A MEETING of the PLANNING COMMITTEE was held at the COUNCIL CHAMBER, CIVIC OFFICE on TUESDAY, 31ST MAY, 2016, at 2.00 pm.

PRESENT: Chair - Councillor Iris Beech Vice-Chair - Councillor Dave Shaw

Councillors Susan Durant, John Healy, Eva Hughes, Andy Pickering, Alan Smith and Jonathan Wood.

Apologies for absence were received from Councillors George Derx, Alan Jones and Sue McGuinness.

1 DECLARATIONS OF INTEREST, IF ANY

Councillor John Healy Wood declared an interest in Application No. 15/02855/FUL (Agenda Item No. 6 (4)) by virtue of being approached by the Applicant and being aware of the Objectors and therefore, took no part in the discussion at the meeting and vacated the room during consideration thereof.

2 MINUTES OF THE PLANNING COMMITTEE MEETING HELD ON 3RD MAY, 2016

RESOLVED that the minutes of the meeting held on 3rd May, 2016, be approved as a correct record and signed by the Chair.

3 BOROUGH COUNCIL TREE PRESERVATION ORDER (NO.378) 2016 CLAYBURN, CHAPEL HILL, CLAYTON

The Committee considered a report which outlined that a Tree Preservation Order (TPO) at Clayburn, Chapel Hill, Clayton, had been made following consideration of a Section 211 Conservation Area Notification to fell and remove one sycamore tree which, in the opinion of the Council, would be detrimental to the character and appearance of the local area.

It was reported that two letters of objection to the making of the TPO, had been received.

Members were required to give due consideration to the representations made in respect of the order when reaching their decision.

In accordance with Planning Guidance, ‘Having Your Say at Planning Committee’, Mr. Allan Reed, spoke in opposition to the TPO for the duration of 5 minutes. A. 1 Subsequently, it was Moved by Councillor Eva Hughes and Seconded by Councillor Susan Durant, that Tree Preservation Order (No. 378) 2016, be confirmed without modification, which was declared as follows:-

On being put to the meeting, the Motion proposed by Councillor Eva Hughes was declared CARRIED.

RESOLVED that the Tree Preservation Order (No. 378) 2016, at Clayburn, Chapel Hill, Clayton, be confirmed without modification.

4 ORDER OF BUSINESS

RESOLVED that in accordance with Council Procedure Rule 4, the order of business be varied by considering Agenda item 6(4), prior to Agenda item 6(2), before returning to the order of business as specified on the agenda.

5 SCHEDULE OF APPLICATIONS

RESOLVED that upon consideration of a Schedule of Planning and Other Applications received, together with the recommendations in respect thereof, the recommendations be approved in accordance with the Schedule hereto and marked Appendix ‘A’.

6 TOWN AND COUNTRY PLANNING ACT 1990, SECTION 106 AGREEMENTS

16. Prior to commencement of construction works, a scheme for [two] continuous acoustic barriers constructed in accordance with Figure 12/1230/F1 of the noise impact assessment report reference 14/1230/R01-0 of minimum surface density of 10 kg/m2 shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include within it the provision of vegetation/tree planting along the barriers. All works which form part of the approved scheme shall be completed prior to the commencement of construction works. The barrier shall be retained throughout the life of the development.
