In the last couple of years, many people moved to Berlin and to Treptow- Köpenick. It cannot be seen that this trend will come to an end. It is not just those coming from within , but also those coming from other countries, who are now playing a more important role. 7 0 Information and Counselling Information and Counselling In the beginning you often ask yourself about your right to remain and your future here in Germany. It does not matter whether you are here to look for work, or to join the rest of your family or to claim asylum. - ever- yone has a bunch of questions when arriving. The answers to questions regarding legal status and financial support are found in the Residence Act and the Asylum Seekers Act. Here we will provide you with the most important points of contact. The Residence Act The Residence Act regulates the matter of residency for those who live in Germany and do not hold the German citizenship. Due to the EU freedom of Movement Act, the Residence Act is of most importance for those holding citizenship from a country outside the EU or the European Economic Area (EEA). Some of the main points of the act: • Entry requirements and residency • Approval, refusal and repeal of residency permit • Deportation

The Ordnance of Recidency (AufenthV) and the Employment Regulations (BeschV) regulate the Residence Act. It is also responsible for issuing passports, processing visas and the right to work for those coming from abroud. www.gesetze-im-internet.de/aufenthg_2004/ Asylum Seekers Act The Asylum Seekers Act (AsylbLG) regulates the material entitlement for asylum seekers, those with short term residency and those with foreign citizenships, those with ‘forced deportation’. What does that mean? Your status will determine the standard, financial and accommodati-

9 on benefits you are entitled to. Accommodation includes emergency accommodation, communal accommodation and apartments including also a single room in a shared apartment. The first 15 months of your stay, those who are entitled to receive standard benefits will do so in accordance with paragraph 3 of the Asylum Seekers Act. After that, you receive so-called „Analogleistungen“, which means analogue services to SGB II (Jobcenter) and SGB XII (social welfare). State Office for matters relating to Refugees The state office for matters relating to refugees (LAF) is responsible for all those receiving support in accordance with the Asylum seekers act. It is also responsible for those who are still in the process of seeking asylum (Aufenthaltsgestattung), who are having a short-term residency (Duldung ohne Arbeitserlaubnis) or who are facing a forced deportation (vollziehbar ausreisepflichtig). The LAF has a department for financial support, rental concerns and a social service for people needing special protection. Many of you might know the LAF as a department of the LAGeSo, but now the LAF is its own institution. You can find it at Darwinstr. 14-18, 10589 Berlin. www.berlin.de/laf/

Federal Office for Migration and Refugees The Federal Office for Migration and Refugees (BAMF) is responsible for the procedure of seeking asylum and supports a variety of programs dealing with integration. In addition it is home to a research centre Information and Counselling und Beratung focussing on European cooperation concerning migration. The decision in the asylum procedure are made by the BAMF. The interview and the hearing will take place at the BAMF. www.bamf.de

Foreigners Registration Office Every district in Germany and each bigger city has a Foreigners Regis- tration Office. They enforce the Foreigners Act. This means that they issue papers such as residence permits or papers which include the right to work or study, settlement permits, but they can also terminate your residence permit. If you are in the procedure of seeking asylum and you want to work, you must get the agreement by the Foreigners Registra- tion Office. The Foreigners Act is valid for all of Germany, but the Home Secretaries of each German state issue action points to their offices. www.berlin.de/labo/willkommen-in-berlin/

Office administrative issues - Where do I go to get what service? Berlin holds a variety of points of contact – depending on the topic and the responsibility. The administration is well connected. For all with a residence permit (e.g. holding an acknowledgement of entitlement to asylum, award of refugee protection, award of subsidiary protection) the Public Office (Bürgerämter) are responsible for many issues: service. berlin.de/dienstleistungen/. Berlin is using a date of birth regulation. People, who do not have a permanent accommodation or who have not been registered in Berlin before, are assigned to a public office according to themonth of their birthday. This is also valid for refugees who are living in refugee accommodation. See the following information for find your public office:

19 Public Offices for Refugees Public offices for Refugees are dealing with topics such as registration, de-registration, changing your registration (in case of a move), issuing the social housing voucher (to access accommodation with reduced rent, WBS) (see chapter 8), validating the Berlinpass and further tasks related to the public office. In addition, they offer counselling and supportith w translators focussing on: residence and gaining German citizenship, work and education, benefits, applying for document etc.

The Berlinpass is for people, who have a small income or who receive

financial support from the Jobcenter, the LAF or the Social Office. 1.2 Registration of marriages and births During the opening hours of the registry office you can get counselling and information about marriage in Germany, which documents you will need to provide and what the requirements are to get married in Germa- ny. The counselling can only take place, if you provide a passport! If you don‘t speak German, please organise a translator to bring along with you.

Certification of the birth of a child must be done at the registry office. You will need to provide the following documents to register the birth: • Passports of the parents • Marriage certificate (authentication proof) • Marriage contract (authentication proof) • Certificate of Birth of the parents All documents must be translated by an interpreter and submitted with the originals.

1.3 Family reunification You are in Germany and you want your family to come to Germany as well? Depending on your status it will be easier or harder. If you are a re- fugee it will be a bit complicated. 23 2 Language 2.1 Integration classes and Learning German with locals The BAMF (chapter 0) offers mandatory integration courses to refuge- es with good or secure prospect of remaining in Germany integration classes. They contain language classes and an orientation class, which will provide you with information about challenges you will face while living in Germany. Participation is open to those who have received their

residence permit after the 01. January 2005 and who are in Germany for Sprache one of the following reasons:

• as employee • as part of a family reunification • as asylum seeker • as long-term resident accoring to §38a Aufenthaltsgesetz (AufenthG)

Refugees, who are still in the procedure of seeking asylum can participa- te at the integration classes if they come from: Eritrea, Irak, Iran, Syrien and Somalia (8/2018).

Offers of the Community Colleges The community colleges (Volkshochschule) offers integration classes and job-related language classes which are supported by BAMF. Refugees without access to integration courses are offered free German langua- ge classes at community colleges. There is regular open office hours at community colleges to seek advice on which course to take.

25 Initiatives and Language Cafés There are not just official offers to learn German, but also many initiati- ves will offer classes led by volonteers. In Treptow-Köpenick you can find support learning German and exercising it. In chapter 7 Participation and Encounter we offer you an overview of activities, which can help you im- prove your German. Based on the EU-legislation 2003/9/EU, 2004/83/EU and 2013/33/EU, this inludes minors, unaccompanied minors, disabled, older, pregnant, single parents with minor children, victims of human trafficking, people with severe physical illness, people with psychological disorders, as well as people who suffered torture, rape or other forms of psychological, physiological or sexual violence like e.g. victims of female genital mutilation.

31 Health insurance In Germany, everone is obliged to hold a health insurance. All refuge- es automatically have health insurance in Germany, it doesn’t matter whether you are still in the procedure of seeking asylum or if you have been awarded a legal status. For refugees the health insurance card is covering all basic medical treatment. As soon as you live in Germany for more than 15 months, you can choose your health insurance on your own. This means that you will be transferred into the regular health insurance system, which means everything is organised as for people receiving benefits (ALG II). 43 4 Accommoda- tion When can I start looking for accommodation? If you are a migrant with legal status in Germany, or have received an Acknowledgement of entitlement to asylum, Award of refugee protection or Award of subsidiary protection you can start to look for an accommo- dation anytime. If you are still in the procedure of seeking asylum and therefore recei- ving support by the LAF, you need to apply for a permission to rent an apartment. You will be awarded this permission latest after living in a camp for six months (including Emergency and group accommodation and hotels).

How do I find an apartment? First of all, you need to collect all your documents. You need to have a copy of your passport, and of your registration confirmation, as well as a SCHUFA information, and a letter that proofs that you have payed your rent in the past and the confirmation letter (that you are receiving benefits) of the LAF or Jobcenter. (Alternatively, you have to provide oury Accommoda- tion pay slips of the last 3 months). We recommend you to collect all documents in a file used for applications and just take copies each time you apply for an apartment. We recommend you to use a cover page, on which you introduce yourself and your family to the landlord. If you have found an apartment that you like you need to ask for a viewing appointment. After seeing the apartment, you need to apply at the LAF or at the Jobcenter for a ‘Kostenübernahme’, a cost acquisition. You will have to hand in this Kostenübernahme together with all your documents at the landlord/house administration. Some house administ- rations also request a questionnaire to be filled in. If the house administration picks you, you can go and sign the rental agreement/contract. After signing the contract, you need to go back to the LAF or Jobcenter to get the rent and the deposit transferred. This can only be done with a valid rental contract. What is a WBS (Wohnberechtigungsschein / social housing voucher) and do I need this? The WBS (Wohnberechtigungsschein) is needed, if you want to live in so called social housing. These apartments are subsidized by the stat and therefore especially cheap. If you have been awarded an legal status that is at least still valid for 11 more month, you can apply for a WBS. This WBS will then be valid for 12 months.

Who pays my rent? If you have an income, you will pay renting costs and deposit on your own, if you are receiving financial support according to SBG II or ac- cording to the asylum seekers act, the Jobcenter or the LAF will pay. To receive the payment, you need to have a written offer (with your name on it) and you then hand in at the office responsible for you. The LAF/ Jobcenter will also pay for the basic equipment of the apartment, if you don‘t have any furniture. They have financial guidelines according to the size of the family and the already existing equipment of your new appartment.

How do I search an apartment? Most people in Berlin search online for apartments or visit the cities apartment building societies. Looking for an apartment in Berlin takes Accommoda- tion normally a long time, especially if your language skills are not good. You might also face racism or rejection due to receiving benefits by many landlords, which is a big problem. In general, Berlin does not offer enough affordable apartments and you will need to search for a long time and apply for many apartments. Many people get an apartment through contacts, family and friends. Therefore, it is important for you to create yourself a network, either through sports, cooking, learning German or other activities. Caution: Fraud! You do not have to pay anyone to find you an apartment. Even if it sounds appealing if someone promises you to find an apartment for you. Stay away from that. It will take a long time to find an apartment in Berlin, those who are promising anything else, are not helping you. It is illegal if you pay someone without getting an official receipt. It is also illegal, if you have been denied an apartment due to racism. There is the general euqality act prohibiting discrimination on seve- ral grounds and there are institutions helping you. The apprenticeship lasts 3 years. To do an appren- ticeship, you need to have a vocational school graduation. If you have not attended school long enough (9 or 10 years) or graduated school in your country of origin, you can attend a vocational collage to qualify for an apprenticeship. The Berlin-Kolleg offers classes for refugees. www.berlin-kolleg.de

A dual apprenticeship is done in combination of working in a company and at the same time visiting the vocational college. Most of the time, the company will pay you a salary. The advantage of a dual training is that you get to know the company very well and that there are often possibilities to continue working for the company after the training.

A school based apprenticeship can be supported by Bafög (scholarship by the German state). In school you will learn all the information needed for the job. Some schools will request you to pay a monthly fee.

If you have already done an apprenticeship and if you have been working in your profession, you can apply to get a shorter apprenticeship, the Umschulung (a retraining). The retraining takes normally 2 years. It can Education be financed by the Jobcenter or the Argentur für Arbeit(Work Agency). If you are applying for an apprenticeship and have not found a position by the 30.09. you can also do a 6 to 9-month long entry qualification. During this period, you can get to know the company.

Refugee Academy • New Berliners can use their potential and in different subjects and support others speaking the same mother tongue • refugeeacademy.de 5.1 Recognition of your qualifications First, you need to provide authenticated German translations. The costs for the translation can be paid by the Jobcenter or the Argentur für Arbeit. It is important that you apply for the cost coverage in advance, as they can’t reimburse you afterwards. To receive recognition of a school graduation certificate, the senate administration for Education, Youth and Family is responsible. In the database Anabin (http://anabin.kmk. org) it is written how foreign certificates will be evaluated, and which international universities are recognised by the German state. For some restricted professions (professions, that need a specified quali- fication) a university graduation is needed. You are only allowed to work in this profession if you have the according and you degree an official confirmation from the senate or professional chamber. If a recognition is needed, you need to file an application at the Standing Conference fo the Ministers of Education and Cultural Affairs. There will be cost connected with this procedure, which can be paid by the Jobcenter or Argentur für Arbeit. The IHK Fosa (Industry and Trade Chamber, Foreign Skills Appro- val) is responsible for recognising foreign state-approved certificates. If the diploma exists, they will check the equality of the diploma. If you can not provide a diploma, you might be asked to present a quality trial. This Education procedure is very expensive. The costs can be covered by the Jobcenter.

Whether your school graduation certificate will be accepted as an entry qualification will be decided by the Uni Assist and/or the ma- triculation office of the university (https://www.uni-assist.de/). Most of the times you will need to apply online. Many universities offer migrants a preparatory college, where you will have language classes and get a training. Even if you are not yet registered, you can apply to be a guest student (Gasthörerschaft). You can visit the lectures, but you can’t write exams.A Bachelor‘s degree usually takes three years of studying. After graduating you can start working in many professions. At state univer- sities you will need to pay a fee each month, which will include a public transport ticket. An additional fee is only required at private universities. Before enrolling you can apply for Bafög (scholarship), but also some foundations offer financial support for refugees (e.g. Hans-Böckler-Stif- tung). There are also special education loans, which you can apply for while studying. You will need to pay back the loan. The Master‘s degree is the second stage of studying. 6.1 Looking for work and Qualification How can I apply? You can find a job through local online job websites or the job pages in newspapers or in special job groups on Facebook. Examples of job websites for refugees and migrants are: Workeer and MigrantHire-Jobs for Newcomers. You can also send out unsolicited applications. This type of application is not for an advertised position, but you would show an interest for working with a specific company, explaining which qualifications and skills you have that would interest the company. An application is most often done in writing either sent by email, or when requested by post. An application includes a CV, cover letter, references and relevant educational certificates. The CV presents in a table form personal information, school and educational information as well as previous job experience. Important individual competences and knowledge would also be presented there. You also have to provide the information of language classes you attended and to which level. If you have completed an internship in Germany that should be included. It is at your own discretion whether to include a photo of yourself in professional look in your CV. If you have the right to remain or the right to work in Germany, this should also be included. In the cover letter you should describe why the position is important for you. You should present which requested skills and qualifications you have. You also state your motivation for the position. It is very important to show which fitting qualifications and competences you will bring to the company. References or other documents should be translated in to German.
