I. COMPENDIUM OF PROVISIONS OF EUROPEAN CONSTITUTIONS

This document has been finalized in October 2012 and contains, for the constitutions of 46 European countries, a compendium of provisions related to the right to social security, which served as a basis for the analysis developed in the main paper. The compendium includes provisions that affirm a right to social security, social protection, or social assistance; that affirm a State duty to protect individuals against specific social risks or to protect specific vulnerable groups of persons; or that have a promotional nature and determine the objectives of the State in matter of social security. For each Constitution, a link to the full text is also provided. However, and due to the frequent changes with regard to such addresses, please refer also to the following, constantly updated, web sites:

Article 52 1. Everyone has the right to social security in old age or when he is unable to work, according to a system set by law. 2. Everyone, who remains without work for reasons independent of their volition, and has no other means of support, has the right to assistance under the conditions provided by law.

Chapter V - Social Objectives Article 59 1. The state, within its constitutional powers and the means at its disposal, aims to supplement private initiative and responsibility with: … g) care and help for the aged, orphans and persons with disabilities; … 2. Fulfilment of social objectives may not be claimed directly in court. The law defines the conditions and extent to which the realization of these objectives can be claimed.

Article 1 1. Andorra is a Democratic and Social independent State abiding by the Rule of Law. Its official name is Principat d'Andorra.

Article 30 The right to health protection and to receive services to look after personal needs shall be respected. With that intent the State shall guarantee a system of Social Security.

Article 1 The Republic of Armenia is a sovereign, democratic state, based on and the rule of law.

Article 32 The family is the natural and fundamental cell of society. Family, motherhood, and childhood are placed under the care and protection of society and the state. Women and men enjoy equal when entering into marriage, during marriage, and in the course of divorce.

Article 33 Every citizen is entitled to social security during old age, disability, sickness, loss of an income earner, unemployment and in other cases prescribed by law.

Article 34 Everyone is entitled to the preservation of health. The provision of medical care and services shall be prescribed by law. The state shall put into effect health care protection programs for the population and promote the development of sports and physical education.

Article 17 - Family and State The family as the foundation of society shall be under special protection of the State. To take care of the children and their upbringing shall be the obligation of the parents. The state shall see to it that this obligation be fulfilled.

Article 35 - Right to Labour … Unemployed shall have the right to get social benefits from the State. …

Article 38 - Right to Social Security Every Person shall have the right to Social Security. It shall be the obligation of the family members in the first place to render assistance to those people in their family who need it. Every Person shall have the right to Social Security in old age, sickness as stipulated by Law, disability, when losing work ability or the breadwinner of the family, when unemployed and in other cases specified by Law. Minimum extent of pensions and social benefits shall be defined by Law. The State shall create possibilities for developing charity work, voluntary social insurance, and other forms of social security and shall do all the best to promote their development.

Article 41 … The State shall create conditions necessary for full employment of the population. If a person is unemployed for reasons which are beyond his control, he shall be guaranteed training in new specialisations and upgrading of his qualifications with regard to social needs, and to an unemployment benefit in accordance with the law. …

Article 47 Citizens of the Republic of Belarus shall be guaranteed the right to social security in old age, in the event of illness, disability, incapability to work, loss of the bread- winner and in other instances specified by law. The State shall display particular care for veterans of war and labour as well as for those who undermined their health defending national and public interests.

Article 14 The family, motherhood and children shall enjoy the protection of the state and society.

Article 47 (1) The raising and upbringing of children until they come of age shall be a right and obligation of their parents and shall be assisted by the state. (2) Mothers shall be the object of special protection on the part of the state and shall be guaranteed prenatal and postnatal maternity leave, free obstetric care, alleviated working conditions and other social assistance. (3) Children born out of wedlock shall enjoy equal rights with those born in wedlock. (4) Abandoned children shall enjoy the protection of the state and society. (5) The conditions and procedure for the restriction or suspension of parental rights shall be established by law.

Article 51 (1) Citizens shall have the right to social insurance and welfare aid. (2) The state shall provide social insurances to the temporarily unemployed in accordance with conditions and procedures established by law. (3) The aged without relatives and unable to take care of themselves, as well as the disabled and the people in socially disadvantaged position shall receive special protection from the state and society.

Article 52 (1) Citizens shall have the right to health insurance guaranteeing them affordable medical care, and to free medical care in accordance with conditions and procedures established by law. (2) Citizens' medical care shall be funded by the state budget, by employers, through private and collective health-insurance schemes, and from other sources in compliance with the law. Article 57 The right of employees and their family members to social security and social insurance shall be regulated by law and collective agreements. Rights related to child-birth, maternity and child care shall be regulated by law.

Article 58 The state shall ensure the right to assistance for weak, infirm or other persons unable to meet their basic subsistence needs as a result of their unemployment or incapacity for work. The state shall devote special care to the protection of persons with disabilities and their inclusion in social life. The state shall devote special care to the protection of Croatian war veterans and disabled Croatian war veterans, as well as the widows, parents and children of fallen Croatian war veterans. Receiving humanitarian aid from abroad may not be forbidden.

Article 59 Everyone shall be guaranteed the right to health care, in conformity with law.

Article 62 The family shall enjoy special protection of the state. Marriage and legal relations in marriage, common-law marriage and the family shall be regulated by law.

Article 63 The state shall protect maternity, children and youth, and shall create social, cultural, educational, material and other conditions promoting the achievement of the right to a suitable life.

Article 64 … Physically and mentally disabled and socially neglected children shall have the right to special care, education and welfare. … The State shall take special care of parentless minors or parentally neglected children.

Article 65 Everyone shall have the duty to protect children and helpless persons.

Article 26 … (3) Everybody has the right to acquire the means of his or her livelihood by work. The State shall provide appropriate material security to those citizens who are unable without their fault to exercise this right; the respective conditions shall be set by law. …

Article 29 (1) Women, adolescents, and handicapped persons are entitled to increased protection of their health at work and to special working conditions. (2) Adolescents and handicapped persons are entitled to special protection in labour relations and to assistance in vocational training. (3) Detailed provisions in this respect shall be set by law.

COMPENDIUM OF PROVISIONS OF EUROPEAN CONSTITUTIONS 9 Article 30 (1) Citizens are entitled to material security in old age and during incapacitation for work, as well as in the case of loss of their provider. (2) Everybody who suffers from material need is entitled to such assistance as is essential for securing his or her basic living conditions. (3) Detailed provisions in this respect shall be set by law.

Article 31 Everybody has the right to protection of his or her health. Citizens are entitled under public insurance to free medical care and to medical aids under conditions set by law.

Article 32 (1) Parenthood and the family are under protection of the law. Special protection of children and adolescents is guaranteed. (2) During pregnancy women are guaranteed special care, protection in labour relations, and appropriate working conditions. (3) Children born in as well as out of wedlock have equal rights. (4) Care of children and their upbringing are the right of their parents; children are entitled to parental upbringing and care. Parental rights may be limited and minor children may be taken away from their parents against the latter's will only by judicial decision on the basis of law. (5) Parents who are raising children are entitled to assistance from the State. (6) Detailed provisions in this respect shall be set by law.

Section 75 Subsection 1. It should be an aim that every able-bodied citizen has the opportunity to work under conditions that safeguard his or her existence in order to promote the common good. Subsection 2. A person who is unable to support himself or his dependants, and whom no one else is under an obligation to support, is entitled to assistance from the State, while accepting the obligations that the Act relating to such assistance imposes.

Article 28 Everyone has the right to the protection of health. An Estonian citizen has the right to state assistance in the case of old age, inability to work, loss of a provider, or need. The categories and extent of assistance, and the conditions and procedure for the receipt of assistance shall be provided by law. Citizens of foreign states and stateless persons who are in Estonia have this right equally with Estonian citizens, unless otherwise provided by law. The state shall promote voluntary and local government welfare services. with many children and persons with disabilities shall be under the special care of the state and local governments.

Section 19 - The right to social security Those who cannot obtain the means necessary for a life of dignity have the right to receive indispensable subsistence and care. Everyone shall be guaranteed by an Act the right to basic subsistence in the event of unemployment, illness, and disability and during old age as well as at the birth of a child or the loss of a provider. The public authorities shall guarantee for everyone, as provided in more detail by an Act, adequate social, health and medical services and promote the health of the population. Moreover, the public authorities shall support families and others responsible for providing for children so that they have the ability to ensure the wellbeing and personal development of the children. The public authorities shall promote the right of everyone to housing and the opportunity to arrange their own housing.

Article XVI 1. Every child shall have the right to the protection and care required for his or her proper physical, mental and moral development. 2. Parents shall have the right to choose the type of upbringing they deem fit for their children. 3. Parents shall be obliged to look after their children. This obligation shall include the provision of schooling for their children. 4. Adult children shall be obliged to look after their parents if they are in need.

Article XIX 1. Hungary shall strive to provide social security to all of its citizens. Every Hungarian citizen shall be entitled to statutory subsidies for maternity, illness, disability, widowhood, orphanage and unemployment not caused by his or her own actions. 2. Hungary shall implement social security for the persons listed in Paragraph (1) and other people in need through a system of social institutions and measures. 3. The nature and extent of social measures may be determined by law in Accordance with the usefulness to the community of the beneficiary’s activity. 4. Hungary shall promote the livelihood of the elderly by maintaining a general state pension system based on social solidarity and by allowing for the operation of voluntarily established social institutions. Eligibility for a state pension may include statutory criteria in consideration of the requirement for special protection to women.

Article XX 1. Every person shall have the right to physical and mental health. 2. Hungary shall promote the exercise of the right set out in Paragraph (1) by ensuring that its agriculture remains free from any genetically modified organism, by providing access to healthy food and drinking water, by managing industrial safety and healthcare, by supporting sports and regular physical exercise, and by ensuring environmental protection. …

Article 30 - Parental Duties and Rights It is the duty and right of parents to support, raise and educate their children, even if born out of wedlock. In the case of incapacity of the parents, the law provides for the fulfilment of their duties. The law ensures such legal and social protection measures as are compatible with the rights of the members of the legitimate family to any children born out of wedlock. …

Article 32 - Health The Republic safeguards health as a fundamental right of the individual and as a collective interest, and guarantees free medical care to the indigent. No one may be obliged to undergo any health treatment except under the provisions of the law. The law may not under any circumstances violate the limits imposed by respect for the human person.

Article 37 - Equality of Women at Work Working women are entitled to equal rights and, for comparable jobs, equal pay as men. Working conditions must allow women to fulfil their essential role in the family and ensure appropriate protection for the mother and child. The law establishes the minimum age for paid labour. The Republic protects the work of minors by means of special provisions and guarantees them the right to .

Article 38 - Welfare Every citizen unable to work and without the necessary means of subsistence is entitled to welfare support. Workers have the right to be assured adequate means for their needs and necessities in the case of accidents, illness, disability, old age and involuntary unemployment. Disabled and handicapped persons are entitled to receive education and vocational training. Responsibilities under this article are entrusted to entities and institutions established by or supported by the State. Private-sector assistance may be freely provided.

Article 25 Public poor relief shall be administered by the communes in conformity with specific laws. The State shall be responsible, however, for the supervision of such activities. Chapter II Social Rights and Duties Article 63 - Social Security (1) Everyone is entitled to social security. (2) It is the duty of the State to organize, coordinate, and subsidize a unified and decentralized social security system, with the participation of the associations, other organizations representing the workers, and associations representing the other beneficiaries. (3) The right to set up private and non-profit-making institutions of social solidarity that pursue the social security objectives laid out in this Article and in Articles 67 (2)(b), 69, 70 (1)(d), 71 and 72, is recognized; they are regulated in the law and subject to State supervision. Article 9 Work is a right and duty of every citizen. The law guarantees the worker a fair wage, holidays, weekly rest and the right to strike. All citizens have the right to social security. Section 8: Housing, Employment, Social Security and Health Art. 111 - Old-age, survivors’ and invalidity pension provision (1) The Confederation shall take measures to ensure adequate financial provision for the elderly, surviving spouses and children, and persons with disabilities. These shall be based on three pillars, namely the Federal Old-age, Survivors’ and Invalidity Insurance, the occupational pension scheme and private pension schemes. (2) The Confederation shall ensure that the Federal Old-age, Survivors’ and Invalidity Insurance and the occupational pension scheme are able to fulfil their purpose at all times. (3) It may require the Cantons to exempt institutions of the Federal Old-age, Survivors’ and Invalidity Insurance and the occupational pension scheme from liability to pay tax and to grant insured persons and their employers tax relief on contributions and reversionary rights.

Article 112 - Old age, Survivors' and Disability Insurance (1) The Federation adopts rules on the old age, survivors, and disability insurance. (2) The Federation respects thereby the following principles: a. The insurance is mandatory; b. The pensions have to cover basic living expenses appropriately; c. The maximal pension amounts at most the double of the minimum pension. The pensions will at least be adapted to the development of prices. (3) The insurance is financed: a. by contributions of the insured persons, whereby the employers will pay half of the contributions for their employees b. by subsidies of the Federation and, if the law so provides, of the Cantons. 4) The subsidies of the Federation and the Cantons amount together at most half of the expenditures. (5) The subsidies of the Federation will be primarily financed by the net proceeds of the tax on tobacco, the tax on distilled spirits, and the tax on the revenue from the operation of casinos. (6) The Federation encourage the integration of disabled persons, and supports efforts for the benefit or aged, survivors and disabled persons. For this purpose it may use means from the old age, survivors, and disability insurance.

Article 113 - Employee Pension Plans (1) The Federation adopts rules on employee pension plans.

Employee pension plans combined with old age, survivors, and disability insurance enable in an appropriate way the continuation of the previous lifestyle; b. Employee pension plans are mandatory for employees; the law may provide for exceptions; c. The employers insure their employees with a pension institution; as far as necessary, the federation gives them the possibility to insure their employees with a federal pension institution; d. Self-employed persons may voluntarily insure themselves with a pension institution; e. For particular groups of self-employed persons, the Federation may declare employee pension plans mandatory, in general or only for particular risks. (3) Employee pension plans is financed through contributions by the insured persons, whereby the employers pay at least half of the contributions of their employees. (4) Employee pension institutions have to satisfy federal minimum requirements; the Federation may provide for nationwide measures to resolve particular tasks.

Article 114 - Unemployment Insurance (1) The Federation adopts rules on unemployment insurance. (2) The Federation respects thereby the following principles: a. The insurance grants an appropriate compensation for loss of earnings, and supports measures to prevent and fight unemployment; b. The affiliation is mandatory for employees, the law may provide for exceptions; c. Self-employed persons may voluntarily insure themselves. (3) The unemployment insurance is financed by the contributions of the insured persons, whereby the employers pay half of the contributions for their employees. (4) The Federation and the Cantons provide for subsidies in extraordinary circumstances. (5) The Federation may adopt rules on unemployment relief.

Article 115 - Assistance to Needy Persons Needy persons are supported by their domiciled Canton (Wohnkanton). The Federation regulates the exceptions and the competencies. (4) The Federation promotes in cooperation with the Cantons individual precaution namely by measures of taxation and ownership policies.

Article 116 - Family Allocations and Maternity Insurance (1) In the fulfillment of its tasks the Federation considers the needs of the family. It may support measures to protect the family. (2) The Federation may adopt rules on family allowance and operates a federal family compensation fund. (3) The Federation institutes a maternity insurance. It may also obligate persons to contributions that cannot benefit from the insurance. (4) The Federation may declare the affiliation to a family compensation fund and to the maternity insurance generally or for certain categories of persons as mandatory, and may make its subsidies dependent upon appropriate contributions by the Cantons.

The state shall take the necessary measures and establish the necessary organisation to ensure the peace and welfare of the family, especially where the protection of the mother and children is involved, and recognizing the need for education in the practical application of family planning.

Article 49 (As amended on October 17, 2001) Everyone has the right and duty to work. The State shall take the necessary measures to raise the standard of living of workers, and to protect workers and the unemployed in order to improve the general conditions of labour, to promote labour, to create suitable economic conditions for prevention of unemployment and to secure labour peace.

Article 56 Everyone has the right to live in a healthy, balanced environment. It is the duty of the state and citizens to improve the natural environment, and to prevent environmental pollution. To ensure that everyone leads their lives in conditions of physical and mental health and to secure cooperation in terms of human and material resources through economy and increased productivity, the state shall regulate central planning and functioning of the health services. The state shall fulfil this task by utilizing and supervising the health and social assistance institutions, in both the public and private sectors.

Article 60 Everyone has the right to social security. The state shall take the necessary measures and establish the organisation for the provision of social security.

Article 61 The state shall protect the widows and orphans of those killed in war and in the line of duty, together with the disabled and war veterans, and ensure that they enjoy a decent standard of living. The state shall take measures to protect the disabled and secure their integration into community life. The aged shall be protected by the state. State assistance to the aged, and other rights and benefits shall be regulated by law. The state shall take all kinds of measures for social resettlement of children in need of protection. To achieve these aims the state shall establish the necessary organisations or facilities, or arrange for their establishment by other bodies.

Article 46 Citizens shall have the right to social protection including the right to financial security in cases of complete, partial, or temporary disability, loss of the principal wage-earner, unemployment due to circumstances beyond their control, old age, and in other cases determined by law. This right shall be guaranteed by the mandatory state social insurance based on insurance payments made by citizens, enterprises, institutions, and organisations, as well as by budgetary and other sources of social security; and by establishing a network of state, communal, and private institutions caring for incapacitated persons. Pensions and other types of social payments and assistance that are the principal sources of subsistence shall ensure a standard of living not lower than the minimum living standard established by law.

Article 51 … The family, childhood, motherhood, and fatherhood shall be under the protection of the State.

Article 52 Children shall be equal in their rights regardless of their origin and whether they are born in or out of wedlock. Any violence against a child or his exploitation shall be prosecuted by law. The subsistence and upbringing of orphans and children deprived of parental care shall be entrusted to the State. The State shall encourage and support charitable activity in regard to children.
