In fact, at this time there was an increasing demand for visual information about the new world, and visitors, settlers and explorers alike were encouraged to document their surroundings. This was a practice that was enthusiastically adopted by many amateur women artists visiting North America, including Anna Jameson (1794-1860), but artists such as Jameson were not always able to translate the firmly established European pictorial traditions to which they were accustomed to Canada's landscapes. The disjuncture between Jameson's knowledge, which was rooted in romantic ideology, and her stay in Canada is apparent in her drawings. This thesis investigates Anna Jameson's visual representations in Canada and considers how she negotiated the often- contradictory frameworks of femininity and colonialism in her pencil and watercolor sketches. The issue of freedom and its associations with travel are ofparticular importance, as it had an undeniable effect on Jameson's ability to define herself as she traveled through Canada's wilderness, ostensibly - although not always - away from limitations related to her gender. Jameson's attempts at self-definition and the emotional transformations that occurred over the course ofher travels are reflected in her depictions of Canada's wilderness - particularly in her water themed images. iii ACKNOWLEDGEMENTS I would like to most sincerely thank my thesis supervisor, Dr. Kristina Huneault, for her support and enthusiasm for this project. PREFACE Anna Jameson's Canadian sketches are affixed to the pages of an album, held in the Special Collections, Genealogy and Maps Centre of the Toronto Public Library (TRL). In order to preserve the integrity of Jameson's album, I have reproduced her sketches in the order they appear in its original form at the end ofthis thesis (see list of plates). Importantly, their numerical designations apply to their place in the original album and do not correspond to the order they appear in the text. Further, in order to properly note the inscriptions that appear in each images, as well as those found within the album itself, I rely on a series of abbreviations that designate their location. These abbreviations correspond only to the plates themselves and have no bearing on the rest of this thesis. Images attributed to artists other than Jameson are catalogued separately and listed as figures, which are numbered in the order they appear in the text. Date:…………25 July 2020.……………………………….. 3 Abstract This study investigates women’s access to work opportunities, and management of their subsequent working careers, in the London art world between 1820 and 1860. As markets became more buoyant, in the 1820s, giving way to a tide of consumerism and mass production from the 1830s onward, the workplace associated with art diversified and grew, yielding new opportunities for training and work in illustration and reproduction, design of commodities, art-teaching and art- historical study to both men and women who, in many cases, also pursued careers as practising artists. Nevertheless, when Emily Mary Osborn’s painting ‘Nameless and Friendless’ was exhibited in 1857, it followed a tradition established in the early 1840s of presenting a demure young woman, clearly vulnerable and insecure in the commercial world, attempting unsuccessfully to earn some much-needed income from her paintings. The narrative of her ‘plight’ in seeking an income from an inadequate education has persisted to the present day, but it is argued here that this did not literally reflect the experience, either of the painting’s female creator, or of other women working in this and associated occupations at the time.

This omission forced stop-gap measures which in the area of mortgages produced a muddle. The confusion introduced into the land market led to protracted controversies among politicians and jurists during the 1820s and 1830s. The many complex principles and motives raised by the lack of an equitable jurisdiction generated much legislative controversy and experimentation. John Beverley Robinson often was central to vital discussions where he revealed both his intelligence and social biases favouring gentlemen of capital. Extremely complicated issues have deflected attention from the central issue: whether the colony needed equity, whether it needed to follow English law.

This is a prosaic, not a poetic age. It is well to conform to the condition of things as we find them." In his school and university AIoss Avas always primus, carrying off many prizes and medals. At Osgoode Hall he was successively Examiner, Lecturer and Bencher. He Avas devoted to his alma mater, and was tAvice elected Vice-Chancellor, while EdAvard Blake Avas the Chancellor. At the Bar he soon won his way and generally had a sheaf of briefs. He was twice elected to the Dominion Parliament by the citizens of Toronto, among whom his boyhood had been spent. The high character and cul­ tivation of other Canadian Judges are referred to in this volume, but none of them Avill lia\'e a more lasting fame, or be more dear to the intelligent Canadian, than Thomas AIoss. EQUITABLE JURISDICTION AND THE COURT OF CHANCERY IN UPPER CANADA By ELIZABETH BROWN* The courts of common law and equity in Ontario were fused to create one Supreme Court of Judicature in 1881. In this new court, equity prevailed over common law and the procedure adopted drew more from Chancery than from common law practice. Earlier in the century, this triumph of equity would have been predicted by very few. Although the need for equity to complement the common law had always been recognized, the traditional administration of a separate court of Chancery was unpopular. Therefore, the introduction of equity into the province had been delayed for many years, despite the harsh legal consequences this entailed. In 1837, a court of Chancery was established, but as John Spragge, later Chancellor of Upper Canada, noted "[I]t was from no love of a Court of Chancery that it was introduced, but in spite of many and strong prejudices." IThese prejudices were understandable.

    PENITENTIARY PATRIOTS: UPPER CANADA REBELLION, 1838, JAMES NICKALLS REPORT Cell door from the Kingston Penitentiary (Photo © Linda Corupe) By Brian Latham & Linda Corupe, U.E. i In the aftermath of the 1837-1838 rebellion in Upper Canada, the government was faced with over 800 political prisoners. Some were held for only a few days, while others were dealt with more harshly. Of the latter group, a few men were sent to serve time in the Provincial Penitentiary at Kingston. Most received sentences of 3 years, with banishment at the end of that time. George Buck, and Murdoch McPhadden were sentenced to just the 3 years, with no banishment following. Erastus Warner and Jesse Doan received sentences of 14 and 7 years respectively. None of these men was required to serve out their full sentences. While these men were serving their time, James Nickalls, President of the Board of Inspectors for the Provincial Penitentiary, was informed by Sheriff McDonnell that His Excellency, the Lieutenant Governor, wished interviews to be conducted into the circumstances and conditions of life for these prisoners. Nickalls complied, asking each man a series of sixteen standardized questions. Of those interviewed, eight were born in the United States, six in Scotland, only two in Upper Canada and one each in England and Ireland. Their ages ranged from 17 to 48, average 33, and their time in the Canadas ranged from 2 to 43 years, with an average of 18½. It is not known how representative they were of all the prisoners. On August 29, 1838, Nickalls transmitted the interviews of these eighteen men, which are now preserved in the collection of Upper Canada Sundries, microfilm C-6901, at both Library and Archives Canada, and the Ontario Archives in diffusion material.

Abstract Situated at the intersection of Indigenous, Canadian, British, and settler colonial literary studies, this dissertation is a transatlantic analysis of the personal and textual interactions of Drummond Island Métis interviewees, Ojibwe poet Jane Johnston Schoolcraft, British travel writer Anna Jameson, and British Lieutenant Governor of Upper Canada Francis Bond Head in the Great Lakes region in the nineteenth century. During the period after the War of 1812 and leading up to Confederation, settler narratives of sympathy for Indigenous peoples proliferated in politics and literature, yet what remains largely unexamined in the Canadian context is how this sympathy supports “the settler-colonial logic of elimination,” meaning “the dissolution of native societies” alongside the creation of “a new colonial society upon the expropriated land base” (Wolfe 2006, 387, 388, 388).

A Most Remarkable Poem… In 1843, the English barrister John Rumsey published a remarkable poem Curiae Canadenses (The Canadian Law Courts), which discusses the structure, composition and jurisdictions of the early to mid-nineteenth- century courts that existed in what are presently known as the Canadian provinces of Ontario and Quebec. The poem, which also presents a rich assortment of legal and historical miscellany, historically appears to have had greater relevance and sentimental value for members of the Ontario legal profession ostensibly because of the traditional connection between the bar of Ontario and its British heritage. Rumsey infused the poem with aspects of the satirical, and ostenta- tiously turned to Latin, publishing Curiae Canadenses under the pseud- onym Plinius Secundus, a nom de plume based on Gaius Plinius Secundus, the ancient Roman naturalist and military commander known in English as Pliny the Elder. His nephew, Pliny the Younger, famously recorded the vol- canic destruction of Pompeii in 79 AD, at which time the Elder tragically died while attempting to rescue people near the Neapolitan community of Castellammare di Stabia. It is arguable that Rumsey also may have been influenced by the pseudonym H. Scriblerus Secundus contrived by the eighteenth-century novelist and dramatist Henry Fielding in connection with the Scriblerus Club, a group of satirists that included Jonathan Swift and Alexander Pope among its members. Curiae Canadenses was originally published as a book of around 126 pages with astoundingly copious notes and supplementary materials for the purpose of educating the reader on the legal and historical details alluded to in the work.

Bringing together the narratives of fragmented family and divided allegiance, my project focuses on how women writers constructed an imagined connection with other people's nationalism by subverting deracinated fantasy to explore the tensions between the individual and racial inheritance. Examining the cultural construction of Italians, Gypsies, and Jews in the British nineteenth century, this dissertation investigates the "timeless" fantasies of artistic freedom, liberation, and tolerance associated with landless "dark Others" that contrast with their historical marginalization in England. What appeal to Barrett Browning and Eliot, are not escape from racial inheritance, but the pressing duties of the lost child to preserve history and identity, as she negotiates a role of political leadership that constrains her private choices. Inspired by the struggle of her adopted country to overthrow Austrian rule, Elizabeth Barrett Browning envisioned a national future of Italy in Casa Guidi Windows. Following the fictionalized travel writing of Anna Jameson and Arthur Hugh Clough that attempts to avoid politics in favor of art, I argue that by constructing kinship through Anglo-Italian literary tradition, Barrett Browning advocates the Italian revolutions of 1848 as liberal politics demanding English sympathy through spiritual inheritance.

Limited editions meant that these popular publications were soon out of print. Since then, these books have been con- sulted by generations of Canadians. They have been used by heritage organizations, university students and avid appreciators of Canada’s diverse architectural history. The books were soon unavailable for purchase, how- ever with the advent of new technology, Parks Canada has updated these publications and are now available in electronic format. These studies provide useful information and analysis for anyone interested in the field of Canadian architec- ture and perhaps will add to the general awareness and appreciation of this important part of Canada's heri- tage.
