    Analysis: Sen. Jeff Sessions’s Record on Criminal Justice By Ames C. Grawert This analysis provides a brief summary of Sen. Jeff Sessions’s past statements, votes, and practices relating to criminal justice. Specifically, this analysis finds that: • Sen. Sessions opposes efforts to reduce unnecessarily long federal prison sentences for nonviolent crimes, despite a consensus for reform even within his own party. In 2016, he personally blocked the Sentencing Reform and Corrections Act, a bipartisan effort spearheaded by Sens. Charles Grassley (R-Iowa), Mike Lee (R-Utah), and John Cornyn (R- Texas), and Speaker of the House Paul Ryan (R-Wis.), and supported by law enforcement leadership. As Attorney General, Sen. Sessions could stall current congressional efforts to pass this legislation to recalibrate federal sentencing laws. • Drug convictions made up 40 percent of Sen. Sessions’s convictions when he served as U.S. Attorney for the Southern District of Alabama — double the rate of other Alabama federal prosecutors. Today, state and federal law enforcement officers have begun to focus resources on violent crime, and away from archaic drug war policies. But Sen. Sessions continues to oppose any attempts to legalize marijuana and any reduction in drug sentences. As Attorney General, Sen. Sessions could direct federal prosecutors to pursue the harshest penalties possible for even low-level drug offenses, a step backward from Republican- supported efforts to modernize criminal justice policy. • Unlike many Republican legislators, Sen. Sessions supports the use of “civil asset forfeiture,” which allows police to confiscate property from people who may not even be accused of a crime.

Bolitho1 I. INTRODUCTION A hypothetical young entrepreneur named Ernest recently read an article reporting that marijuana distribution was a lucrative business. After extensive research and discussions with some friends who work in the “marijuana industry,” Ernest decided to open a retail store selling marijuana in his hometown of Raleigh, North Carolina. He entered a supply agreement with a local horticulturist who was also an expert marijuana grower. Ernest named his business “Best Buds Dispensary, Inc.,” registered it with the secretary of 1Assistant Professor, Campbell University School of Law, Raleigh, North Carolina. We also request that you evaluate the authority and scope under which U.S. Attorney Durham is operating, as Attorney General Barr has only provided vague and shifting statements about the purpose and scope of the investigation. We are concerned by indications that Attorney General Barr might depart from longstanding DOJ principles to take public action related to U.S. Attorney Durham’s investigation that could impact the presidential election. Under longstanding DOJ policy, the Attorney General is expected to refrain from commenting on an ongoing investigation. Attorney General Barr and U.S. Attorney Durham have made several public comments that could violate this Department policy and related guidelines.1 Attorney General Barr has signaled repeatedly that he is likely to allow DOJ to take prosecutorial actions, make public disclosures, and even issue reports before the presidential election in November. Such actions clearly appear intended to benefit President Trump politically. Specifically, Attorney General Barr has indicated that he would consider taking such steps in the Durham investigation—including the issuance of a report or other summary—within 60 days of the upcoming election.

    Calling it like it is: Republicans Continue to Disrespect President Obama with Obstruction of Supreme Court Nomination Within an hour of Supreme Court Justice Antonin Scalia’s confirmed passing, Senate Majority Leader Mitch McConnell (R-KY) made an unprecedented announcement: That the 44th President of the United States, Barack Obama, had no authority to name a replacement to the U.S. Supreme Court. Now that President Obama has done his constitutional duty by nominating Chief Judge Merrick Garland to fill the vacancy, most Republicans are continuing their disrespect to President Obama by refusing to grant a hearing, hold a vote, or even meet with his highly regarded and impressively qualified nominee. This twists every understanding of the constitutional duties of the President. But, sadly, it is what so many of us have come to expect of congressional Republicans after almost eight years of attempts to undermine, obstruct, and delegitimize the authority of our nation’s first Black president. Since the day President Obama took office, Republicans have channeled animus into an unprecedented campaign to undermine and disrespect the presidency, including: • Spreading lies that President Obama is a citizen of Kenya, not the United States, until well into his presidency. People who have spread “birtherism” include Mitt Romney, Donald Trump, Newt Gingrich, and even sitting members of Congress. • In his first year of office, South Carolina Congressman Joe “You Lie!” Wilson made an unprecedented and deeply disrespectful outburst when the President was addressing a joint session of Congress during the State of the Union address. • The Senate Majority Leader, Mitch McConnell, declaring that making President Obama a one- term president was his “number one priority.” • Former New York City Mayor Rudy Giuliani declaring that President Obama doesn’t love America.
