I am now delivering to you documents from the Department of Planning, Industry and Environment referred to in that resolution and in my letter to you of 12 September 2019. Enclosed at Annexure 1 is a letter from the Secretary of the Department of Planning, Industry and Environment, advising that all documents covered by the terms of the resolution have now been provided. Enclosed at Annexure 2 is an index of all of the non-privileged documents that have been provided in response to the resolution. In accordance with item 5(a) of Standing Order 52, those documents for which a claim for privilege has been made have been separately indexed and the case for privilege has been noted. Enclosed at Annexure 3 is an index of all privileged documents and a submission in support of the claim of privilege. I note that submissions in support of a claim of privilege may sometimes reveal information that is privileged. To the extent that they do, such submissions should be considered to be subject to the same confidentiality as the documents over which the privilege claim is made. The Order seeks the following documents: a) All documents directly relating to the urban planning and population density exemptions granted to the City of Ryde in May 2018 b) All documents directly relating to any further urban planning and population density exemptions granted to other Sydney local government areas c) All documents concerning the assessment of Sydney local government areas whose services and infrastructure cannot cope with increasing residential population levels where advice has been provided to the Government about overdevelopment, as per the Premier's statement in August 2018 that some parts of Sydney "cannot handle extra development", and d) Any legal or other advice regarding the scope or validity of this order of the House created as a result of this order of the House The Department has interpreted points a, b and c to refer to the deferral of the commencement of the Low Rise Medium Density Housing Code (the Code). It is unclear what an "urban planning and population density exemption" may comprise, and we have provided the attached material regarding the Code on the basis that this is what is sought by the House. I note that all documents over which the Department is claiming privilege were provided to the Department of Premier and Cabinet on 25 November 2019. I now seek to provide the remainder of the documents falling within the scope of the order. Local Area Emergency declared for Greater Sydney On 26 June the NSW Government implemented a stay at home direction for people in Greater Sydney, Blue Mountains, Central Coast, Wollongong and Shell Harbour Local Government Areas (LGAs) in response to the evolving COVID-19 situation. Restrictions apply to regional and rural NSW. Details can be found on the NSW Government’s COVID- 19 response website. About Shelter NSW Shelter NSW has been operating since 1975 as the State’s peak housing policy and advocacy body, with a vision of a secure home for all. We pursue this vision through critical engagement with policy and practice, and thought leadership. We provide systemic advocacy and advice on NSW policy and legislation to resolve housing inequality. About SEPP 70 SEPP 70 is a NSW planning instrument that identifies a need for affordable housing in specified local government areas – currently Canada Bay, City of Randwick, City of Ryde, City of Sydney, City of Willoughby, Inner West and Northern Beaches councils. Being included in SEPP 70 allows a council to require an affordable housing dedication (of land or dwellings) or contribution (of money) as part of the development approval process in specified precincts. This requires a scheme that is authorised and included in a council’s local environmental plan/s, which must be approved by the Department of Planning and Environment per the requirements set out in the Environmental Planning and Assessment Act 1979 (the Act, at section 7.32). 1 Inclusion in SEPP 70 does not impose any positive obligation upon a council.
