GT Academy 2016 Specific & General Rules of Entry THE TERMS WITH CAPITAL LETTERS SET OUT BELOW HAVE SPECIAL MEANINGS: “COMPETITION” the GT Academy competition 2016 comprising of Live Events and a Territory Final, as described herein. “GENERAL RULES” the general rules which apply to this Competition and which can be found in Part D. “RACE CAMP the opportunity to participate in the “GT Academy Race Camp” event which may be up PRIZE” to 10 days in duration to take place at Silverstone (or any other European venue, as the Organiser may select at its sole discretion). “ORGANISER” NISSAN MARKET AND ADDRESS “SPECIFIC RULES” specific rules of this competition on eligibility, entry and participation as detailed herein “TERMS” the Specific Rules and the General Rules. “TERRITORY” COUNTRY OR GROUP OF COUNTRIES AND WHAT REGION THEY FORM OTHER TERMS USED HEREIN AND WITH SPECIAL MEANINGS (AND CAPITAL LETTERS) ARE SET OUT BELOW IN BOLD/QUOTES. PART A: ELIGIBILITY AND ENTRY REQUIREMENTS 1. Eligibility 1.1. This Competition is open to residents of the Territory who fulfil the entry criteria described below, except employees, agents, contractors or consultants of the Organiser or Nissan Motor Co., Ltd group of companies (“Nissan”), their families, subsidiaries, affiliates and associated companies and anyone professionally connected with the Competition (who shall not be entitled to enter), (the “Entrants”). 1.2. Entrants may only enter the Competition in their country of permanent residence. For the avoidance of doubt, this is the country where you live at the time of entering and for duration of the Competition, it is where you live and work or study and where you do or would pay taxes. 1.3. To enter this Competition, each Entrant must: (a) be a permanent resident in a country listed as part of the Territory; (b) be aged 18 years or over; (c) hold a valid passport issued by the appropriate government agency of the Territory and be capable of obtaining the appropriate visa (at the Entrant’s own cost) to enter the country hosting the Race Camp Prize; (d) hold a valid driving license; (e) have not been convicted of any criminal offence or is the subject of, or part to a criminal, civil or administrative proceeding as a party litigant; - 1 - (f) be in good general health and able to comply with Motor Sports Associations (“MSA”) medical requirements detailed in section 9, 10 and 11 of the MSA 2016 License Notes, they can be found at https://www.msauk.org/assets/2016competitionlicencenotes.pdf (g) not have an existing competition driving contract with any motor sports team, body, agent or management company that conflicts with his/her ability to accept the Race Camp Prize; (h) not previously held a National A or superior MSA license or equivalent in another Federation Internationale de l’Automobile (FIA) recognised National Sporting Authority (ASN) or internationally or locally recognised motorsport Body; (i) not have competed in any form of 4 wheeled motorsport at a national championship level for more than one full season (the Organiser reserves the right to judge what classes as national level motorsport); (j) not have previously and concurrently competed at the GT Academy Race Camp stage (or equivalent or similar stages) in any previous GT Academy competition held in any territory. 1.4. By entering the Competition, each Entrant promises he/she fulfils the above entry requirements. The Organiser reserves the right to verify the eligibility of Entrants at any time during the Competition or the Race Camp Prize (which includes, but is not limited to requesting copies of any Entrant’s passports, driving licences, government issued IDs, competent proof of identity, residence and requesting any Entrant to undergo medical examination). Failure to comply with any verification procedures operated by the Organiser will result in disqualification from the Competition and/or withdrawal of the Race Camp Prize. In the event of any dispute concerning the eligibility of any Entrant to participate in the Competition, the Organiser’s decision shall be final and no appeal shall be allowed or entertained. 1.5. Entrants advancing to the Territory Finals (as defined below) and beyond may not be eligible to enter any future GT Academy competition. 2. Recruitment Period The Recruitment Period for receipt of entries to participate at a Live Event (defined below) is from XX MONTH 2016 to XX MONTH 2016 (“Live Entry Period”). PART B: HOW TO ENTER 3. Entry 3.1. To enter this Competition, Entrants must follow: (a) all the steps set out at Section 4 below during the Live Entry Period for the Live Event. 4. The Live Event 4.1. Various publicly accessible events will take place during the Recruitment Period in the Territory, allowing members of the public to participate in live gaming competitions (each a “Live Event”) in order to qualify for the Territory Final. 4.2. At each Live Event, Entrants will be invited to take part in various virtual races on the Game. 4.3. The twenty (20) Entrants from the Territory who achieve the best performances during the Live Events (“Qualifying Entrants”) will be invited to compete at the Territory Final. 4.4. The Organiser reserves the right to disqualify Entrants for unsportsmanlike conduct. Entrants who cheat by any means, including cutting corners and exploiting glitches or any other unintended functionality in the Live Event, will be disqualified. - 2 - 4.5. The Organiser’s and/or the judge’s decision (as the case may be) is final and no appeal shall be allowed or entertained 5. The Territory Final 5.1. All Qualifying Entrants will be contacted by the Organiser via SMS, call, email and registered mail through contact details communicated by the Entrant at the time of entry to a Live Event, as soon as practicable after the end of the Recruitment Period and shall be invited to take part in the Territory Final. Each such Qualifying Entrant must claim their place in the Territory Final within five (5) days of the date the notification is sent by the Organiser, or they will cease to be a Qualifying Entrant. 5.2. In the event that a Qualifying Entrant does not wish to continue participating in the Competition, or fails to claim their place in the Territory Final within the relevant deadline, or is disqualified from the Competition in accordance with these Terms or for failure to comply with these Terms, they will cease to be a Qualifying Entrant and the Organiser may, at its sole discretion, select a substitute Entrant to become a Qualifying Entrant. Such substitute Entrant shall be the Entrant from the Territory who achieved the next best performance in the Live Event. The Organiser shall repeat this process until the number of Entrants required to participate in the Territory Final is reached. 5.3. The Territory Final will be an event that will take place in the Territory at a location, date and time to be notified by the Organiser to the Qualifying Entrants by email at least ten (10) days before the Territory Final takes place. It is intended that the Territory Final will take place during MONTH or MONTH 2016; however, the Organiser reserves the right to select any date for the Territory Final. The Organiser will provide overnight accommodation for Qualifying Entrants if the Territory Final takes place over more than one (1) day. Entrants will otherwise be responsible for any expenses they incur in attending the Territory Final (e.g. travel and food expenses). 5.4. All Qualifying Entrants will be required to complete a medical questionnaire and shall be required to sign a “Participation Agreement”, and return such signed Participation Agreement to the Organiser prior to participating in the Territory Final. The Organiser reserves the right to disqualify any Entrant who fails to comply with this requirement at any stage of the Competition, or who the Organiser reasonably considers (based on the contents of the medical questionnaire) has a physical or mental condition which would make them unsuitable to participate in any part of the Competition or Race Camp Prize or could prevent the Entrant from holding a competition licence for motor sports. 5.5. Failure to disclose medical conditions that prevent the Entrant from holding a race licence may result in the Organiser seeking reimbursement for monies spent on the Entrant that enabled the Entrant to take part in the Competition. 5.6. The content of the Participation Agreement will require Qualifying Entrants to: (a) confirm their acceptance of these Terms; (b) commit to attending and participating in the entire Race Camp Prize should they win the Race Camp Prize at the Territory Final; (c) commit to participating full-time in all necessary training and racing events in relation to this Competition; (d) consent to being interviewed, photographed, filmed and recorded during all stages of the Competition and the Race Camp Prize and for any resultant footage, stills and audio (in relation to which each Qualifying Entrant will be required to waive its moral rights) to be used worldwide by the Organiser, the Nissan Motor Co., Ltd group of companies and third parties associated to the Competition , for their own promotional purposes in connection with the - 3 - Competition, the Race Camp Prize and/or the Gran Turismo series of games, in perpetuity, in all media, including online platforms, subject to the Rules under Part D “GENERAL” below. 5.7. During the Territory Final, Qualifying Entrants may be required to compete in various virtual and “real-world” challenges to test their skills and abilities, and undergo assessments which may include mental challenges and medical and physical assessments. Qualifying Entrants may be eliminated at any stage in a Territory Final on the basis of their performance in, or the results of, any of these challenges or assessments.
