A will may be the most vital piece of your estate plan, even if your estate is a modest one. It is a legal document that lets you direct how your property will be dispersed (among other things) when you die. It becomes effective only after your death. It also allows you to nominate an estate executor as the legal representative who carries out your wishes. In addition, in many states, your will is the only legal way you can name a guardian for your minor children. Without a will, your property will be distributed according to the intestacy laws of your state. The laws of your state also govern the validity of a will. What are the requirements? Requirements vary from state to state. Generally, for your will to be valid, the following requirements must be satisfied. You must be 18 and of sound mind Generally, you must be 18 years of age to execute a will, although some states have a different minimum age requirement. You also must be of sound mind. That means that you must have testamentary capacity--that you know and understand what property you own, its nature, who would inherit it, and the plan for disposition outlined in the will. You must also be free of undue influence or fraud at the time the will is drafted. -

Caregiving and the Case for Testamentary Freedom Joshua C. Tate* Almost all U.S. states allow individuals to disinherit their descendants for any reason or no reason, but most of the world’s legal systems currently do not. This Article contends that broad freedom of testation under state law is defensible because it allows elderly people to reward family members who are caregivers. The Article explores the common-law origins of freedom of testation, which developed in the shadow of the medieval rule of primogeniture, a doctrine of no contemporary relevance. The growing problem of eldercare, however, offers a justification for the twenty-first century. Increases in life expectancy have led to a sharp rise in the number of older individuals who require long-term care, and some children and grandchildren are bearing more of the caregiving burden * Assistant Professor of Law, Southern Methodist University. The Elective Share Terry L. Turnipseed I. INTRODUCTION There is certainly no doubt that community property has its faults. But, as with any flawed thing, one must look at it in comparison with the alternatives: separate property and its companion, the elective share. This Article argues that the elective share is so flawed that it should be jettisoned in favor of community property.' The elective share can trace its ancestry to dower and curtesy, with the concept of dower dating to ancient times.2 In old England, a widowed woman was given a life estate in one-third of certain of her husband's real property-property in which the husband held an inheritable or devisable interest during the marriage.3 Once dower attached to a parcel of land at the inception of the marriage, the husband could not unilaterally terminate it by transferring the land.4 The right would spring to life upon the husband's death unless the wife had also consented to the transfer by signing the deed, even if title were held in only the husband's name.5 Copyright 2011, by TERRY L. -

Wills and disability planning documents A. Will formalities and enforceability of foreign wills 1. ESTONIAN WILLS In Estonia, a testator may freely transfer his or her property (movable and immovable things or non-material objects, eg, securities and trademarks), claims of patrimonial character and property obligations by executing a will that can be altered, supplemented or revoked at any time by drawing up a new will, or not making a will. An estate does not include the rights and obligations of the testator that pursuant to law or by their nature are inseparably bound to the person of the testator. In cases provided for by law, property subject to succession may include intellectual property (authors’ property rights to works of literature, science and art, neighbouring property rights and rights to industrial property), as well as other property rights and duties stipulated by law. A will can be made, altered, supplemented or revoked exclusively by the testator him or herself and only by a legally capable person who is able to comprehend the importance and consequences of his or her actions. A will may be made in a notary authenticated form by a minor of at least 15 years of age, and in that case, the minor does not require the consent of his or her legal representative for making a will. Under the laws of Estonia a reciprocal will of spouses is available. A reciprocal will of spouses can be made exclusively as an official will and only by spouses. -

That is to say, we may have more than one home or spend significant amounts of time in more than one country. There can be nothing more sublime than to immerse oneself in a foreign culture, converse in a different language than one’s own native tongue, and open the mind to ways of thinking that may even be anathema to the values instilled in us from our very first years. One can only benefit. But what if you were someone like Douglas Raines Tompkins, founder of The North Face and Esprit apparel companies, and adventurist-turned- philanthropist? When Tompkins sold his companies, which he founded in San Francisco, California, where he lived most of his life, he committed to donating his entire wealth to land conservation and wildlife preservation.1 Tompkins acquired millions of acres of land in Chile and Argentina and made grand bargains with the governments of those nations: he offered to donate his land to the governments as long as they too contributed land, and agreed to dedicate the entirety of those lands for national parks and wildlife preserves. -

TEXAS COMMUNITY PROPERTY LAW: CONSERVATIVE ATTITUDES, RELUCTANT CHANGE JOSEPH W. MCKNIGHT* I INTRODUCTION Reform of Texas family property law has been significantly restrained by the conclusion of the Supreme Court of Texas in 1925 that the marital property system is constitutionally defined.' If the court felt that recourse to the state constitution was required to save the underlying doctrine of Texas marital property from being subverted by ill-conceived legislative efforts to improve the legal lot of married women,2 it may have been correct. A major tenet of the system was thereby preserved,3 and subsequent pressures for legislative change were removed due to reduced legislative power. Without the decision of 1925, however, the system could have been developed very differently. While Texans have gradually lifted most fundamental inhibitions by amending the constitution itself, the Texas Supreme Court's failure to formulate consistent principles of matrimonial property law has encouraged resort to statutory reform as the principal means of legal modernization. On its face, the Texas Constitution gave no hint of the interpretation put upon it in 1925. Since the advent of no-fault divorce in the 1960s and 1970s, both divorce litigation and negotiation have focused predominantly on the distribution of property and debt. Many divorcing couples do not have minor children, and spousal support is today awarded only rarely.4 But virtually all divorcing couples have debts, and most have assets.
