GENERAL COUNSEL'S REPORT

I. BACKGROUND: On September 8, 1978, the Reports Analysis Division referred to the Office of the General Counsel the names of two candidates and one committee which failed to file a 10 Day Pre-Election Report for the Oklahoma Primary in violation of 2 U.S.C. §434(a) (1). The reports were due on August 12, 1978. The reason to believe

PN notices were sent on August 14, 1978 and the reasonable cause to believe notices were mailed August 16, 1978. On August 19, 1978, a list of those candidates and committees which failed to file the 10 Day Pre.-Primary Election Report was published.

TI. ANALYSIS: A copy of the Reports Analysis Referral (Attachment I) and the Oklahoma vote return (Attachment II) are attached. ROSELLA PETE SAKER Respondent Rosella Pete Saker was a Democratic candidate for the U.S. Senate. The candidate lost the primary election receiving 5,137 votes or .9% of the votes cast. The Ten Day Pre-Election Report filed by the candidate was postmarked August 16, 1978 and revealed $76.72 in receipts and $76.72 in expenditures. As the candidate reported minimal financial activity and received less than 1% of the vote, the Office of the General Counsel recommends -2- in accordance with the Commission's non-filing procedures dated May 23, 1978, that no further action be taken against Rosella Pete Saker. SUSAN JANE COLLINS Respondent Susan Jane Collins is the principal campaign committee for Jessie Knipp. Mr. Knipp won the Democratic primary receiving 22,550 votes or 55.3% of the votes cast. Mr. Knipp reported expending $1,303 for the primary on his Ten Day Pre-Election Report filed before publication on August 17, 1978.

The committee, Susan Jane Collins, reported 0 receipts and expenditures on its Ten Day Pre-Election Report filed September 1, 1978. As the candidate filed before publication and there is no evidence of financial activity by the committee, the General Counsel's Office recommends in accordance with the Commission'ss non-filing procedures dated May 23, 1978, that no further action be taken against the Susan Jane Collins committee. ANTHONY POINTS Respondent Anthony Points was a Democratic candidate for the U.S. Senate. He lost the primary election receiving 3,772 votes or .7% of the votes cast. Mr. Points has not designated a principal campaign committee. No pre-primary report has been filed by Mr. Points. The last report filed by Mr. Points was a 1978 April 10 letter which reported $15 in receipts and $480 in expenditures (Attachment III). As Mr. Points lost the election receiving less than 1% of the vote and as he has had minimal financial activity on previous reports filed; the Office of the General

Counsel recommends in accordance with the Commission's non-filing

procedures dated May 23, 1978 taking no further action against Anthony Points.

III. RECOMMENDATION: Take no further action and close the file with respect to respondents Rosella Pete Saker, Anthony Points, and the Susan Jane Collins committee.
