Memo to Kenya’s Youth: Protect Your Motherland or Perish By Willy Mutunga Kenya’s mixed election history Sometimes it is said, with some validity, that the only peaceful, non-violent, free, fair, credible, verifiable, and acceptable elections took place during the “sunset” years of British colonialism in Kenya (1957-1963). During these six years we elected our African representatives to the now multi-racial Legislative Council (LEGCO). It is during this period that decolonization talks took place in Kenya and later at Lancaster House, London. In 1961 Jomo Kenyatta was released from his detention at Maralal in the Samburu County. He soon joined his fellow Africans in the LEGCO, participated in the independence talks at Lancaster, London, as the leader of Kenya African National Union (KANU). His party KANU won the 1963 Elections, forming the internal self- government (Madaraka) from 01 June 1963. He became our first Prime minister on 12 December 1963 and the first President of our Republic on 12 December 1964. Although it was widely accepted that the colonial government and the British settlers would have loved a government of Kenya African Democratic Union (KADU) and the liberal British settlers, KANU was the more popular party. Rigging an election against KANU was out of the question. Gone were the days the colonial government would select their colonial chiefs from the outcomes of rigged queue voting (if for some reason they thought this voting was necessary). The post-colonial times are peppered with stories of the rigging of elections, particularly during the few years the Kenya People’s Union (KPU) existed before it was banned and its leaders detained in 1969. -

KENYA ELECTION HISTORY 1963-2013 1963 Kenya Election History 1963 1963: THE PRE-INDEPENDENCE ELECTIONS These were the last elections in pre-independent Kenya and the key players were two political parties, KANU and KADU. KADU drew its support from smaller, less urbanized communities hence advocated majimboism (regionalism) as a means of protecting them. KANU had been forced to accept KADU’s proposal to incorporate a majimbo system of government after being pressured by the British government. Though KANU agreed to majimbo, it vowed to undo it after gaining political power. The majimbo constitution that was introduced in 1962 provided for a two-chamber national legislature consisting of an upper (Senate) and lower (House of Representative). The Campaign KADU allied with the African People’s Party (APP) in the campaign. KANU and APP agreed not to field candidates in seats where the other stood a better chance. The Voting Elections were marked by high voter turnout and were held in three phases. They were widely boycotted in the North Eastern Province. Violence was reported in various parts of the country; four were killed in Isiolo, teargas used in Nyanza and Nakuru, clashes between supporters in Machakos, Mombasa, Nairobi and Kitale. In the House of Representative KANU won 66 seats out of 112 and gained working majority from 4 independents and 3 from NPUA, KADU took 47 seats and APP won 8. Journalism and Mass Communication, ISSN 2160-6579 D July 2012, Vol. 2, No. 7, 717-734 DAVID PUBLISHING Newspaper Visibility of Members of Parliament in Kenya* Kioko Ireri Indiana University, Bloomington, USA This research investigates variables that predicted news coverage of 212 members of parliament (MPs) in Kenya by four national newspapers in 2009. The 10 variables examined are: ordinary MP, cabinet minister, powerful ministry, parliamentary committee chairmanship, seniority, big tribe identity, major party affiliation, presidential ambition, commenting on contentious issues, and criticizing government. Findings indicate that commenting on contentious issues, criticizing government, cabinet minister, ordinary MP, powerful ministry, and seniority significantly predicted visibility of the parliamentarians in newspaper news. However, a multiple regression analysis shows that the strongest predictors are commenting on contentious issues, cabinet minister, criticizing government, and big tribe identity. While commenting on controversial issues was the strongest predictor, major party identification and committee leadership were found not to predict MPs’ visibility. Through the mass media, citizens learn what their leaders are doing for them and the nation. Similarly, politicians use the media to make their agendas known to people. It is, thus, rare to come across elected leaders ignorant about the importance of registering their views, thoughts, or activities in the news media. In Kenya, members of parliament have not hesitated to exploit the power of the mass media to its fullest in their re-election bids and in other agendas beneficial to them. -

GOVERNANCE ASSESSMENT KENYA: JANUARY 2013 – JULY 2016 Kenya: Governance Assessment GOVERNANCE ASSESSMENT Kenya: January 2013 – July 2016 Roland Ebole and Morris Odhiambo1 1 Introduction This report focuses on politically significant developments in Kenya from 2013, when the country held its first general elections under the 2010 constitution. The constitution is considered to have markedly enhanced protection of basic rights, significantly constrained executive power, and provides limited devolution of powers across 47 newly created county governments.2 In 2013, Kenya held its first general election under the 2010 constitution. Kenyans cast their votes for president, national and county-level representatives, female representatives to the National Assembly, and governors. With 50.5% of the vote, Uhuru Kenyatta of the National Alliance (TNA), backed by the Jubilee Alliance, won the presidency. His opponent, Raila Odinga of the Orange Democratic Movement (ODM), backed by the Coalition for Reforms and Democracy (CORD), was second with 43.7%. The election of governors and local assemblies strengthened the position of county governments. Female representatives to the National Assembly were elected in all 47 counties3 while 16 more were nominated to the Senate.4 Following the vote, CORD and a civil society organization (CSO) challenged the outcome of the presidential election at the Supreme Court,5 which had only 14 days to consider their petition under the constitution.6 Moreover, the pay scale for members of parliament set by the Salaries and Remuneration Commission was rejected by legislators, forcing the SRC to approve higher salaries.7 Implementation of the constitution and additional reforms continued, including the vetting of police officers by the National Police Service Commission (NPSC) and scrutiny of judges and magistrates by the Judges and Magistrates Vetting Board (JMVB). -

Why BBI Will Not Promote Peace or Prevent Violence By Patrick K. Mbugua President Uhuru Kenyatta has touted the Building Bridges Initiative (BBI) report as the panacea for peace that will end political and/or election-related violence in Kenya. Mr. Kenyatta has not given Kenyans his definition or understanding of peace, but his lines of argument affirm his minimalist understanding of peace or what peace studies (PS) call negative peace. Students of peace studies caricature this concept of peace as akin to peace between the proverbial happy slave and the slave master. Overall, Mr. Kenyatta’s arguments on peace and political violence in Kenya are based on flawed premises, among them a very naïve essentialist view of ethnicity, and a tunnel vision of Kenya’s social divides. But that is a topic for another day. Rather, this commentary aims to assess whether BBI is a panacea for peace and whether it can prevent political and/or election-related violence in the future. I will comment on the BBI process and analyse who perpetrated the past political violence and why, and then evaluate BBI’s response to that political violence. The article will end with a comment on an observed and horrifying pattern of current events that negates BBI’s proclaimed intentions. Exclusive process A core dictum in peace studies, which originates from Mahatma Gandhi’s moral philosophy, is the unity of processes and ends. The dictum posits that the process that is used to engender social change should be consistent with the goal. This means that if the end goal is inclusion, then the process for attaining this goal should be inclusive because an exclusive process cannot attain inclusion.
