A Distant Reading of Legal Dissertations from German Universities in the Seventeenth Century The Historical Journal (2021), 1–31 doi:10.1017/S0018246X2100011X ARTICLE A Distant Reading of Legal Dissertations from German Universities in the Seventeenth Century Luca Scholz University of Manchester, Manchester, UK Email: [email protected] Abstract Scholars and students at early modern European universities wrote hundreds of thou- sands of dissertations. One reason why these sources have long been neglected is that they defy any individual’s capacity for close reading. This article adopts a digital distant reading approach to uncover long-term trends in the titles of over 20,000 legal disserta- tions written at German universities during the seventeenth century. Providing a path- way into a forbidding archive, the article highlights the dissertations’ interest for the history of jurisprudence and its receptiveness to social change, the history of univer- sities and academic publishing, baroque rhetoric, and cultural, political, and economic history. The titles reveal a markedly declining interest in civil law, with topical issues like debt and marriage eluding this trend. Initially, dissertations were often written in dialogic form, but these were gradually supplanted by more single-voiced and mono- graphic texts. Jurists increasingly preferred sharply delineated, diverse, and often ori- ginal subjects, writing about anything from somnambulism to pearl fishing. The way in which seventeenth-century jurists expanded the scope of their writing reflects broader revaluations of scholarly curiosity and baroque polyhistorism as well as the heightened stature of an epistemic community that interpreted ever more spheres of life through its own categories. In the course of the seventeenth century, German jurists increas- ingly set aside established subjects like servitudes, a classic institution of civil law, and engaged with themes that were more thematically focused, diverse, and sometimes highly imaginative, ranging from the law of calculation errors3 to the law of shadows.4 Increasingly abandoning the scholastic question– answer format and sometimes even embracing the German vernacular in their titles, jurists created a collection of single-voiced, monographic disserta- tions that is so diverse, wide-ranging, and frequently original that it should command the attention of historians of all stripes. This article adopts a distant reading approach to retrace long-term methodological and thematic shifts and continuities in over twenty thousand dissertations written at German univer- sities in the seventeenth century. Methodologically, it highlights the interest of argument-driven digital history and aims to encourage scholars to engage with a type of data that is available in many other contexts. Providing a path- way into a forbidding archive, this study highlights the vast diversity of insights – into the history of jurisprudence and its receptiveness to social change, academic education and publishing, baroque rhetoric, and the broader cultural, political, and economic history of the German lands – that can be gleaned from one of the richest and most neglected sources in European legal history. The first section discusses the dissertation as a genre, its ambivalent histori- ography, and the method and data underpinning this article. Similar to literary scholars who embraced computational text mining under the banner of ‘dis- tant reading’, historians could benefit from integrating more digital evidence of this kind in their work. Following a concise spatial and temporal outline of the dissertations and their unequal distribution among universities and pro- fessors, the third section retraces one of the most striking thematic shifts in this archive: a drastic decline in civil law dissertations. While the waning inter- est in fields from property to inheritance law raises important questions, topics like marriage and debt eluded this pattern. The third section of the article discusses how a growing share of the dissertations lost the dialogic attributes characteristic of the oral disputation and took on a monologic and monographic form. The decline of dialogic and antagonistic forms of reasoning – encapsulated in the scholastic quaestio and controversia – reflected broader changes in seventeenth-century academic culture, but they also transformed the dissertations as a genre. The fading of dialogue and controversy went hand in hand with a preference for more sharply delineated, diverse, and often original subjects that are the theme of the last part of the article. The way in which late seventeenth- century jurists expanded the scope of their writing reflects broader conjunc- tures of baroque curiosity and polymathy, but it also illustrates the juridifica- tion of public affairs in the Holy Roman Empire and the heightened stature of an epistemic community that felt increasingly entitled to interpret all spheres of life through its own categories. I Disputations were one of the most common teaching formats in European uni- versities from the high middle ages to the end of the eighteenth century.5 Students and teachers regularly held disputations to practise defending argu- ments, to prove their mastery of a subject, or to obtain academic degrees. The makeup of these exercises varied, but they usually involved a respondent (respondens or defendens) who, under the direction of a professor or lecturer ( praeses), had to defend publicly a number of theses against objections brought forward by an opponent. All participants were bound by strict rules of argu- mentation and behaviour. Disputations were popular among jurists, also because they were thought to prepare students for the forensic practice.6 Disputations had traditionally been held orally. In the last decades a number of studies have shed light on early modern scientific experience. While some of these studies have focused on how new facts were forced out of nature in so-called experimental situations, others have charted long-term transformations. In this dissertation I explore a rather different facet of scientific experience by focusing on the case of the Prussian university town Halle in the period from the late seventeenth till the mid-eighteenth century. At this site philosophers, theologians and physicians were preoccupied with categories such as inner senses , inner experience, living experience, psychological experiments and psychometrics. In the study I argue that these hitherto almost completely overlooked categories take us away from observations of external things to the internal organisation of experience and to entirely internal objects of experience. Rather than seeing this internal side of scientific experience as mere theory and epistemology, I argue that it was an integral and central part of what has been referred to as the cultura animi tradition, that is, the philosophical and medical tradition of approaching the soul as something in need of cultivation, education, disciplination and cure.

By the eighteenth century, there were enough printed sources and available archival materials to deluge or even overwhelm historians and biographers with information about past actors of sixteenth century history. Those biographical lexicographers made choices about whom to give prominence and whom to minimize or ignore in their works. Much has been written about the impact of printing from the time of Gutenberg through the early modern period of European history. New methods of storing and retrieving data, producing accurate maps and printing biographical lexicons are but a few of the contributions of early modern European printing presses.1 By the end the seventeenth century, a new book genre, the biographical lexicon and encyclopedia, emerged from sixteenth century German print technology.

LEAVER Apart from the various rebukes of the consistory in 1705–1706,1 not a great deal is known about Bach’s life in Arnstadt, yet these must have been formative years for the young musician. Between 1703 and 1707 he was organist of the rebuilt Bonifatiuskirche—then known as the Neue Kirche.2 These were years when he was still in his early twenties. As a musician he was already extremely accomplished, but in other respects he was still a very young man gathering knowledge and experience. Various generations of the Bach family continued to live and work in and around Arnstadt.3 The family connection was probably the main reason the young Bach, then only nineteen, was invited first to test the new organ built by Johann Friedrich Wender in 1703,4 and then to become the church’s full-time organist later the same year.5 Another extended family was active in Arnstadt. The numerous Olearius family of pastors, theologians, professors and lawyers, with branches in Halle, Leipzig and Weissenfels, also had two members, father and son, who served the churches in Arnstadt. Most music history books are strangely silent about these matters. The intertwined, indeed, inseparable historical relationships between places,performers and composers are frequently slighted in favor of the usual biographical sketches of composers, tabulations of their works, and sometimes less than historical, if relevant, discussions of musical forms, harmony and so-called styles. Music historiography, like historical writing in general, should depend, as Collingwood suggested, on the "re-enactment of past experiences in the mind of the present thinker," experiences that are "objective" or known to the historian "only because they are also subjective, or activities of his own."' Musical history is not something apart from history itself, from the historical knowledge of a given time, place and society responsible for musical works and their performance. Which brings us to the subject of the present essay. To better understand the music of a composer like Bach, his approach to orchestration and employment of specific instruments, it is useful to have a better perception of the circumstances of his musical performances and the careers of those to whom wereentrusted the onerous taskofreproducing his ideas.

    The pianos of Bartolomeo Cristofori and Gottfried Silbermann: different instruments with the same hammer action Kerstin Schwarz Bartolomeo Cristofori, working at the Medici court in Florence at the end of the seventeenth century, developed a hammer action for the harpsichord, thus inventing the first piano. The two earliest documents concerning Cristofori’s new instrument comprise a description in a 1700 inventory of the musical instrument collection of Grand Prince Ferdinando de’ Medici and an article pubished by Scipione Maffei in the Giornale de’letterati d’Italia in 1711.1 Maffei was one of the editors of the Giornale. The description in the inventory of 1700 begins with the words: Arpicimbalo di Bartolomeo Cristofori, di nuova inventione, che fa il piano e il forte and the title of Maffei’s article begins with the words: Nuova Invenzione d'un gravecembalo col piano e forte.2 Both sources thus mention a newly invented harpsichord that could play soft and loud. The earliest clear reference to a piano by Gottfried Silbermann is in Johann Heinrich Zedler’s Universal-Lexicon aller Wissenschafften und Künste in volume V, published in 1733: ‘Not long ago, this famous Herr Silbermann invented another instrument. He calls it Piano Forte […].’ 3 Silbermann apparently chose the name that the instrument can still have today, that is, without the word cembalo (harpsichord). Der Charakter eines Studienbuchs hat Schilters Institutionen iuris ex principiis iuris naturae, gentium et civilis, tum Romani, tum germanici, ad usum fori hodierni costatae (Leipzig 1685, Straßburg 1691). Schilter hat viele Institute des Privatrechts besprochen, so dominium plurium, Emphyteuse, Abtretung, Qualitätsfehler, Lex Rhodia de iactu, Erbvertrag.     Jan Schröder Politische Aspekte des Naturrechts in der zweiten Hälfte des 17. Jahrhunderts: Die Begründung des staatlichen Rechtserzeugungsmonopols Einführung In der modernen rechtshistorischen Literatur ist die folgende Ansicht über das rationale Naturrecht verbreitet: Das sogenannte „Vernunftrecht" seit der Mitte des 17. Jahrhunderts soll eine verweltlichte Sozialethik darstellen, eine Art univer- salrechtliches Minimum in dem unentscheidbar gewordenen Religionskonflikt. „Die Besonderheit des neueren Vernunftrechts", so liest man etwa bei Franz Wie- acker1, „ist... seine methodische Emanzipation von der Moraltheologie und seine Erhebung zu einer selbständigen profanen Sozialethik. Die Voraussetzung dieser Emanzipation", schreibt Wieacker, „war freilich die durch die große Glaubens- spaltung erzwungene Entkonfessionalisierung eines Naturrechts, das in den Glaubens-, Verfassungs- und Kolonisationskriegen der Epoche die gemeinsame Sprache einer auch mit geistigen Waffen geführten Auseinandersetzung bleiben mußte." Das Naturrecht war danach also eine Art Religionsersatz, eine universale, überpositive Wertordnung. Das klingt auf den ersten Blick plausibel, aber es drän- gen sich doch bald verschiedene Einwände auf: Das Naturrecht soll die gemein- same Basis für Katholiken und Protestanten gewesen sein - aber überraschender- weise stammen die maßgeblichen Lehrwerke fast durchweg von Protestanten und nicht von Katholiken. Das Naturrecht soll eine verbindliche überpositive Rechts- grundlage gewesen sein - aber in keiner frühneuzeitlichen Epoche findet man eine solche Fülle positiver Gesetzgebung wie in der des Vernunftrechts. Das Natur- recht war übernational - aber es mündet kaum mehr als 100 Jahre nach Hobbes und Pufendorf in eine Nationalisierung der Rechtsordnungen, wie sie bis dahin auf dem europäischen Kontinent unbekannt war. Wenn einem solche Zweifel einmal gekommen sind, dann lassen sie sich nicht mehr so ohne weiteres unterdrücken.
