CHAIRMAN FRANK B. AGUON, Jr., convened the public hearing and discussion on Bill No. 275 (LS) at 3:24 PM, and, again explained that Senators and Committee members would be joining and leaving the hearing on a continuing basis due the Legislative Session running concurrently with the hearing. Called the first panel to testify.

Chairman Aguon stated his intention of hearing Bill No. 275 (LS) and Bill No. 280 (LS), concurrently, because of the relative complimentary nature of both bills as they both tried to address a particular requirement within the Department of Public Health and Social Services.

Linda De Norcey, Administrator of the Northern and Southern Region Community Health Centers. Submitted written testimony (attached), and provided oral testimony, IN SUPPORT of Bill 275. In addition to her written testimony, stated that she is defmitely supporting Bill No. 275 so that vendors are paid in a timely fashion. She stated that patients are not getting primary access once the vendors decide not to continue their services. Although we established an irrevocable letter of credit, we need to ensure that all programs debts are paid in a timely fashion for services, professionals, purchases of drugs and vendors. De Norcey suggested the need to maintain a separate bank account apart from the General Fund.

Daniel T. Perez, Board of Directors, Community Health Centers, provided oral testimony IN SUPPORT of Bill 275, and reiterated Linda De Norcey's testimony and stated that funds that are not available on a timely basis because of bureaucracy and the lengthy process of the documentation are not an excuse for the delay of the public health services. Stressed the need to get a separate bank account for Community Health Center funds. Also suggested that line #3 of Bill 280-on page 3 Advisory Council be amended to read Board of Directors.

Arthur San Agustin, Acting Director, Department of Public Health & Social Services, provided oral testimony IN SUPPORT of Bill 275, and thanked all the supporters of the Bill, and further stated that Bill is a response to a system that will allow us to have direct access funds and help sustain critical services.

CHAIRMAN AGUON: Opened up questions from Senators.

SENATOR E.J. CALVO: Mentioned the good impression that the North Community Health Center has made; congratulated the good job of the Community Health Center staff; and, congratulated the author of the Bill and stated that he is IN SUPPORT of Bi11275.

SENATOR BEN PANGELINAN: Stated his support on Bill 275, and expressed his intention to work on the recommendation that will be presented before his Committee, and "put into place a program allowing the revenue generated to support the Community Health Center programs. The objective is to support the measure to address the program that will properly help the Community Health Center act in the best interests of the patients and the organization." 2

III. FINDINGS & RECOMMENDATIONS

Bill No. 275 (LS), received THREE (3) testimonies IN SUPPORT. No testimony was received opposed to Bill No. 275 (LS).

Amendments

1. A substantive amendment was made to Section 2 of the Bill, to provide for a clear and legal delineation that the accounts cited are clearly to be apart and separate from the General Fund or any other government accounts. It reads, as follows: "Community Health Center Revolving Fund. There is hereby established a Community Health Center Revolving Fund ('Fund') to be maintained by the Administrator, Community Health Centers, of the Department of Public Health & Social Services. The Fund shall be established and maintained in a bank account apart and separate from the General Fund or any other bank account(s) of the government of Guam, and shall not be co-mingled with, or a part of, the General Fund nor any other bank account. All funds due or accruing to the account from whatever source(s), as provided or authorized pursuant to applicable law, inclusive of any interest, shall be deposited in the Fund in its entirety immediately upon receipt by the government of Guam."

2. Section 2 of the Bill was further amended to establish the Administrator of the Community Health Centers as the principal administrator of the Community Health Center Revolving Fund; and to require the reporting of all expenditures and receipts of funds to the members of the Advisory Council.

No other substantive amendments, other than minor technical corrections, were made to the Bill.

9 Fund by accordingly amending §3811(a) of Chapter 3, Title 10, Guam Code

My name is Linda Unpingco-DeNorcey, the Administrator of the Northern and Southern Region Community Health Centers. I am in support of Bill 275- 30 and Bill 285-30.

The Northern and Southern Region Community Health Centers, Federally Qualified Health Centers, aim to increase access to primary health care and preventive services and to reduce health disparities among the medically underserved population. The CHCs contract health professionals, Diagnostic Laboratory Services, management information system vendors such as Cerner Etreby and Sage Inc. for the centers' operation. Most recently, the community health centers entered into a Prime Vendor Agreement with Amerisource Bergen, one of the National Pharmacy Distributors, for the procurement of pharmaceutical supplies through the centers' enrollment in the 340B Drug Discount Pricing Program. The U.S. Bureau of Primary Care Services, Health Resources and Services Administration mandates the Guam CHCs to enroll in the 340B program in order to be in compliance with the Federal Cost Principal since the CHCs receive federal money through Section 330 funding. By enrolling in the 340B Drug Discount Pricing program through Amerisource Bergen, the CHCs can procure pharmaceutical supplies at the lowest cost. Otherwise, failure to participate in the 340B program may result in a negative audit finding, cost disallowance, or the reduction in grant funding.

Since the CHCs are gearing up to implement the 340B program, it is crucial that Amerisource Bergen gets paid within 15 days after the procurement and receipt of pharmaceutical supplies in order to maintain a good credit rating with the company. Although the CHCs have an irrevocable letter of credit, the lack of payment or any delay in payment(s) may cause the vendor to place the CHCs' account on hold and/or cease doing business with the CHCs.

Over the past years, the CHCs have struggled in making prompt payments to vendors even though daily deposits from patient revenues are made to the Treasurer of Guam. As a result, the CHCs are unable to pay health professionals, laboratory, and other contractual services in a timely manner, which undoubtedly has adversely affected the efficiency and effectiveness of the CHCs' operation. When physicians and nurses under contractual agreement are not paid on time, they threaten the CHC management team of their desire not to report to work, or they will not provide their clinic schedule, the latter being a barrier in the provision of primary health care services.

Bill275-30 (page 2line 1) states: There is hereby established a Community Health Center Revolving Fund to be maintained by the Director of the Department. The Fund shall be established and maintained in an account apart and separate from any other account(s) of the government of Guam, and shall not be co-mingled."

I am proposing that this paragraph be amended so that the revolving fund be maintained by the CHC Board of Directors and the BPCS Administrator. The fund shall be established and maintained in a separate bank account apart from the general fund as well as other account(s) of the government of Guam, and shall not be co-mingled with the General Fund.

It is crucial that the phrase: "maintained in a separate bank account apart from the general fund" be added to Bill275-30. Otherwise, Department of Administration would not establish a separate bank account for all the revenues collected by the CHCs from Medicaid, Medicare, private insurance indemnities, and self-pay patients.

Additionally, I am in support ofBill285-30. On page 1, line 3 ofBill285-30, the word: "advisory council" needs to be amended to "Community Health Center Board of Directors" since the CHC Board is not an advisory council, but a governing body with fiduciary responsibilities over the CHCs. The CHC board also is a non-profit organization with the 501 (c) 3 non-profit status.

Furthermore, the Community Health Center Board of Directors do not receive any payment for their services, thus, they volunteer their time and energy working for the CHCs. Many of them have to travel to the meeting venues paying for gasoline without being reimbursed for mileage. As you know, the cost of fuel keeps rising and this can pose as a barrier in attending meetings. Thus, Bill 285-30 proposes to compensate stipends for board members, which I am very much in support of given the continual rising of gasoline prices and the added burden of such cost that has to be endured as an "out of pocket" expense for the board members. Therefore, on page 2, line 11 of Bill 285- 30, I am requesting that the $50 stipend be changed to $75 so that this amount is in accordance with the CHC Bylaws, which has been registered with the Guam Department of Revenue and Taxation.

Thank-you senators and CHC Board members for supporting Bills 275-30 and 285-30 and with your advocacy, we can improve the efficiency of the CHCs' operation as well as its financial viability. By doing so, we can achieve the mission of the CHCs, which is to increase access to primary health care services for those who are most in need of care and least able to find it and ensure that the underserved, indigent, and uninsured populations have a "medical home" where care is coordinated, comprehensive, and culturally appropriate. lf~-~~ M.iJ. ft.
