BELVEDEREMERIDIONALE 5 AVANTPROPOS ❖ Sujet vaste, à peine saisissable qui est la culture juridique des clercs médievaux. Néanmoins, s’inspirés de l’aveu de présenter les conjonctions de l’héritage des ecclésiastiques et les débuts de l’état moderne est un des grands défi s des médiévistes. Pour y répondre, nombreux chercheurs se sont associés sous l’égide d’un goupement de recherches européennes (GDRE « At the Foundations of the Modern European State: the Legacy of the Medieval Clergy ») à appréhender les éléments dont les clercs médivaux avaient contribué à la construction de l’état moderne. e présent volume accueille en majorité des études présentées dans le cadre d’un des rencontres thématiques, celui qui s’est tenu à Angers en november de 2011. Le sujet de cette Ljournée d’études était – près de la mobilité – la culture juridique des clercs médiévaux ; on a le plaisir de publier ici les communications presqu’intégralement. Elles off rent des perspectives d’analyses très variées. Présenter la culture juridique des clercs médievaux se repose avant tout sur celle des sources du savoir, ensuite sur l’usage de celui-ci et enfi n sur les manifestations intellectuelles, les bibliothèques. Les deux premières des études en présentent un panorama entier portant sur des deux extrémités des territoires angevins, Anjou, Maine (J.-M. Matz) d’une part et la Hongrie d’autre part (G. Kiss). Les deux autres contributions (A. Le Roux, M. A. Bilotta) proposent un aspect plus particulier à première vue, l’analyse de la constitution des bibliothèques, de la circulation et de l’usage des oeuvres juridiques. Elles nous permettent de mieux comprendre quels étaient les éléments qui constituaient la culture juridique des clercs mediévaux, combien ces oeuvres refl étaient un usage professionnel et/ou un intérêt intellectuel personnel, à quel points des ateliers pouvait combler les besoins de ces milieux. Le présent volume abrite également une communication des deux collegues salernitains qui proposent l’évolution d’un des diocèses les plus compliqués de l’Italie méridionale. Suivi de près la formation d’évêché depuis la conquête des Lombards à travers l’époque de la prinicipauté ensuite l’époque normande, l’occupation des Stafuens pour fi nir avec l’installation des Ange- vins, cette communication off re un panorama des chaînes et des facteurs de l’évolution à la fois institutionnelle et physique. Ce dernier élément forme – par la présentation d’un patrimoine remarquable – une sorte de jonction à l’héritage culture des clercs médiévaux. Les notices de recherches présentent deux projets de recherches collectifs. Le premier est celle de l’entreprise à grande échelle des Fasti Ecclesiae Gallicanae qui commémore cette année ses vingt-cinquième anniversaire. Le concept, les méthodes appliqués pouvaient et pourront sans doute inspirer d’autres projets. L’exemple du Portugal en est emblématique : servi du modèle fran- çais les chercheurs portugais ont achevé leurs recherches prosopographiques, mais ils viennent de lancer un nouveau projet – ici présenté par un des ses leaders, H. Vilar – visant à examiner le rôle du clergé dans la construction des monarchies de la péninsule Ibérique. Enfi n, la rubrique Atelier nous permet de rejoindre le contexte des études présentées de l’issue actuelle de notre revue. On expose ici les travaux menés entre 2010 et 2013 dans le cadre du GDRE « At the Foundations of the Modern European State: the Legacy of the Medieval Clergy ». L’intérêt de celle-ci est bien claire : elle sert à introduire une deuxième issue thématique de Belvedere Meriodionale dédié à présenter d’autres productions intellectuelles de ce même projet à suivre. Ennek ellenére a medievisták előtt álló egyik legnagyobb kihívás annak bemutatása, hogyan kapcsolódott egymáshoz a középkori egyháziak öröksége és a modern állam. E kérdés megválaszolására számos kutató részvételével tett kísérlete egy nemzetközi kutatási program (GDRE « At the Foundations of the Modern European State: the Legacy of the Medieval Clergy »), amely arra kereste a választ, hogy a középkori egyháziak mennyiben járultak hozzá a modern állam kialakulásához. jelen lapszám ytanulmán ait a 2011 novemberében Angers-ban (Franciaország) tartott egyik tematikus műhelykonferencián elhangzott előadások többsége teszi ki. A két első tanulmány átfogó képet ad az Anjou területek két végpontjáról, Anjou, Maine (J.-M. Matz) ill. Magyarország (Kiss G.) vidékéről. A másik két tanulmány (A. Le Roux, M. A. Bilotta) elsőre túlságosan is specifi kusnak tűnhet, valójában azonban magába foglalja a könyvtárak, a jogi művek forgalmának és hasznosításának beható elemzését. Segítségükkel jobban megérthetjük, milyen elemekből épült fel a jogi műveltség, az egyes művek mennyiben tükrözték szakmai vagy személyes intellektuális igényeket,

Foreigners in Hungary, especially in the 11th and 12th century came from Western Europe. Great immigration waves of the romance population are documented mostly during the reign of king Géza II (1141 – 1162), when they managed to settle in peripheral regions of the country and increase the population and signicance of weakly populated regions. Foreigners in the 12th recieved privileged status as the „guests“. In the 11th and 12th century these guests have settled in Srem, Spiš, Transylvania and Tokaj. Some information about Srem region are provided by crusades chronicles. In Srem there was a village called Francavilla, which belonged to the oldest and most important romanesque settlement in Hungary. e Guests in Transylvania had their own church organization and there were several bishops of Transylvania and Bihar/Oradea of western european origin. Other regions with Romanesque population – Spiš and Tokaj laid on international routes. e collegiate chapter of Spiš even owned vineyards in Tokaj – in Sárospátak, one of the oldest Hungarian cities with privileges. A large number of documented pilgrimage passing through Hungary could also stand behind the increase of new romance population in the country. Additional aspect of the Crusades was the creation of religious orders, the Knights Templar and the Hospitallers, who just few decades after their formation appeared in Hungary and were engaged in the life of Hungarian kingdom.

    A Programme of Terror and Cruelty Aspects of Mongol strategy in the light of Western Sources JOHANNES GIEBAUF At the beginning of the thirteenth century the Mongol emperor Chingiz-Khan mobilized a war-machine that succeeded, within the space of a few decades, in overwhelming the majority of the known world. In 1235 his third son and succes- sor, Ogodei, launched a new attempt to realize his father's idea of Mongol world- conquest. In 1981, Maria Holban managed to raise the doubt about the name of Severin's first banus documentary attested in 1233 (Luca or Jula?). The documentary sources undoubtedly show us that it is Luca who participates at the oath in Bereg Forest (22.08.1233). The dignity of Banatus Zeuriniensis is documented on this occasion. We do not know for sure who Jula Banus is, who appears in a letter dated 27.11.1233. We suspect that he is Gyula, the son of Leustachius, from Rátólt’s kindred.     THOMAS OF SPALATO AND THE MONGOLS: A THIRTEENTH-CENTURY DALMATIAN VIEW OF MONGOL CUSTOMS* James Ross Sweeney When Qadan, grandson of Genghis Khan, and his Mongol horsemen arrived be- fore the walls of Spalato in the spring of 1242, the Adriatic Sea became the westernmost boundary of the Tartar Empire, stretching eastward across the vast Eurasian landmass to the shores of the Sea of Japan.1 Thomas, archdeacon of Spalato (1200-1268) , was a witness and principal reporter of that historic moment. Four chapters of his Historia Pontificum Salonitanorum atque 2 Spalatensium narrate the approach of the Mongols to Hungary, the conquest of the country, the flight of Béla IV to Dalmatia with the invading army in pur- suit, the unexpected withdrawal of the Mongols, and the famine that followed their departure. This portion of Thomas's work ranks as a major western nar- rative of the Mongol invasion of Europe. The value of his narrative lies in the fact that the author was a contemporary of the events described and that his sources included his own eyewitness observation and reports made to him by informed refugees. Moreover, although he embraced a traditional mediaeval Christian historiographical outlook, his work is relatively free of the apocalyp- tic speculation found in other accounts of the Mongol invasion. His narrative is by no means a complete description of events in Hungary and Dalmatia during 1241-1242, but the information he provides can be shown, wherever corroboration exists, to be largely trustworthy. Within the last decade or so, mediaeval scholars have de.-voted consider- able attention to the re-examination of western sources on the Mongols.
