253 SEXTA PARTE LA CAL A PARTIR DEL MOTU PROPRIO DECESSORES NOSTRI DESDE 1988 254 255 El año 1988 es importante en la historia de la Pontificia Comisión para América Latina. En ese año el Santo Padre Juan Pablo II, con el Motu Proprio Decessores Nostri del 18 de junio y con la Constitución Apostólica Pastor Bonus del 28 de junio, reorganizó y potenció la CAL, dándole una ubicación en el orgánico de la Curia Romana y precisando más su naturaleza y finalidad. Estos dos actos pontificios son el punto de partida de una nueva etapa en la vida de este Organismo de la Curia Romana, cuya importancia era cada vez más evidente para la renovación y fortalecimiento del catolicismo latinoamericano. Después de 30 años de existencia, Su Santidad Juan Pablo II, consideró que había llegado el momento de reestructurar y potenciar la Comisión para América Latina de modo que fuera siempre en grado de responder a las expectativas que la Santa Sede había depositado en ella desde su constitución en 1958. El Santo Padre renovando y potenciando la CAL quiso dar un nuevo impulso a la obra evangelizadora de la Iglesia en América Latina y renovar el organismo de la Curia Romana especialmente llamado a animar la Nueva Evangelización del “Continente de la Esperanza”. En estos últimos 20 años la CAL ha tenido como Presidente los Eminentísimos Cardenales Bernardín Gantin (1984-1998), Lucas Moreira Neves (1998-2000), Giovanni Battista Re (desde el año 2000). El Motu Proprio Decessores Nostri dispuso que el Presidente fuese ayudado por un Obispo Vice-Presidente, este cargo lo han ejercido: S.E. Cipriano Calderón (1988-2003), S. E. Luis Robles Díaz (2003-2007), S.E. José Octavio Ruiz Arenas (desde el 31 de mayo del 2007). 256 Capítulo XXI El Motu Proprio Decessores nostri y la Constitución Apostólica Pastor Bonus 1. La reestructuración de la Pontificia Comisión para América Latina Juan Pablo II, durante los 27 años de su pontificado, realizó 22 viajes apostólicos a América Latina, visitando 19 países. Desde su elección hasta la promulgación del Motu Proprio Decessores Nostri, visitó República Dominicana, México y Bahamas, en 1979; Brasil, en 1980; Argentina, en 1982; América Central, Bélice y Haití, en 1983; Santo Domingo y Puerto Rico, en 1984; Venezuela, Ecuador, Perú, Trinidad y Tobago, en 1985; Colombia, en 1986; Uruguay, Chile y Argentina, en 1987; Uruguay, Bolivia y Perú, en 1988. En su primer viaje, inauguró la III Conferencia General del Episcopado Latinoamericano, en Puebla de los Ángeles; y en 1988 en Lima, clausuró el V Congreso Eucarístico y Mariano de los países bolivarianos. En varias oportunidades, con ocasión de estos viajes se reunió con el CELAM: Río de Janeiro, 1980; Port-au-Prince, 1983; Santo Domingo, 1984; Bogotá, 1986. Además, recibió a todos los episcopados de América Latina en visita Ad Limina Apostolorum. Todo lo anterior le permitió entrar en contacto con la realidad católica de América Latina, “una grey que dentro de poco constituirá casi la mitad de los católicos de todo el mundo”.290 El constatar, de una parte, el fervor religioso del pueblo latinoamericano y la fuerte raigambre de la fe cristiana en la cultura de esos pueblos y, de otra parte, la evidente presencia de peligros antiguos y nuevos para la fe en esas tierras, movieron al Papa a dar nuevo vigor a la solicitud de la Santa Sede por la Iglesia peregrina en América Latina. Así, en el marco de la novena de años de preparación al V Centenario del inicio de la Evangelización del Nuevo Mundo, apenas pasados los dos años de encuentro con los obispos latinoamericanos en visita Ad Limina, y en vísperas de su viaje a Colombia (1-7 de 290 JUAN PABLO II, Discurso a la Asamblea del CELAM, Port-au-Prince (Haití), 9 de marzo de 1983. 257 julio de 1986), el Papa presidió una reunión de los cardenales responsables de los Dicasterios de la Curia Romana, para hablar explícitamente de la Pontificia Comisión para América Latina. Juan Pablo II, con el deseo de centrar cada vez más la atención y la solicitud de la Santa Sede por esos pueblos, y de prestar un apoyo siempre más eficaz a la tarea de nueva evangelización a la que había exhortado a la Iglesia en América Latina, quiso reorganizar y potenciar la Comisión para América Latina. Esta reunión se celebró el 12 de junio de 1986 en la sala de las Congregaciones del Palacio Apostólico Vaticano. La reunión preveía una relación del Cardenal Bernardin Gantín, Prefecto de la Congregación para los Obispos y Presidente de la Pontificia Comisión para América Latina: naturaleza, actividad, prospectivas para una reestructuración de dicha Pontificia Comisión. La relación del Cardenal Gantin se articuló en 4 puntos: 1) Institución y naturaleza de la CAL y su composición; 2) Institución del COGECAL (Consejo General de la Pontificia Comisión para América Latina); 3) Actividad de la CAL y del COGECAL; y 4) Prospectivas para una reestructuración de la CAL. EL Cardenal Gantin subrayaba cómo las normas que han regulado la naturaleza y finalidad del CAL han sido siempre de carácter interno, solamente con la aprobación del Santo Padre, pero sin un documento pontificio, como por ejemplo un Motu Proprio. Hasta entonces ningún documento pontificio había mencionado esta Pontificia Comisión. La Constitución Apostólica Regimini Ecclesiae Universae, por la que Pablo VI reformó la Curia Romana en 1967, no menciona la CAL que existía ya desde 1958. Así, el Cardenal Gantin propuso que se le dieran nuevas normas a la mencionada Comisión y que tales normas tuviesen un carácter plenamente oficial, emanadas con un documento pontificio. A la exposición del Cardenal Gantin siguió la intervención de los eminentísimos Cardenales presentes. Todas las intervenciones reconocieron la importante labor desempeñada por la CAL en sus primeros treinta años y la necesidad de reforzar su estructura. Fruto de las sugerencias y propuestas hechas en aquella reunión es el Motu Proprio Decessores Nostri, promulgado por Juan Pablo II el 18 de junio de 1988, con el cual se reorganizó y potenció la Pontificia Comisión para América Latina. Diez días después fue promulgada la Constitución Apostólica Pastor Bonus, que disponía una reforma 258 general de la Curia Romana; este importante documento pontificio dedica dos artículos a la Pontificia Comisión para América Latina. A partir de este momento la CAL quedó plenamente incorporada en el cuadro de la Curia Romana. 2. La Pontificia Comisión para América Latina en el cuadro de la Curia Romana.291 2.1 El Motu Proprio Decessores Nostri en el cuadro de la Curia Romana El Motu Proprio fue emanado 10 días antes de la promulgación de la Constitución Apostólica Pastor Bonus, que reformaba la Curia Romana. A decir de Mons. Giovanni Battista Re, Ya es importante y significativo que Juan Pablo II haya publicado una “Carta Apostólica” en forma de “Motu Proprio”, con el fin de reorganizar la Pontificia Comisión para América Latina, diez días antes de la promulgación de la Constitución Apostólica “Pastor Bonus” sobre la Curia Romana. Quiere decir que el Papa ha querido dar un relieve particular a esta Comisión, mostrando un especial afecto eclesial al “Continente de la esperanza”. Hay que agradecer mucho al Santo Padre este fino y delicado gesto de su Ministerio Apostólico. El Motu Proprio Decessores Nostri tiene una introducción y ocho artículos, que constituyen las normas por las cuales se regirá en adelante la Pontificia Comisión para América Latina. En la introducción se manifiesta en primer lugar cómo, movidos por la “cotidiana solicitud hacia todas las Iglesias”, los Pontífices han dedicado gran parte de sus afanes y han puesto su firme esperanza en la situación y destino de la Iglesia en América Latina. Testimonio de esta solicitud pastoral es la “especial Pontificia Comisión para América Latina”, constituida por Pío XII en 1958, a la que Paolo VI 291 El título de este numeral así como las líneas generales de su contenido estan tomadas de: GIOVANNI BATTISTA Re, La Pontificia Comisión para América Latina en el cuadro de la Curia Romana: estructura, finalidades y competencias de la misma según el motu proprio “Decessores nostri” y la Constitución Apostólica “Pastor Bonus” de Juan Pablo II (Indicaciones generales para la elaboración del reglamento). Esta es una ponencia que Mons. Giovanni Battista Re, Secretario de la Congregación para los Obispos y Miembro de la Pontificia Comisión para América Latina, presentó el lunes 4 de diciembre de 1989 en el marco de la Primera Reunión Plenaria de la Pontificia Comisión para América Latina. El original en español en: Arch. PCAL, I Reunión Plenaria, Atti, I, 4-7. XII. 1989. 259 añadió en 1963 el Consejo General de la Pontificia Comisión para América Latina.292 Juan Pablo II pone de relieve cómo los dos Organismos han prestado un importante servicio a la Iglesia y es justamente la importancia de su misión lo que motiva una ulterior potenciación: Los frutos y saludables efectos producidos por ambos Organismos estrechamente ligados entre sí, así como la importante y tan laudable labor que han realizado, durante los años pasados, aconsejan vivamente ahora que se les potencie ulteriormente y se les dé una estructura más sólida y más articulada.293 Con esta motivación procede primero a declarar la unificación de los dos Organismos en uno solo que se llamará Pontificia Comisión para América Latina; y a reconfirmar cuanto ya establecido en 1970 en relación a su dependencia de la Congregación para los Obispos. Luego enumera las normas por las cuales se regirá la Comisión. 2.1.1 Su vinculación a la Congregación para los Obispos El Motu Proprio declara que “Esta Comisión está estrechamente vinculada a la Congregación para los Obispos”.

For so many of my own generation, even beyond the boundaries of the Roman Catholic Church, that Council was a sign of great promise, a sign that the Church was strong enough to ask itself some demanding questions about whether its culture and structures were adequate to the task of sharing the Gospel with the complex, often rebellious, always restless mind of the modern world. 2. The Council was, in so many ways, a rediscovery of evangelistic concern and passion, focused not only on the renewal of the Church's own life but on its credibility in the world.

Bishop of Spokane May 5, 2006 THE UNITED STATES CONFERENCE OF CATHOLIC BISHOPS DECREE OF PROMULGATION On November 13, 2002, the members of the United States Conference of Catholic Bishops approved as particular law the Essential Norms for Diocesan/Eparchial Policies Dealing with Allegations of Sexual Abuse of Minors by Priests or Deacons. Following the grant of the required recognitio by the Congregation for Bishops on December 8, 2002, the Essential Norms were promulgated by the President of the same Conference on December 12, 2002. Thereafter, on June 17, 2005, the members of the United States Conference of Catholic Bishops approved a revised text of the Essential Norms. By a decree dated January 1, 2006, and signed by His Eminence, Giovanni Battista Cardinal Re, Prefect of the Congregation for Bishops, and His Excellency, the Most Reverend Francesco Monterisi, Secretary of the same Congregation, the 19 recognitio originally granted to the Essential Norms of 2002 was extended to the revised version donec aliter provideatur. As President of the United States Conference of Catholic Bishops, I therefore decree the promulgation of the Essential Norms of June 17, 2005. These Norms shall obtain force on May 15, 2006, and so shall from that day bind as particular law all Dioceses and Eparchies of the United States Conference of Catholic Bishops.
