objects), there are intensified tendencies to think in terms of an “animal turn”, which becomes close not only to activists and pro-ani- mal activists but also to scientifically engaged humanists. I believe, however, that the animal turn should be treated as a meta-turn: a process that requires a change in the relationship between the reflecting subject and the object of reflection, and not only as a specific kind of representation of the surrounding world. In the proposed text, I attempt to analyze the causes of the turn towards animals. I also address the theme of cognitive resistance in view of the recognition of animal studies as a fully-fledged theoretical and research area of contemporary humanities. We must however be ready to accept the conse- quences of these assumptions: the obvious existence of many interpretations of the world. Each of these interpretations is realized through a unique kind of discourse based on a peculiar metaphor and a peculiar language. The multitude of the created mental worlds makes us realize that the reflecting subject has no access to the world as such - it has access only to the representation of the world, created through the mind that discovers this world. As I wrote in another place: “The concept of repre- senting reality through various forms of reflection arises in humanistic discourse from the approach proposing the assumption as the basic thesis that objective recreation of reality is not possible, that it always requires the use of a kind of “community” per- spectives (borrowed, of course, from the influence of culture and social context) that alter not only the form but also the meaning of the analyzed phenomena. Psycholog- ically, this is a universally accepted process when considering the accuracy of human perception. However, the popularization of approaches emphasizing the importance of interpretation has also allowed to propagate the idea of transforming the perceived world, not only on the level of mental processes taking place in the mind of the sub- ject, but above all on the level of socially regulated cultural processes that influence the way of seeing, writing and understanding the world and the way of transferring the knowledge about it” (Mamzer 2008: 62). The representation of the reality through the metaphors of discourses has until now taken two significantly visible forms - textual turn embedded in poststructural- ism and carrying a rational message, and the opposite visual turn embedded in post- modernism, which restores intuition and emotions and their role in human percep- tion of the world. This opposition was formed on the basis of the Cartesian concept of psycho-physical dualism: not only antagonizing these two ways of cognition, but also hierarchizing them in such a way that the discredited emotional cognition was for many years removed from research practice as inferior, unworthy and… feminine. The Descartes’ way of looking at the world of living beings only strengthened the vi- sion already proposed in ancient times, especially by Aristotle: “The post-humanistic perspective is associated with animal studies only when it implies a critical attitude towards anthropocentrism and not an anticipation of the post-human or the post-hu- man era. In our culture, the privileged status of man inherited from the Greeks and strengthened by Christianity involves the glorification of the mind, the language and the immortal soul” (Bakke 2011:199). Thus, both the hierarchical perception of the world built on anthropocentrism and the strengthening of psychic-somatic opposi- tion (and thus: emotional opposition

If so, what are they, and why? Should or could non-human animals have legal rights? Should we treat wild and domestic animals differently? Do human beings have the right to eat the other animals, raise them for that purpose on factory farms, use them in experiments, display them in zoos and circuses, make them race or fight for our entertainment, make them work for us, and keep them as pets? We will examine the work of utilitarian, Kantian, and Aristotelian philosophers, and others who have tried to answer these questions. This course, when taken for a letter grade, meets the General Education requirement for Ethical Reasoning. Sources and How to Get Them: Many of the sources from we will be reading from onto the course web site, but you will need to have copies of Singer’s Animal Liberation, Regan’s The Case for Animal Rights, Mill’s Utilitarianism and Coetzee’s The Lives of Animals. RATTLING THE CAGE DEFENDED STEVEN M. WISE* Abstract: In Rattling the Cage: Toward Levi Rights for Animals, the author advocated basic legal rights—specifically common law rights—for chimpanzees, bonobos, and other nonhuman animals. In this Article, the author responds to many of the major criticisms of Rattling the Cage. The author confronts critics of his historical arguments for legal rights for nonhuman animals, tracing those arguments through ancient philosophy and nineteenth century English statutes. The author also expands upon his legal arguments for animal rights, reexamining various theories of rights and justifications for treating animals as property, Finally, borrowing from his upcoming book Drawing the Line: Science and The Case for Animal Rights, the author defends his advocacy of legal rights for nonhuman animals based on the relative autonomy nonhuman animals possess.     Book Review Animal Rights Richard A. Posner' Rattling the Cage: Toward Legal Rightsfor Animals. By Steven M. Wise. Cambridge,Mass.: PerseusBooks, 2000. Pp. 362. $25.00. The "animal rights" movement is gathering steam, and Steven Wise is one of the pistons. A lawyer whose practice is the protection of animals, he has now written a book in which he urges courts in the exercise of their common-law powers of legal rulemaking to confer legally enforceable rights on animals, beginning with chimpanzees and bonobos (the two most intelligent primate species).' Although Wise is well-informed about his subject-the biological as well as legal aspects-this is not an intellectually exciting book. I do not say this in criticism. Remember who Wise is: a practicing lawyer who wants to persuade the legal profession that courts should do much more to protect animals. Judicial innovation proceeds incrementally; as Holmes put it, the courts, in their legislative capacity, "are confined from molar to molecular motions."2 Wise's practitioner's perspective is, as we shall see, both the strength and the weakness of the book. f Judge, U.S. Court of Appeals for the Seventh Circuit; Senior Lecturer, University of Chicago Law School.     Sociology Compass 6/2 (2012): 166–181, 10.1111/j.1751-9020.2011.00440.x The Animal Rights Movement in Theory and Practice: A Review of the Sociological Literature Lyle Munro* School of Applied Media and Social Sciences, Monash University Abstract Traditionally, philosophers have had most to say about the ethics of our treatment of non-human animals (hereafter animals); it is only in recent years that social scientists have engaged with issues concerning humans and other animals. However, in the sociological literature and more generally in the emerging field of Human–Animal Studies (HAS), evidence of interest in the animal protec- tion movement is slight. This review of Eliasian theory, Marxist realism, feminism, ecofeminism, and social constructionist theory – along with key activist approaches to animal activism and advo- cacy – indicates the theoretical richness of the topic that is nonetheless empirically poor. The ani- mal protection movement is referred to here simply as the animal movement or where appropriate, as one of its three strands – animal welfare, animal liberation and animal rights. The article concludes with a discussion of how social movement theory (the ‘why’) and practice (the ‘how’) might be enhanced by social movement scholars working in collaboration with animal acti- vists. Introduction A number of writers including Tovey (2003), Hobson-West (2007), and Irvine (2008) have recently drawn attention to the rare appearance of human–animal topics in social science texts. Work in the field of Human–Animal Studies (HAS) has mainly been con- fined to specialist journals and more recently to edited anthologies of previously published articles (Arluke and Sanders 2009; Flynn 2008; Wilkie and Inglis 2007).

    A Backdoor to Policy Making: The Use of Philosophers by the Supreme Court Neomi Raot The Supreme Court's decisions in Vacco v Quill' and Wash- ington v Glucksberg2 held that a state can ban assisted suicide without violating the Due Process or Equal Protection Clauses of the Fourteenth Amendment. In these high profile cases, six phi- losophers filed an amicus brief ("Philosophers'Brief') that argued for the recognition of a constitutional right to die.3 Although the brief was written by six of the most prominent American philoso- phers-Ronald Dworkin, Thomas Nagel, Robert Nozick, John Rawls, Thomas Scanlon, and Judith Jarvis Thomson-the Court made no mention of the brief in unanimously reaching the oppo- site conclusion.4 In light of the Court's recent failure to engage philosophical arguments, this Comment examines the conditions under which philosophy does and should affect judicial decision making. These questions are relevant in considering the proper role of the Court in controversial political questions and are central to a recent de- bate focusing on whether the law can still be considered an autonomous discipline that relies only on traditional legal sources. Scholars concerned with law and economics and critical legal studies have argued that the law is no longer autonomous, but rather that it does and should draw on many external sources in order to resolve legal disputes. Critics of this view have main- tained that legal reasoning is distinct from other disciplines, and that the law has and should maintain its own methods, conven- tions, and conclusions. This Comment follows the latter group of scholars, and ar- gues that the Court should, as it did in the right-to-die cases, stay clear of philosophy and base its decisions on history, precedent, and a recognition of the limits of judicial authority.

Some writings have emerged in theological circles arguing for animal rights or even for how to conceive of animals in terms of conventional theological notions such as souls and salvation. However, not many examine ideas and ways of living and being with animals in the ordinary, even mundane, situations of daily life. I suggest we need to cultivate ethical imagination in our interaction with animals, and that one way to do this involves coming face-to-face with them and being attentive to our embodiment. I draw on philosopher Emmanuel Levinas as well as theopoetics to represent the ethical experience of the encounter.
