The Committee on Economic Development, Health and Human Services, and Judiciary held a public hearing on Thursday, October 01, 2009, 09:00 am, at I Liheslaturan Guahan 's Public Hearing Room on BILL NO. 30-181 (COR), AN ACT TO AMEND SECTION 3106.1 OF CHAPTER 3, DIVISION 1, TITLE 7 GUAM CODE ANNOTATED, RELATIVE TO JUDICIARY OF GUAM ruDGES AND ruSTICES.

Notices of the public hearings were disseminated to all local media via fax and publication, and are attached herein, meeting the requirements of the Open Government Law.

II. SUMMARY OF TESTIMONY

•!• Chief Justice, Judiciary of Guam, Robert J. Torres testified IN SUPPORT of Bill No. 30-181(COR). Stated that Justice Carbullido would be making the main presentation, and talk about the history of the Judiciary Efficiency Act and its nexus with Bill No. 30-181 today. Justice Torres stated he was there to lend support for the judicial salary adjustment, which would allow the Justices to make good on their commitment to evaluate the trial judges based upon their performance and compliance with the time standards that have been promulgated by the Supreme Court. He further stated that the budgetary amount involved is not significant, approximately $34,000 dollars, and that the Judiciary's not asking for additional funding to cover this amount, which would be absorbed within the context of the judiciary budget.

The Judicial Council would have addressed the salary adjustment increase, as allowed by current law, back in April so as to have it approved prior to the May 1st deadline, as prescribed by law, with the submission of the annual budget request to the Legislature. However, at that time, the Judiciary was in the midst of a fiscal crises having only received less than 60% of their monthly budgetary allotment. In light of that, and the possible reduction in workforce hours, the matter was put off until such time as the Judiciary's fiscal situation was resolved. The Judiciary's fiscal situation has since been resolved, and Bill No. 30-181 would provide the flexibility to address the matter now.

•!• Associate Justice F. Phillip Carbullido submitted written testimony IN SUPPORT of the passage of Bill No. 30-181(COR). Additionally provided oral testimony, which he stated was a short summary of the written submission.

III. COMMENTS AND DISCUSSION

Chairman Frank B. Aguon, Jr., began the discussion by clarifying that Bill No. 30-181 does not establish a new statute or provision of law. Rather, it simply provides the Judicial Council the flexibility to resolve the outstanding FY2009 and FY20 10 salary adjustment issues for the trial judges. Chief Justice Torres concurred.

Senator Matt Rector stated he supports a 4% increase, and inquired as to when was the last time the clerks in the courts received a raise. Justice Torres responded that court employees receive an increment every year. Dan Tydingco, Judiciary Policy Director, further clarified that the employees are evaluated annually, and that dependent upon their time in service they would receive an increase based upon a graduated percentage. Justice Torres stated: that due to the fiscal crises they were unable to address the trial judges increments, which are addressed under a different pay structure than court employees. The fiscal crises has been resolved, and Bill 181 would allow them the flexibility to address the trial judges

Senator Rector: What about the language in the bill which changes shall to should include the increase amount in the budget? Justice Torres: There is a statutory requirement to submit the budget by May 1st. This would give us more flexibility in the 5 event a decision was not reached by May 1 \ due to circumstances.

Senator Edward J.B. Calvo asked if this salary adjustment process included court referees and magistrates. Justice Torres responded: no, that it only addresses the six trial judges. The magistrates are tied into a different pay structure. Page 2 of4 Public Hearing Bill No. 30-181 Senator Thomas C. Ada How many judges? Justice Torres: six. What's the annual impact? Justice Torres: It's about $34, 000 dollars. Senator Ada: I understand the question Sen. Rector was talking about; should versus shall. Do you have reservations with language that subsequent to the next fiscal year it shall be included? Justice Torres: That's fine. It's just that the circumstances that happened before May of this year may come again before the Judicial Council. It's important that we have the flexibility, should, due to similar circumstances we again find ourselves in the same situation. In May we weren't in a position to vote for it. During the summer when we again started to get our allotments, circumstances changed. We need to have the flexibility at least to the close of the fiscal year.

Chairman Aguon: If a new judge is brought in, would that judge have to go back and revert to the original salary structure, and then incremental adjustments would be provided, or are you looking at continuous adjustments being made and just slotting that individual into the existing pay structure? Justice Torres: It applies to all the judges, both current and future.

Associate Justice F. Phillip Carbullido presented a synopsis of his written presentation.

Chairman Aguon: As I previously stated, and I appreciate you reiterated, this is not new legislation, but rather, simply an adjustment of something that was previously adopted into law.

Senator Vicente C. Pangelinan: Why are you excluding the Presiding Judge? Justice Torres: The Presiding Judge's salary is higher than the others, and at that time when the legislation initially went through there was not an effort nor support to include the position. Justice Carbullido: We do not mind including the Presiding Judge. Senator Pangelinan: Won't the judges eventually catch up with and exceed the Presiding Judge's salary? Justice Carbullido: The Presiding Judge works just as hard as the other judges. I would like to have the Judicial Review Committee be able to address all the judges, across-the-board. Justice Torres: I think that's something that should be examined.

There being no further discussion from the committee members, Chairman Aguon concluded the hearing on Bill No. 30-181 (COR).

IV. FINDING AND RECOMMENDATION

The current situation within the Judiciary, wherein the May 1st deadline for the inclusion of the trial judges annual salary adjustment in the budget request could not be met, was a direct result of fiscal difficulties being encountered relative to obtaining their monthly budget allotments on a timely basis. This necessitated a delay in the annual determination of an adjustment, pending a resolution of the fiscal issues being encountered. Bill No. 30-181, as amended, would provide the necessary flexibility to address the annual salary adjustment for judges when able to appropriately do so, without exceeding their budget.

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. Section 3106.1 of Chapter 3, Division 1, Title 7, Guam Code

3 Annotated, is amended to read:

4 "§3106.1. Annual Adjustment of Judges and Justices Compensation.

s (a) Annually, prior to October 1, [prior to ~4ay 1,] the Judicial Council

6 may, with reference to Title 7 GCA Chapter 4( e), adjust the annual

7 compensation of the judges of the Superior Court, including [except] the s Presiding Judge and the Justices of the Supreme Court, for the next fiscal

9 year by an amount not in excess of four percent (4%) more than the previous

10 fiscal year's annual rate of compensation.

11 [(b) The annual compensation of the Presiding Judge shall be One

12 Thousand Dollars ($1,000) more than the salary ofthejudges.]

13 (b) Funding requirements for any adjustment approved by the Judicial

14 Council should be contained within its' approved fiscal year budget,

2 budget, then, any funding requirements shall be absorbed from its' approved

I am here to testify in support of Bill 181 which has been introduced by our good Chairman, Senator .

Mr. Chairman, I want to personally thank you for authoring this measure, particularly since its passage will make good on the intent and provisions of Public Law 28-137, the Judicial Efficiency Act, which was enacted three years ago.

1 The 28 h Guam Legislature, in close dialog with the island Judiciary, passed legislation in June 2006 to address two major issues: the requirement to establish time standards for the prompt disposition of court cases; and the adjustment of trial judges' salaries which had been frozen since 1991.

In furtherance of the recently passed law, the Supreme Court adopted time standards for the prompt disposition of court cases. It is my belief that under the time standards adopted, the trial judges are making substantial progress in timely disposing of cases.

The reason we are before the Legislature today pertains to the timing when the Judicial Council is required to act on the trial judges' 4% salary adjustment. Current law requires the Judicial Council to act on the adjustment by May 1 of each year to be effective the next fiscal year.

Earlier in the fiscal year and up to July of this year, the Judiciary was experiencing severe financial shortfalls from the erratic and incomplete releases of its monthly allotments. During this time, the Judiciary was receiving on average about 60% of its monthly allotments. As a result, the Judiciary adopted austerity measures to live within the limited revenue streams and made every effort to continue to deliver the same level of service to the public. The most extreme austerity measure was sending timely notices to the Judiciary employees of possible furloughs and operating under a 32-hour work week. With that threat and possibility looming over the rank and file personnel of the Judicial Branch, the Judicial Council, which was obligated to adopt and transmit a proposed 5 budget for the upcoming fiscal year by May 1 \ made the difficult decision of turning down a 4% salary adjustment for our trial judges. I supported the decision of the Judicial Council. I could not in good conscience approve a 4% salary adjustment for our trial judges when our employees were facing a 20% reduction in pay for the remainder of the fiscal year. I felt constrained to take this position even when the data clearly demonstrated that the trial judges had substantially achieved the time standard goals. There was little reservation in my mind that the trial judges as a group deserved the 4% salary adjustment. Now that fiscal normalcy has been restored with the regular release of more than 90% of our monthly allotments, our employees no longer face the threat of 32 hour work weeks. Therefore, I am requesting the Judicial Council be granted the authority to approve the 4% salary adjustment of our trial judges for Fiscal Year 2009-10 by extending the May 1 deadline in which the Judicial Council is required to act. Bill 181 accomplishes this request. I am asking for your favorable action on Bill181.

The Committee on Economic Development, Health & Human Services, and Judiciary will hold a public hearing on ten (10) legislative bills, as well as two (2) confmnation hearings, beginning at 09:00AM on Thursday, October 1, 2009, in the Guam Legislature Public Hearing Room.

The public hearing on legislative bills is broken into two (2) sessions, as follows: 1. 09:00 AM to 12:00 Noon 2. 5:00PM to completion

The two (2) confinnation hearings will be conducted from 1:30PM to 5:00PM. The two (2) nominees are: 1. Lillian Perez-Posadas, appointed Member, Guam Memorial Hospital Authority Board of Trustees. 2. Alberto E. Tolentino, nominee, Magistrate Judge, Judiciary of Guam.

The Committee on Economic Development, Health & Human Services, and Judiciary will hold a public hearing on ten (10) legislative bills, as well as two (2) confirmation hearings, beginning at 09:00AM on Thursday, October 1, 2009, in the Guam Legislature Public Hearing Room.

The public hearing on legislative bills is broken into two (2) sessions, as follows: 1. 09:00AM to 12:00 Noon 2. 5:00PM to completion

The two (2) confirmation hearings will be conducted from 1:30PM to 5:00PM. The two (2) nominees are: 1. Lillian Perez-Posadas, appointed Member, Guam Memorial Hospital Authority Board of Trustees. 2. Alberto E. Tolentino, nominee, Magistrate Judge, Judiciary of Guam.
