An audit of the funds by the National Taxpayers Association (NTA) has ranked Ugenya constituency among the worst performing constituencies in the management and usage of the funds with losses run- ning to more than 50 per cent. However, the best performing constituency out of the twenty-eight audited was Rift Valley’s Tin- deret, which recorded the least amount of losses due to misuse compared to the rest. Others rated highly included Matuga, Kilome, Bura, and Makueni. Hon Esther has been a member of parliament representing Nyeri Town Constituency from 2008- 2017. As a Member of Parliament, her job was to represent the people; legislate and oversight both the executive and judiciary. She also had the opportunity to serve as a Minister for two ministries. She was the minister for Gender, Children and Social Affairs. This involved formulation of policies for the care of children and most vulnerable in society i.e. elderly and persons with disability (2008 – 2010). She also served as the Minister of Special Programmes which entailed dealing with disaster both manmade and natural. Article 35 allows a person acting on public interest to move to court and seek redress in case of denial, violation, threat or infringement of rights Already Kituo Cha Sheria is compiling a list of cases that point to blatant embezzlement of public funds with a view to instituting private legal prosecutions on behalf of the aggrieved constituencies. “Some of these cases will inform the basis of our private prosecution,” says the Executive Director of Kituo Cha Sheria Priscilla Nyokabi. She says that the organization is currently focusing on the Constituency Development Fund (CDF) and will soon file criminal proceedings against corrupt officials in the affected constituencies. She says that in the past, CDF has been considered as a political question where the MPs besides being legislators un- dertook the role of implementers and watchdogs of the CDF activities and therefore imposed a major constraint on effec- tiveness and transparency of the fund “The current institutional arrangement of the CDF and the political context are particularly prone to abuse,” avers Nyoka- bi during an interview with The Link.
