How and where are new laws published? Can laws be passed with retrospective effect? Australia is a common law jurisdiction. Australian law is based on the law of the United Kingdom, and until the passing of the Australia Act 1986 (Cth), the UK Parliament could legislate for Australia and the Privy Council was the ultimate court of appeal in the Australian hierarchy. In Australian courts, the judgments of other Commonwealth jurisdictions are regarded as persuasive, but not binding, precedent. The instruments with legal force and effect are laws made by Parliament (Acts) and statutory rules, which operate as subordinate legislation. The principal lawmaking body is the Parliament, which operates at both Commonwealth and state/territory levels. There is also a further level of local government, which is given its function and powers by the relevant state or territory parliament. Proximity to clients is the most important consideration for firms when opening offices and determining office location, although prestigious offices are considered important for establishing and maintaining the brand. China, Korea and Singapore are markets that are seeing significant numbers of new law firms arrive due to changes in regulation, economic activity and new trade agreements allowing foreign law firms greater access to the market. Law firms continue to adopt predominantly enclosed office layouts. Although firms are increasingly cost conscious and new ways of working have been considered, this is unlikely to change the approach of mainstream firms dramatically. A number of trail blazers are embracing more progressive workplace requirements that address the growing importance of ‘soft’ assets—flexibility (remote working), technology in enhancing productivity and employee performance. With pressure on profitability and operational costs, law firms are increasingly focused on containing real estate spend whilst reviewing accommodation requirements.     234 VOL 17 ISSUE 6 BSLR : FELTHUN, FIXLER, COTTER AND BLAIKIE : COMPENSATING WRONGLY RESTRAINED DEFENDANTS IN PHARMACEUTICAL PATENT CASES Compensating the interests of the alleged infringer. This is because, at an early stage in proceedings, the court is required to consider wrongly restraining an alleged infringer from certain conduct (and, in many cases, the launch of a new product or process) before it restrained has had the opportunity to give careful consideration to the validity of the patent and whether such conduct actually defendants in infringes it. In an effort to protect the alleged infringer subject to pharmaceutical these restraints, many jurisdictions have a mechanism for compensating the defendant should it transpire that the patent cases: patent is invalid or the relevant conduct would not have been infringing. The mechanism for providing such compensation recent throughout the EU (Article 9(7) of Directive 2004/481 (‘the Directive’)) was considered by the European Court of developments Justice in 2019 in Case C–688/17 Bayer Pharma AG v Richter Gedeon Vegyészeti Gyár Nyrt. and Exeltis Magyarország in the EU, Gyógyszerkereskedelmi Kft.
