A. EXECUTIVE SUMMARY

1. The Urban Development and Housing Department (UDHD) of Government of Madhya Pradesh (GOMP) launched Madhya Pradesh Urban Services Improvement Project (MPUSIP) with the loan assistance from Asian Development Bank (LOAN NO. 3528-IND). ADB and the GOMP agreed on ADB's investment in phased manner in this priority sector taking up water supply scheme (WSS) in 64 ULBs and sewerage management in 4 ULBs under Phase 1. The Urban Development and Housing Department is an Executing Agency for the Project. Madhya Pradesh Urban Development Company Limited (MPUDCL) is the nodal Implementing Agency through a central Project Management Unit (PMU) for implementation of the Project with further supported by Project Implementation Units (PIUs). The PMU has been assisted by Project Management Consultant (PMC) namely M/S TATA Consulting Engineers Limited in association with JPS Associates Private Limited, New Delhi.

2. List of the towns, as per revised procurement plan is depicted in Appendix 1. The entire project is planned to be implemented in three periods: (i) preparatory and procurement; (ii) construction and (iii) operations and maintenance. Prior to implementation of the project, design Consultants were hired by MPUDCL to develop Detailed Project Report (DPR) of each subproject town. In regard to social safeguard, subprojects are classified as category ‘B’ for involuntary resettlement and indigenous peoples as per ADB Safeguard Policy Statement (2009). Each subproject has been screened to assess the social impacts likely to be occurred due to project interventions. Resettlement Plan is developed using approved Resettlement Framework (RF) and Indigenous People Planning Framework (IPPF). 4. Semi-annual Social Monitoring Report(SSMR) on social safeguards is required to be submitted under Safeguard component of MPUSIP. This is the 5th Semi-annual Social Monitoring Report (SSMR) which presents progress of the subprojects of 64 towns of water supply scheme and 4 towns of sewerage under Phase 1 from August 2019 to July 2020.

Period of reporting is 12 months as one of the SSMR was missed out due to endemic of COVID 19.

5. Social safeguard reports such as involuntary resettlement due diligence report (DDR) / Resettlement Plan and indigenous peoples DDR are prepared for the subproject towns under packages having nil or insignificant temporary impacts of involuntary resettlement and indigenous peoples impacts. Resettlement Plan is prepared for subproject water supply town Khajuraho and Rajnagar, although significant impact is not expected. Altogether, subprojects under Phase 1 are considered under category ‘B’ because of insignificant involuntary resettlement impact. It is confirmed that none of the sub project is identified up to now, which will make the negative impact on Indigenous People. Except Package 1C, under WSS Sohagpur, no issue of private land acquisition emerged where the livelihood of the people would get impacted. Land proposed for subproject components belongs to government and allotment of the identified land for subproject components in the name of concerned urban local body (ULB) is either completed or in progress.

6. Summary of involuntary resettlement and indigenous peoples reports were prepared in vernacular language Hindi for disclosure at the notice board of respective urban local body (ULB)s and project implementation unit (PIU)s. Some sub project towns were visited to identify the social risks and impacts due to subproject components and verified the status of land ownership from local revenue or ULB office. Out of 26 packages, updation of social safeguard reports (IR DDR / IP DDR) of 16 packages have been done and submitted to ADB and two packages are approved. Compliance of the observations on remaining 14 packages are in progress.

7. The overall project is classified as category ‘B’ in accordance with ADB Safeguard Policy Statement (SPS). ADB's SPS covers both temporary and permanent impacts. One parcel of land for approach road to intake well had been acquired during the implementation period for WSS town Sohagpur under Package 1C. In Sohagpur, a total of 5 private land owners sold their land under negotiated settlement and all five affected persons have received compensation amount for their land. In other subprojects, land has also been donated voluntarily by private landowners for subproject components in WSS subproject town Amla under pkg 1C, town Gautampura under pkg 2A, town Dhamnod under pkg 2C and town Mauganj under pkg 7C. In the another subproject WSS Amla, private land needs to be acquired to access the identified land for subproject component and acquisition of land is being processed through negotiated settlement. Social issues, in particular related to the land proposed for components under subproject towns are depicted in Table 4 of Chapter C.

8. During reporting period (Aug 2019 to July 2020), considerable number of consultative meetings were held in community about subproject and to address the compliance of grievance, if any mainly related to social issues and on health and hyigene. The meeting covered issues of land as well as compensation and other related to project activities. Regular consultation / meeting with community are being conducted throughout the implementation phase. For more details, refer to Table 5 under chapter E.

9. Grievance Redressal Mechanism (GRM): Out of 67 awarded towns, 64 grievance redress committee (GRC) at town level has been established at awarded subproject towns, for details refer to Table 6. Grievance registers are placed at subproject town and grievances are registered and resolved. For more details, refer to table 7 under Chapter F.

10. During this reporting period about 383 and 246 numbers of grievances are reported each from August 2019 – January 2020 and February 2020 – July 2020 respectively and all are resolved.

B. BACKGROUND OF REPORT AND PROJECT DESCRIPTION

11. Project Description: The Government of Madhya Pradesh (GOMP) has been implementing the Madhya Pradesh Urban Services Improvement Project (MPUSIP) with financial assistance (loan) of the Asian Development Bank (ADB). ADB approved the sector loan for the GOMP to implement MPUSIP. The Project aims to improve urban services, particularly water supply in the 128 towns and wastewater management in the selected 10 towns of the state Madhya Pradesh. These selected towns are further divided into two phases. The sector project loan was approved on 18 May 2017, signed on 19 June and got effective on 21 August 2017 for Phase 1. ADB's support was sought to improve water supply services in small and remote urban local body (s) (ULBs) of Madhya Pradesh as well as sewerage management in selected towns which were not supported by any other program. ADB and the GOMP agreed on ADB's investment in phased manner in this priority sector taking up water supply scheme (WSS) in 64 ULBs and sewerage management in 4 ULBs under Phase 1. The towns were selected based on certain criteria’s like having reliable water resource, sound engineering feasibility, available land and commitment for operations and maintenance. As per revised Procurement Plan during April 2020, MPUSIP’s physical components include (a) improvements to water supply scheme in 64 subproject towns, and (b) sewage collection and treatment services proposed in four (4) identified towns namely , , Saikheda and under Phase 1 while in Phase 2 – water supply scheme in 64 subproject towns and sewage collection and treatment services proposed in six (6) towns namely Sanchi, Dhamnod, , Maihar, Khajuraho and Rajnagar, refer to Figure 2. Revised list of the subproject towns is attached as Appendix 1. The entire Project envisages to deliver:

• Continuous, pressurized, safe and sustainable drinking water through private household metered connections in 64 towns each under Phase 1 and Phase 2; • Sewage water collection and treatment systems are proposed in 4 and 6 identified towns under Phase 1 and Phase 2 respectively and; • Non-physical investments comprising of establishing GIS system, capacity building of participating urban local bodies in contract management, improving local operators’ capability through global partnership and building capacity of the implementing agency, urban local bodies and services utilities for ensuring long term sustainability of services.

12. The State’s Urban Development and Housing Department (UDHD) is the Executing Agency for the Project. The Madhya Pradesh Urban Development Company Limited (MPUDC) is the nodal Implementing Agency through a central Project Management Unit (PMU), who is mainly responsible for implementation of the Project with further supported by Project Implementation Units (PIUs). The PMU and PIUs both have been assisted by Project Management Consultant (PMC) namely M/s TATA Consulting Engineers Limited in association with JPS Associates Private Limited, New Delhi for subproject towns under Phase 1. The PMC (PIU)s are located at regional levels like Bhopal, Indore, Jabalpur, Sagar and Gwalior. These regional PMC (PIU)s are playing an important role in the supervision of execution, safeguard compliance, reporting and coordination.

13. The entire Project is planned to be implemented in three phases - (i) preparatory and procurement; (ii) construction and (iii) operations and maintenance. The project preparatory activities include preparation of design and procurement of consultants. Design Consultants were hired to prepare detailed project report (DPR) along with safeguard reports of each subproject town. Each component under subprojects are carefully addressed in terms of its involuntary resettlement and indigenous people impacts in the DPR which includes social and

environmental report. Design, build and operate (DBO) model is adopted during construction, operation and maintenance phase and this will include (i) finalization of design of each subproject components on the basis of detailed design and detailed measurement surveys (DMS) (ii) construction of water supply facilities, using DBO model in all project towns the facilities will include raw water intake, water treatment plant (WTP), overhead tanks (OHT), distribution networks including the metered household connections. After the construction (expected to be completed in 2 years), DBO Contractors of the civil works packages will continue to operate and provide continuous water supply service for subproject towns for a period of 10 years. The DBO contractor will also ensure proper metering and volumetric billing, adequate water pressure is maintained at the consumer end and supplied water complies with national quality standards for drinking water.

14. All subprojects are classified as category ‘B’ under the MPUSIP for impact on involuntary resettlement and for indigenous peoples as per ADB Safeguard Policy Statement (SPS), 2009. Social impacts of each subproject are being screened to assess the likely impacts on the project which are categorized as either ‘Category B’ or ‘Category C’. If required, a Resettlement Plan (RP) is prepared to address the negative impacts of proposed works as per approved Resettlement Framework (RF) and Indigenous People Planning Framework (IPPF). It is perceived that the significant number of subprojects would not make impact on any physical or economic displacement. Therefore, Involuntary Resettlement Due Diligence Reports (DDR)s are prepared in absence of any private land acquisition and involuntary resettlement impact.

15. The Loan Agreement was signed between Government of Madhya Pradesh (GOMP) and ADB in the month of August 2017. As per the agreement, State Government is responsible for execution of the project works according to the budget line. Total estimated cost of the project is US$ 829 Million. Out of total estimated cost, US $399 Million is the estimated cost for Phase1 and US $430 Million is the estimated cost for Phase 2 of MPUSIP.

16. Purpose of the Report – This semi-annual social monitoring report (SSMR) on social safeguards of subproject towns under Phase 1 aims to review and ensure project implementation in view of the objectives and ADBs Safeguard Policy Statement 2009. The report is outlined on the basis

of the structure presented in the project administration manual (PAM) and includes information on – the scope of impact, compensation, rehabilitations, public participation, consultations, grievance redress mechanism (GRM), institutional arrangement, monitoring results, compliance status, follow up actions, recommendations and disclosure etc.

C. SCOPE OF SOCIAL SAFEGUARD IMPACTS

18. ADB's classification system - Prior to civil works implementation, all the subprojects selected for implementation are screened and classified using ADB's classification system. The classification system is presented below for more understanding:

• Category A: Subprojects proposed for construction or development, will fall under this category, if, it caused a significant involuntary resettlement impacts with a physical displacement of 200 or more persons from their residences, or 200 or more persons lose 10% or more of their productive or income generating assets, or more persons or 200 or more persons experience a combination of both. • Category B: Any proposed subproject that includes involuntary resettlement impacts but are not deemed significant considering loss of shelter/houses or productive or income generating assets will be considered for category B. • Category C: A proposed subproject that has no involuntary resettlement impact.

19. Social Safeguard Impacts (involuntary resettlement): This Project under MPUSIP is classified as category ‘B’ for its involuntary resettlement impacts and impacts on indigenous peoples residing in the sub-project area in considerations of the ADB Safeguard Policy Statement-2009. Primarily, land identified for the subproject components for construction or interventions are owned by Government and its local government departments. The transmission/distribution line are being laid with in the right of way (ROW) of the existing roads. However, if any unanticipated impact is involved in form of either temporary economic displacement, or temporary restrictions to land use, they is being duly addressed in line with ADB policy on involuntary resettlement.

20. Impact on Indigenous People- According to ADB SPS, 2009 - requirement no. 3 on indigenous people, the indigenous people safeguard requirements triggered if a project directly or indirectly affects the dignity, human rights, livelihood system, or culture of indigenous people or affects the territories, natural, or cultural resources that they own, use, occupy, or claim as their ancestral property. The requirements also apply to MPUSIP and its components. It also covers action conducted by the executing and implementing agencies in anticipation of ADB project. Under Phase 1, 10 subprojects towns (09 under WSS and 1 under sewerage scheme) are reported as scheduled areas under fifth Schedule as per Constitution of India, which deals with administration and control of scheduled areas and scheduled tribes. These towns are reported under Package 2B, 2C, 2D, 2F and 7B. But, no adverse impacts on indigenous people/groups was observed during the monitoring period. It is important to mention here that none of the proposed subproject facilities are located on land belonging to indigenous people. However, improvement of proposed WSS (s) and sewerage scheme (s) are not only important for the people living in the locality but also for Indigenous peoples living in the same locality under subproject town. Thus, significant number of indigenous peoples households under subproject area would have benefitted. MPUSIP will ensure that these populations are included inall the benefits of the Project.

21. Status of Social Safeguard Reports: Social safeguard reports such as Resettlement Plan (RP) / Involuntary Resettlement (IR) Due Diligence Report (DDR) and Indigenous Peoples (IP) DDR are prepared for the subproject towns having insignificant or nil temporary

impacts. Altogether, improvements to water supply systems in 641 subproject towns and to sewerage systems in 4 subproject towns are proposed under Phase 1. Tranche 1 or Phase 1 is categorized as ‘B’ for both involuntary resettlement and indigenous peoples impacts. It is confirmed that none of the sub project is identified up to now, which will make the negative impact on indigenous people community. No issue of private land acquisition emerged till date where the livelihood of the indigenous people would get impacted.The Resettlement Plan prepared for WSS town Khajuraho and Rajnagar (Pkg 6A) and sewerage scheme town Sanavad (Pkg 2H) under Phase 1 does not have significant impact. All these reports are submitted to ADB, status of each involuntary resettlement and indigenous peoples report (package wise and town wise) are duly illustrated in Table 1.

22. Social Safeguard Policy and Implementation: MPUSIP has been implementing the subprojects since February 2017, as letter of award (LOA) has been issued to DBO Contractor

since February 2017 aiming to improve the overall of water supply and wastewater systems in the selected subproject towns. Resettlement Framework and indigenous people planning framework (IPPF) prepared for the project, in accordance with ADB's SPS 2009 and agreed between the Borrower (MPUSIP) and ADB. In one of the subproject WSS town Sohagpur under Package 1C, after detailed measurement survey (DMS), private land was acquired to construct approach road to reach at Jack Well cum Pump House proposed at . Five affected persons are reported and land acquisition is done through negotiated settlement under consent land purchase policy of Government of Madhya Pradesh, for details – refer to preceding SSMR. In addition to that, there are temporary inconveniences reported like increased vehicle movements that affect the pedestrians of the immediate vicinity of the work, care is being taken through mitigation measures. Project activities don't displace to any persons and no indigenous people is affected by the subproject components.

23. Packages Awarded and Disclosure of the Safeguard Reports: MPUSIP interventions are expected to improve living conditions of people in the subproject towns after completion of the Project. The expected outcome is envisaged as inclusive of gender-focused, pro poor and sustainable WSS and sewerage management in the towns under Phase 1. These subprojects are in progress. The input provided during the reporting period is -establishment of PIUs, mobilization of experts/ human resources, development of checklist and guidelines to review and compliance of indigenous people and involuntary resettlement reports, develop understanding and Contract Agreement with design built and operate (DBO) Contractors on project requirements in relation to social safeguard through workshop and personal interactions, prepared summary of indigenous people and involuntary resettlement reports in local Hindi language to disclose the project interventions at respective ULBs office. Under Phase 1, there are 64 WSS subproject towns covered under 22 packages while 4 sewerage towns are split into four packages. No package is awarded during reporting period (August 2019 to July 2020). Out of 26 packages, 25 packages (22 of WSS and 3 of sewerage management) are awarded as on 31st July 2020 except package 2H only which is reported under bidding process.

24. Most of the DBO Contractors have submitted the designs of structures, hydraulics and electro-mechanical of subproject components for approval and civil works is commenced accordingly. List of the awarded packages to DBO Contractors along with their submission of final design (in %) and physical progress (in %) of each town/package-wise is as follows in the Table 2.

25. Compliance of National / State and ADB Policy: MPUSIP subprojects are categorized as ‘B’ or involuntary resettlement and indigenous peoples safeguards as per ADB Safeguard Policy Statement (SPS)-2009. In general, involuntary resettlement impacts are reported temporary in nature during the civil works. Majority of proposed subproject components are located on the existing facilities or public land or government’s right of way (ROW). A Resettlement Framework has already been developed for the MPUSIP in accordance with (i) the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013”; (ii) State laws and regulations; and (iii) ADB’s Safeguard Policy Statement, 2009. Resettlement Framework guides the screening and planning for all subprojects that have resettlement impacts, for more details about resettlement framework visit http://www.mpudc.co.in/mpusip-adb-funded.html. Accordingly, displaced persons (titleholders and non-titleholders) will be compensated at replacement cost and rates for different categories of losses and norms of special assistance are detailed in the Resettlement Framework. If there would be any unanticipated impact reported during the implementation, affected people would be compensated as per the agreed Resettlement Framework.The Indigenous Peoples Planning Framework (IPPF) for MPUSIP has also been developed to manage and mitigate possible impacts to the indigenous people in the project area. The IPPF sets out the policy, principles, and implementation mechanisms to address

such impacts according to ADB’s Safeguards Policy Statement (SPS)-2009 requirement no. 3 on indigenous people.

26. Updation / Revision of Social Safeguard Reports: As mentioned earlier, MPUSIP had engaged DPR Consultant to prepare detailed project reports including social and environment safeguard reports during planning stage, refer to table 1. During implementation, these reports are being reconfirmed upon completion of detailed design and detailed measurement surveys (DMS) which is conducted by Design Build and Operate (DBO) Contractor jointly with safeguard personnel of PIU field engineer and sub engineer of PMC (PIU) and PIU before initiation of civil works during implementation2. Safeguard reports (Resettlement Plan, Involuntary Resettlement DDR and Indigenous People DDR) are being updated during reporting period (August 2019 to July 2020) as final design for subproject is almost completed or in progress. No construction work is allowed to commence by PMU before the updated social safeguard document for the package is reviewed and approved by ADB and compensation paid to affected persons, if any. Final Involuntary Resettlement / Indigenous Peoples reports of subproject towns will be approved by ADB and disclosed on website of urban local body (ULB), MPUSIP and ADB. MPUSIP is responsible to hand over the land /sites to the contractor which should be free from all encumbrances.

27. During the implementation period, detailed measurement survey (DMS) was carried out by Contractor, the nature and extent of impact were assessed again through conducting field survey and consultation with project beneficiaries. Updation of social safeguard reports of 16 packages are submitted to ADB. In addition to that, three updated social safeguard reports of town Karea, Pichhore and Issagarh under Package 4D was submitted in December 2019 to ADB during reporting period. Status of the land proposed for subproject components are verified and updated with the help from ULBs and revenue officials. Proposal for allotment of the land has been submitted to concerned District Collector/Tehsildar.

28. No unanticipated involuntarily resettlement impact has resulted so far, from the construction activities under the project during reporting period (August 2019 to July 2020). Efforts have been continued to minimize environmental and social team in design the project activities. The social parameters are regularly monitored during project construction activities. During the construction phase, temporary inconveniences are reported such as increased vehicle movements that affect the pedestrians in the immediate vicinity. The social safeguard reports (Involuntary Resettlement DDR and Indigenous Peoples DDR) are being updated in the event of any site/alignment/design changes and submitted to ADB.

29. Safeguard Issues and Mitigation Measures: Project activities are being monitored regularly in all subproject towns with regard to social safeguard and involuntary resettlement aspects. No major issues were observed during the reporting period except issue of street vendors and pedestrian, some difficulty was noticed during trench digging and laying of the pipeline under construction works. In spite of that, community has taken it in positive way and supportive to the project. Some mitigation measure has been developed to avoid any social impacts in project towns. Office of the urban local body (ULB) of each subproject town is in

30. Household Survey: During implementation phase, DBO Contractors is responsible to validate the technical, environment and social data. Under the contract agreement, households survey of subproject towns will be conducted by DBO Contractor under close coordination of PIU, PMC (PIU) and PMC. Household survey is verified by the respective field engineer, safeguard team of PIU (PMC) and PIU both. After completion of the household survey, DBO Contractors will prepare the data in excel and this data will be integrated with GIS Map along with topographic survey drawing (Auto Cad) with zero referencing and covering with complete network of road/lane and by lanes under the jurisdiction of the subproject town. During reporting period (August 2019 to July 2020), households survey of package 4F (Gormi, Lahar and Mehgaon), 4B (Bhind) and 4D (Karera, Bairad, Pichhore, Issagarh, Aron and Vijaypur) was completed. Now, household survey of all awarded towns has been completed

under Phase 1. This household survey will help to gain more understanding on baseline situation against the project benefits extended to subproject towns.

31. Subproject Components and Issues: In general, sites / land parcels proposed for subproject components are owned by revenue department under Government of Madhya Pradesh (GOM), or any other government department for which the No Objection Certificate (NOC) is required from concerned department. Besides that, private land is also considered for subproject components in a few instances. In this regard, donation of the land is either voluntary (without any coercion) or purchased through negotiated settlement or land acquisition act / procedures as per Resettlement Framework. The subproject components such as Anicut, Intake well, Water Treatment Plant (WTP) and overhead tanks (OHT) are proposed on public land owned by Government and the transmission / distribution networks are laid down within right-of-way (ROW) of the existing roads.

32. During the reporting period (August 2019 – July 2020), Indian Resident Mission (INRM) visited WSS town Rahatgarh (Pkg 6C), Sagar and Makroniya (Pkg 6B) Hatta and Buxwaha (Pkg 6D), Khajuraho and Rajnagar (Pkg 6A) in October 2019 and ADB Review Mission visited Raghogarh (Pkg 4I) in February 2020. In another visit in August 2019, ADB review mission reviewed all type of progress and status at Bhopal itself. During the site visit of INRM at proposed site of WTP for Khajuraho/Rajnagar (Pkg 6A), few local people along with complainant has reported grievance about an accident of the staff enagaged with Contractor at WTP site and demanded compensation in cash for his treatment, refer to photo in Figure 3. In presence of all, contractor assured to resolve this issue. Later on, Contractor has given compensation amount of one lakh rupees to the complainant, receipt and consent letter is depicted in Figure 3. It is important to mention here that complainant (Mr. Ramesh Patel son of Narayandas Patel) was employed by Contractor as a Night Watchman at WTP site but accident was not took place at site.

33. Social issues, in particular related to the land proposed for subproject components for subproject towns are depicted below in Table 4:

34. Due to change of location of Anicut on river Bel at WSS town Amla under package 1B, private land may likely to be acquired for approach to Anicut. In this regard, identification of the land owners has been done with the help oflocal revenue officials (patwari) and a proposal was submitted to Tehsildar. And in another subproject WSS town Karhi Padliya, private land of two land owners needs to be acquired for approach bridge of Intake well at river Narmada and in WSS town Betma and Depalpur (Pkg 2A), private land of six land owners likely to be acquired for Anicut for Betma and two private land owners for Intake well for Depalpur. In some of the subprojects, land for proposed components are donated voluantirily by private

land owners. In WSS town Amla for OHT-200 KL, a private land owner has voluntarily donated his land to Nagar Parishad-Amla. In another package 2A, 2C and 7A, private land owner voluntarily donated their land for Intake well for WSS town Gautampura, OHT-360 KL in WSS town Dhamnod and for Anicut in WSS town Mauganj respectively, for more details refer to Table 4. Keeping in view, third party verification is required to address the ADB Policy. In WSS town Khajuraho and Rajnagar under package 6A, seven affected persons were identified in Resettlement Plan at proposed site of WTP near Kutni dam as this site is encroached by these affected persons from adjacent village. As per Resettlement Plan, these seven farmers had been cultivating crops in the encroached government land for their own consumption. But during implementation period, these affected persons had given a consent cum certificate letter which states that they had not grown any crop on the encroached land since 2016-17 because WTP has been proposed and significant number of households will get potable water supply from there. During the visit of ADB Social safeguard Expert (Consultant) in October 2018 guided to conduct Third Party Verification, if no impact reported or otherwise pay the compensation as per Resettlement Plan.

35. Apart from the above issues, NOC needs to be obtained from water resource department (WRD), archaeological survey of India (ASI), forest department, Indian railways, national highways authority of India (NHAI), public works department (PWD) etc., if required for subproject components.

D. COMPENSATION AND REHABILITATION

36. The overall project is classified as category ‘B’ in accordance with ADB Safeguard Policy Statement (SPS). ADB’s SPS covers both temporary and permanent impacts. As mentioned earlier, proposed site/land for subproject components belongs to government, but in one of the subprojects WSS town Sohagpur under Package 1C, private land was acquired. After detailed measurement survey (DMS), it came to notice that private land needs to be acquired to construct approach road to reach at Jack Well cum Pump House proposed at Narmada river. Five affected persons are reported and land acquisition is done through negotiated settlement under consent land purchase policy of Government of Madhya Pradesh. Under this policy, department or undertakings will pay the value of the land after calculating prevalent collector guideline rates of lands plus value of available assets on the land (trees, well, house etc.) and will also pay an equal rehabilitation grant to land owner. Keeping in view of ADB policy, socio-economic profile of affected persons along with a third-party verification has been done and attached in the updated Involuntary Resettlement DDR of town Sohagpur. All the five affected persons have received compensation amount, for details refer to preceding bi-annual SSMR.

E. CONSULTATION, PARTICIPATION AND DISCLOUSRE

37. Information dissemination and community participatory consultation is a continuous process and is being complied at every stage of the Project under MPUSIP. Community Awareness and Participation Program (CAPP) has been initiated right from the beginning of the project preparedness level, and is still continued at implementation level. During inception, site visit was conducted by the DPR team, participatory consultation and group discussions were organized in an informal and formal manner with ULB, elected body of ULB, other government departments, inhabitants including local key persons etc. This opportunity was a means of information disclosure of the proposed designs, alignment, details of civil works to be done and the people’s view about the project and ADB Policy of involuntary resettlement. During implementation, safeguard team conducted series of consultation meetings, focus

group discussions (FGD) with the local inhabitants, other vulnerable groups3 to make them aware about ongoing works, entitlement matrix of the project and compensation receiving procedure under Resettlement Framework, formation of GRC under GRM, mitigation measures including safety and security measures, employment opportunity, policy of equal payment for similar work by male and female workers etc. In addition to that safeguard teams are also conducted meeting and consultations with community people and labors on health and hygiene with awareness campaigns on HIV/ AIDS and importance of the Project linking it to health, gender, social empowerment etc. has been conducted in all the subproject towns. Viewing the impact of COVID-19, consutations are being organized with labour and community groups to take preventive measures. Training sessions are also being organized in view of community involvement in the Project such as training on plumbing activities with kit.

38. The Executing Agency has made available the summary of Initial Environment Examination (IEE) and Involuntary Resettlement / Indigenous Peoplereports of awarded subproject towns to the ULB, affected persons and local public. Subproject information was made available in a local language i.e Hindi. Summary of awarded subprojects has already been disclosed at notice board of the concerned Urban Local Body (ULB) / PIU.

39. The consultation process and its results are documented in the updated Involuntary Resettlement / Indigenous Peoples Plan (IPP) Due Diligence Report of each subproject. The consultations with affected peoples, local community particularly vulnerable groups were informed about the subproject components/activities to ensure that it adequately deal with their needs, priorities, and preferences. The outcome of the social assessment and mitigation measures were discussed with local inhabitants. Detail of consultation meetings conducted so far including reporting period (August 2019 – July 2020 are given below in the table 5.

40. PIUs level staff under guidance of PMU and PMC experts had conducted various consultations with the local populace of subproject towns to understand their views on existing water supply and proposed water supply scheme. At the same time, the communities were informed about the Resettlement Framework and grievance redress mechanism (GRM) under MPUSIP in detailed along with proposed water supply infrastructure of the town. During consultations, community enquired about the tariff and perceived benefits of water supply scheme. During reporting period (August 2019 to July 2020), there has been consultations on project design, features, implementation procedures, sewerage scheme, health and sanitation, formation of GRC, land transfer, resettlement framework and rehabilitation of affected households, possible positive and negative impacts of the project and other social safeguard issues. There is great acceptance among community about Project as there is only positive impact on the daily life of community. The people mainly raised the issue of timing and supply hours of water supply, timely road restoration and completion of the project, traffic management during business hours at the time of civil activities, O and M procedures and community participation. Apart from that local inhabitant also asked about sanitation which will be resolved after availability of safe water.

F. GRIEVANCE REDRESS MECHANISM (GRM)

41. A subproject town project-specific grievance redress mechanism (GRM) has been established in each construction phase town projects to receive record, evaluate, and facilitate the resolution of affected people’s project related concerns, complaints, and grievances. The GRM is responsible for the social and environmental performance at the sub project level. The GRM will aim to provide a time-bound and transparent mechanism to voice and resolve social and environmental concerns related to the town project.A multi-tier GRM for the town project has been proposed; each tier having time-bound schedules and with responsible persons identified to address grievances and seek appropriate persons’ advice at each stage, as required. The grievance redresses process is basically initiated at site level at first. If the grievances that are immediate, urgent and site specific, the DBO Contractor and PIU andPIU (PMC) on-site personnel, who are the most easily accessible or first level of contact persons, will provide for quick resolution of grievances. Contact phone numbers and names of the concerned site office focal person and contractors, will be posted at all construction sites at visible locations. The multi-tier (three tier) GRM for the project is outlined below:

44. 2nd Tier (At PIU Level): Composition of the PIU level GRC:

• Project Manager, associated with Project Implementation Unit (PIU) of Madhya Pradesh Urban Development Company Limited – Chairperson • An elected member nominated by Mayor in Council/ President in Council of associated Urban Local Body (ULB). • A Social Worker nominated by Mayor in Council/ President in Council of associated Urban Local Body. • Commissioner of associated Urban Local Body/Chief Municipal Officer or Community Development Officer/Community Organizer of Urban Local Body. • Community Development Officer CDO-PIU – Secretary.

45. At this tier (2nd), nomination of at least one member must be belong to tribal community (indigenous people community) in the scheduled area subproject town under composition of the PIU level GRC.

46. Major Functions: The following functions will be performed by the PIU level GRC:

• Registration of complaints by CDO-PIU from the 1st tier GRC and/or affected people; • Eligibility assessment of grievances by the GRC Chairperson; • Information to the complainant about eligibility of the complaint; • Grievance Redress Committee meetings to discuss grievances and action required; • Ensuring collection of detailed information about the eligible complaint; • Assessment of complaint, draw conclusion from discussions and make recommendations; • Develop action plan outlining activities required to implement the recommendations; • Ensuring implementation of recommendations by stakeholders or concerned authorities; • Monitoring actions of the recommendations in view of timeline; • Feedback to the complainant on action completed against registered complaint and • seeking complainant feedback on level of satisfaction; • Closure of grievances by CDO-PIU or forwarding of complaint to PMU GRC if grievance remains unresolved.

47. 3rd Tier (At PMU-State Level): Composition of State Level GRC

48. Major Functions: The state level GRC will be responsible to perform the following functions:

• Registration of complaints received from GRC PIU and/or affected people; • Information to the complainant about eligibility of the complaint; • Eligibility assessment of grievances by the GRC PMU chairperson with support of the Secretary of state GRC- – whether grievance is eligible for consideration or not at the state level; • Ensuring collection of required information about the eligible complaint; • Assessment of complaint to draw conclusion from discussions and make recommendations; • Develop action plan outlining activities required to implement the recommendations; • Ensuring implementation of recommendations by stakeholders or concerned authorities; • Monitoring actions of the recommendations in view of timeline; • Closing complaint after all actions taken as per recommendations and feedback to the complainant. • Advise to complainants about approach /appeal to the concerned department in case the complainant is not satisfied or complaint is beyond the scope of the GRC PMU.

50. The GRM is envisaged to provide a time bound and transparent mechanism to voice and resolve social and environmental concerns linked with the project. In this regard, MPUSIP had issued an official order along with the guideline to all PIUs and ULBs to establish grievance redress committee (GRC) at all awarded subproject towns. Copy of government order to establish GRC at each subproject town is enclosed as Appendix 3 and 4. Status of the formation of GRC at town level (awarded subproject towns) is as follows in the Table 6:

51. It is important to mention that most of the awarded subprojects towns have established GRC except towns namely Badarwas and Shadora (pkg 4I) and Sagar (pkg 6B). Formation of GRC of the remaining three towns are still pending as elected body has been dissolved and administrator has been appointed by the Government. During reporting period (August 2019 to July 2020), GRC is formed at two towns namely Raghogarh (pkg 4I) and Makroniya (pkg 6B).

52. The GRM aims to provide a trusted way to voice and resolve concerns linked to the Project, and to be an effective way to address affected people’s concerns. During this reporting period about 383 and 246 numbers of grievances are reported each from August 2019 – January 2020 and February 2020 – July 2020 respectively and all are resolved. These grievances are related to breakage of the existing pipeline, poor housekeeping during civil works and excavation of the road occurred by project activities. Other grievances reported during period are spreading around the dust due to civil works/excavation, excess excavation and removal of excavated material.

53. PMU has advised all the officials including Contractor to expedite the tasks fully adhering to the process mentioned in Grievance Redress Mechanism (GRM). They have also been advised to keep proper report and record of grievances received, if any. Table-7 provides the information on submitted grievances and resolved status while details of grievances reported during period (Aug 2019 – January 2020 and February 2020 – July 2020), refer to Appendix 5 and 6 respectively.

54. Till the reporting period implementation of Resettlement Plan and Due Diligence Reports in 67 subproject towns under 25 packages are ongoing. Social Safeguard Expert- Resettlement of PMC has been working closely with Project Officer (Safeguards) at PMU and with each PIUs assisted by safeguard team of PIU (PMC) so as to avoid the adverse impacts. The grievances related to social safeguard has to be treated immediately within the project entitlement framework and the numbers of grievances related to social safeguard are minimal so far.

55. There has been successful implementation of social safeguard policy including involuntary resettlement and indigenous people till date. Most of the project operations are as per the prescribed methodology of the resettlement plan and policy (Resettlement Framework). A town project-specific grievance redress mechanism (GRM) has been established in most of subproject towns to receive record, evaluate, and facilitate the resolution of affected person’s project related concerns, complaints, and grievances. All the grievances were minor and mostly informal. Most of them were related to breaking of existing water supply pipeline, road restoration and resurgence of dust during excavation. Few grievances were reported in the subproject town Pansemal, resistance from the villagers (farming community) residing in and around of the Gomai dam is reported due to abstraction of water from Gomai dam for WSS town Pansemal. In this regard, consultations are being conducted with villagers by Nagar Parishad-Pansemal, District administration and MPUSIP officials. Proper consultations and interactions with affected persons were carried out by PIU, PMC (PIU) and contractor’s representatives and all grievances were settled locally. Other that some non-recorded minor grievances have been solved through verbal assurances to the affected parties.

56. In regard to adopt the safety measures and occupational health, the workers have become more aware about their safety. They are regularly using safety gears. Occupational health and hygiene has been well taken care of. None of the single cases of accident or serious disease have been recorded in this period. There are no complaints regarding land acquisition and involuntary resettlements as well. Some of the minor issues were appropriately managed and handled in the local level with some negotiations and mutual understanding. Affordability for the use of proposed water supply is well considered through different approach and socio- economic study. Eventually, social safeguard policy is well addressed through planning and designing.

57. Nevertheless, in order to assess the existing gaps and issues of the social safeguards in all subproject towns, extensive field visits to be made by Social Safeguard Expert of PMC and Project Officer (Safeguard) of PMU would be the best effort. Most of the social safeguard issues are anticipated to be raised during construction phase. Therefore, there is need to perform regular monitoring of social safeguard issues in these projects.

G. INSTITUTIONAL ARRANGEMENTS

58. The State’s Urban Development and Housing Department (UDHD) is the executing agency of the Project and Madhya Pradesh Urban Development Company Limited (MPUDC) is the nodal implementing agency. Both the agencies are also responsible to ensure compliance with safeguard requirements of the State Government, (GOI) and ADB and for day-to-day monitoring of project progress, including the implementation of resettlement provisions in the project and produce progress report on all aspects concerning to planning, implementation and monitoring of the land acquisition and resettlement issues. In this regard, the executing agency has already set up a state level Project Management Unit (PMU) headed by the Managing Director. Implementing Agency has also set up 13 Project

Implementation Units (PIUs) to manage implementation of subproject packages in their respective towns. The PIUs are located at regional levels i.e Bhopal, Indore, Jabalpur, Sagar, Gwalior, Riwa, Chhindwara, Shahdol, Chhatarpur, , Ujjain, Khargone and Hoshangabad. Institutional arrangement and human resources are described below to ensure effective implementation of social safeguard issues:

 PMU: Social safeguard component is headed by the Project Officer (safeguards) at PMU. Project Officer-Safeguards is being supported by one Environment Engineer, one Community Development Officer (CDO) and one Gender and Social Officer to plan, manage and supervise social activities under leadership of Managing Director and Engineer in Chief (EnC).  PIU: Each PIU has a Project Manager who is overall responsible to plan, manage and implement technical as well as resettlement activities of their jurisdiction. Project Manager is supported by one Dy. Project Manager (DPM), one Assistant Project Manager (APM) and one Procurement Officer. In addition, a post of Civil Engineer for each package under PIU is also sanctioned and officials are in place. One Community Development Officer (CDO) is posted at each PIU to plan, manage and implement Resettlement Plan and other social safeguard issues.  PMC: For safeguard components, PMC has a Social Safeguard Expert, an Environment Expert and a Gender and Communication Expert to plan and manage activities related to Social Safeguards. PMC experts are also responsible to provide technical assistance to PMU and PIUs during implementation of the project by conceptualization of the activities, building their capacity for effective implementation and documentation. PMC also has positions of Resettlement Coordinator, Environmental Coordinator and Communication Assistant to support at each PIUs (One position for each PIU). Position of Resettlement Coordinator and Environment Coordinator are posted on intermittent basis. Communication Assistants are placed at Sagar, Bhopal, Gwalior, Indore and Jabalpur.  Design Built Operate Contractor (DBOC): One Safeguard Expert (Environment and Social expert) may likely be appointed by contractor for safeguard compliances, implementation of Resettlement Plan and preparation/updation of DDR/RP and its implementation etc.

59. During the reporting period, safeguard officials at PMU and PIUs are positioned on regular basis while PMC has deployed their safeguard experts on intermittent basis. Details about deployment of these Social Safeguard Officials is depicted below in the Table 8.

60. All social safeguards personnel of PMU, PMC and PIUs -are expected to work in close coordination. Social Safeguard Expert is mainly responsible to assist PMU for the implementation of ADB’s social safeguard policies on involuntary resettlement and indigenous people in the subproject towns with conceptualize design/interventions, develop plan, manage and monitor interventions. While respective PIU and PMC (PIU)s officials are responsible to ensure implementation of works with quality. PIUs has been established to assist PMU, facilitate day-to-day implementation and management of the Project. One CDO has been deployed at each PIU to look after the social safeguard issues. Civil engineers are also deployed at the subproject (Package wise) level as Nodal Safeguard Officer and working closely with the Urban Local Bodies, to expedite the safeguard compliance and payments of assistance to affected households, if any. During the reporting period, most of the social safeguard staff were discontinued and only two Resettlement Coordinators are reported in position at Bhopal and Jablapur PMC (PIU)s.

H. MONITORING RESULTS / FINDING

61. Up to the reporting period, implementation of Resettlement Plan and compliances of social safeguards is ongoing. It has come to notice that private land needs to be acquired in WSS Amla (Pkg 1B), WSS Betma and Depalpur (Pkg 2A) and Karhi Padliya (Pkg 2B). Safeguard team is working closely with technical design team so to avoid adverse impacts. In the subproject WSS town Amla for OHT-200 KL, town Dhamnod for OHT-360 KL, town Gautampura for Intake well and town Mauganj for Anicut, private land owners has voluntarily donated their land to respective Nagar Parishad. Therefore, third party verification is required to address the ADB Policy. Apart from these towns, third party verification is also required for WSS town Khajuraho/Rajnagar, for details refer to para 34. In addition to above, RPs for any of the subprojects as required will be prepared/updated, once design for these components under the respective subproject is complete. However, updation of Due Diligence reports

(DDR) are in progress where there was no land acquisition or resettlement. The grievances related to social safeguards are addressed immediately through the project entitlement framework and the numbers of grievances related to social safeguards are minimal. The assessment, monitoring, evaluation and reporting of the resettlement activities will be undertaken by the Project. The monitoring and assessment / evaluation of the contractors’ resettlement activities has been carried out by using formats to each subproject and visiting the sites during working hours. The format presents the status of work, problems, mitigation measures adopted by the Contractors etc. Such information is expected in Consultant’s monthly report on Environmental and Social Safeguards. Resettlement Plans will be prepared/updated with the entitlements, assistance and benefits, institutional arrangements, tasks and responsibilities of each level of the agencies involved in resettlement planning for the project.

62. Social safeguards are being monitored through – physical verification in the field, seeking community feedback, monthly and quarterly progress report. PMU with the assistance of PMC safeguard experts has been consolidating reports/data and inputting into quarterly monitoring report. The same has been shared with the ADB. These reports have been stating the progress of the implementation of resettlement activities, compliance issues and corrective actions. PMC Safeguard Expert-Resettlement has visited few subproject towns namely, Rahatgarh (pkg 6C), Aron, Karera and Pichhore (Pkg 4D), Gormi, Lahar and Mehgaon (Pkg 4F), Mauganj (Pkg 7A), Kurawar and Boda Alampur, Daboh, Mihona and Phuph Kalan (pkg 4A), Bhind (pkg 4B) and Rahatgarh (Pkg 4I) under Phase 1. During visit, interacted with ULB officials, elected representatives, community leaders, community of vulnerable groups, local residents and Contractor’s staff to understand and resolve social issues, if any.

I. COMPLIANCE OF SOCIAL SAFEGUARDS LOAN COVENANTS

J. FOLLOWUP, ACTION, RECOMMENDATIONS AND DISCLOUSRE

65. Under implementation phase (till the reporting period), implementation of Resettlement Plan and compliance of Due Diligence Reports in 67 subproject towns are either complied or in progress. The grievances related to social safeguard are being recorded in the register and addressed immediately in accordance with the Project GRM and the numbers of grievances related to social safeguards are minimal so far.

66. Successful implementation of social safeguard policy including involuntary resettlement and indigenous people is reported till date. Town wise subproject specific grievance redress mechanism (GRM) has been established in all construction phase towns to receive record, evaluate, and facilitate the resolution of affected persons project related concerns, complaints, and grievances. Proper consultations and interactions with stakeholders in particular local residents were carried out by PMU/PMC, PIU/PMC and Contrac’or's representatives and all grievances were settled locally. A few non-recorded minor grievances have been solved through appropriate actions taken immediately.

67. In regard to adopt the safety measures and occupational health, the workers have become more aware about their safety. They are regularly using safety gears. No child labour policy is adopted and implemented, equal pay for equal work is ensured and there are separate toilets and rest areas for male and female workers in labor camps. Occupational health and hygiene is well taken care of. Not a single case of serious disease have been

recorded in this reporting period. Some of the minor issues were appropriately managed and handled atthe local level with some negotiations and mutual understanding. Affordability and willingness for the proposed water supply is well considered through different approaches including community participation. Thus, social safeguard policy is being properly addressed during implementation phase

68. Nevertheless, in order to assess the existing gaps and issues of the social safeguards in all town projects, extensive field visits should be made by PMC Social Safeguard Expert and Project Officer (Safeguards) of PMU would be the best effort. The monitoring of social safeguard activities and implementation will be continued during the project implementation. The project will involve in following action for the implementation of social safeguard reports

• Facilitate Compensation distribution: Distribution of compensation payments will be facilitated. • Facilitate Third Party certification for any land donation and negotiated settlement/purchase under Project • Facilitate Grievance Management: It will be facilitated through GRC formed at each subproject town to address the claims, obstruction and grievances. Respective GRC will verify the case related to compensation claims and resettlement close collaboration with project affected families. • Organize GRC Meetings: The meeting will be organized as and when required. • Resolution of pending grievance: further consultations are planned for early resolution. • Facilitate for Title Transfer: It will be facilitated to follow up activities to be carried out to collect Land Ownership details form revenue department that have been transferred to concerned ULBs. • Monitoring of Safeguard Compliance: The regular follow up and monitoring of safeguard compliance will be continued.
