1 Background of the Project 1.1 Introduction to the Project The Xiangjiang River and its watershed are part of the larger watershed. Both watersheds are integral elements of the downstream River watershed. The Yangtze River Economic Belt (YREB) covers nine provinces and two specially administered cities in the Yangtze River Basin. It accounts for over 40% of the PRC’s population and has 40% of the freshwater resources. It also serves as the drinking water resource for 400 million people, provides 60% of the total fisheries production, has 20% of the total wetland area, and contributes about 45% of the PRC’s economic output. The PRC’s YREB Development Plan, 2016-20301 stipulates the prioritization of ecological protection and promotion of green development as the guiding principle for the YREB development. As upstream watersheds, the Xiangjiang River and Dongting Lake play a pivotal role in the water quality of the Yangtze River watershed and in the general maintenance of healthy rivers and waterways. Therefore, the Xiangjiang River watershed is a key water resource in the overall strategic planning for water security in the Yangtze River, and its ecological improvement in turn promotes ecosystem restoration, environmental protection, and water resources management of the YREB and its watersheds. In addition, in order to protect the water quality of the Xiangjiang River watershed, and dispose of the existing landfills, the Hunan Provincial Government applied for a loan of $150 million with the ADB in 2018 to implement the Project, which has a gross investment of $258 million, and will be implemented from April 1, 2019 to December 31, 2023. The Project is expected to reduce pollutant emissions in the Xiangjiang River watershed1, and benefit a population of 6.9 million. The Project has 6 outputs. Output 1: Substandard municipal solid waste landfills closed. This output will close and restore nine substandard landfills, demonstrating at each site the installation of a capping layer and drainage, a leachate collection system, a landfill gas collection and treatment system, and the restoration of vegetation and landscaping.2 Output 2: Substandard municipal solid waste landfills mined and remediated. This output will demonstrate the remediation of two substandard landfill sites through mining, which will include the excavation and transport of waste materials to adjacent

sanitary landfill sites. This output will include the closure and restoration of the Xiaowujia site (in Lanshan) and the site. Output 3: New urban-rural integrated municipal solid waste management systems established.3 This output will establish best practice and well-defined urban- rural MSW management systems in seven project areas. It will support Hunan’s strategy for integrated MSW management by piloting the construction of collection and transfer stations in selected locations to demonstrate differing scale and approaches. It will include the procurement of the associated collection and transport equipment and fleet vehicles.4 Output 4: Sanitary landfill facilities upgraded. This output will upgrade the facilities in four sanitary landfill sites. This output will include upgrading and expanding leachate treatment facilities, installing leachate residual treatment facilities, improving site drainage, upgrading landfill cover and associated improvements, and refurbishing and upgrading site infrastructure.5 Output 5: A new kitchen waste treatment and management system established. This output will assist the Yongzhou City Government to establish a kitchen waste treatment and management system for commercial facilities. It will include the collection, transport and treatment, and associated operation and maintenance (O&M) and management systems. This output will support these initiatives by developing a well-prepared regulatory framework, appropriate institutional arrangements, a selection of appropriate technology, and a financially sustainable operational model. Output 6: Capacity for environmentally sustainable municipal solid waste management enhanced. This output will support capacity development and institutional strengthening to ensure the successful implementation of the Project. This will include technical support for project management and implementation, and training. This output will prepare operationally focused studies on MSW policies and best practice, accompanied by research on innovation and technology and pilot projects as inputs to developing knowledge products and guidelines and/or procedures to guide future

1.2 Category of Involuntary resettlement The Project is a Category B project in terms of involuntary resettlement, and has insignificant resettlement impacts. The Project involves 1,421.14 mu of land, where: 519.34 mu of land was acquired before the commencement of the Project (before

2016). 4 due diligence reports were prepared at the preparation stage (Guiyang, Dong’an, Hengshan and Lengshuijiang); 901.8 mu of rural collective land will be acquired for the Project, including 3.7 mu of cultivated land, with the remainder being woodland or unused land. 6 RPs were prepared at the preparation stage (Hengyang, Yongzhou, Changning, Zixing, Leiyang and Lanshan). The 6 RPs will be updated after the completion of the detailed design. At the implementation stage, internal monitoring will be conducted, and the PMOs will submit monitoring reports to the ADB semiannually. The monitoring methods and indicators are included in the RPs. 1.3 Report Period The period of this report is from January 2020 to June 2020. This report was completed by the Hunan PMO with the support of the consultants, and all data was provided by the IAs.

2 Construction and Resettlement Progress 2.1 Construction Progress 2.1.1 Changning City The preliminary design of Changning City Urban-Rural Integrated MSW was completed and approved in March 2020. The gross investment in this component is 114.2276 million yuan, including construction costs of 46.8387 million yuan, equipment purchase costs of 42.7697 million yuan, installation costs of 3.5888 million yuan, and other costs of 21.0304 million yuan. The preliminary design of Changning City Tietong MSW Landfill was approved in 2019. The gross investment in this component is 62.9681 million yuan, including construction costs of 52.4609 million yuan, other costs of 5.8651 million yuan, and contingencies of 4.6421 million yuan. As of June 30, 2020, the fund availability of Changning City Urban-Rural Integrated MSW and Changning City Tietong MSW Landfill was 1.07%, and the 4 contracts had not been awarded. 2.1.2 Dong’an County As of June 30, 2020, the design workload of Dong'an County MSW Landfill has varied greatly from the estimated workload, and the preliminary design has been approved, with fund availability of 0.46%. None of the 3 contracts (one for civil works, one for goods and one for consulting) has been awarded. 2.1.3 Guiyang County As of June 30, 2020, the fund availability of this subproject was 0.11%, the civil works contract was expected to be bid for in Q3 2020, and the preliminary design had been approved, with the addition of vertical seepage control. 2.1.4 Hengyang County The gross investment in this subproject is 202 million yuan, and it mainly includes: 1) Doupi MSW Landfill: waste pile shaping, closure, rainwater and sewage separation, leachate treatment, gas collection and treatment, and landscaping, with a planned investment of 59 million yuan; 2) Hengyang County Urban-Rural Integrated MSW: construction of 28 waste transfer stations in the county town and townships, and purchase of 83 collection and transfer vehicles, with a planned investment of 120 million yuan; 3) Hengyang County Lida Sanitary Landfill Upgrade: construction of a group of leachate treatment facilities, and upgrading some existing facilities, with a planned investment of 19 million yuan, including 5 contracts (two goods contracts: leachate

treatment system upgrading and transfer facility purchase; 3 construction contracts: existing waste disposal, landfill upgrading and transfer station construction). The overall progress of this subproject is slow. The preliminary design of the Doupi MSW Landfill has been completed and is being reviewed. As of June 30, 2020, only domestic counterpart funds of 4 million yuan were available, with a percentage of 1.98%, and no construction had begun. The preliminary design of Hengyang County Urban-Rural Integrated MSW and Hengyang County Lida Sanitary Landfill Upgrade have not approved. 2.1.5 Lanshan County As of June 30, 2020, fund availability was 11.79%, and the preliminary design had been approved. The changes include: 1) addition of vertical seepage control to the Jiufenshan MSW Landfill; 2) change in workload of the Xiaowujia MSW Landfill; 3) cancellation of the integrated building and concentrate treatment, change of the leachate treatment process from the membrane method to Fenton, and addition of anti-seepage rehabilitation for the Urban-Rural Integrated MSW; 4) reduction of some township transfer stations, and adjustment of the capacity of the central station in the county town to 500t/d. No construction has begun. 2.1.6 Leiyang City As of June 30, 2020, fund availability was 14.5%, and no construction had begun. The preliminary designs of the 2 components have not been approved. 2.1.7 Lengshuijiang City This subproject consists of the Heiniling MSW Landfill, Sanitary Landfill Upgrade and MSW Transfer Station, with a total ADB loan of $17.5 million. As of June 30, 2020, the progress of this subproject was as follows: • In April 2018, the feasibility study report was approved by the provincial development and reform commission; • In June 2019, the EIA report was approved by the Municipal Ecology and Environment Bureau; • In May 2019, the Loudi Municipal Finance Bureau entered into an on-lending agreement with the provincial finance department; • In October 2019, the preliminary design of the Heiniling MSW Landfill was reviewed; • In December 2019, the construction drawings of the Heiniling MSW Landfill were reviewed;

• In March 2020, the bidding documents of the Heiniling MSW Landfill were reviewed by the ADB, bidding approval was underway, and preliminary design documents were being prepared for the two other components. No construction has begun. 2.1.8 Yongzhou City This subproject consists of 7 contracts, including 4 construction ones and 3 goods ones. The 4 construction contracts are: 1) Shanglingqiao MSW Landfill, including landfill closure of 33,300 m2 and disposal of existing MSW of 800,000 m3; 2) Zhugemiao MSW Landfill, including landfill closure of 53,900 m3 and disposal of existing MSW of 800,000 m3; 3) Yongzhou City Kitchen Waste Treatment, including purchase of kitchen waste collection and transfer vehicles, and kitchen waste treatment equipment, and construction of the kitchen waste treatment plant; 4) Yongzhou City Urban-Rural Integrated MSW: construction of large waste transfer stations, and purchase of relevant equipment, vehicles and sanitation management systems. 3 goods contracts: management equipment for Yongzhou City Urban-Rural Integrated MSW and Yongzhou City Kitchen Waste Treatment, and Yongzhou City smart sanitation management system As of June 30, 2020, the design and review of the EIA report, preliminary design and construction drawings, budgeting, and financial review had been completed for the Zhugemiao MSW Landfill and the Shanglingqiao MSW Landfill; geological survey, site selection and land planning had been completed for Yongzhou City Kitchen Waste Treatment, and the preliminary design submitted to HURD for approval; the purchase of waste transfer and separation equipment, and the site selection and LA for 7 waste transfer stations had been completed for Yongzhou City Urban-Rural Integrated MSW. Domestic counterpart funds of 28.795 million yuan had been withdrawn in total. 2.1.9 Zixing City The gross investment in the Zixing subproject is 116 million yuan, and it mainly includes: 1) Zixing City Changyilong Sanitary Landfill Upgrade: including landfill and leachate treatment system upgrading, and the construction of a capacity of 900,000 m3 for Stage 2 of Phase 1 of the landfill (not covered by the feasibility study); 2) Zixing MSW Landfill: with a floor area of 20,000 m2, and the transfer of the Tangyilong simple landfill with a filled volume of 350,000 m3; 3) Zixing City MSW Collection and Transfer: construction of 4 town collection stations of 30t/d, reconstruction of 6 urban collection stations of 120-150t/d; purchase of vehicles, intelligent sanitation management system,

and the regulation of irregular rural waste sites, etc., including 5 contracts (3 for goods: leachate treatment system upgrading, waste transfer equipment purchase and intelligent sanitation, and two for construction: existing MSW disposal and upgrading, and waste collection and transfer). Zixing City Changyilong Sanitary Landfill Upgrade: Geological survey, construction drawing design, budgeting, and EIA have been completed, and bidding will be conducted in July. Zixing MSW Landfill: Preliminary design and construction drawing review, EIA, bidding document preparation, and budgeting have been prepared. Zixing City MSW Collection and Transfer: Surveying, LA, preliminary design preparation, and EIA have been completed, the preliminary design is being reviewed, and the bidding documents being prepared.

2.2 Resettlement Progress 2.2.1 Changning City Changning City Urban-Rural Integrated MSW: From June 2018 to June 2020, some LA, HD and young crop compensation work for 16 township transfer stations have been paid. As the data have not been investigated. A separate DDR will be prepared in the updated RP. Changning City Tietong MSW Landfill: This component applies the land lease mode, and land lease has not begun. 2.2.2 Lanshan County LA has not begun; the RP has been released but is to be updated. 2.2.3 Lengshuijiang City The preliminary design specifies the floor area for excavation, and collective land will still be leased. 2.2.4 Yongzhou City The preliminary designs of the Zhugemiao MSW Landfill and the Shanglingqiao MSW Landfill have been approved, that of Yongzhou City Kitchen Waste Treatment submitted to HURD for approval, and that of Yongzhou City Urban-Rural Integrated MSW is being prepared. The Zhugemiao MSW Landfill will be bid for in August, and the Shanglingqiao MSW Landfill, Yongzhou City Urban-Rural Integrated MSW and Yongzhou City Kitchen Waste Treatment in December. Site selection and LA for 7 waste collection stations in Lingling have been

completed, and LA for the Shanglingqiao MSW Landfill and Yongzhou City Urban-Rural Integrated MSW is underway. 2.2.5 Guiyang City The DMS of one component has been completed, and the RP will be updated pending the approval of the design of another component. 2.2.6 Zixing City The design is to be approved, and the RP to be updated. 2.2.7 Leiyang City The design is to be approved, and the RP to be updated.

2.3 RP Updating Progress The RPs of Hengyang, Yongzhou, Changning, Zixing, Leiyang and Lanshan will be updated after the designs are approved. In addition, LA completed before project commencement will be subject to due diligence. RP upgrading will be conducted by HydroChina Zhongnan Engineering Corporation. As of June 30, 2020, the DMS of one component in Guiyang City has been completed.

3 Impact Changes and Reasons Up to June 30, 2020, some resettlement changes have been identified as table 3-1. Most of them are caused by the potential adjustment of project sites.

4 Resettlement policies 4.1.1 New version of Land Administration Law has issued in Aug 2019 and has been put into enforcement in Jan 1, 2020 The main changes between the outdated version and the new version is the land acquisition

procedures which will be applied in our project for those to be conducted land acquisition.

The new procedures is as follow:

If a people’s government at or above the county level is to apply for land acquisition, it shall conduct a current status survey and a social stability risk assessment, and disclose the range and purpose of acquisition, current status, compensation rate, resettlement mode, social security, etc. in the township (town), village and village group to collect comments from the affected rural collective economic organization and its members, village committee and other stakeholders. If most members of the affected rural collective economic organization think that the land compensation and resettlement program does not conform to the laws and regulations, the people’s government at or above the county level shall organize a public hearing, and modify the program according to the laws, regulations and public hearing. Owners or users of the land to be acquired shall, within the time limit specified in the announcement, go through compensation registration on the strength of the real estate ownership certificate. The people’s government at or above the county level shall organize the department concerned to estimate the relevant costs and make them fully available, enter into compensation and resettlement agreements with the owners and users of the land to be acquired. The people’s government at or above the county level shall apply for land acquisition only when the preparatory work has been completed. 4.1.2 New land acquisition compensation policy has issued in Hunan province The new Notice of Hunan Provincial People’s Government on Adjustment of Compensation Standards for Land Acquisition in Hunan Province (XZF [2018] No.5) was issued by Hunan provincial government in 2018 which is higher than that in the draft RP preparation phase. The LA of this project to be conducted will use the new compensation rates. The new compensation rate is about 1.2 times of the old compensation rates according to different land type which is advantageous for the APs livelihood restoration.

6 Resettlement budget and resource According to the project construction plan, the People's Government of each municipal government are responsible for the raising and payment of resettlement fund of the Project. It is expected that the resettlement fund will be put into use in 2021-2023.

The Resettlement Fund Management and Appropriation method is same as draft RP.

The new resettlement budget will be updated in each updated RP.

7 IAs 7.1 Organizational Setup The Hunan Provincial Housing Urban-Rural Development Department (HURD) is the executing agency of the Project, and the local city / county governments are the IAs, including (i) Dong’an, Guiyang, Hengshan, Hengyang and Lanshan Counties; and (ii) Changning, Leiyang, Lengshuijiang, Yongzhou and Zixing Cities (county-level cities). The PMO under HURD is responsible for project planning, guidance, supervision and management. See Figure 7-1.

7.2 Agencies for Resettlement and Social Affairs The IAs have appointed dedicated staff to be responsible for social and resettlement affairs, as shown in Table 7-1. There are 10 staff members (2 females) and 10 leaders (4 females) directly related to the Project. In addition, the local natural resources, forestry, and labor and social security bureaus, and women’s federations will also participate in the Project’s LA and social affairs.

7.3 Capacity Building From January to June 2020, 12 training sessions were held for the Project, with 335 trainees in total, including 128 females, accounting for 38.21%. The PMOs invited social and resettlement experts to offer pre-implementation support in April 2020, who trained the social and resettlement staff of the PMOs in June 2020. A semiannual reporting system has been established by the 3 pre-implementation experts, covering involuntary resettlement, ethnic minorities and social development. See Table 7-2.

8 Information Disclosure and Public Participation The PMOs attach great importance to public participation, and issued a notice on conducting public participation activities under the Project actively in June 2020, highlighting the importance of public participation, defining relevant players and duties, and stressing file management and reporting. According to incomplete statistics, over 500 messages were disclosed during this report period, mainly including LA announcements and project information. The RPs and SGAP have been disclosed on the websites of the ADB and the local governments. During this report period, 5 public participation activities were conducted, involving 205 participants, including 74 women, 65 minority residents and 37 low-income residents, and expenses of 28,000 yuan incurred. See Table 8-1.

At same time, in June 2020, the provincial PMO issued a notice on the Strengthening the meaningful participation activities during the resettlement design and implementation phase.

9 Grievance Redress Mechanism To ensure that the APs can file appeals about LA, resettlement, ethnic minorities, gender development, etc., a two-stage grievance redress mechanism has been established. The agencies will accept grievances and appeals for free. Stage 1: If any AP is dissatisfied with resettlement, he/she may file an oral or written appeal with the township government, which should make a disposition within two weeks. Stage 2: If the AP is dissatisfied with the disposition of Stage 1, he/she may file an appeal with the city / county PMO or natural resources bureau, which should make a disposition within 4 weeks. In addition, any AP may bring a suit in a court in accordance with the Administrative Procedure Law of the RPC at any stage. Any AP may also file an appeal with the Office of the Special Facilitator or Compliance Review Panel of ADB in accordance with ADB’s accountability mechanism. The APs may file appeals for free, and all reasonable expenses so incurred will be disbursed from the contingencies. As of June 30, 2020, no appeal had occurred. See Table 7-1.

10 Conclusions and Suggestions

10.1 Conclusions 1. Overall progress slightly behind schedule Project implementation has been delayed by the COVID-19 pandemic to some extent. 2. Local PMOs unfamiliar with the ADB’s social safeguard policies and documents Despite of training, the local PMOs are still unfamiliar with ADB’s social safeguard policies and documents, such as the RP, EMDP and GAP, affecting their implementation to some extent.

10.2 Suggestions 1. Complete the preliminary designs and updated RPs of the relevant subprojects. A preliminary design is the basis for the updating of the relevant RP. If the RP is not updated, the construction contract will not be awarded, because RP updating is a compulsory requirement in the loan contract. The agencies concerned must attach great importance to preliminary design approval and RP updating. 2. Conduct LA, HD and other social development work according to new laws and regulations. The new Land Administration Law was promulgated in August 2019, and came into effect in January 2020, raising further requirements for LA procedure and elements, such as public hearing and stability risk assessment. With the implementation of the new policy, local LA compensation rates will also rise dramatically. 3. Involve forestry and natural resources authorities at the design stage. The Project involves the acquisition of some woodland, which requires compliance with forestry planning. Therefore, the local forestry and natural resources authorities should be involved at the design stage. 4. Further conduct effective public participation activities. Public participation activities that may be conducted at the present stage include without limitation: 1) project design optimization to reduce resettlement and social impacts, such as odor, leachate and dust reduction; 2) cross-departmental land use demonstration and resettlement program consultation; 3) participatory resettlement impact survey ; 4) participatory stability risk assessment ; and 5) briefing of updated RPs (with agencies concerned and APs).
